IHMM In-Person or Remotely Proctored Exams

The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.

76% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

Welcome to IHMM Thomas Gerding – Our First Student ASHM

On behalf of Jan Rosenberg, Chair of the IHMM ASHM Committee, and the entire Institute, we are very pleased to announce that Thomas Gerding has passed his Student Associate Safety and Health Manager [ST/ASHM] examination and has become IHMM’s first Student ASHM.

The Student ASHM program was launched in 2022 following the successful experience with IHMM’s Student CHMM program which now has 96 student certificants. These student certification programs underscore IHMM’s commitment to helping students become successful as they pursue studies in either hazardous materials or dangerous goods or environment, health, and safety. IHMM has backed up that commitment with a $32,000 student scholarship program.

IHMM Seeks New York Dept of Labor Recognition for the CSHM and CSMP

Institute of Hazardous Materials Management [IHMM] is working with the New York State Department of Labor concerning NYS Form SH 890 [4-15] and the references the form makes concerning certain ICR 59 Workplace Safety and Loss Prevention Safety Consultation certifications referenced in Section V, Section VI, and Section VIII of that document and throughout the rest of SH 890 [4-15]

While IHMM has high regard for the CSP, CIH, and other certifications mentioned in SH 890 [4-15], we find that there are two workplace safety and loss prevention certifications missing in the current form. IHMM brought to their attention the Certified Safety and Health Manager® [CSHM®] and Certified Safety Management Practitioner® [CSMP®] credentials.

IHMM thanks Anthony Dellisola, CSHM, for bringing this to our attention. Anthony has taken the IHMM material and shared it with his State Senator to get the process of amending either regulations or statute underway. Good work Anthony!

IHMM Seeks CSHM and CSMP Recognition in Puerto Rico

Institute of Hazardous Materials Management [IHMM] is working with a CSHM in Puerto Rico on recognition of the CSHM and CSMP at the PR Department of Labor. IHMM has a CSHM who works at the PR DOL and wants to be helpful gaining recognition for the credentials.

IHMM-AHMP 45 in 5 Adds the State Of Georgia to Credential Recognition

The IHMM-AHMP 45 in 5 Project securing credential recognition by federal and state governments is pleased to announce that we have added the State of Georgia to the growing list of 13 states that recognize IHMM credentials

IHMM has produced a crosswalk between 40 CFR § 312.10 Definitions and the CHMM Blueprint that documents how the EPA regulation aligns with the CHMM Blueprint and demonstrates that in each instance the blueprint meets or exceeds 40 CFR § 312.10 Definitions. The EPA definition of an Environmental Professional is in the Federal Register dated November 1, 2005 at page 66080. On that page is the instruction to private certifications being considered Environmental Professionals and how to compare 40 CFR § 312.10 to the certification.

EPA Amends SNUR Regulations to Protect Workers’ Health

As stated in Bergeson & Campbell, P.C.’s (B&C®) July monthly update, B&C is providing a more detailed memorandum on the U.S. Environmental Protection Agency’s (EPA) final rule amending the regulations governing significant new uses of chemical substances under the Toxic Substances Control Act (TSCA) to align with revisions that were made to the Occupational Safety and Health Administration (OSHA) Hazard Communications Standard (HCS) and changes to the OSHA Respiratory Protection Standard and the National Institute for Occupational Safety and Health (NIOSH) respirator certification requirements for the respiratory protection of workers from exposure to chemicals. 87 Fed. CDC streamlines COVID-19 guidance to help the public better protect themselves and understand their risk

On August 11th, the CDC offered streamlining of its COVID-19 guidance to help people better understand their risk, how to protect themselves and others, what actions to take if exposed to COVID-19, and what actions to take if they are sick or test positive for the virus. COVID-19 continues to circulate globally, however, with so many tools available to us for reducing COVID-19 severity, there is significantly less risk of severe illness, hospitalization and death compared to earlier in the pandemic.

“We’re in a stronger place today as a nation, with more tools—like vaccination, boosters, and treatments—to protect ourselves, and our communities, from severe illness from COVID-19,” said Greta Massetti, PhD, MPH, MMWR author. “We also have a better understanding of how to protect people from being exposed to the virus, like wearing high-quality masks, testing, and improved ventilation.  This guidance acknowledges that the pandemic is not over, but also helps us move to a point where COVID-19 no longer severely disrupts our daily lives.”

ASTM International Revises Key Standard for Limited Environmental Due Diligence

ASTM International’s environmental assessment, risk management and corrective action committee (E50) has revised its standard practice for limited environmental due diligence.

The standard practice for limited environmental due diligence: transaction screen process (E1528) was first published in 1993 as a way for current or prospective property owners to gather information about potential environmental risks associated with a property believed to present a low risk of potential environmental concerns.

As the standard was designed to be used by non-professionals, part of the revision process included efforts to modernize the standard and make the transaction screen more broadly accessible. Additional revisions include:

  • A completely rewritten questionnaire and guide section;
  • A revised appendix with new photographs to help preparers fill out the questionnaire; and
  • Changes to wording within the standard itself to better highlight the fact it provides no Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) liability protection.

