IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as enabling mentees signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.
Beltway Buzz – Ogletree Deakins
Government Shutdown Clock. Federal funding expires at 11:59 p.m. (EDT) on September 30, 2025. However, as the Buzz recently explained, because the U.S. Congress is scheduled to be out the week beginning September 22, 2025, lawmakers have only seven legislative days to reach a deal.
FTC Drops Defense of Noncompete Ban. Late last week, the Federal Trade Commission (FTC) filed motions with two separate appeals courts voluntarily dismissing its defense of the Biden-era regulation that banned noncompete agreements. This is not terribly surprising, as current FTC Chairman Andrew Ferguson dissented from the initial promulgation of the rule, writing, “We do not have the power to issue the Final Rule … the Federal Trade Commission Act does not authorize the Commission to make substantive rules regulating private conduct.”
NLRB Acting GC: Injunctions Still on the Table. On September 5, 2025, National Labor Relations Board (NLRB) Acting General Counsel (GC) William B. Cowen issued a memorandum, entitled, “Proceedings Under Section 10(j) of the Act.” The memo advises regional directors to “continue to assess whether interim injunctive relief is appropriate in each case” and emphasizes that certain unfair labor practices, “such as discharges during an organizing campaign … [and] withdrawals of recognition from incumbent unions,” warrant such relief. Acting GC Cowen previously rescinded multiple memos relating to 10(j) injunctions that were issued by his predecessor, Jennifer Abruzzo, but this memo dispels any notions that he is abandoning the 10(j) program. The memo further reminds regional directors that they now must adhere to the traditional four-factor test for preliminary injunctions announced by the Supreme Court of the United States in 2024.

Is The Department of Labor Getting Ready to Repeal the Independent Contractor Rule?
In 2024, the Department of Labor (Department) published a final rule providing an analysis for determining employee or independent contractor classification under the Fair Labor Standards Act (FLSA). See 89 FR 1638 (2024 IC Rule). The 2024 IC Rule took effect on March 11, 2024. However, the 2024 IC Rule is the subject of five separate legal challenges. The Department intends to rescind the 2024 IC rule and is considering how it will proceed with respect to independent contractor classification under the FLSA, employee or under the FLSA.

Dept of Labor – OSHA – July 1 FR – IHMM Collects Comments
On July 1, 2025, the U.S. Department of Labor’s Occupational Safety and Health Administration [OSHA] published 4 rulemakings for public comment. IHMM is requesting certificant input into whether we should submit comments on one or more of these proposal rulemakings and what we should submit. Each proposed rulemaking is briefly described below. The newly extended deadline is November 1, 2025.

USDOL – OSHA – Rescission of Coordinated Enforcement Regulations
Deadline: November 1, 2025
The Department of Labor (the Department or DOL) proposes to remove the regulations that set forth the procedures within the Department for the coordination of enforcement activities by the Wage and Hour Division (WHD), the Occupational Safety and Health Administration (OSHA), and the Employment and Training Administration (ETA) relating to migrant farmworkers. The Department is proposing this removal because these regulations limit the Department’s discretion, impose unnecessary and duplicative internal procedures, and prevent the Department’s agencies from coordinating with regard to migrant farmworkers in more efficient, effective ways. USDOL – OSHA – Construction Illumination Standards
Deadline: November 1, 2025
OSHA is seeking comment on fully rescinding the construction illumination rules found in 29 CFR 1926.26 and 1926.56, citing that current lighting standards are “not reasonably necessary” to reduce significant risk. The Federal Register notice is here.

PHMSA Announces Public Meetings For International Standards On The Transport Of Dangerous Goods
The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced on March 12, 2025, that its Office of Hazardous Materials Safety (OHMS) will host four public meetings during 2025 in advance of certain international meetings. The third meeting will be held in preparation of the 30th session of the ICAO DGP (DGP/30) scheduled for October 6 – 10, 2025, in Montreal, Canada. The fourth meeting will be held in preparation of the 67th session of the UNSCOE TDG scheduled for November 24 – December 3, 2025, in Geneva, Switzerland. PHMSA will solicit public input on current proposals for each of these meetings. PHMSA states that each public meeting will take place approximately two weeks preceding the international meeting at the headquarters for the Department of Transportation in Washington, D.C.
Important Stories for IHMM Certificants

Per- and Polyfluoroalkyl Substances in New Jersey Soils: A Statewide Investigation
Per and polyfluoroalkyl substances (PFAS) are a class of fluorinated chemicals first discovered in 1938. PFAS compounds, known for their water, stain, grease, and temperature-resistant properties, have been added to or used in the manufacture of a wide range of industrial and consumer products. PFAS compounds are also a major component of aqueous film-forming foams (AFFF) used to extinguish flammable fuel fires. Many PFAS compounds are highly persistent in the environment and PFAS have been detected in many environmental media (ITRC, 2023a). PFAS compounds can bioaccumulate in humans and wildlife and exposure to certain PFAS has been linked to negative health effects (Fenton et al., 2020).

Federal Government Shutdown Looms – September 13 Update
As of mid-September 2025, Congress has not passed any of the twelve annual appropriations bills required for FY 2026, and current funding expires on September 30. Without enactment of either those bills or a continuing resolution (“CR”), non-essential federal operations will be legally required to cease funding as required under the Antideficiency Act.
Latest Proposal: The White House has proposed a stopgap measure that would extend current funding through November 20, 2025, thereby averting a shutdown on October 1. The proposal’s language will be released on September 15th and will face political negotiation, particularly over discretionary spending levels and emergency appropriations, such as disaster relief.

IHMM Foundation Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
