IHMM-AHMP 45 in 5 Credential Recognition During Its First 18 Months
Mark Bruce and Gene Guilford launched 45 in 5 in January 2021, so about 18 months ago. The “45” was a target to add 45 states recignizing our credentials, as we had 5 at the time, and the “5” was for 5 years. How are we doing after the first 18 months? Note: IHMM intends on engaging in this work on behalf of ALL of our credentials.

After adding the Commonwealth of Pennsylvania that Mark led, we added Nebraska, Colorado, and Minnesota. By the fall of 2021, the group wanted us to focus on federal agencies, so we embarked on some research to add to the 8 agencies that already recognized the CHMM.

IHMM Launches Scholarship Program
IHMM is pleased to announce the launch of the IHMM Scholarship program.
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

Austin Peay State University Joins IHMM Student CHMM Program
Peter F. Downing, CHMM, Chair of the IHMM Student CHMM Committee, is pleased to announce that Austin Peay State University of Clarksville, Tennessee has joined the Student CHMM program.
Austin Peay State University becomes the 6th college or university to join the Student CHMM program and make the credential available to its students. IHMM is grateful for Austin Peay’s support for the growing Student CHMM program and the tremendous benefits that accrue to undergraduate and graduate students who, early in their academic career, become involved with IHMM’s credentials.
The Student CHMM committee oversees the development of and engagement with the Student CHMM including, but not limited to; changes in the Student CHMM handbook, the Student CHMM examination, and item bank soliciting new colleges and universities to participate in the Student CHMM program, and Student CHMM community in Collaboration and its Mentor Match program. EPA Announces New Chemical Engineering Initiative Intended to Increase Transparency and Reduce Rework
EPA is conducting a broad outreach effort to describe and discuss with stakeholders how the Agency evaluates data provided for new chemicals submissions and common issues that cause EPA to have to reconduct risk assessments (“rework”) for these submissions. The goal of this effort is to reduce rework of initial risk assessments for new chemicals submissions that is caused by submitters supplementing incomplete initial new chemicals review submissions, which has contributed to delays in EPA’s review of these chemicals and stretched already limited resources. Both EPA and stakeholders share an interest in reducing process inefficiencies while also ensuring a protective review of new chemical risks. EPA anticipates this outreach effort will be particularly helpful for Low Volume Exemptions (LVEs), which constitute about 60% of TSCA section 5 submissions annually.
Clean Water Act Section 401 Water Quality Certification Improvement Rule
Following a careful reconsideration of the water quality certification rule promulgated in 2020, the Environmental Protection Agency (EPA or the Agency) is publishing for public comment a proposed rule revising and replacing the Agency’s 2020 regulatory requirements for water quality certification under Clean Water Act (CWA) section 401. This proposed rule would update the existing regulations to be more consistent with the statutory text of the 1972 CWA; to clarify, reinforce, and provide a measure of consistency with respect to elements of section 401 certification practice that have evolved over the 50 years since the 1971 Rule was promulgated; and to support an efficient and predictable certification process that is consistent with the water quality protection and cooperative federalism principles central to CWA section 401. This proposal is consistent with the Executive order signed on January 20, 2021, “Protecting Public Health and the Environment and Restoring Science to Tackle the Climate Crisis,” which directed the Agency to review the water quality certification rule EPA promulgated in 2020. The Agency is also proposing conforming amendments to the water quality certification regulations for EPA-issued National Pollutant Discharge Elimination System permits.
Comments must be received on or before August 8, 2022. Please refer to the SUPPLEMENTARY INFORMATION section for additional information on the public hearing.
Spring 2022 OSHA Regulatory Agenda
As part of our efforts to keep you informed of OSHA’s activities, we wanted to let you know that the Department of Labor, including OSHA, has issued its Spring 2022 Regulatory Agenda. Federal agencies post their regulatory agendas on the Reginfo.gov website twice a year to provide a snapshot of their rulemaking priorities.

OSHA Advance Notice of Proposed Rule Making (ANPRM) – Blood Lead Level for Medical Removal
The Occupational Safety and Health Administration (OSHA) is publishing an Advance Notice of Proposed Rulemaking (ANPRM) to solicit input from the public on how the current OSHA Lead standards for general industry and construction could be modified to reduce worker blood lead levels (BLLs) and more effectively prevent adverse health effects in workers exposed to lead.
The ANPRM focuses primarily on BLL triggers for medical removal protection and medical surveillance provisions, including triggers for and frequency of blood lead monitoring. OSHA is also requesting input on other aspects of the Lead standards and potential regulatory alternatives, including the permissible exposure limit and several safe harbor protocols that employers in certain industries, or who meet specified requirements, could opt to use as alternatives to complying with the main rule. The ANPRM also seeks input on the ancillary provisions for personal protective equipment, housekeeping, hygiene, and training as well as employers’ current practices that address workplace lead exposure and associated costs. The ANPRM reviews updates that Michigan, Washington State and California State Plans have implemented or proposed for their occupational lead rules and asks for comment on whether OSHA should consider similar revisions to 29 CFR 1910.1025 and 29 CFR 1926.62.