E1528 was developed in tandem with another standard aimed at defining “good commercial and customary practice” for conducting environmental site assessments (E1527), which was also recently revised.  In contrast to E1528, E1527 establishes standards for eligibility for CERCLA liability protection.

NPDES BASIC PERMIT WRITERS’ COURSE

Virtual Guided Learning
August 18, 2022 – September 22, 2022

The U.S. EPA is pleased to announce the opening of registration for the the National Pollutant Discharge Elimination System (NPDES) Basic Permit Writers’ Virtual Guided Learning Course starting on August 18, 2022, with an afternoon session running for five weeks.

The objective of this course is to provide the basic regulatory framework and technical considerations that support the development of wastewater discharge permits required under the NPDES program. The course was designed for permit writers with about six months to one year of experience in the NPDES program, but experienced permit writers wanting a refresher course and other water program staff or interested parties wanting to learn more about the NPDES program also are welcome.

The 5-week course will begin on Thursday, August 18, 2022. Participants should anticipate a time commitment of approximately 8-10 hours per week and should seek supervisor approval before signing up. The course is scheduled to conclude on September 22nd, however a “rain date” of September 29th should be reserved by the participants in case of technical issues.

Each week, participants will have assigned “homework” consisting of NPDES online modules and permit exercises. These modules and exercises will then be discussed in a live virtual classroom setting on Tuesday and Thursday of each week. Participants will have the opportunity to join live office hour discussions with instructors and other participants each Tuesday as well.

Microsoft Teams will be utilized for the virtual classroom and can be accessed through the desktop application or a web browser. Course materials will be provided electronically on the Microsoft Teams classroom site for download by the participants prior to the start date.

As a foundational course, the training does not address in detail specialized topics such as industrial and municipal stormwater, concentrated animal feeding operations, and pesticide discharges. IHMM Fellows Becoming Mentors

IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to provide instruction to the more than 75 IHMM Fellows in becoming mentors.

Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities.

IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

Beltway Buzz – Ogletree & Deakins

Congressional Update. It’s the dog days of summer in Washington, D.C., and both the U.S. Senate and U.S. House of Representatives are out on recess. But Congress is still making news.

  • Inflation Reduction Act. Over the past weekend, the U.S. Senate passed the Inflation Reduction Act of 2022. As the Buzz discussed last week, the legislation provides tax incentives related to certain clean energy projects where prevailing wage and apprenticeship requirements are met. House Majority Leader Steny Hoyer (D-MD) called House members back to Washington, D.C., to take up the bill on August 12, 2022. House Democrats can afford only four defections if the bill is to pass.
  • House to Continue Proxy Voting. This week, Speaker of the House Nancy Pelosi (D-CA) extended the practice of proxy voting in the U.S. House of Representatives. Members of the House have been allowed to vote by proxy since May 27, 2020—instituted as a safety measure in the early days of the COVID-19 pandemic. The practice was scheduled to end on August 12, 2022, but it will now expire on September 26, 2022. Proxy voting obviously provides the House with more flexibility when it comes to advancing legislation. For example, it is being reported that more than 140 House members will vote by proxy on the aforementioned Inflation Reduction Act of 2022.

OSHA Seeks More Feedback on AZ Proposal. On August 10, 2022, the U.S. Department of Labor’s (DOL) Occupational Safety and Health Administration (OSHA) announced that it would reopen the comment period for an additional sixty days to receive additional feedback on its proposal to revoke Arizona’s State Plan for Occupational Safety and Health. During the initial comment period, OSHA received feedback from the Arizona Division of Occupational Safety and Health (ADOSH), which stated that Arizona had “completed a number of measures to address the concerns OSHA identified in the proposal.” As a result, OSHA is reopening the public comment docket to allow stakeholders to address “any impact those actions should have on OSHA’s proposed revocation of the State Plan’s final approval.” A public hearing on the matter, originally scheduled for August 16, 2022, has been postponed.

Federal Contractor Proposal to Take Step Forward. Just a heads-up for comment-drafting procrastinators: Monday, August 15, 2022, is the deadline to submit comments on a proposed rule of the DOL’s Wage and Hour Division that would implement President Biden’s Executive Order 14055, “Nondisplacement of Qualified Workers Under Service Contracts” (November 18, 2021). The DOL has a bit of a head start on drafting a final regulation, as versions of this rule have previously been on the books. This means that a final rule could be issued before the year concludes.

Congress Passes H.R. 5376 – Inflation Reduction Act of 2022

On Friday the House passed a sweeping tax, health and climate bill, delivering a major win for Democrats and President Joe Biden less than three months before the pivotal midterm elections. The chamber approved the more than $430 billion package by a 220-207 margin, as all Democrats backed it and all Republicans opposed it. The measure, which caps a more than yearlong slog by Democrats to pass a core piece of their agenda, will head to Biden’s desk for his signature.

HMS Makes Finding Courses to Earn CMPs Easy

Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.

If you are a vendor offering exam prep courses and your prep course is on the HMS site, IHMM applicants will find it. If you do not have an exam prep course on the HMS site, no applicant will find it.
