The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.
75% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

IHMM-AHMP 45 in 5 Credential Recognition During Its First 18 Months
Mark Bruce and Gene Guilford launched 45 in 5 in January 2021, so about 18 months ago. The “45” was a target to add 45 states recignizing our credentials, as we had 5 at the time, and the “5” was for 5 years. How are we doing after the first 18 months? Note: IHMM intends on engaging in this work on behalf of ALL of our credentials.

IHMM Launches Scholarship Program
IHMM is pleased to announce the launch of the IHMM Scholarship program.
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

Supreme Court Issues Decision in West Virginia v. EPA
As the current Supreme Court term ended last week the court issued its long-awaited decision in the case of West Virginia v. EPA.
The issue was whether, in 42 U.S.C. § 7411(d), an ancillary provision of the Clean Air Act, Congress constitutionally authorized the Environmental Protection Agency to issue significant rules — including those capable of reshaping the nation’s electricity grids and unilaterally decarbonizing virtually any sector of the economy — without any limits on what the agency can require so long as it considers cost, non air impacts and energy requirements. West Virginia, and other petitioners, argued that Congress did not clearly authorize the EPA to take any measure it deems helpful to reduce carbon emissions solely by administrative rulemaking, as Congress had not passed specific authority for EPA to undertake such action.
In a 6-3 decision for West Virginia, Chief Justice Roberts, writing for the majority said, in part, “…this Court doubts that “Congress intended to delegate . . . decision[s] of such economic and political significance,” i.e., how much coal-based generation there should be over the coming decades, to any administrative agency. Brown & Williamson, 529 U. S., at 160. Nor can the Court ignore that the regulatory writ EPA newly uncovered in Section 111(d) conveniently enabled it to enact a program, namely, cap-and-trade for carbon, that Congress had already considered and rejected numerous times.”
As the decision was being read and understood, social media was exploding from assertions that, on the one hand the world was coming to an end, and on the other hand Congress needed to write law.

Final Revision to HBCD Risk Determination Finds HBCD, as a Whole Chemical Substance, Presents an Unreasonable Risk
EPA The U.S. Environmental Protection Agency (EPA) announced on June 29, 2022, the availability of the final revision to the risk determination for the cyclic aliphatic bromide cluster (HBCD) risk evaluation issued under the Toxic Substances Control Act (TSCA). 87 Fed. Reg. 38747. The revision reflects EPA policy changes intended to ensure the public is protected from unreasonable risks from chemicals in a way that is supported by science and the law. EPA states that it determined that “HBCD, as a whole chemical substance, presents an unreasonable risk of injury to health and the environment when evaluated under its conditions of use.” In addition, the revised risk determination does not reflect an assumption that all workers always appropriately wear personal protective equipment (PPE). According to the notice, EPA “understands that there could be occupational safety protections in place at workplace locations; however, not assuming use of PPE reflects EPA’s recognition that unreasonable risk may exist for subpopulations of workers that may be highly exposed because they are not covered by [Occupational Safety and Health Administration (OSHA)] standards, or their employers are out of compliance with OSHA standards, or because OSHA has not issued a permissible exposure limit (PEL) (as is the case for HBCD).” The revised risk determination supersedes the condition of use-specific no unreasonable risk determinations in the September 2020 HBCD risk evaluation and withdraws the associated order included in Section 5.4.1 of the September 2020 HBCD risk evaluation. Canada – Publication of Proposed Amendments to the TDG Regulations (Registration Database)
Transport Canada has published an amendment entitled “Regulations Amending the Transportation of Dangerous Goods Regulations (Registration database)” in Part I of the Canada Gazette (CGI) on June 25, 2022 for a 70-day comment period. The amendment is accessible through the following URL: https://gazette.gc.ca/rp-pr/p1/2022/2022-06-25/html/reg2-eng.html.
The proposed amendment includes updates to the Transportation of Dangerous Goods Regulations (TDGR) to require that persons who handle, offer for transport, transport, or import (HOTI) dangerous goods be registered in a new registration database, when applicable, and provide contact/site information as well as information on the dangerous goods being handled, offered for transport, transported or imported at their facilities.
The Government of Canada is transitioning to a new feature in CGI that is meant to facilitate submitting comments on proposed regulations and to heighten transparency and accountability of the Canadian regulatory consultation process. The new feature allows online submission of comments on regulatory proposals; comments are published on the Canada Gazette website at the end of the consultation period.

IHMM Fellows Becoming Mentors
IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to provide instruction to the more than 75 IHMM Fellows in becoming mentors.
Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities.
IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

