The 6th Circuit Court of Appeals in Cincinnati has dissolved the decision of the 5th Circuit Court of Appeals in New Orleans concerning the November 5, 2021, OSHA Emergency Temporary Standard [ETS] to protect the health of employees by mitigating the spread of the coronavirus.
The conflict between the two federal circuit courts of appeal ensures that the next stop for this issue will be the Supreme Court.
