For the period of July 22–28, 2026, dangerous-goods and hazardous-materials transportation policy in North America was defined less by the issuance of a comprehensive new code than by active federal permitting proceedings, approaching pipeline-rule deliberations, Canadian containment-standard modernization, Mexican implementation of existing UN-aligned standards, and several highway incidents demonstrating the continuing consequences of tanker and commercial-vehicle failures.
The broader regulatory direction remains clear: the United States, Canada, and Mexico continue moving toward more data-driven administration, internationally harmonized technical requirements, closer scrutiny of means of containment, and greater reliance on electronic records, special permits, risk assessments, and emergency-response planning.
United States
PHMSA Special-Permit Proceedings Remain Active
PHMSA’s July special-permit proceedings remained an important part of the federal hazardous-materials agenda throughout the reporting period. The agency’s July 14 notices addressed applications for new special permits, applications to modify existing permits, and actions granting or denying requests.
The comment period for proposed modifications closes July 29, 2026, immediately after this reporting period, while comments on new applications and agency actions close August 13. These proceedings matter because special permits authorize transportation methods that vary from the literal requirements of the Hazardous Materials Regulations where PHMSA determines that an equivalent level of safety is achieved.
A special permit is not a general exemption available to the entire industry. Its protection is limited to authorized persons operating strictly within the permit’s terms. Packaging specifications, quantity limits, testing, employee training, shipping papers, markings, operational controls, and recordkeeping conditions contained in the permit remain enforceable requirements.
Companies relying on special permits should therefore maintain a controlled-permit register, verify that party status remains current, distribute the applicable permit to affected facilities and carriers, and document employee training on each permit’s conditions.
Pipeline Advisory Committee Deliberations Approach
PHMSA’s Gas Pipeline Advisory Committee and Liquid Pipeline Advisory Committee are scheduled to meet jointly on July 30, 2026. The committees will consider pending pipeline-safety proposals and provide technical advice before PHMSA proceeds further with those rules.
Although the meeting falls just outside the reporting period, preparation for it was underway during July 22–28. The committee process is significant because federal pipeline rules frequently depend upon technical findings concerning feasibility, costs, repair criteria, inspection technology, reporting, and the expected safety benefit of proposed requirements.
Operators transporting natural gas, petroleum, carbon dioxide, and hazardous liquids by pipeline should monitor the meeting materials and resulting recommendations. Particular attention should be directed to proposed changes affecting crack-repair criteria, integrity-management procedures, incident reporting, annual reports, right-of-way surveillance, and construction notifications.
Digital Administration and Portal Availability
PHMSA continues transferring registration, explosives approvals, special permits, and other administrative functions to electronic systems. The PHMSA portal announced a maintenance outage from the evening of July 24 through July 25.
Although a planned technology outage is not a substantive regulatory amendment, it illustrates the practical consequences of digital-only compliance systems. Regulated entities should not wait until a filing deadline to submit approval applications, registration materials, supplemental comments, or permit documentation.
Organizations should maintain internal filing calendars, confirmation receipts, copies of electronic submissions, and contingency procedures for documenting attempted filings when a government portal becomes unavailable.
Hazardous-Materials Registration
The 2026–2027 federal hazardous-materials registration period remains underway. Registration applies to persons offering for transportation or transporting specified quantities and types of hazardous materials and is increasingly integrated into PHMSA’s compliance-data environment.
Registration should not be treated as a routine accounting exercise. Companies should verify that the filing reflects their correct legal identity, operational locations, business category, hazardous-materials activities, and applicable fee classification. Inaccurate registration data may create an independent enforcement issue and may also complicate inspections, permits, grants, and emergency-response coordination.
Important News: Ohio Tanker Rollover and Release
During the reporting period, a commercial tanker overturned on Ohio Route 255 in Monroe County, spilling a flammable hazardous substance and forcing the closure of nearby roads. The driver reportedly suffered serious injuries, and specialized hazardous-materials responders were required.
The incident illustrates the overlapping legal duties that follow a roadway release. The carrier may face inquiries involving driver qualification, hours of service, vehicle maintenance, cargo-tank integrity, shipping documentation, emergency notifications, spill response, environmental remediation, and compliance with any routing or operating restrictions.
Even where the immediate cause is driver error or roadway conditions, investigators will ordinarily examine whether the carrier maintained a defensible safety-management system before the movement began.
Additional Commercial-Vehicle Incidents
A separate Texas collision involving commercial vehicles produced a fuel leak and a hazardous-materials response near the Interstate 10 and Texas 99 interchange. Although the vehicle was reportedly carrying furniture rather than a regulated bulk hazardous-materials load, the diesel or motor-fuel release still required incident control and traffic restrictions.