NLRB GC Provides Update on Recent Remedies. Remember back in September 2021 when the Buzz reported on National Labor Relations Board (NLRB) General Counsel Jennifer Abruzzo’s memorandum instructing regional directors to “request from the Board the full panoply of remedies available” in unfair labor practice cases? Well, late last week, General Counsel Abruzzo issued an update on the matter, writing in a memo that “[r]egions have done an excellent job implementing the settlement approach.” The latest memo further notes that “[r]egions have secured compensation for derivative economic harm, including reimbursing fees for late car loan payments and late rent, payment of monthly interest on the loan a discriminatee took out to cover living expenses, the cost of baby formula due to the loss of a workplace breast pumping station, and the cost of a retrofitting a discriminatee’s car to make it usable in a new job.” The memo touts other examples of recent settlement terms, including “[l]etters of apology to reinstated employees” and “[p]ermitting union use of employer bulletin boards.”
Term Ends for Former EEOC Chair. July 1, 2022, marks the expiration of Republican commissioner Janet Dhillon’s term on the U.S. Equal Employment Opportunity Commission (EEOC). (Provisions of Title VII of the Civil Rights Act of 1964 allow Dhillon to continue to serve until her successor is appointed or the current U.S. Congress adjourns.) Commissioner Dhillon served as chair of the Commission from May 15, 2019, to January 20, 2021. Among her accomplishments as chair, Dhillon led the Commission in issuing important guidance at various points during the COVID-19 pandemic, issued the Commission’s first rule establishing transparent guideposts during the conciliation process (this was subsequently rescinded by Congress), and returned much of the EEOC’s litigation authority to the commissioners themselves.
OSHA: Get the Lead Out. On June 28, 2022, the Occupational Safety and Health Administration (OSHA) issued an advance notice of proposed rulemaking (ANPRM) to revise its standards for lead exposure in the workplace. According to the announcement, OSHA “seeks public input on modifying current OSHA lead standards for general industry and construction to reduce the triggers for medical removal protection and medical surveillance and prevent harmful health effects in workers exposed to lead more effectively.” The notice also solicits feedback on the permissible exposure limit as well as “[a]ncillary provisions for personal protective equipment, housekeeping, hygiene and training.” Comments are due on or before August 29, 2022.
MA Workplace Safety Plan on the Way. On June 30, 2022, OSHA issued a proposal to approve the Massachusetts Department of Labor Standards’ (DLS) submission of a state plan for occupational safety and health. According to OSHA, the DLS has “provided assurances that it will adopt such standards, policy changes, or requirements that are at least as effective as Federal OSHA’s within six months of Federal promulgation (30 days for any emergency temporary standard).” Comments are due by August 1, 2022.
USCIS Proposed Fee Schedule Advances. This week, a proposal to adjust fees for certain immigration benefits requests took a step closer to being made public. On June 27, the Office of Information and Regulatory affairs received the draft amended fee schedule proposal from U.S. Citizenship and Immigration Services (USCIS). The most recent attempt to amend the fee schedule was blocked by a federal court in 2020. The forthcoming proposal “would rescind and replace the changes made by the August 3, 2020, rule and establish new USCIS fees to recover USCIS operating costs.”
Jackson Joins as Breyer Retires. On June 30, 2022, Associate Justice Stephen Breyer officially retired from active service on the Supreme Court of the United States. In a letter to President Biden, Breyer wrote, “It has been my great honor to participate as a judge in the effort to maintain our Constitution and the Rule of Law.” At noon on the same day, immediately after Breyer’s retirement became effective, Judge Kentanji Brown Jackson was sworn in (by Chief Justice John Roberts and Associate Justice Breyer) as the 104th associate justice of the Supreme Court.
Frequently Asked Questions (FAQ) on the Applicability of the Hazardous Material Regulations
In March of 2022, PHMSA announced an initiative to publish frequently asked questions (FAQ) on its website to facilitate better public understanding and awareness of the hazardous materials regulations. The FAQ contained in this repository were informed by historical letters of interpretation (LOI) and are meant to resolve recurring requests for common letters of interpretation. The initial Federal Register notice included answers to a list of twelve frequently-asked questions, to be published to PHMSA’s Online Code of Federal Regulations (oCFR) tool.
In addition, the initial notice requested comment on the initiative, and sought stakeholder input on the prioritization of future sets of frequently asked questions. To encourage greater engagement, the comment period was extended an additional 60 days, until July 22, 2022. PHMSA also held a webinar to clarify the process and offer direct Q&A (recording available at the link below).

PHMSA’s “Transporting Lithium Batteries” webpage consolidates lithium battery resources, as well as information on the latest requirements and actions related to lithium batteries in transportation. The page includes links to electronic resources from a wide range of federal and modal partners, including the Occupational Safety and Health Administration (OSHA), the Environmental Protection Agency (EPA), the Federal Aviation Administration (FAA), and the United States Postal Service (USPS).

SPOTLIGHT: Safety Advisory Notice for the Transportation of Lithium Batteries for Disposal or Recycling
Are you involved in the transportation or handling of lithium batteries at end-of-life? PHMSA has issued the Safety Advisory Notice for the Transportation of Lithium Batteries for Disposal or Recycling for those who transport, dispose of, or recycle lithium batteries and products containing lithium batteries. The notice aims to increase awareness for the public and shippers about the often unrecognized dangers posed by lithium batteries in transportation, especially those for disposal or recycling.

HMS Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the

Applications for the 2022 HMS Scholarship Awards Now Open
The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
DEADLINE TO SUBMIT SCHOLARSHIP AWARD APPLICATIONS IS December 1, 2022. All submissions and associated materials must be submitted using the online form.
Scholarship Winners Will Be Announced at the HMS Annual Meeting.

One of the most important projects of the Hazardous Materials Society is our Scholarship Program.
HMS wants to make it as easy as possible for those who cannot always afford to participate in pursuing certification, or keeping up with professional development, or attending great conferences and receiving outstanding training. HMS does not solicit contributions from the general public. HMS does ask IHMM’s certificants and their companies and our education and training vendors to consider a contribution.
