IHMM Remotely Proctored Exams Available Now
IHMM is pleased to announce that the American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April of this year.
About 60% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination. There are Kryterion centers available world-wide and we also offer remotely-proctored testing wherever you are.

IHMM Board Nominations for 2021 Open
IHMM Board Nominations for 2021 OpenThis newsletter opens the 2021 Board Nominations season. In 2021 we have one position open, the CHMP representative, open for a four-year term beginning on January 1, 2022.
This process is guided by the IHMM Nominating Committee, chaired by Nathan Phelan > https://ihmm.org/nominating-committee/ We appreciate our Nominating Committee volunteers’ work working through the following documents and reviews before coming to a proposed slate of nominees.

This announcement is the Call for Nominations. ONLY CHMPs may participate in this year’s process as the position is for a CHMP representative on the Board. IHMM will hold this phase of the process open through June 30, 2021, when it will then close to further nominations.
The Nominating Committee will review nomination documents, interview nominees, perform a series of background checks, and then deliberate on a proposed slate of nominees through August 13, 2021. After August 31, 2021, the proposed slate will go to the IHMM Board for review at its September meeting.
The CHMP representative’s elections will begin on October 1, 2021, and run through October 29, 2021. The winning nominee will be announced during the week of November 5, 2021, for a term to commence on January 1, 2022.

A 529 plan is a tax-advantaged savings plan designed to encourage saving for future education costs. 529 plans, legally known as “qualified tuition plans,” are sponsored by states, state agencies, or educational institutions and are authorized by Section 529 of the Internal Revenue Code. Under H.R. 2171 those pursuing or who already have private credentials may use their Section 529 savings for applications, examinations, professional development/certification maintenance points costsrecertification, and so on.
The “Freedom To Invest in Tomorrow’s Workforce Act” will enable those who seek professional, post-secondary credentials from institutions recognized by the Internal Revenue Service. A copy of the draft legislation is here.
Spanberger co-led the introduction of the legislation alongside U.S. Representatives Fred Upton (R-MI-06), Dean Phillips (D-MN-03), and Rob Wittman (R-VA-01). A companion bill in the U.S. Senate is led by U.S. Senators Amy Klobuchar (D-MN) and Mike Braun (R-IN).

One way to contribute to IHMM’s communities of practice is to become a mentor. Helping to guide applicants or newly certified professionals with your wealth of experience means we grow the most important element of our communities – our people. We already have 8 mentors signed up and always look for more and we thank the 8 who have come forward thus far.
Becoming a mentor is easy, though it requires a commitment of some time that the mentor controls and is done through IHMM’s Collaboration platform.

Mentors fill out the areas of issue interests most closely resemble their background, decide how long a period of time they wish to be a mentor, how much time they prefer to mentor others, how many mentees they are willing to work with, and how they wish to communicate with mentees.
5. Those who are looking for mentors simply click on ENROLL AS A MENTEE, and fill out a simple form of issue interests as well. Having done that the system matches a mentees issue interests with the mentor’s issue interests and the match is made.
Give it a try. Those who enroll as Mentors can earn up to 10 Certification Maintenance Points [CMPs] per year.

OSHA is encouraging organizations to host virtual Stand-Downs events or events for small groups that follow CDC guidelines on social/physical distancing and the use of face coverings. Companies can conduct a Safety Stand-Down by taking a break to have a toolbox talk or another safety activity such as conducting safety equipment inspections, developing rescue plans, or discussing job specific hazards. OSHA is hosting a Workers Memorial Day Program this Wednesday, April 28, 2021, at 2 pm ET, to honor working people who lost their lives on the job, and acknowledge the families, friends and coworkers who grieve their loss. The event is open to the public and will be live-streamed via YouTube. See additional information below.
Every year on April 28, the nation recognizes Workers Memorial Day. This year, we also recognize that, more than a year into the pandemic, every day essential workers, many of whom are people of color and immigrants, have put their lives on the line during the COVID-19 pandemic. Many were sickened or died as a result of just going to work – for simply doing what they had to do to support their families. We remember and honor every worker who has lost their life to largely preventable fatal injuries and illnesses, and we commit ourselves to fighting to make sure that others do not suffer the same terrible fate.

IHMM & AHMP 45 in 5 Project – National Credential Recognition – 21 States Targeted
On January 25th, we began outlining the strategy to go after the 21 states in yellow, above. Since then we have succeeded in adding Nebraska, Colorado, and California.

- There are 21 states that recognize the CHMM for phase I and phase II site assessments, though the 45 in 5 group is also looking at Small Business Administration [SBA] rules for these assessments to determine what we may need to do to gain SBA recognition as well.
In 2019 Mark Bruce from AHMP and Gene Guilford from IHMM worked on a project to get the Commonwealth of Pennsylvania to recognize the CHMM and CDGT credentials. With Mark’s work on the ground in Pennsylvania, we succeeded.
Since the launch, we have added Delaware, Florida, Texas, California, Washington, Georgia, Ohio, Tennessee, Alabama, Maryland, Virginia, Massachusetts, Missouri, Iowa, North Carolina, Colorado, Missouri, Kansas, Oklahoma, Nebraska, New Mexico, and Puerto Rico as the next places for us to work on with 44 volunteers.
The Task Force meets again in May.

Are adverse reactions to the COVID-19 vaccine recordable on the OSHA recordkeeping log?
In general, an adverse reaction to the COVID-19 vaccine is recordable if the reaction is: (1) work-related, (2) a new case, and (3) meets one or more of the general recording criteria in 29 CFR 1904.7 (e.g., days away from work, restricted work or transfer to another job, medical treatment beyond first aid).
If you require your employees to be vaccinated as a condition of employment (i.e., for work-related reasons), then any adverse reaction to the COVID-19 vaccine is work-related. The adverse reaction is recordable if it is a new case under 29 CFR 1904.6 and meets one or more of the general recording criteria in 29 CFR 1904.7.