Revisions and Confidentiality Determinations for Data Elements Under the Greenhouse Gas Reporting Rule
The Environmental Protection Agency (EPA) is proposing to amend specific provisions in the Greenhouse Gas Reporting Rule to improve the quality and consistency of the data collected under the rule, streamline and improve implementation, and clarify or propose minor updates to certain provisions that have been the subject of questions from reporting entities. These proposed changes include revisions to improve the existing calculation, recordkeeping, and reporting requirements by incorporating updates to existing emissions estimation methodologies and providing for collection of additional data to understand new source categories or new emission sources for specific sectors. The proposed changes would improve understanding of the sector-specific processes or other factors that influence greenhouse gas emissions rates, improve verification of collected data, and complement or inform other EPA programs. The EPA is also proposing revisions that would improve implementation of the Greenhouse Gas Reporting Rule such as updates to applicability estimation methodologies, providing flexibility for or simplifying calculation and monitoring methodologies, streamlining recordkeeping and reporting, and other minor technical corrections or clarifications. This action also proposes to establish and amend confidentiality determinations for the reporting of certain data elements to be added or substantially revised in these proposed amendments. Further, this action includes a request for comment to solicit information that may aid in potential future revisions to the Greenhouse Gas Reporting Rule.

Comments. Comments must be received on or before August 22, 2022. Under the Paperwork Reduction Act (PRA), comments on the information collection provisions are best assured of consideration if the Office of Management and Budget (OMB) receives a copy of your comments on or before August 22, 2022.
Lifetime Drinking Water Health Advisories for Four Perfluoroalkyl Substances
The Environmental Protection Agency (EPA) announces the release of health advisories for four perfluoroalkyl substances (PFAS), including interim updated lifetime drinking water health advisories for perfluorooctanoic acid (PFOA) and perfluorooctane sulfonic acid (PFOS), and final health advisories for hexafluoropropylene oxide (HFPO) dimer acid and its ammonium salt (together referred to as “GenX chemicals”) and perfluorobutane sulfonic acid and its related compound potassium perfluorobutane sulfonate (together referred to as “PFBS”). EPA’s health advisories, which identify the concentration of chemicals in drinking water at or below which adverse health effects are not anticipated to occur, are: 0.004 parts per trillion (ppt) for PFOA, 0.02 ppt for PFOS, 10 ppt for GenX chemicals, and 2,000 ppt for PFBS. Health advisories are non-regulatory and reflect EPA’s assessment of the best available peer-reviewed science. The interim updated health advisories for PFOA and PFOS supersede EPA’s 2016 health advisories for PFOA and PFOS.

IHMM Fellows Becoming Mentors
IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to provide instruction to the more than 75 IHMM Fellows in becoming mentors.
Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities.
IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

The workshop curriculum is in accordance with 49 CFR § 172.704 for General Awareness, Function-Specific, Safety, and Security Awareness training requirements.