Such events demonstrate that hazardous-materials liability is not limited to placarded cargo. Fuel contained in vehicle tanks, refrigeration systems, batteries, cleaning products, and other operational materials can create fire, environmental, and emergency-response obligations following an accident.
Canada
Highway-Tank and Portable-Tank Standards
Canada’s principal dangerous-goods regulatory development remained the modernization of the CSA B620, B621, and B622 standards governing highway tanks and TC portable tanks. Transport Canada’s consultation concerning the proposed new editions closed July 26, 2026, during this reporting period.
CSA B620 addresses the design, construction, certification, assembly, modification, repair, inspection, testing, maintenance, and marking of highway tanks and TC portable tanks. Related standards B621 and B622 govern the selection and use of containment systems for specified classes of dangerous goods, including gases, flammable liquids, oxidizers, toxic materials, corrosives, and miscellaneous dangerous goods.
Because Canada incorporates these standards into the Transportation of Dangerous Goods Regulations, revision of the referenced edition may create binding obligations after the regulatory incorporation and applicable transition periods take effect.
Canadian carriers, consignors, tank owners, repair facilities, and inspectors should maintain version-controlled copies of the applicable standards and identify whether contemplated repairs, alterations, inspections, or tests must be performed by a Transport Canada-registered facility or qualified person.
Electronic Documentation and Regulatory Modernization
Transport Canada continues planning amendments that would permit electronic shipping documents for dangerous goods transported by rail and remotely piloted aircraft. The department also continues work on international harmonization, competency-based training, remotely piloted aircraft, and nationally specific updates to classification, shipping names, packing provisions, dangerous-goods marks, and rail requirements.
These initiatives have not all become enforceable rules. Nevertheless, they demonstrate Canada’s policy direction toward electronic information, reduced dependence on equivalency certificates, closer alignment with the UN Model Regulations, and greater use of risk-based compliance data.
Companies should distinguish carefully between current legal requirements and future regulatory proposals. Adopting a proposed electronic-document system does not excuse compliance with existing paper-document requirements unless a regulation, equivalency certificate, or other lawful authorization permits the alternative.
Marine Safety Management Requirements
Canada’s expanded Marine Safety Management System Regulations became applicable to additional classes of domestic vessels on July 3, 2026, and therefore remained an important implementation obligation during this reporting week.
For vessels transporting fuels, chemicals, packaged dangerous goods, or dangerous goods in bulk, a documented safety-management system should address operational responsibility, emergency procedures, equipment maintenance, reporting, crew competency, and corrective action. Compliance with the TDG Regulations or marine dangerous-goods requirements should be integrated into—not separated from—the vessel’s broader safety-management system.
Emergency Response and Site Registration
Transport Canada continues emphasizing CANUTEC, Emergency Response Assistance Plans, and registration of sites that import, offer for transport, handle, or transport dangerous goods. Canadian oversight increasingly depends upon complete and accurate information regarding regulated locations and activities.
Companies should ensure that site-registration records are updated when operations, addresses, dangerous-goods activities, or organizational control change. They should also verify that emergency telephone information and ERAP activation procedures remain accurate and available at all times.
Canadian Assessment
No major new amendment to the Transportation of Dangerous Goods Regulations and no comparably significant nationally reported dangerous-goods transportation accident were identified for July 22–27. Canada’s principal development was therefore the close of the highway-tank standards consultation and continuing implementation of its broader regulatory-modernization program.
Mexico
National Quality Infrastructure Program
Mexico continues implementing its 2026 National Quality Infrastructure Program, which identifies amendments to dangerous-goods transportation standards, including the national list of dangerous substances and materials and associated instructions for packages, intermediate bulk containers, large packagings, portable tanks, multiple-element gas containers, and bulk containers.
The program reflects Mexico’s continuing effort to keep its NOM framework aligned with changes to the UN Model Regulations and international modal codes.
These projects do not become enforceable merely because they appear in the standards program. A proposed or planned NOM must proceed through the legally required development, consultation, approval, and publication process before regulated parties may be held to its new substantive requirements.
Existing NOMs Remain Controlling
During the reporting period, Mexico’s existing dangerous-goods regulations and NOMs continued to govern classification, identification, packaging, documentation, vehicle markings, and road transportation.
Cross-border operators should not assume that compliance with the U.S. Hazardous Materials Regulations or Canada’s TDG Regulations automatically establishes compliance in Mexico. Mexico may apply different shipping descriptions, packaging references, documentation formats, permit requirements, or conditions for limited and excepted quantities.
