Derek Falzoi, Winner of the 2024 Excellence in EHS Management Award
IHMM is proud to announce the winner of the 2024 Excellence in EHS Management Award.
Derek Falzoi is a Certified Safety and Health Manager (CSHM), a Certified Hazardous Materials Manager (CHMM), a Certified Industrial Hygienist (CIH), and a Certified Safety Professional (CSP). IHMM is proud to name Derek Falzoi as our 2024 winner of the 2024 Excellence in EHS Management Award. Recently received an Architect’s Safety Award “In recognition of consistently ensuring the occupational safety and health of the AOC through leadership, dedication, and adept expertise by taking an innovative approach to recognizing and investigating hazards to ensure they are completely remediated”. He was also selected by office to represent the Safety Division in the Architect of the Capitol’s 2024 Performance and Accountability Report (PAR), “Operate as One Team, Dedicated to One Mission” section, which mentioned “Derek’s leadership, dedication, and expertise as an Industrial Hygienist have impacted key safety initiatives and elevated overall safety standards at the Capitol campus”. Derek provides a level of exceptional, consistent, and high-quality performance.
Currently, Derek serves as a Chairperson for the Agency’s Occupational Safety and Health Community of Practice (OSH CoP) promoting collaboration and ISO 45001 safety management system strategies. He volunteered for the AOC and AIHA Mentorship Programs and recently accepted the At-Large Director position of the Board of Directors for AIHA’s Potomac Section. He also volunteers for AIHA’s TSCA Working Group, Indoor Environmental Quality Committee, Exposure Assessment Strategies Committee, and Exposure & Control Banding Committee. To stay informed about emerging issues, Derek routinely attends AIHA Conferences, with the most recent being this year in Kansas City.

NLRB Chair Kaplan Departs. Marvin Kaplan, chair of the National Labor Relations Board (NLRB), departed the agency this week, as his term expired on August 27, 2025. Kaplan had served on the NLRB since August 2017. During his initial years on the NLRB, Kaplan formed a Republican majority that largely focused on decisions issued by the Board during the Obama administration. During much of the Biden administration, however, Kaplan was in the minority, and during 2023 and 2024 served as the only Republican on the Board. Kaplan’s dissents during this most recent period are expected to serve as roadmaps for future decisions reversing Biden-era rulings when Republicans achieve a majority on the Board. In the meantime, David Prouty remains as the sole member on the Board, while nominees Scott Mayer and James Murphy await their confirmation hearings in the U.S. Senate.
ICE Proposes Fixed Period of Stay for F-1 Students, J-1 Exchange Visitors. On August 28, 2025, U.S. Immigration and Customs Enforcement (ICE) published a notice of proposed rulemaking, entitled, “Establishing a Fixed Time Period of Admission and an Extension of Stay Procedure for Nonimmigrant Academic Students, Exchange Visitors, and Representatives of Foreign Information Media.” The proposal would change “the admission period in the F, J, and I classifications from duration of status to an admission for a fixed time period.” Currently, F-1 students and J-1 exchange visitors are permitted to remain in the United States as long as they are pursuing a full course of study at an educational institution or participating in an authorized program. (J-1 students engaged in authorized practical training following the completion of their studies may also remain in the United States.) ICE now proposes to set the authorized admission periods for F and J nonimmigrants up to the length of the particular program, with a four-year maximum period (at which time they can apply for an extension of stay). ICE also proposes new limitations on F-1 students’ abilities to transfer or change programs, as well as the collection of biometric information from these visa holders. ICE maintains that the changes are necessary because the increase in individuals residing in the United States on these visas, combined with the indefinite period of admission, “poses a challenge to the Department’s ability to monitor and oversee these nonimmigrants while they are in the United States.” A similar proposal was advanced during President Trump’s first administration but was withdrawn by then-President Joe Biden in 2021. Comments must be received on or before September 29, 2025.
Republican Senator Sponsors Bill to Revive OSHA Ergonomics Standard. The Warehouse Worker Protection Act (S.2613) was recently reintroduced in the 119th Congress. Readers may recall that, among other provisions, the bill would establish a Fairness and Transparency Office within the U.S. Department of Labor’s Wage and Hour Division, would create a new unfair labor practice for certain productivity quotas, and would require the Occupational Safety and Health Administration (OSHA) to promulgate a “standard for ergonomic program management.” OSHA finalized an ergonomic standard in 2000, but it was rescinded in 2001 pursuant to the Congressional Review Act. The action has since prohibited the agency from issuing a regulation that is in “substantially the same form,” unless specifically authorized by Congress.
Once again, Senator Josh Hawley (R-MO) is a cosponsor of the bill, and it is a feature of his labor reform framework. The Buzz previously examined another pillar of Senator Hawley’s framework, the Faster Labor Contracts Act.
Bill Would Increase Penalties for Willful Wage/Hour Violations. Representative Seth Magaziner (D-RI) has reintroduced the Don’t Stand for Taking Employed Americans’ Livings (Don’t STEAL) Act (H.R. 5048). Pursuant to the bill, employers that willfully fail to properly pay employees wages, overtime pay, or tips could face up to five years in prison. Magaziner introduced the same bill in the previous Congress, with twenty-four Democrats joining him as cosponsors.
Administration Pauses Issuance of Visas for Commercial Truck Drivers. Secretary of State Marco Rubio announced last week that the United States will pause the issuance of visas for commercial truck drivers. The pause follows a crash in Florida that killed three people, after a truck driver—whom the U.S. Department of Homeland Security (DHS) states was in the country illegally—made an unlawful U-turn. Commercial truck drivers seeking to enter the United States on H-2B visas will be most affected.

