IHMM Remotely Proctored Exams Available Now
IHMM is pleased to announce that the American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April of 2020.
About 60% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination. There are Kryterion centers available worldwide and we also offer remotely-proctored testing wherever you are.

Throughout our certificant’s MYIHMM accounts are also now placed 10 Year, 20 Year, and 30 Year badges signifying their longevity as an IHMM certified professional.
IHMM has also added Distinguished Diplomates and Fellows of the Institute badges to the appropriate people in the MYIHMM database. These two badges will be accompanied by new lapel pins to be sent to each of those distinguished by holding these designations.

IHMM “702” Project
Rule 702. Testimony by Expert Witnesses
A witness who is qualified as an expert by knowledge, skill, experience, training, or education may testify in the form of an opinion or otherwise if:
(a) the expert’s scientific, technical, or other specialized knowledge will help the trier of fact to understand the evidence or to determine a fact in issue;
(b) the testimony is based on sufficient facts or data;
(c) the testimony is the product of reliable principles and methods; and
(d) the expert has reliably applied the principles and methods to the facts of the case.
The IHMM “702“ project is based on rule 702 of the federal rules of expert testimony/witnesses and the use of experts in trials. Even though the project is based on that rule it is not relegated only to the use of experts in legal proceedings. It is our intention to extend the use of this project and its population to include media commentary and the demands of environmental, dangerous goods, health, and safety regulators on matters directly related to the jurisdictions of IHMM certifications.
IHMM would inform the news media, state and federal regulators, and the legal profession of the availability of “experts” for use in legal proceedings, working with environmental regulators or commenting on matters in the news for the news media. This will raise the level of visibility of all IHMM credentials and those who hold them.
We will construct a section of our AA/database allowing IHMM certificants to register for this project and select the areas of specialization they hold. Only those whose fees are up-to-date will be allowed to register and be available for public view of their levels of expertise.
This project will increase the value of our credentials as well as our ability to serve the legal, media, and government regulator sectors of the economy by offering experts to provide commentary or testimony. Registration would be strictly voluntary.

Before IHMM does any further work on this project we need to collect some data. This survey is designed to collect data from IHMM certificant’s general attitude toward this new feature being created and whether or not you may ultimately register for it. The survey obligates you to nothing. We are just collecting data on whether or not IHMM certificants believe this service if it is created, would be worthwhile.

HMS and Earning Certification Maintenance Points [CMPs]
IHMM created HMS, in large measure, so that IHMM certificants could have one, central place within which to find professional development courses in which to earn certification maintenance points. HMS courses cover all of IHMM’s 8 credentials, not only one.
We’ve made it easy to find CMPs.

- Scroll down until you see these buttons…and click on the CMPs button
- The system will produce a listing of the programs on the platform that have already been reviewed and given CMP ratings. You can find the programs suitable for you.
For example, one of the programs is from Columbia Southern University, offered online, has 36 CMPs attached, and is FREE. This is only one example. There are hundreds of programs on HMS.
Recertification of your IHMM credential is easy and straightforward – encompassing the 5 basic steps shown above. This graphic applies to the CHMM, CHMP, CDGP, and CDGT credentials. IHMM is constructing the system to incorporate the former ISHM point system to the IHMM point system for all CSHM and CSMP credentials later this summer.

IHMM’s recertification system allows certificants to start a recertification application at any time, don’t wait until the 4th year and the 11th month to start one – start now and enter your CMPs as you go. That makes completing the application easy when the time comes to recertify. Certificants can start a recertification application with their CMPs through their individual MYIHMM accounts.

A 529 plan is a tax-advantaged savings plan designed to encourage saving for future education costs. 529 plans, legally known as “qualified tuition plans,” are sponsored by states, state agencies, or educational institutions and are authorized by Section 529 of the Internal Revenue Code. Under H.R. 2171 those pursuing or who already have private credentials may use their Section 529 savings for applications, examinations, professional development/certification maintenance points /costs recertification, and so on.
The “Freedom To Invest in Tomorrow’s Workforce Act” will enable those who seek professional, post-secondary credentials from institutions recognized by the Internal Revenue Service. A copy of the draft legislation is here.
Spanberger co-led the introduction of the legislation alongside U.S. Representatives Fred Upton (R-MI-06), Dean Phillips (D-MN-03), and Rob Wittman (R-VA-01). A companion bill in the U.S. Senate is led by U.S. Senators Amy Klobuchar (D-MN) and Mike Braun (R-IN).
IHMM & AHMP 45 in 5 Project – National Credential Recognition – 21 States Targeted
On January 25th, we began outlining the strategy to go after the 21 states in yellow, above. Since then we have succeeded in adding Nebraska, Colorado, and California.

In 2019 Mark Bruce from AHMP and Gene Guilford from IHMM worked on a project to get the Commonwealth of Pennsylvania to recognize the CHMM and CDGT credentials. With Mark’s work on the ground in Pennsylvania, we succeeded.
Since the launch, we have added Delaware, Florida, Texas, California, Washington, Georgia, Ohio, Tennessee, Alabama, Maryland, Virginia, Massachusetts, Missouri, Iowa, North Carolina, Colorado, Missouri, Kansas, Oklahoma, Nebraska, New Mexico, and Puerto Rico as the next places for us to work on with 44 volunteers.

The Hazardous Materials Society (HMS) is looking for the best and brightest to lead the organization forward. A total of FOUR (4) DIRECTOR positions are open with a two-year term, beginning on January 1, 2022 and ending on December 31, 2024. The maximum number of years any candidate may serve is six (6) years.
These positions are open to ANY IHMM-certificant, who is in good standing with the Hazardous Materials society (HMS) as well as the Institute of Hazardous Materials Managers (IHMM). Self-nominations are permitted.