A shipment should therefore undergo a Mexico-specific legal and technical review before it crosses the border.
Vehicle and Containment Integrity
Mexican requirements governing the physical and mechanical condition of federal motor vehicles remain particularly important for tank trucks and specialized carriers. Vehicle defects may implicate general roadworthiness standards as well as dangerous-goods-specific containment and safety obligations.
For petroleum, liquefied petroleum gas, corrosives, toxic substances, and other high-consequence cargoes, carriers should maintain inspection records, tank-test documentation, proof of insurance, driver credentials, vehicle permits, maintenance history, emergency equipment, and evidence of lawful cargo possession.
Fuel and LP-Gas Oversight
Mexico’s continuing emphasis on fuel and LP-gas transportation follows serious tanker incidents and concerns regarding vehicle integrity, speed, routing, monitoring, and unlawful fuel movements.
Regulated entities should expect enforcement to focus on the condition of tanks and vehicles, GPS or other monitoring systems, insurance, driver competency, emergency response, and the consistency of transportation documents with energy and customs records.
Mexican Assessment
No major new dangerous-goods NOM and no independently verified nationally significant transportation accident were identified for July 22–27. The principal Mexican development remained continued implementation of existing requirements and development of future standards under the 2026 quality-infrastructure program.
North American Themes
Five themes define the July 22–28 reporting period.
First, technical regulation increasingly develops through special permits, incorporated standards, and agency guidance rather than a single comprehensive rulemaking.
Second, containment integrity remains central. Tankers, highway tanks, portable tanks, pipeline systems, and vehicle fuel systems all present potential fire, release, and environmental risks.
Third, digital government systems are becoming part of the compliance obligation. Electronic filing failures, outdated registrations, or incomplete database information may have substantive legal consequences.
Fourth, harmonization remains influential but incomplete. The United States, Canada, and Mexico rely heavily upon UN-based principles while preserving nationally specific rules and exceptions.
Fifth, recent highway incidents demonstrate that emergency preparedness cannot be confined to shipments bearing placards. Vehicle fuel, batteries, and operational chemicals may also create hazardous-materials response obligations.
Conclusion
For July 22–28, 2026, North American dangerous-goods transportation law was characterized by active PHMSA permit proceedings, approaching pipeline-rule deliberations, closure of Canada’s highway-tank standards consultation, and Mexico’s continued development of UN-aligned national standards.
For regulated entities, the prudent legal standard requires current registration, defensible classification, strict control of special permits, version-managed technical standards, verified tank and vehicle integrity, accurate electronic filings, competent personnel, jurisdiction-specific cross-border review, and an emergency-response system capable of addressing both regulated cargo and vehicle-related hazardous substances.
Dangerous-goods compliance is no longer adequately managed through labels and shipping papers alone. It now requires integrated control of regulatory data, equipment condition, employee competency, contractual allocation of responsibility, environmental response, and operational risk.
- PHMSA’s July special-permit notices established July 29 and August 13 comment deadlines, while the pipeline advisory committees are scheduled to meet July 30. The 2026–2027 registration cycle began July 1, and PHMSA’s portal announced scheduled maintenance for July 24–25.
- The Ohio tanker rollover spilled a flammable substance and closed roads, while a Texas commercial-vehicle collision caused a fuel leak requiring a hazmat response.
- Transport Canada’s consultation concerning CSA B620, B621, and B622 closed July 26; the standards govern highway and portable-tank construction, inspection, testing, maintenance, and use. Existing Mexican NOMs continue to regulate vehicle identification, packaging, containment, and the transport of limited or excepted quantities.
Europe, Africa, Asia, and South America
For the period of July 22–28, 2026, international dangerous-goods transportation policy was characterized principally by implementation of existing regulatory instruments, preparation for the next UNECE amendment cycle, expansion of electronic freight oversight, and escalating security risks affecting tankers carrying crude oil, petroleum products, naphtha, LNG, and other dangerous cargoes.
No new edition of ADR or the UN Model Regulations entered into force during the reporting period. ADR 2025 therefore remains controlling for covered international road movements, while the twenty-fourth revised edition of the UN Model Regulations continues to provide the principal technical foundation for future modal and national amendments.
Europe
ADR 2025 Remains Controlling
European consignors, carriers, packers, fillers, loaders, tank operators, and consignees remain subject to ADR 2025 for covered international road transportation. The agreement governs classification, packaging, tanks, marking, labeling, placarding, documentation, vehicle equipment, driver training, security, and emergency procedures.