Beltway Buzz – Ogletree & Deakins
- PFA Passes House. On April 15, 2021, the U.S. House of Representatives passed the Paycheck Fairness Act by a vote of 217–210 (one Republican voted “yea”). The bill will face an uphill climb in the U.S. Senate due to the legislative filibuster.
- Workplace Violence Bill Passes House. On April 16, 2021, the Workplace Violence Prevention for Health Care and Social Service Workers Act passed the House by a vote of 254–166 (38 Republicans voted “yea”).
- Liquidated Damages Return to DOL. The U.S. Department of Labor’s (DOL) Wage and Hour Division announced that effective April 9, 2021, it had “return[ed] to pursuing pre-litigation liquidated damages” in lieu of litigation. The previous administration stopped the practice in order to encourage economic recovery during the pandemic.
- California Safety Regulator to Be Nominated to Run OSHA. The White House announced that President Joe Biden will nominate Douglas L. Parker to be assistant secretary of labor for the Occupational Safety and Health Administration (OSHA). Parker currently serves as chief of California’s Division of Occupational Safety and Health, which is often referred to as Cal/OSHA.
- USCIS Vet to Be Nominated for Top Role. President Biden will nominate Ur Jaddou to be director of U.S. Citizenship and Immigration Services (USCIS). An attorney with experience on Capitol Hill and in the U.S. Department of State, Jaddou previously served as USCIS chief counsel. USCIS has not had a director confirmed by the Senate since May 2019.
PRO Act Update: Manchin Supports; ABA Opposes Persuader Provision. Senator Joe Manchin (D-WV) made waves this week by signing on as a co-sponsor to the Protecting the Right to Organize (PRO) Act. The sweeping labor bill, which passed the House on March 9, 2021, now has 47 cosponsors in the U.S. Senate—all Democrats. Labor unions will now focus their lobbying efforts on the remaining three holdout Democrats: Senators Kyrsten Sinema (AZ), Mark Kelly (AZ), and Mark Warner (VA). Majority Leader Chuck Schumer (D-NY) has promised to bring the bill to the Senate floor for a vote if the bill gets 50 cosponsors. As a reminder, the legislative filibuster essentially means that 60 votes will be needed to pass the bill.
Furthermore, this week the American Bar Association (ABA) sent a letter to Majority Leader Schumer, Minority Leader Mitch McConnell (R-KY), and Republican and Democratic leaders of the U.S. Senate Committee on Health, Education, Labor and Pensions (HELP) objecting to the “persuader” provisions of the PRO Act as “deeply flawed.” In the letter, the ABA states that it opposes the provision because, among other reasons, it “would seriously undermine both the confidential attorney-client relationship and employers’ fundamental right to legal counsel.”
OSHA Issues New Guidance on COVID-19 Vaccines. If an employee has an adverse reaction to a COVID-19 vaccine, is the employer required to record this in its workplace illness logs? Does it matter if the employer requires employees to be vaccinated as a condition of employment? How about if the employer merely recommends vaccination? OSHA answered these questions this week, and Melissa A. Bailey and J. Davis Jenkins have the details.
NLRB Retains Contract Bar Doctrine. On April 21, 2021, the National Labor Relations Board (NLRB) issued a bipartisan decision retaining its contract bar doctrine, which bars union elections during the term of a collective bargaining agreement for up to three years. Much of the decision focused on the underlying facts of the case—particularly whether the relevant union security clause was unlawful—rather than the policy merits of the contract bar doctrine.
DOL Nominee Advances. On April 21, 2021, the Senate HELP Committee advanced the nomination of Julie Su to be deputy secretary of labor. The mainly party-line vote perhaps portends a similar breakdown for Su’s vote on the Senate floor. Readers may recall that Su serves as secretary of the California Labor and Workforce Development Agency. If Su and the prospective OSHA assistant secretary Doug Parker (mentioned above) are confirmed, the DOL could advance a policy agenda that has a decidedly California feel.
DHS to Make More H-2B Visas Available. On April 20, 2021, the U.S. Department of Homeland Security (DHS) announced that it would make available an additional 22,000 H-2B visas “in the coming months.” According to DHS, “[t]he supplemental increase will require businesses seeking H-2B workers to engage in additional recruitment efforts for U.S. workers.” DHS stated that it would publish an interim final rule in the Federal Register that “will allow employers to immediately hire H-2B workers who are already present in the United States.”

PHMSA – Hazardous Materials: Notice of Public Meetings in 2021 for International Standards on the Transport of Dangerous GoodsSUMMARY: The notice announces that PHMSA’s Office of Hazardous Materials Safety will host four public meetings during 2021 in advance of certain international meetings.
- The first meeting will be held in preparation of the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP) Working Group 21 (WG/21) virtual meeting scheduled for May 24– 28, 2021.
- The second meeting will be held in preparation of the 58th session of the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) scheduled for June 28 to July 2, 2021, in Geneva, Switzerland.
- The third meeting will be held in preparation of the ICAO DGP 28 Meeting (DGP/28) scheduled for September 27 to October 1, 2021.
- The fourth meeting will be held in preparation of the 59th session of the UNSCOE TDG scheduled for November 29 to December 8, 2021. For each of these meetings, PHMSA will solicit public input on current proposals.
Public notices will be published in the Federal Register prior to the public meetings conducted by the International Standards Group.
