IHMM Remotely Proctored Exams Available Now

IHMM is pleased to announce that the American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April of this year.

About 65% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

Free college, child care, and all the spending that has been taking place in Washington D.C. has to be paid for somehow. It is not free money. The Biden administration has proposed strengthening its coffers by bolstering the IRS to go after every penny that they can.

The Biden administration has proposed requiring financial institutions to report to the IRS all transactions of all business and personal accounts worth more than $600, including withdrawals and deposits, instead of relying on the taxpayers themselves.

The most recent development, wrapped in fancy trappings, is the American Families Plan.

CALL TO ACTION – Freedom to Invest in Tomorrow’s Workforce Act

IHMM and PCC will host a “virtual fly-in” on October 6 at 1:00 p.m. ET to urge Members of Congress to support H.R. 2171/S. 905, the Freedom to Invest in Tomorrow’s Workforce Act, and the soon-to-be-introduced REBUILD Skills Act.  Visit our website to register.

The goal of the fly-in is to encourage Members of Congress to cosponsor each of these bills and to persuade them to request that congressional leaders allow the bills to move expeditiously, either on a standalone basis or as part of a larger legislative package.  We are pleased to announce that Rep. Abigail Spanberger (D-VA), the author of the Freedom to Invest in Tomorrow’s Workforce Act, is confirmed to speak to participating PCC members at the beginning of the virtual fly-in. After the Congresswoman’s remarks and an internal PCC member strategy and prep session, PCC members will participate in virtual meetings with their Members of Congress (arranged either by the PCC or by the PCC members, depending on preference/availability).

IHMM Certified Hazardous Materials Specialist [CHMS] Committee

The IHMM Certified Hazardous Materials Specialist Committee [CHMS] is in the latter stages of creating a new hazardous materials credential targeted specifically at the more than 250,000 military service personnel who muster out of the armed services each year with no degree and less than three years experience in a MOS, as well as recent college graduates with degrees in targeted disciplines but with no experience as they begin their hazmat careers. The latter serves as the next step after IHMM’s present Student CHMM program.

Call for Volunteers – Student CHMM Committee

From Spring 2020 through Early Summer 2021 IHMM ran a pilot program for the newly created Student CHMM credential. Call for Volunteers – IHMM Professional Textbook Committee

IHMM is calling for volunteers to participate in updating the IHMM Managing Hazardous Materials – A Definitive Text, textbook. Preference is given to those who last participated in this endeavor, though IHMM seeks CHMM and CHMP hazardous materials professionals generally to populate this committee and contribute to this effort.

In addition, this committee will be permanent and provide continuous improvement of the material by not only produced a single new textbook but also producing an annual update of material.

Here is how a professional certification body operates:

The IHMM Managing Hazardous Materials text is an integral part of the system that begins with producing or updating a blueprint for an IHMM credential, such as the CHMM or CHMP. Arising from the blueprint next comes creating examinations and item banks of questions that feed the exams. The IHMM text then mirrors the blueprint and examinations in order to best prepare applicants to take the exam. Then, arising from the blueprint and textbook comes the creation of preparatory courses further enabling applicants to prepare for and ultimately to pass the exam. The prep courses are offered through IHMM’s foundation at the Hazardous Materials Society.

Call for Volunteers – IHMM CSSS-CSSM Committee

IHMM is calling for CSSS and CSSM volunteers to participate in the CSSS-CSSM Committee. IHMM inherited the CSSS and CSSM credentials when it acquired ISHM in April 2019. The CSSS and CSSM credentials have no job task analysis, no blueprints, no exams, or item banks. Now that IHMM has spent the past 18 months establishing the updated processes to recreate the CSHM and CSMP credentials, we can turn to the CSSS and CSSM designations.

IHMM-AHMP 45 in 5 Task Force

We are preparing an initiated rulemaking at EPA to amend 40 CFR § 312.10 – Definitions to include CHMMs, as well as a petition to the Small Business Administration recognizing CHMMs for the purposes of conducting Phase I and Phase II site assessments.

These regulatory proposals go to the IHMM Board for its September 24, 2021 meeting.

