The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.
76% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

Proposed Designation of Perfluorooctanoic Acid (PFOA) and Perfluorooctanesulfonic Acid (PFOS) as CERCLA Hazardous Substances
EPA is proposing to designate two per- and polyfluoroalkyl substances (PFAS) — perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS), including their salts and structural isomers — as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as Superfund. This proposed rulemaking would increase transparency around releases of these harmful chemicals and help to hold polluters accountable for cleaning up their contamination.
The rulemaking would require entities to immediately report releases of PFOA and PFOS that meet or exceed the reportable quantity to the National Response Center, state or Tribal emergency response commission, and the local or Tribal emergency planning committee (local emergency responders).
EPA Will Propose Revisions to RMP Rule to Enhance Chemical Safety
The U.S. Environmental Protection Agency (EPA) announced on August 19, 2022, that it will propose revisions to the Risk Management Program (RMP) rule to protect further vulnerable communities from chemical accidents, especially those living near facilities with high accident rates. According to EPA, the “Safer Communities by Chemical Accident Prevention” (SCCAP) rule “would strengthen the existing program and includes new safeguards that have not been addressed in prior RMP rules, such as enhanced employee participation and transparency for communities on safety decisions.” EPA has posted a prepublication version of the proposed rule. Publication of the proposed rule in the Federal Register will begin a 60-day comment period. EPA will hold three virtual public hearings on September 26, 27, and 28, 2022. Registration for the hearings will be available upon publication of the proposed rule in the Federal Register. For more information on the revisions to the RMP rule, please read the full memorandum.
IHMM-AHMP 45 in 5 Credential Recognition During Its First 18 Months
Mark Bruce and Gene Guilford launched 45 in 5 in January 2021, so about 18 months ago. The “45” was a target to add 45 states recognizing our credentials, as we had 5 at the time, and the “5” was for 5 years. How are we doing after the first 18 months? Note: IHMM intends on engaging in this work on behalf of ALL of our credentials.

After having Connecticut, New York, Pennsylvania, Washington, and Indiana, we added Nebraska, Colorado, Minnesota, Arkansas, Oklahoma, Ohio, California, and Georgia. By the fall of 2021, the group wanted us to focus on federal agencies, so we embarked on some research to add to the 9 federal agencies that already recognized the CHMM.
The states highlighted in yellow in the map above are where we have legal research being conducted now. Last week IHMM began working with Alaska, Arizona, and Puerto Rico as well.

EPA CSO Tools Published on Website
EPA has posted beta versions of three CSO tools that are intended to help communities with combined sewer overflows and permitting authorities with the planning and management of different aspects of CSO programs. Links to the tools can be found below:
- Long-Term Control Plan (LTCP) Review Checklist: Checklist designed to help CSO permittees and NPDES authorities determine if LTCPs meet the requirements of the CWA and CSO Control Policy, and conform with EPA guidance on developing LTCPs.
- Post-Construction Compliance Monitoring (PCCM) Checklist: Checklist designed to help CSO permittees and NPDES authorities develop and evaluate PCCM programs to meet the requirements of the CWA and CSO Control Policy, and conform with EPA guidance on PCCM.
- Combined Sewer Overflow (CSO) Model for Small Communities: Planning tool for small CSO communities that want a reasonably simple approach for estimating a CSO occurrence, as well as treated or untreated CSO volume over a 24-hour period, and have limited resources to invest in more advanced CSO monitoring and modeling.
Each tool consists of an interactive spreadsheet, fact sheet or user guide, and two recorded trainings (with the third coming soon). These tools, which are currently in beta test versions, do not present new or changed requirements but rather attempt to help break down information in a more digestible and interactive fashion. EPA is requesting feedback via web form on how to further improve the utility of these tools in the future. Please submit your suggestions by December 31, 2022.

The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

These workshops are offered with U.S. DOT PHMSA HMIT (Hazardous Materials Instructor Training) Grant support to the National Partnership for Environmental Technology Education (National PETE).
This training is FREE for employees and federal, state, county, and local government employees involved in DOT HazMat Shipping, Receiving and Handling via Ground, Air, and Vessel Transportation.
The workshop curriculum is in accordance with 49 CFR § 172.704 for General Awareness, Function-Specific, Safety, and Security Awareness training requirements.

