The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.
72% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

In 2022 the IHMM Nominating Committee solicits candidates for three [3] director positions that will be open on January 1, 2021. [1] Certified Dangerous Goods Professional [CDGP], [1] Certified Safety and Health Manager [CSHM], and [1] At-Large, that can be either a CHMM, CDGP, CHMP, CSHM, or CSMP.

EPA Recognition of the IHMM CHMM as an Environmental Professional
IHMM’s Board approved an initiative to have the U.S. Environmental Protection Agency recognize the Certified Hazardous Materials Manager [CHMM] credential in the context of 40 CFR § 312.10, Definitions. The key element of this regulation includes,
“However, the Agency notes that any individual with a certification from a private certification organization where the organization’s certification qualifications include the same or more stringent education and experience requirements as those included in today’s final regulation will meet the definition of an environmental professional for the purposes of this regulation.”
IHMM has produced a crosswalk between 40 CFR § 312.10 Definitions and the CHMM Blueprint that documents how the EPA regulation aligns with the CHMM Blueprint and demonstrates that in each instance the blueprint meets or exceeds 40 CFR § 312.10 Definitions. The EPA definition of an Environmental Professional is in the Federal Register dated November 1, 2005 at page 66080. On that page is the instruction to private certifications being considered Environmental Professionals and how to compare 40 CFR § 312.10 to the certification.

IHMM’s Board Chair Richie Spangler, CHMM, CDGP, made a presentation of IHMM’s major activities and future developments during the Delegates meeting of the recently completed AHMP conference in Las Vegas.
Richie, seen at left, outlined the development of new credentials for the AHMM, Student CHMM, Student ASHM, Microcredential/Pandemic Preparedness, as well as highlighting the new blueprints for the CSHM, CSMP, and CSSM credentials.
A great deal of attention was given to the EPA regulation at 40 CFR § 312.10, Definitions, and the instruction by EPA in the Federal Register notice of 11/1/2005, page 66080, concerning private certifications and the crosswalk IHMM produced pursuant to those instructions for the CHMM. [article above]. IHMM has documented, commensurate with the EPA rule guidance, how an IHMM CHMM is an Environmental Professional under the rule.
IHMM Fellows Becoming Mentors
IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to provide instruction to the more than 75 IHMM Fellows in becoming mentors.
Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities.
IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

These workshops are offered with U.S. DOT PHMSA HMIT (Hazardous Materials Instructor Training) Grant support to the National Partnership for Environmental Technology Education (National PETE).
This training is FREE for employees and federal, state, county, and local government employees involved in DOT HazMat Shipping, Receiving and Handling via Ground, Air, and Vessel Transportation.
The workshop curriculum is in accordance with 49 CFR § 172.704 for General Awareness, Function-Specific, Safety, and Security Awareness training requirements.
Class size is limited to 10-15 students with mask/social distancing protocols, so act fast. Minimum of 6 attendees is needed to confirm the class.

