IHMM In-Person or Remotely Proctored Exams
The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.
72% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

EPA Recognition of the IHMM CHMM as an Environmental Professional
IHMM’s Board approved an initiative to have the U.S. Environmental Protection Agency recognize the Certified Hazardous Materials Manager [CHMM] credential in the context of 40 CFR § 312.10, Definitions. The key element of this regulation includes,
“However, the Agency notes that any individual with a certification from a private certification organization where the organization’s certification qualifications include the same or more stringent education and experience requirements as those included in today’s final regulation will meet the definition of an environmental professional for the purposes of this regulation.”
IHMM has produced a crosswalk between 40 CFR § 312.10 Definitions and the CHMM Blueprint that documents how the EPA regulation aligns with the CHMM Blueprint and demonstrates that in each instance the blueprint meets or exceeds 40 CFR § 312.10 Definitions. The EPA definition of an Environmental Professional is in the Federal Register dated November 1, 2005 at page 66080. On that page is the instruction to private certifications being considered Environmental Professionals and how to compare 40 CFR § 312.10 to the certification.
IHMM Fellows Becoming Mentors
IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to provide instruction to the more than 75 IHMM Fellows in becoming mentors.
Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities.
IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

World Day for Safety and Health at Work is April 28. It is an annual international campaign to promote safe, healthy and decent work conditions. It is estimated that work days lost to Occupational Safety and Health-related causes represent almost 4 percent of global GDP, in some countries as much as 6 percent.
By far the greatest proportion of current work-related deaths, 86 percent, come from disease. An estimated 6,500 people a day die from occupational diseases, compared to 1,000 a day from fatal occupational accidents.
Organizers stress that an occupational safety and health culture is one in which every worker has the right to a safe and healthy working environment. A healthy and safety culture is respected at all levels, where governments, employers, and workers actively participate in securing a safe and healthy working environment.

2022 National Safety Stand-Down for Fall Prevention

NPDES BASIC PERMIT WRITERS’ COURSE

The U.S. EPA is pleased to announce the opening of registration for the National Pollutant Discharge Elimination System (NPDES) Basic Permit Writers’ Virtual Guided Learning Courses starting on May 5, 2022, with separate morning and afternoon sessions running for five weeks.
The objective of this course is to provide the basic regulatory framework and technical considerations that support the development of wastewater discharge permits required under the NPDES program. The course was designed for permit writers with about six months to one year of experience in the NPDES program, but experienced permit writers wanting a refresher course and other water program staff or interested parties wanting to learn more about the NPDES program also are welcome.
The 5-week course will begin on Thursday, May 5, 2022. Participants should anticipate a time commitment of approximately 8-10 hours per week and should seek supervisor approval before signing up. The course is scheduled to conclude on June 9th, however a “rain date” of June 16th should be reserved by the participants in case of technical issues.
Each week, participants will have assigned “homework” consisting of NPDES online modules and permit exercises. These modules and exercises will then be discussed in a live virtual classroom setting on Tuesday and Thursday of each week. Participants will have the opportunity to join live office hour discussions with instructors and other participants each Tuesday as well.
Microsoft Teams will be utilized for the virtual classroom and can be accessed through the desktop application or a web browser. Course materials will be provided electronically on the Microsoft Teams classroom site for download by the participants prior to the start date.
As a foundational course, the training does not address in detail specialized topics such as industrial and municipal stormwater, concentrated animal feeding operations, and pesticide discharges. For more information on these specialized topics, please visit EPA’s NPDES website at www.epa.gov/npdes