The principal regulatory development during this period was not adoption of a new ADR text, but continued preparation for future UNECE deliberations. The next WP.15 session is scheduled for November 3–6, 2026, and the next UNSCOE session for November 23–December 1, 2026. The September RID/ADR/ADN Joint Meeting has been cancelled.
This procedural posture is important. Technical proposals concerning batteries, tanks, pressure receptacles, packaging, waste movements, and alternative fuels are not binding merely because they have been discussed or accepted at an expert meeting. They must proceed through the appropriate UN, modal, treaty, and domestic implementation processes.
Multilateral Agreements
UNECE multilateral agreements continue to permit narrowly defined departures from ADR among participating countries. Such agreements must not be treated as Europe-wide exemptions. A carrier relying upon one should verify that every relevant jurisdiction has signed it, that the agreement remains effective, and that the shipment satisfies every stated condition.
European Exposure to Maritime Disruption
Although the period produced no comparably significant new European road-transport accident identified in the reviewed record, European chemical, petroleum, and manufacturing supply chains were materially affected by security conditions in the Red Sea and Strait of Hormuz.
Reduced tanker traffic and vessel diversions threaten the timely arrival of petroleum products, LNG, feedstocks, and industrial chemicals at European ports. Those disruptions may implicate charter-party rights, force-majeure clauses, insurance notice requirements, demurrage, alternative routing, port substitutions, and downstream supply obligations.
Asia and the Middle East
Tankers Reroute as Security Risks Escalate
The most consequential dangerous-goods transportation news arose from the Middle East and Asian maritime trade routes. On July 22, vessel movements through the Strait of Hormuz had fallen sharply, with no very large crude carriers or LNG tankers observed in the reported crossing data. At the same time, oil tankers began changing course in the Red Sea following threats against vessels associated with Saudi ports.
On July 24, the Danish-flagged product tanker Torm Innovation, carrying approximately 500,000 barrels of naphtha to Japan, rerouted through the Suez Canal and around the Cape of Good Hope because of security concerns in the southern Red Sea. The longer route could add substantial transit time and cost.
Two Chinese supertankers carrying a combined four million barrels of Saudi crude successfully exited the Red Sea on July 23, but the movements occurred against a backdrop of reduced traffic and reported attacks on Saudi oil tankers.
Consequences for Dangerous-Cargo Operations
These events demonstrate that technical compliance with the IMDG Code does not, by itself, discharge an operator’s broader duty to conduct a reasonably safe voyage. Owners, charterers, cargo interests, and ship managers should review:
- voyage-specific security assessments;
- war-risk insurance and notification conditions;
- charter-party deviation and safe-port clauses;
- cargo-containment and emergency-shutdown systems;
- fire, evacuation, salvage, and emergency-towing procedures;
- pollution-response arrangements; and
- contractual responsibility for delay, diversion, transshipment, or nondelivery.
Where a vessel is carrying crude oil, LNG, naphtha, chemicals, or other dangerous cargo, a security incident may simultaneously trigger maritime-safety, environmental, insurance, contractual, customs, and sanctions consequences.
LNG and Petroleum Supply Effects
Asian LNG prices rose to a four-month high amid concern that conflict could further restrict shipping through the Strait of Hormuz and Red Sea. The market response demonstrates how transportation insecurity can affect not only vessel operations but also cargo availability, storage planning, emergency procurement, and contractual performance.
Batteries and Air Transportation
Asian manufacturers and exporters also remain subject to the 2025–2026 ICAO Technical Instructions and the 2026 IATA Dangerous Goods Regulations. The IATA rules provide the principal operational system used by airlines, freight forwarders, handlers, and shippers to classify, package, mark, label, and document dangerous goods offered for air transportation.
Battery shippers should retain UN 38.3 test evidence, test summaries, watt-hour information, state-of-charge documentation where applicable, and proof that cells and batteries are protected against short circuits, movement, damage, and unintended activation.
Africa
Existing International and National Rules Remain Controlling
No major continent-wide dangerous-goods regulation was identified as having been adopted during July 22–27. African dangerous-goods transportation remains governed through national road, rail, aviation, maritime, customs, environmental, and port requirements derived in substantial part from the UN Model Regulations, ICAO Technical Instructions, and IMDG Code.
Accordingly, the absence of a new regional enactment should not be interpreted as an absence of legal responsibility. Depending upon the jurisdiction and mode, a dangerous-goods movement may require compliant packaging, vehicle approval, driver training, placarding, shipping documentation, emergency information, environmental authorization, and port or carrier acceptance.