Beltway Buzz – Ogletree & Deakins
DACA Regulations Finalized. On August 24, 2022, the U.S. Department of Homeland Security’s (DHS) U.S. Citizenship and Immigration Services (USCIS) released a final rule to codify the Deferred Action for Childhood Arrivals (DACA) policy. The policy, which was initiated more than ten years ago via a memorandum by then-secretary of homeland security Janet Napolitano and proposed as a rule on September 28, 2021, grants work authorization and deferred action from removal proceedings to “certain young people who came to the United States many years ago as children, who have no current lawful immigration status, and who are generally low enforcement priorities.”
DACA has been the subject of multiple legal challenges over the years and the Biden administration is undoubtedly hoping that DACA’s current iteration, which has gone through notice-and-comment rulemaking, proves more durable. Despite the time that has passed since the policy’s creation in June 2012, USCIS has not extended the original eligibility dates, meaning that the policy applies only to qualifying individuals who “[c]ame to the United States under the age of 16,” “were not above the age of 30 on June 15, 2012,” and “have continuously resided in the United States since June 15, 2007.” The regulation supersedes the Napolitano memo and becomes effective on October 31, 2022. The final rule is scheduled to be published in the Federal Register on August 30, 2022.
H-1B Cap Hit. Speaking of USCIS, on August 23, 2022, the agency announced that it had “received a sufficient number of petitions needed to reach the congressionally mandated 65,000 H-1B visa regular cap and the 20,000 H-1B visa U.S. advanced degree exemption, known as the master’s cap, for fiscal year (FY) 2023.” Beyond the cap issue, the H-1B program is always a top candidate for reform, whether by Democrats and Republicans in the U.S. Congress, or administrative regulators. The Buzz is tracking both the H-1B and L-1 Visa Reform Act in Congress, as well as the pending DHS/USCIS proposal to amend the regulations implementing the program. Jennifer M. Cofer and Amanda M. Mullane have the details on the USCIS announcement.
PLA Proposal Introduced. Late last week, the U.S. Department of Defense (DoD), General Services Administration (GSA), and National Aeronautics and Space Administration (NASA) issued a proposed rule that would amend the Federal Acquisition Regulation (FAR) in order to implement President Joe Biden’s February 4, 2022, executive order mandating the use of project labor agreements (PLAs) on federal construction projects that cost $35 million or more. (The executive order replaces a similar executive order issued in 2009 by then-president Barack Obama that had encouraged, rather than required, project labor agreements.) According to the proposal, “[r]equiring a PLA means that every contractor and subcontractor engaged in construction on [a] project agree, for that project, to negotiate or become a party to a project labor agreement with one or more labor organizations.” The proposed rule states that exceptions to the PLA mandate would be granted when:
- “Requiring a project labor agreement on [a] project would not advance the Federal Government’s interests in achieving economy and efficiency in Federal procurement.” Examples are when the project (1) is of short duration and uncomplicated, (2) involves specialized skills that are available only through a small number of contractors, or (3) is of “unusual and compelling urgency” that makes the use of a PLA impracticable.
- “Market research indicates that requiring a project labor agreement on the project would substantially reduce the number of potential offerors to such a degree that adequate competition at a fair and reasonable price could not be achieved.”
- “Requiring a project labor agreement on [a] project would otherwise be inconsistent with statutes, regulations, Executive orders, or Presidential memoranda.”
Comments on the proposed rule are due by October 18, 2022.
OFCCP Opens Construction Contract Notification Portal. This week, the Office of Federal Contract Compliance Programs (OFCCP) announced the debut of the Notification of Construction Contract Award Portal, an online platform intended to “make it easier for contracting officers and contractors to submit information about construction contract awards, which will provide more timely and complete information on federal contracts.” Such information includes the value and duration of a contract, the contract receiving entity, and the location at which the contract will be performed. Current law requires contractors (as well as contracting officers and applicants) to notify OFCCP “within 10 working days of an award of a federal or federally assisted construction contract or subcontract in excess of $10,000.” The portal opened today, August 26, 2022, and the landing page includes frequently asked questions (FAQs), how-to videos, and a user guide. HMS Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:

- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and

Applications for the 2022 HMS Scholarship Awards Now Open
The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