Beltway Buzz – Ogletree Deakins
KBJ Makes History. On April 7, 2022, the U.S. Senate confirmed Judge Ketanji Brown Jackson to be an associate justice of the Supreme Court of the United States. Judge Jackson was confirmed by a vote of 53–47, with Republicans Susan Collins (Maine), Lisa Murkowski (Alaska), and Mitt Romney (Utah) all voting for confirmation. Judge Jackson will be the first female African-American justice on the Court— a momentous occasion in U.S. judicial history. Of course, Judge Jackson will have to wait a few weeks until Justice Stephen Breyer officially steps down, at which time she can be appointed to fill the vacancy.
NLRB GC to Target Employer Speech. On April 7, 2022, National Labor Relations Board (NLRB) General Counsel Jennifer Abruzzo issued a memorandum to regional offices on “The Right to Refrain from Captive Audience and other Mandatory Meetings.” In the memo, Abruzzo writes “when employees are (1) forced to convene on paid time or (2) cornered by management while performing their job duties” they are “deprived of their statutory right to refrain, and instead are compelled to listen by threat of discipline, discharge, or other reprisal—a threat that employees will reasonably perceive even if it is not stated explicitly.” General Counsel Abruzzo states that she will be submitting to the Board a brief in which she will recommend that “the Board adopt sensible assurances that an employer must convey to employees in order to make clear that their attendance is truly voluntary.”
Board Sees Increase in Both Representation Petitions and ULPs. In other traditional labor news, the Board announced this week that in the last six months (from October 2021 to March 2022, the first half of federal fiscal year 2022), there has been a 57 percent increase in the filing of union representation petitions compared with the same time period last year (1,174 filed petitions compared to 748). The Board also announced that during the same period, there has been a 14 percent uptick in unfair labor practice charges (from 7,255 to 8,254). The Board does not offer reasons for the increases, though the Buzz has some ideas.
POTUS Announces Nominee for EEOC. On April 1, 2022, President Biden announced his intention to nominate plaintiffs’ attorney Kalpana Kotagal to be a commissioner on the U.S. Equal Employment Opportunity Commission (EEOC). If confirmed, Kotagal would replace Commissioner (and former EEOC chair) Janet Dhillon, whose term expires on July 1, 2022. Kotagal’s confirmation would also tilt the EEOC’s majority in favor of Democrats for the first time since late 2018. The current “upside down” makeup of the Commission—a Democratic chair (Charlotte Burrows) who is in the voting minority—has created a bit of a policy logjam. But this logjam will break when the Commission flips to three Democrats and two Republicans, and issues like payroll data collection, regulations on employer wellness programs, and a renewed interest in sexual harassment guidance are likely priorities.
Immigration Legal EAGLEs. On April 6, 2022, the House Committee on the Judiciary passed the Equal Access to Green cards for Legal Employment (EAGLE) Act of 2021 (H.R. 3648). A previous version of the bill, called the Fairness for High-Skilled Immigrants Act of 2020, passed the U.S. House of Representatives (in 2019) and the U.S. Senate (in 2020), but the 116th Congress adjourned before the two bills could be reconciled in conference committee. The Buzz shared some of the details of the bill previously.
Good as Gold. 89 years ago this week, President Franklin D. Roosevelt signed Executive Order 6102 “Requiring Gold Coin, Gold Bullion and Gold Certificates to Be Delivered to the Government.” Issued just weeks after FDR’s inauguration, and in the middle of the Great Depression, the order prohibited “the hoarding of gold coin, gold bullion, and gold certificates within the continental United States by individuals, partnerships, associations and corporations.” The order gave individuals less than one month to turn over all but a small amount of gold to the federal government in exchange for the payment of $20.67 per troy ounce (approximately $450 today). FDR and proponents argued that nationalizing the gold was necessary to allow the federal government to print more money to help stimulate the economy. This restriction on private ownership of gold lasted over 40 years, until it was legalized by federal statute in 1974.
Notice of Public Meetings in 2022 for International Standards on the Transport of Dangerous Goods
The PHMSA Office of Hazardous Material Safety (OHMS) will host public meetings in advance of three international meetings to allow the public to give input on current proposals being considered by the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) and the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP). These international meetings include:

Each of these public meetings will be held approximately two weeks before the corresponding international meeting. Specific information for each meeting, including date, time, conference call-in number, and details for advance registration will be posted when available on the PHMSA website under “Upcoming Events.” These meetings will be virtual, with concurrent in-person sessions possible, pending public health guidelines.

EPA Publishes Final Scope of D4 Risk Evaluation, Seeks Comment on Draft Revision to PV29 Risk Determination
On March 7, 2022, the U.S. Environmental Protection Agency (EPA) announced the availability of the final scope of the risk evaluation to be conducted for octamethylcyclotetra-siloxane (D4), a chemical substance for which EPA received a manufacturer request for risk evaluation under the Toxic Substances Control Act (TSCA). 87 Fed. Reg. 12696. The scope document includes the conditions of use (COU), hazards, exposures, and the potentially exposed or susceptible subpopulations (PESS) that EPA plans to consider in conducting the risk evaluation for this chemical substance. EPA also published a separate notice announcing the availability of and requesting public comment on a draft revision to the risk determination for the Colour Index Pigment Violet 29 (PV29) risk evaluation. 87 Fed. Reg. 12690. EPA states that the draft revision finds that PV29, as a whole chemical substance, presents an unreasonable risk of injury to health when evaluated under its COUs. The draft revision would supersede the COU-specific no unreasonable risk determinations in the January 2021 PV29 risk evaluation, would withdraw the associated order, and would make a revised determination of unreasonable risk for PV29 as a whole chemical substance. EPA notes that in addition, the draft revised risk determination does not reflect an assumption that workers always appropriately wear personal protective equipment (PPE). Every IHMM credential page has a section providing guidance on Exam Preparation.
In each credential’s Exam Preparation section is the graphic at left, linked to the section of the Hazardous Materials Society [HMS] website where the applicant can find the exam prep courses being offered to assist the applicant with preparing for the IHMM exam.
If you are a vendor offering exam prep courses and your prep course is on the HMS site, IHMM applicants will find it. If you do not have an exam prep course on the HMS site, no applicant will find it.

Applications for the 2022 HMS Scholarship Awards Now Open
The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