IHMM CSHM Scheme Committee

The IHMM CSHM Scheme Committee is expected to complete the task of creating a new blueprint for the credential by Q4 of 2021. When released, this will lead to IHMM creating a separate group to organize the creation of new supporting text materials as well as working to create a new exam preparatory course.

IHMM CSMP Scheme Committee

The IHMM CSMP Scheme Committee is expected to complete the task of creating a new blueprint for the credential by Q4 of 2021. When released, this will lead to IHMM creating a separate group to organize the creation of new supporting text materials as well as working to create a new exam preparatory course.

IHMM Professional Standards Committee

The IHMM Professional Standards Committee is in the process of creating a new IHMM Code of Ethics orientation program for use by new applicants as well as during the recertification process.

IHMM Microcredential Task Force

The IHMM Microcredential Task Force is in the latter stages of preparing two draft blueprint recommendations for the IHMM Board for the creation of microcredentials for Pandemic Preparedness and Pandemic Response.

IHMM Professional Sustainability Task Force

The IHMM Professional Sustainability Task Force is in the initial stages of exploring the potential of creating a sustainability credential for IHMM and making a recommendation to the IHMM Board to that end.

IHMM is also completing an update with Association Anywhere/MYIHMM to facilitate the transition of former ISHM credential holders [CSHM and CSMP] to participate in the IHMM recertification system. When formally announced, CSHM and CSMP credential holders will have one year to complete what will be a simple process of recertification.

IHMM has been soliciting responses to its RFP for a 360° cybersecurity audit of its operations and those of the contractors with whom IHMM works. IHMM has solid cybersecurity protection and is making sure that status remains ahead of the curve.

IHMM has just completed its application for ANSI/ANAB accreditation audit for the 2020-2021 year. The strength of credentials is based on the strength of their accreditation and IHMM’s ANSI/ANAB accreditation is the gold standard.

IHMM Certified Hazardous Materials Practitioner [CHMP]

HMS Education and Training

Hazardous Materials Society now has 6,347 education and training programs on its website, with more coming every week. Certificants will note that most of these programs carry a CMP value, making it easier to know in advance what to expect. The HMS Education and Training platform also provides a wide variety of courses for professional development across all of IHMM’s credentials – and more are being developed by the HMS Education and Training Committee.

IHMM applicants and certificants are free to search the landscape for training. IHMM wanted to make that task easier by aggregating training in one place if you choose to use it. Among these more than 11.000 programs are webinars delivered online and virtually all carry IHMM CMPs values with them for your annual / 5-year CMP planning.

IHMM GOVERNMENT AFFAIRS

Beltway Buzz – Ogletree & Deakins

Administration to Mandate Vaccines for Federal and Private-Sector Employees. President Joe Biden this week dramatically ramped up his administration’s efforts to increase COVID-19 vaccination rates across the country.

  • On September 9, 2021, the president issued an executive order requiring all executive branch employees to be vaccinated and another executive order that will likely result in a similar mandate for certain employees of federal contractors. Regarding the order applicable to federal contractors, most of the implementation details will be spelled out in forthcoming guidance from the Safer Federal Workforce Task Force. Leigh Nason has the details.
  • Also on September 9, 2021, the president announced that the Occupational Safety and Health Administration would require private-sector employers with 100 or more employees to mandate vaccinations for their employees or engage in frequent testing. John Martin has the details.

House Begins Work on Potential Federal Employment Law Changes. Until this week, we have primarily been dealing with summary documents, fact sheets, and rumors of what will be contained in the congressional Democrats’ $3.5 trillion “Build Back Better” reconciliation package. But now, we actually have some draft legislative text to review. This week, both the House Committee on Ways and Means and the House Committee on Education and Labor released legislative text of their respective provisions of the budgetary reconciliation package. There is still a lot of process to go through, so all of this is subject to change, but the draft labor and employment policy provisions include the following proposals.

Federal Paid Leave (Ways and Means Committee)

  • Creates a taxpayer-funded, 12-week paid family and medical leave benefit for all workers that would begin in July 2023 (there would be no phase-in period).
  • Provides reimbursement for states continuing to operate qualifying preexisting paid leave laws, as well as for employers that sponsor or provide qualifying paid leave (which includes, in part, job protection for employees on leave).