Biden Administration Releases Regulatory Plans. Maybe someone in the White House just read the Buzz’s Summer Forecast, because on June 21, 2022, the Biden administration released its Spring 2022 Unified Agenda of Regulatory and Deregulatory Actions. As the Buzz has discussed previously, the Unified Agenda provides stakeholders with notice of a presidential administration’s forthcoming regulatory plans. Set forth below is a preview of the significant labor and employment actions that the Biden administration is currently considering.
U.S. Department of Labor
Wage and Hour Division (WHD)
- Overtime. In October 2022, the WHD is slated to issue a proposal amending the regulations “which implement the exemption of bona fide executive, administrative, and professional employees from the Fair Labor Standards Act’s [FLSA] minimum wage and overtime requirements.” Given the current post-pandemic state of the U.S. economy and its continuing supply chain and inflationary challenges, there will be significant debate surrounding this proposal, if it is released.
- Independent contractor and joint employer issues. Somewhat interestingly, the WHD is not forecasting any regulatory activity with regard to joint employment or independent contractor relationships under the FLSA. Recall that WHD Acting Administrator Jessica Looman recently penned a blog post noting that the agency would “engage in rulemaking on determining employee or independent contractor status under the FLSA.” Perhaps the disconnect is due to the fact that the Unified Agenda often reflects information submitted by federal agencies weeks, or even months, prior to publication.
Occupational Safety and Health Administration (OSHA)
- COVID-19. The final COVID-19 standard applicable to healthcare workplaces is scheduled to be issued in September 2022.
- Comments are due next week (on June 30, 2022) on OSHA’s proposed amendments to its injury and illness recordkeeping regulation. A final regulation is expected to be promulgated in December 2022.
- Heat stress and illness. There is no set date for the next step in OSHA’s nascent foray into developing a heat stress standard, except to analyze comments in response to the agency’s advance notice of proposed rulemaking.
- Infectious diseases. A proposal addressing workplace infectious disease hazards (such as COVID-19, Severe Acute Respiratory Syndrome [SARS], tuberculosis, chickenpox, shingles, and measles) is not expected until May 2023.
- Workplace violence. OSHA has been tinkering with developing a workplace violence prevention standard for health care and social assistance workplaces for some time. A small business review panel process is scheduled to begin in September 2022.
- Arizona state plan. The agency continues to review comments regarding its proposal to “revoke its affirmative determination … granting final approval” to Arizona’s state occupational safety and health plan.
Office of Federal Contract Compliance Programs (OFCCP)
- Investigations and conciliation. In April 2022, OFCCP closed the public comment docket on its proposal to amend procedures with respect to how it will conduct investigations of federal contractors. According to the latest regulatory agenda, a final rule is not expected until May 2023.
- Subcontractor reporting. A proposal “requiring contractors to provide notice to OFCCP when they award supply and service subcontracts” has been pushed back to January 2023.
- Religious exemption rule. A final rule that would rescind OFCCP’s 2020 rule regarding the religious exemption contained in Executive Order 11246 is scheduled to be issued in November 2022.
Office of Labor-Management Standards (OLMS)
By the end of June 2022, OLMS is scheduled to propose “a requirement for employers to disclose on the Form LM-10 [a reporting and disclosure form] whether the filer is a federal contractor and other related information.”
National Labor Relations Board
Joint employer. A rulemaking relating to the joint employer standard under the National Labor Relations Act is scheduled to be released in July 2022. Many expect the proposal to rescind or amend the Board’s 2020 rule and replace it with a broader, expansive test.
Election protection rule. In September 2022, the Board will propose revising the rule that was finalized on April 1, 2020, relating to blocking charges, voluntary recognition, and bargaining relationships in the construction industry.
U.S. Equal Employment Opportunity Commission (EEOC)
The EEOC did not submit any pending actions for the Spring 2022 Unified Agenda. This is likely due to the fact that Chair Charlotte Burrows and fellow Democratic commissioner, Vice Chair Jocelyn Samuels, remain outnumbered on the Commission by three Republican commissioners. Assuming Democrats regain the Commission majority (as is expected to occur later this summer), look for the EEOC to reenter the regulatory game this fall.
Notice of Public Meetings in 2022 for International Standards on the Transport of Dangerous Goods
The PHMSA Office of Hazardous Material Safety (OHMS) will host public meetings in advance of three international meetings to allow the public to give input on current proposals being considered by the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) and the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP). These international meetings include:
- The 60th session of the UNSCOE TDG, scheduled for June 27 to July 6, 2022, in Geneva, Switzerland.
- The ICAO DGP Working Group 22, tentatively scheduled for November 21–25, in Montreal, Canada.
- The 61st session of the UNSCOE TDG, scheduled for November 28 to December 6, 2022, in Geneva, Switzerland.
Each of these public meetings will be held approximately two weeks before the corresponding international meeting. Specific information for each meeting, including date, time, conference call-in number, and details for advance registration will be posted when available on the PHMSA website under “Upcoming Events.” These meetings will be virtual, with concurrent in-person sessions possible, pending public health guidelines.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.

Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?
HMS has made that simple and easy.

HMS Certified Dangerous Goods Professional [CDGP] Exam Prep
The Columbia Southern University/HMS CDGP prep course is found here on the Hazardous Materials Society [HMS] education and training website > https://hazmatsociety.org/training/ce-1112-cdgp-exam-prep/2022-02-02/
The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).

Applications for the 2022 HMS Scholarship Awards Now Open
The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
DEADLINE TO SUBMIT SCHOLARSHIP AWARD APPLICATIONS IS December 1, 2022. All submissions and associated materials must be submitted using the online form.
Scholarship Winners Will Be Announced at the HMS Annual Meeting.