SCOTUS Nomination Hearings Begin. The U.S. Senate Committee on the Judiciary held hearings this week on Judge Ketanji Brown Jackson’s nomination to be an associate justice of the Supreme Court of the United States. Republican senators focused on Judge Jackson’s criminal sentencing record and culture war issues, while Democrats spent much of their time bolstering the nominee. The Judiciary Committee will mark up Judge Jackson’s nomination next week and a vote in the committee is expected on April 4, 2022. Democrats hope a floor vote in the U.S. Senate will happen shortly thereafter, as the Senate is scheduled to begin a two-week in-state work period beginning on April 9, 2022.
As the Buzz previously discussed, Judge Jackson likely has the votes to be confirmed and may even earn some votes from Republicans (some of whom voted to confirm her to the United States Court of Appeals for the District of Columbia Circuit). One factor that could impact the confirmation vote is COVID-19: Senator Bob Casey (D-PA) tested positive for COVID-19 earlier this week, making him the most recent member of the 117th U.S. Congress to test positive. Senator Casey will presumably be available for a vote that first week of April, but his situation is a reminder of the razor-thin majority that the Democrats enjoy in the Senate. If just one Democratic senator (or Vice President Kamala Harris) is unavailable—due to COVID-19 or any other reason—this could delay Judge Jackson’s confirmation vote.
OSHA Proposes Finalizing COVID-19 Healthcare Standard. The Occupational Safety and Health Administration (OSHA) this week took steps toward a permanent COVID-19 standard for healthcare employers. On March 23, 2022, OSHA announced that it would be reopening the existing public comment docket for the COVID-19 healthcare emergency temporary standard (ETS) that was issued on June 21, 2021, and expired on December 21, 2021. Any final standard will be based on the now-expired ETS and contemplate a number of changes and additions that OSHA proposed in this week’s announcement. Among other issues, OSHA is considering: (1) realigning the ETS with current U.S. Centers for Disease Control and Prevention (CDC) recommendations, (2) assessing whether control measures are necessary “where healthcare employees are not reasonably expected to encounter people with suspected or confirmed COVID-19,” and (3) tweaking the vaccination leave provision to require up to four hours of paid leave to get vaccinated. Importantly, the notice states that “OSHA is not considering at this time requiring mandatory vaccination for employees covered by [the] standard.” (Emphasis in original.) Stakeholder comments are due by April 22, 2022, and an online public hearing will be held on April 27.
OFCCP Proposes Changes to Investigation Procedures. On March 22, 2022, the Office of Federal Contract Compliance Programs (OFCCP) published a noticed of proposed rulemaking on “Pre-Enforcement Notice and Conciliation Procedures.” The proposed rule would rescind portions of OFCCP’s 2020 rule that established guideposts for OFCCP investigations and set consistent criteria for the issuance of predetermination notices or notices of violation. As such, the 2020 rule was intended “to increase clarity and transparency for Federal contractors, establish clear parameters for OFCCP resolution procedures, and enhance the efficient enforcement of equal employment opportunity laws.” With the change in administrations, OFCCP now states that the 2020 rule “unduly constrain[s] the agency’s broad enforcement discretion” and that the proposed changes “would allow OFCCP to tailor the pre-enforcement process to the specific facts and circumstances of each case.” As Scott Kelly and Emily Halliday discuss, the proposal forecasts a return to a “hide-the-ball” enforcement strategy for OFCCP. Comments are due by April 21, 2022.
CROWN Act Passes House. Late last week, the U.S. House of Representatives passed the Creating a Respectful and Open World for Natural Hair Act by a vote of 235–189, with 14 Republicans voting for the measure. The bill, also called the CROWN Act of 2022, would make it unlawful for an employer:
to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against an individual, based on the individual’s hair texture or hairstyle, if that hair texture or that hairstyle is commonly associated with a particular race or national origin (including a hairstyle in which hair is tightly coiled or tightly curled, locs, cornrows, twists, braids, Bantu knots, and Afros).
A companion bill in the U.S. Senate has twenty-three cosponsors, with twenty-two Democrats and one Independent, Senator Bernie Sanders.
NLRB Arbitration Case Advances. This week was the deadline for stakeholders to submit comments in response to the National Labor Relations Board’s (NLRB) latest case concerning the interplay of the Federal Arbitration Act (FAA) and Section 7 of the National Labor Relations Act (NLRA). Specifically, the Board asks whether provisions in an arbitration agreement that provide for the confidentiality of arbitration proceedings and expressly permit employees to file unfair labor practice charges with the Board violate the NLRA. In a joint brief submitted by the Coalition for a Democratic Workplace, the Restaurant Law Center, the National Association of Manufacturers, the National Retail Federation, and HR Policy Association, the groups wrote that federal law does not “empower the Board to overrule agreements covered by the FAA that set forth the procedures under which legal claims under other statutes will be adjudicated” and that “arbitration does not bar employees from discussing their workplace grievances with co-workers or the public.” Expect a final ruling from the Board in the coming months.
EPA Publishes Final Scope of D4 Risk Evaluation, Seeks Comment on Draft Revision to PV29 Risk Determination
On March 7, 2022, the U.S. Environmental Protection Agency (EPA) announced the availability of the final scope of the risk evaluation to be conducted for octamethylcyclotetra-siloxane (D4), a chemical substance for which EPA received a manufacturer request for risk evaluation under the Toxic Substances Control Act (TSCA). 87 Fed. Reg. 12696. The scope document includes the conditions of use (COU), hazards, exposures, and the potentially exposed or susceptible subpopulations (PESS) that EPA plans to consider in conducting the risk evaluation for this chemical substance. EPA also published a separate notice announcing the availability of and requesting public comment on a draft revision to the risk determination for the Colour Index Pigment Violet 29 (PV29) risk evaluation. 87 Fed. Reg. 12690. EPA states that the draft revision finds that PV29, as a whole chemical substance, presents an unreasonable risk of injury to health when evaluated under its COUs. The draft revision would supersede the COU-specific no unreasonable risk determinations in the January 2021 PV29 risk evaluation, would withdraw the associated order, and would make a revised determination of unreasonable risk for PV29 as a whole chemical substance. EPA notes that in addition, the draft revised risk determination does not reflect an assumption that workers always appropriately wear personal protective equipment (PPE). Comments on the draft revision to the PV29 risk determination are due April 21, 2022. For more information, please read the full memorandum.

Retiring? IHMM Invites You to Become an Emeritus
You may have decided, after a long and successful career, to retire from active daily duty. Congratulations. That doesn’t mean you have to completely disengage from your profession. IHMM is pleased to offer Emeritus status to all certificants who will no longer be actively engaged in their communities of practice but who still want to stay in touch. Please let us know when you’re approaching that decision and we will assist you in the credential transition.

IHMM has 975 students in the pipeline moving through applications and examinations. IHMM has 358 students taking examinations right now. IHMM has another 546 students headed to take examinations.