Protecting the Right to Organize (PRO) Act and Other Labor Provisions (Education and Labor Committee)

  • Enacts civil penalties of up to $50,000 for each unfair labor practice (ULP) committed by an employer (interestingly, the bill does not include such penalties for ULPs committed by labor unions) and up to $100,000 for certain repeat violations. The “public interest” is one of the statutory factors that the National Labor Relations Board (NLRB) would consider in assessing the penalty amount.
  • Permits civil penalties to be assessed against individual directors or officers of an employer.
  • Prohibits the following conduct via a similar civil penalty scheme without requiring the employer to cease the prohibited activity (presumably to track as closely as possible to rules limiting the scope of reconciliation bills to federal revenue and budget issues):
    • “promis[ing], threaten[ing], or tak[ing] any action” that would “permanently replace” striking employees, discriminate against employees for supporting or participating in a strike, or lock out employees;
    • misclassifying a worker as outside the scope of the definition of “employee” under the National Labor Relations Act (NLRA);
    • “requir[ing] or coerc[ing] an employee to attend or participate” in the “employer’s campaign activities”; or
    • requiring class action arbitration agreements.
  • Appropriates $5 million for the “implementation of systems to conduct electronic voting for union representation elections.”

Wage and Hour, Child Labor, and Workplace Safety Issues (Education and Labor Committee)

  • Increases fines on employers that repeatedly or willfully violate the minimum wage or overtime prescriptions from $1,100 to $20,740. The fines for unlawfully keeping employees’ tips would increase from $1,100 to $11,620. Civil penalties for violations of child labor prohibitions would also increase.
  • Pursuant to the bill’s workplace safety provisions, the maximum penalty for a willful or repeat violation would increase from $70,000 (currently adjusted for inflation to $136,532) to $700,000, and the minimum penalty would increase from $5,000 (currently adjusted for inflation to $9,753) to $50,000. Caps on serious violations and failure to correct a violation would increase from $7,000 (currently adjusted for inflation to $13,653) to $70,000.

Retirement (Ways and Means Committee)

The bill would require employers with five or more employees that do not offer employer-sponsored retirement plans to automatically enroll their employees in individual retirement accounts (IRAs) or other automatic contribution plans or arrangements.

NLRB GC to Seek “Full Panoply of Remedies.” On September 8, 2021, National Labor Relations Board (NLRB) General Counsel Jennifer Abruzzo issued a memorandum instructing regional directors to “request from the Board the full panoply of remedies available to ensure that victims of unlawful conduct are made whole for losses suffered as a result of unfair labor practices.” According to the memo, potential remedies include the following (most of which we relay verbatim):

For ULPs Committed During Organizing Drives

  • “Union access (e.g., requiring an employer to provide a union with employee contact information, equal time to address employees if they are convened by their employer for a “captive audience” meeting about union representation, and reasonable access to an employer’s bulletin boards and all places where notices to employees are customarily posted)”

  • “12-month insulation periods, including extensions of the certification year … during which a union’s status as bargaining representative may not be challenged”
  • “Reinstatement of unlawfully withdrawn bargaining proposals”
  • “Reimbursement of collective-bargaining expenses (e.g., requiring a respondent to reimburse an opposing bargaining party for negotiation expenses incurred during the entire period in which it fails to bargain in good faith)”

OSHA – Request for Information on the Mechanical Power Presses Standard

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) is requesting information and comment on issues related to the mechanical power presses standard. OSHA is seeking information regarding whether it should update the mechanical power presses standard and, if so, how closely the standard should follow the current ANSI standard for mechanical power presses. It is also seeking information on the types of presses that should be covered, the use and certification of equipment, and other topics such as presence-sensing device initiation (PSDI) systems, and requirements for press modifications, training, and injury reporting. Please reference the Federal Register here.

Individuals may submit comments electronically at http://www.regulations.gov (Docket No. OSHA-2007-0003, which also includes documents referenced by OSHA in the RFI). Please refer to the Federal Register notice for additional details. The deadline for submitting comments is October 26, 2021.