Are adverse reactions to the COVID-19 vaccine recordable on the OSHA recordkeeping log?
In general, an adverse reaction to the COVID-19 vaccine is recordable if the reaction is: (1) work-related, (2) a new case, and (3) meets one or more of the general recording criteria in 29 CFR 1904.7 (e.g., days away from work, restricted work or transfer to another job, medical treatment beyond first aid).
If you require your employees to be vaccinated as a condition of employment (i.e., for work-related reasons), then any adverse reaction to the COVID-19 vaccine is work-related. The adverse reaction is recordable if it is a new case under 29 CFR 1904.6 and meets one or more of the general recording criteria in 29 CFR 1904.7.

Beltway Buzz – Olgetree & Deakins
Last Week Today. Here is a quick rundown of some of the labor and employment policy developments we missed last week while at Workplace Strategies in Austin, Texas (be sure to join us next year for the program at the Arizona Biltmore).
- OSHA COVID-19 ETS Now Effective. The Occupational Safety and Health Administration’s COVID-19 emergency temporary standard (ETS) became effective on June 21, 2021. This means that covered employers (e.g., generally speaking, those in the healthcare industry) must comply with most of the provisions by July 6, 2021, but have until July 21, 2021, to comply with the requirements regarding physical barriers, ventilation, and training. The new standard is already the subject of multiple legal challenges from unions claiming that it does not go far enough.
- DOL Proposes Return to 80/20 Rule for Tipped Employees. The U.S. Department of Labor’s (DOL) Wage and Hour Division issued a proposal to rescind portions of a Trump-era DOL guidance and rulemaking that allows employers to take a tip credit for time employees spend on work that does not generate tips (such as refilling condiment bottles or folding napkins), as long as those tasks are reasonably related to the tip-generating work. The new proposal would instead restore the 80/20 rule, prohibiting employers from taking a tip credit if employees’ non-tip producing work exceeds 20 percent of the work week. Victoria L. Vish and Steven F. Pockrass have the details.
- FLSA Joint-Employer Rule. Despite not having a Senate-confirmed administrator, the DOL’s Wage and Hour Division continues to roll back Trump-era initiatives. Late last week, the DOL sent its proposed rescission of the 2020 joint-employer regulation, which established a straightforward test for determining joint-employer status, to the Office of Information and Regulatory Affairs for final review. This means that a final rule likely rescinding the 2020 regulation will arrive shortly.
- USCIS Nominee Advances. The Senate Judiciary Committee recently approved the nomination of Ur Mendoza Jaddou, who is an attorney with 20 years of experience in immigration law and policy, to be director of U.S. Citizenship and Immigration Services. Jaddou’s nomination now awaits a vote by the full Senate.
- President Biden Announces New Nominee to NLRB. President Biden nominated long time union-side attorney David Prouty to fill a not-yet-empty seat on the National Labor Relations Board. Prouty will queue up in anticipation of replacing current member William Emanuel when his term expires on August 27, 2021. As the Buzz discussed previously, President Biden nominated another union attorney, Gwynne Wilcox, to fill the currently vacant seat on the Board. With these two nominations, Democrats are poised to flip the Board in their favor as early as September 2021.
EEOC Transparency Rule Nixed. On June 30, 2021, President Biden signed a resolution rescinding the U.S. Equal Employment Opportunity Commission’s (EEOC) regulation that requires EEOC attorneys to be more transparent with their demands during the conciliation process. Because the rule was rescinded pursuant to the Congressional Review Act, the EEOC will generally be prohibited from future attempts to clarify the conciliation process, absent express consent from Congress. EEO-1 Filing Deadline Extended. Speaking of the EEOC, the Commission has extended the deadline for employers to submit their EEO-1 forms. Kiosha H. Dickey and James A. Patton, Jr. have all the details.
Voters Wary of PRO Act. As part of the ongoing lobbying campaign over the Protecting the Right to Organize Act of 2019 (PRO Act), this week the Coalition for a Democratic Workplace released the results of a survey regarding the public’s opinions of the bill. A bipartisan firm surveyed more than 1,000 voters and concluded, among other findings, that:
- “70% of voters are concerned about the PRO Act abolishing state right-to-work protections.”
- “70% of voters are concerned that the PRO Act limits the ability of individuals to work as independent contractors.”
- “68% of voters are concerned about the PRO Act interfering with small business’ access to legal advice on labor law matters.
The PRO Act remains stalled in the Senate for now, and advocates on both sides will undoubtedly continue their lobbying efforts.
Life is a Highway. Much of the debate in Washington, D.C., these days is focused on a legislative infrastructure package to provide funding to rebuild our roads, bridges, and waterways. Thus, it is fitting that this June 29 marked the 65th anniversary of the enactment of the Federal Aid Highway Act of 1965. The historical statute, signed into law by President Dwight D. Eisenhower, authorized $26 billion dollars—generated from an increased gasoline tax—for the construction of a 41,000-mile network of interstate highways. The bill’s primary congressional champions were representative Hale Boggs (D-LA) (who is presumed to have died in a 1972 plane crash in Alaska along with representative Nick Begich) and Senator Albert Gore, Sr. (D-TN) (who was “Al Gore” before the 45th vice president was “Al Gore”). Today, the longest interstate highway is I-90, which connects Seattle, Washington, with Boston, Massachusetts.
