IHMM Elections 2025

The 2025 election for a seat on the IHMM Board is to fill the seat of the CHMP representative. June Brock-Carroll is coming to the end of her second, 4-year term on December 31, 2025, as the CHMP representative on the Board, and we cannot express enough our profound thanks to June for her service to IHMM.

IHMM solicited CHMP nominees between March and July this year. The IHMM Nominating Committee received one CHMP nomination, Mr. Kevin Herron, CHMP of Dublin, Ohio. Now Kevin’s name will appear on the IHMM Board of Directors Election Ballot for the election that began on October 8, 2025, and concludes on November 8, 2025.

Every eligible IHMM certificant has received a personal, numbered ballot with which to cast one vote this year.

The Dr. John H Frick Memorial IHMM Scholarship Program – Closed for 2025

The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.

IHMM seeks to foster the growth and academic success of students whose courses of education and participation in one of our Student certifications will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

New Mexico Publishes Proposed Rule to Implement PFAS Protection Act, Will Hold Webinar on October 22, 2025

Following up on the New Mexico Environment Department’s (NMED) September 25, 2025, webinar on a labeling requirement for products containing intentionally added per- and polyfluoroalkyl substances (PFAS), NMED announced on October 8, 2025, that it has petitioned New Mexico’s Environmental Improvement Board (EIB) to adopt a proposed rule to implement the PFAS Protection Act. If passed by EIB, the rule would take effect July 2026. NMED will hold an informational webinar on October 22, 2025. Comments on the proposed rule are due March 31, 2026, by 4:00 p.m. (MST). NMED has created a web page compiling all PFAS Protection Act material, including a link to the proposed rule and draft labels. Important Stories for IHMM Certificants

EPA Updates Lead Guidance to Accelerate Cleanup of Superfund, Hazardous Waste Sites Across the Nation

This week, the most consequential development from the Environmental Protection Agency (EPA) is the agency’s issuance of updated guidance to expedite cleanup of lead-contaminated soil at residential and hazardous-waste sites. Environmental Protection Agency

From an IHMM certificant’s perspective, the implications are substantial. The new guidance establishes a regional screening level of 200 parts per million and a removal management level of 600 parts per million for lead in residential soil, and signals stricter expectations for timely action. Environmental Protection Agency Those responsible for sites under the Superfund or other remediation regimes should treat this as more than guidance: the EPA is clearly signaling increased regulatory and community scrutiny. Legal strategies should now include reviewing site-specific exposure pathways, engaging early with state/local partners, and documenting remediation decision-making in light of lowered tolerance for delay. Liability exposure for property owners, developers and waste generators rises as the agency defines clearer thresholds and accelerates the pace of cleanup.

New Research Shows There’s a Simple Way to Protect Workers. Is OSHA listening?

This week’s most significant workplace-safety development involves a new study showing that simple protections — water, shade, rest breaks — markedly reduce injuries among workers exposed to extreme heat on the job. Occupational Safety and Health Administration-observers note the findings arrive at a critical moment, as rule-making for a first-ever federal heat-safety standard remains stalled. From a safety perspective: employers must re-evaluate their heat-hazard policies now, not later. Even absent a formal regulation, failure to provide basic safeguards when published research links them to risk may invite negligence-based liability or regulatory scrutiny. For in-house counsel, this means auditing heat exposure plans, documenting provision of water/shade/rest breaks, and ensuring training for supervisors and frontline staff. Moreover, any upcoming formal standard from OSHA will likely back-date compliance expectations — proactive prevention now strengthens both defence and duty-of-care.

Shutdowns Complicate Exposures

When the federal government fails to vigorously enforce environmental laws, regulated entities face significant and multifaceted exposures. Even in the absence of federal oversight, statutory obligations under laws such as the Clean Air Act, Clean Water Act, and Resource Conservation and Recovery Act remain in full effect. A lapse in federal enforcement does not create a legal safe harbor; rather, it heightens the risk that violations will be identified and prosecuted by other authorities or private parties.

IHMM Comments on Two OSHA Proposed Rules

On October 14th, the Institute of Hazardous Materials Management [IHMM] filed comments on two OSHA proposed rulemakings. As always, the Institute prefaces its comments on proposed regulations with an introduction to the subject matter experts who are the certificants of IHMM, along with our accredited credentials, recertification requirements, and professional development activities. The Institute thanks the subject matter experts who contributed to the construction of these comments, as they are a critical resource for our ability to speak with government.

Federal Government Shutdown – October 21 Update

As of October 20, 2025, the federal government remains in its twentieth day of a partial shutdown, now among the longest in U.S. history. The impasse stems from Congress’s failure to enact either full-year appropriations or a continuing resolution, leaving agencies without legal authority to obligate funds under the Anti-Deficiency Act. Negotiations between the House, Senate, and White House remain stalled over whether to include extensions of Affordable Care Act premium subsidies in any funding measure. The result has been widespread furloughs, suspension of public programs, and increasing strain on essential services. Federal courts began furloughing employees this week, the FAA has warned of air-traffic delays due to staffing shortages, and Head Start programs face closure as funds expire. A federal judge has temporarily blocked mass layoffs proposed by the administration, citing statutory limits on personnel actions during a lapse in appropriations.
Economically, the shutdown is beginning to ripple through state programs and federal contractors, while politically, neither party shows movement toward compromise. Absent an immediate agreement on a short-term continuing resolution, the government faces a deepening administrative paralysis, escalating costs, and mounting public pressure that threatens to transform a fiscal dispute into a constitutional crisis of governance.
Exit path: The most likely way out is a short-term continuing resolution (CR) to reopen the government quickly, while separate negotiations continue on policy matters (like the ACA credits). But getting enough votes (60 in the Senate) remains a big hurdle.