IHMM Comments – Hazardous Materials: Remove Redundant List of U.S. EPA CERCLA Hazardous Substances

ACTION: Notice of Proposed Rulemaking (NPRM)
SUMMARY: To eliminate redundant and unnecessary requirements in the hazardous materials regulations (HMR; 49 CFR parts 171-180), PHMSA is proposing to remove Appendix A to § 172.101—List of Hazardous Substances and Reportable Quantities and insert a reference to the Environmental Protection Agency’s (EPA) list of hazardous substances and reportable quantities in the definitions of “hazardous substance” and “reportable quantity” ( see,40 CFR 302.4). PHMSA is also proposing a conforming revision to requirements for empty packagings to remove reference to the now deleted Appendix A. Finally, PHMSA is proposing an editorial change to rename Appendix B to § 172.101—List of Marine Pollutants to Appendix A and to revise the definition of “marine pollutant” to refer to Appendix A instead of Appendix B based on these proposed changes. PHMSA does not expect that these proposed revisions will have any adverse impact on safety.

ACTION: Request for information (RFI).
SUMMARY: The safe and efficient movement of freight is vital to the Nation’s economic growth and to the creation of well-paying jobs for millions of Americans. In 2020, the U.S. Department of Transportation (DOT) published a National Freight Strategic Plan (NFSP). 49 U.S.C. 70102 requires the DOT to update the NFSP based on 17 components to address multimodal freight transportation. DOT seeks information from the public, including stakeholders (e.g., State, metropolitan planning organization, and local agencies, port authorities, private owners and operators, industry trade groups, shippers, and beneficial cargo owners) to aid development of the updated NFSP.
DATES: Comments must be received on or before August 14, 2025. DOT will consider comments filed after this date to the extent practicable.

Dept of Labor – OSHA – July 1 FR – IHMM Collects Comments
On July 1, 2025, the U.S. Department of Labor’s Occupational Safety and Health Administration [OSHA] published 4 rulemakings for public comment. IHMM is requesting certificant input into whether we should submit comments on one or more of these proposal rulemakings and what we should submit. Each proposed rulemaking is briefly described below. The newly extended deadline is November 1, 2025.

USDOL – OSHA – Rescission of Coordinated Enforcement Regulations
Deadline: November 1, 2025
The Department of Labor (the Department or DOL) proposes to remove the regulations that set forth the procedures within the Department for the coordination of enforcement activities by the Wage and Hour Division (WHD), the Occupational Safety and Health Administration (OSHA), and the Employment and Training Administration (ETA) relating to migrant farmworkers. The Department is proposing this removal because these regulations limit the Department’s discretion, impose unnecessary and duplicative internal procedures, and prevent the Department’s agencies from coordinating with regard to migrant farmworkers in more efficient, effective ways. OSHA is seeking comment on fully rescinding the construction illumination rules found in 29 CFR 1926.26 and 1926.56, citing that current lighting standards are “not reasonably necessary” to reduce significant risk. The Federal Register notice is here.

PHMSA Announces Public Meetings For International Standards On The Transport Of Dangerous Goods
The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced on March 12, 2025, that its Office of Hazardous Materials Safety (OHMS) will host four public meetings during 2025 in advance of certain international meetings. The third meeting will be held in preparation of the 30th session of the ICAO DGP (DGP/30) scheduled for October 6 – 10, 2025, in Montreal, Canada. The fourth meeting will be held in preparation of the 67th session of the UNSCOE TDG scheduled for November 24 – December 3, 2025, in Geneva, Switzerland. PHMSA will solicit public input on current proposals for each of these meetings. PHMSA states that each public meeting will take place approximately two weeks preceding the international meeting at the headquarters for the Department of Transportation in Washington, D.C.

ECHA Publishes Updated REACH Restriction Proposal for PFAS
The European Chemicals Agency (ECHA) announced on August 20, 2025, that it published an updated proposal to restrict per- and polyfluoroalkyl substances (PFAS) under the European Union’s (EU) Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) Regulation. The authorities from Denmark, Germany, the Netherlands, Norway, and Sweden (Dossier Submitters) submitted the initial proposal in January 2023 and have now completed their evaluation of more than 5,600 scientific and technical comments and prepared an updated restriction proposal (Draft Background Document). The proposed restriction could restrict more than 10,000 PFAS across the EU. For more information on the updated restriction proposal, please read the full memorandum

UN commission approves universal bill of lading standard. The United Nations Commission on International Trade Law has approved a draft convention introducing negotiable cargo documents as a universal standard across all modes of transport. This draft convention will be recommended for adoption by the UN General Assembly later this year.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

IHMM Foundation Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