Fuel-Tanker Risks
Fuel distribution by road remains a high-consequence transportation activity throughout the continent. Historically recurring hazards include tanker rollovers, inadequate maintenance, driver fatigue, public access to spilled fuel, delayed emergency response, and ignition following a release.
During this reporting period, no major Africa-specific tanker disaster was located in sufficiently reliable reporting to warrant presenting it as a confirmed regional event. Nevertheless, the recurrent pattern of catastrophic fuel-tanker incidents supports continued regulatory attention to vehicle integrity, route planning, driver competency, spill-site exclusion, and emergency coordination.
Ports and Carriers as Enforcement Points
For international cargo moving through African ports, the most immediate compliance review may occur through vessel operators, airlines, terminals, and customs authorities. A shipment may be rejected for an inaccurate dangerous-goods declaration, invalid packaging certification, improper IMDG segregation, or deficient emergency information even where roadside enforcement is limited.
Businesses should therefore treat carrier and terminal conditions as additional requirements rather than substitutes for national law.
South America
Colombia Continues RNDC Implementation
Colombia continued implementation of its updated Registro Nacional de Despachos de Carga, or RNDC, framework. On July 22, the Ministry of Transport announced training for cargo-transport companies concerning FOPAT withholding and RNDC operations, with the session scheduled for July 23.
The broader RNDC regulation, Resolution No. 20263040016075, requires United Nations coding where the cargo consists of dangerous goods or hazardous waste. The system permits transportation authorities to compare cargo descriptions, UN numbers, quantities, vehicles, carriers, routes, consignees, and supporting documents.
The legal significance is substantial. An inaccurate electronic entry may become affirmative evidence of a classification, documentation, commercial, customs, or environmental violation. Regulated entities should apply documented quality-control procedures to RNDC submissions and should not treat them as clerical records of secondary importance.
Brazil’s Dangerous-Products Framework
Brazil continues regulating road transportation of dangerous products under ANTT Resolution No. 5.998/2022. The regulation establishes the national road-transport framework and complementary instructions governing dangerous-products operations on public roads.
During the reporting period, no major new dangerous-products resolution was identified. ANTT did, however, publish an internal risk-management amendment on July 23. Although not a direct amendment to dangerous-products transportation requirements, it reflects the agency’s broader emphasis on risk-based regulatory administration.
Brazilian operators should continue verifying vehicle and tank condition, equipment certification, driver qualifications, shipping documents, placards, emergency equipment, insurance, and compliance with environmental requirements applicable to the cargo.
MERCOSUR Transportation
Argentina, Brazil, Paraguay, Uruguay, and other participating jurisdictions continue using UN-aligned and MERCOSUR-based principles for inland dangerous-goods transportation. Regional harmonization facilitates cross-border commerce but does not eliminate domestic differences.
A carrier should separately verify each country’s requirements concerning permits, documentation, driver credentials, vehicle inspections, emergency information, customs records, and nationally recognized exceptions.
Cross-Regional Developments
Several themes define the July 22–28 period.
First, existing codes remain controlling while regulators prepare for future amendment cycles. Proposed UNSCOE or UNECE language should not be represented as binding until the necessary treaty and domestic procedures are completed.
Second, maritime security has become inseparable from dangerous-goods compliance. Route selection, war-risk insurance, deviation authority, cargo integrity, pollution response, and crew protection must be addressed together.
Third, electronic freight systems are becoming direct enforcement tools. Colombia’s RNDC framework demonstrates how regulators may compare dangerous-goods information against vehicle, carrier, route, and commercial data.
Fourth, batteries remain a principal focus of air, maritime, road, and rail regulation. Classification, test evidence, state of charge, damage assessment, packaging, and fire-response capabilities require continuing review.
Finally, international harmonization does not establish universal compliance. ADR, the UN Model Regulations, the IMDG Code, ICAO Technical Instructions, MERCOSUR instruments, and national laws must be read together.
Conclusion
For July 22–28, 2026, dangerous-goods transportation law across Europe, Africa, Asia, and South America was characterized by continued implementation of existing regulatory instruments, preparation for future UNECE and UNSCOE meetings, expansion of electronic freight oversight, and severe maritime-security disruption affecting petroleum, naphtha, and LNG movements.
Europe remains governed by ADR 2025 while preparing for later amendment cycles. Asia and the Middle East face immediate tanker-routing and energy-supply risks. It requires defensible classification, accurate electronic records, tested packaging and containment, competent personnel, route-security analysis, adequate insurance, version-controlled regulatory procedures, and coordinated emergency-response planning.