DG Transportation Issues

IHMM Global DG Transport Compliance Matrix (2025–2026)
United States (influenced by UNECE “Orange Book”)

Although the U.S. is not party to ADR, DOT/PHMSA keeps 49 CFR aligned with the UN Model Regulations. PHMSA’s HM-215Q final rule (effective May 10, 2024; delayed compliance to Apr 10, 2025) incorporated broad harmonization changes (shipping names, special provisions, lithium-battery updates, etc.). PHMSA also acknowledged use of the 2025–2026 ICAO/IMDG/UN updates where multimodal segments require them, easing transitional compliance for exporters.

Europe (ADR/RID/ADN + EU law)

The 2025 editions of ADR (road), RID (rail), and ADN (inland waterways) entered into force on 1 January 2025. Core themes include new/revised DG entries—especially for batteries (e.g., sodium-ion) and advanced propulsion vehicles—documentation tweaks, and targeted tank/waste carriage changes. The EU continues to mandate ADR/RID/ADN for domestic movements via Directive 2008/68/EC, ensuring uniformity across Member States.

Global baseline (UNECE/UN Model Regulations)

The UN Model Regulations (the “Orange Book”) are the common source that ADR/RID/ADN implement. The 23rd revised edition (2023) underpins ADR 2025 (including new entries for sodium-ion batteries and related notes), and the 24th revised edition (2025) further updates hybrid battery provisions and related standards—now being taken up by modal/ regional systems. Expect consequent rolling amendments in ADR/RID/ADN and national law over the 2025–2026 cycle.

Asia

Beyond Europe, ADR is open to all UN Member States. The notable 2025 development: Kyrgyzstan’s action on ADR is recorded among UNECE’s latest treaty movements, signaling continued Asian uptake of UNECE transport instruments. Operationally, Asian shippers already follow UN Model Regulations via air/sea modes; as ADR participation spreads, over-the-road alignment should tighten.

Africa

Several African states use UN Model Regulations directly and some have acceded to ADR (e.g., Morocco), with UNECE running structured “road-map” programs to support accession and implementation. Morocco’s long-standing ADR membership and subsequent domestic framework illustrate how UNECE texts can be transplanted effectively on the continent; additional accessions and capacity-building are ongoing under UNECE auspices.

Central & South America

While ADR is not the dominant legal instrument here, MERCOSUR’s Agreement on the Inland Transport of Dangerous Goods adopts UN Model Regulations and ADR-style architecture for road/rail, and countries (e.g., Argentina, Brazil) update national DG rules accordingly. The practical effect is a high degree of technical compatibility with ADR labelling, classification, and packaging—even when ADR itself isn’t the formal treaty base.

Practical takeaways for shippers and carriers
  • Batteries & vehicles. Expect new UN numbers and conditions for sodium-ion batteries and battery-powered vehicles across ADR/RID/ADN and, by harmonization, in U.S./MERCOSUR practice. Verify Table A entries, special provisions, and any tank/vehicle-specific clauses before Q1 shipments.

  • Documentation & transitional use. EU/ADR states are on ADR 2025 as of 1 Jan 2025; U.S. shippers have HM-215Q in force with a compliance transition through Apr 10, 2025, plus PHMSA flexibility for current ICAO/IMDG/UN segments. Align paperwork and markings to avoid “mixed-regime” delays.

  • Geographic expansion. Watch for new ADR accessions in Asia/Africa; participation can change route planning (e.g., tunnel restrictions, security plans, multilingual documentation) and mutual-recognition practices at borders.

For multinational DG movements in 2025–2026, treat the UN Model Regulations Rev. 24 (2025) as the north star and assume rapid downstream incorporation into ADR/RID/ADN and national systems (EU via Directive 2008/68/EC; U.S. via HM-215 series; MERCOSUR via its regional agreement). Update classification matrices (especially batteries and waste), retrain drivers/consignors on ADR 2025 documentation nuances, and refresh multimodal SOPs to manage transitional divergences. This reduces exposure to enforcement findings, detentions, and insurer reservations when incidents occur.

Partnerships

School districts are invited to join the Safe Communities Safe Schools (SCSS) National Implementation Project, led by the Center for the Study and Prevention of Violence (CSPV) at the University of Colorado Boulder and funded by the Bureau of Justice Assistance. Through this partnership, districts will work with CSPV to strengthen their school safety action planning and implementation. Apply by 11/4.

Progress on Grand Challenges

In 2020, the AIHA Board of Directors approved a project to develop “grand challenges” for the occupational and environmental health and safety profession. Many other professions, from mathematics to social work, have identified their own grand challenges: ambitious but achievable goals intended to address significant problems. The volunteers leading AIHA’s project selected other criteria to ensure that our grand challenges remained both aspirational and practical—for example, by stipulating that progress toward solutions should be likely within five to ten years.
