The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.
76% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

When the Toxic Substances Control Act (TSCA) was enacted in 1976, the U.S. Environmental Protection Agency (EPA) focused its attention on chemical substances and chemical mixtures, while largely exempting the regulation of chemicals in “articles,” generally meaning finished products or manufactured goods. EPA’s more recent announcement of its intent to regulate chemicals in articles to a much greater extent has caught many in the regulated industries off guard and reflects a significant shift in U.S. chemical regulation policy. This change in policy affects all commercial entities that deal with a physical product, as they must now become familiar with the law, its requirements, and the chemical makeup of their finished goods. This webinar will cover the policy changes that led to the regulation of articles, EPA’s authority to regulate these articles, and what companies need to know to stay in compliance.

In 2019 Mark Bruce from AHMP and Gene Guilford from IHMM worked on a project to get the Commonwealth of Pennsylvania to recognize the CHMM and CDGT credentials. With Mark’s work on the ground in Pennsylvania, we succeeded.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
In January 2021 Mark at AHMP and Gene at IHMM has launched 45 in 5, getting the other 45 states to recognize our credentials in 5 years. If we can find a volunteer like Mark in other states [see above] we can work with those volunteers on crafting the right message to the right agencies in state governments across the country. If we find enough volunteers we can get this done in less than 5 years.
In January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

EPA Issues SNPRM Modifying and Supplementing 2021 Proposed TSCA Fees Rule
On November 16, 2022, the U.S. Environmental Protection Agency (EPA) published a much-anticipated supplemental notice of proposed rulemaking (SNPRM) to modify and supplement its 2021 proposed rule that would amend the 2018 Toxic Substances Control Act (TSCA) fees rule. 87 Fed. Reg. 68647. EPA states that “[w]ith over five years of experience administering the TSCA amendments of 2016, EPA is publishing this document to ensure that the fees charged accurately reflect the level of effort and resources needed to implement TSCA in the manner envisioned by Congress when it reformed the law.” EPA will hold a webinar on December 6, 2022, to provide an overview to stakeholders of the SNPRM. Registration for the webinar is open. Stakeholders who wish to provide oral comments during the webinar are asked to register by December 1, 2022. Written comments are due by January 17, 2023. EPA Seeks To Expand Community Involvement While Touting PFAS Progress
EPA in a new “progress report” is touting its achievements over the past year in advancing an agency-wide strategy to address PFAS, highlighting work on Superfund hazardous substance designations and drinking water advisories, among other efforts, and announcing plans to hold “community listening sessions” in response to advice from environmental justice (EJ) advisors.
“EPA continues to deliver on its promise to confront PFAS and protect the health of people and communities across the nation,” EPA water office chief Radhika Fox said in a Nov. 17 press release announcing the release of the agency’s progress report on per- and polyfluoroalkyl substances (PFAS) actions. “Today’s progress report highlights how much we have accomplished in the first year of implementing the PFAS Roadmap.”
She said it also features upcoming milestones, including efforts to invest $10 billion from the bipartisan infrastructure law (BIL) into communities affected by PFAS and other emerging contaminants in water.
The report, “A Year of Progress Under EPA’s PFAS Strategic Roadmap,” highlights major actions advanced under its October 2021 roadmap — which centers on the three goals of “research,” “restrict” and “remediate.”
These actions include the agency’s landmark proposal in late August to designate the two most-studied PFAS as hazardous substances under the Superfund law, its issuance of stringent drinking water health advisories for four PFAS — three of which are now being challenged by industry litigation — and an order under its National PFAS Testing Strategy to require companies to test and sample for 29 PFAS in drinking water starting next year, which the report says lays the groundwork for enhancing data on PFAS. The report also lists other achievements.

EPA Floats Higher Climate Damage Values In Draft Carbon ‘Cost’ Update
EPA is issuing a draft update to the social cost of carbon (SCC) metric that floats significantly higher estimates of the climate-related damage caused by greenhouse gases than the Biden administration’s interim values, as well as a new dynamic approach to setting the “discount rate” used to reduce the value of future benefits from curbing emissions.
The draft update, floated Nov. 11 alongside EPA’s just-issued supplemental oil and gas methane rule, is separate from an ongoing update to the SCC by a White House interagency working group (IWG).
It is unclear how EPA’s values will interact with the forthcoming SCC update by the White House group, of which the agency is a member.
The SCC metric is generally used to determine the benefits of federal regulation though EPA did not incorporate the draft SCC estimates into the formal cost-benefit analysis for its supplemental methane proposal, and it instead continues to rely on “interim” SCC values the Biden administration adopted in February 2021.
EPA’s draft report, on which the agency is seeking external review, recommends setting a social cost of carbon dioxide that ranges from $120 to $340 per ton in 2020, to between $280 and $600 per ton in 2080.

EPA Touts Release Of TSCA New-Chemical Filings Amid Ongoing Litigation
EPA is touting its recent releases of “thousands” of industry submissions related to TSCA reviews of new chemicals and vowing to pair continued look-backs at previously undisclosed documents with “near real-time” publication of newly filed material, even as a court could soon rule on environmentalists’ suit seeking still-greater transparency in the program.
In a Nov. 21 statement, the agency highlighted what it said is “improved public access to certain reports submitted by chemical companies” under the Toxic Substances Control Act (TSCA) and promised to step up releases of such documents through its ChemView website — particularly new-chemicals reviews governed by section 5 of the law, and a section 8(e) requirement for firms to report discoveries of “substantial” health risks from their chemicals.
“Going forward, EPA will continue to identify older, previously submitted unpublished information to make available in ChemView and will publish newly received TSCA section 5 notices and TSCA section 8(e) reports on a near real-time basis,” the agency’s statement says.
It frames that commitment as the latest step in an ongoing effort to release more industry-submitted documents, particularly under section 5, though with the caveat that it will continue to shield data deemed confidential business information (CBI) from disclosure.

EPA Affirmation Of Air Permit ‘Reactivation’ Policy Leaves Ambiguity
EPA’s recent move to reaffirm its policy on whether industrial facilities are “reactivated” and therefore require new air permits underscores the agency’s discretion about when to treat plants as “new,” establishing general principles to guide regulators but eschewing any “bright line” test in favor of considering a plant operator’s “intent.”
In a decision announced Nov. 17, EPA Administrator Michael Regan and other agency officials said they would require the owners of a shuttered oil refinery on St. Croix, in the U.S. Virgin Islands, to seek a new prevention of significant deterioration (PSD) air permit before restarting the plant, among other conditions of resuming operations at the Limetree Bay facility.
EPA’s enforcement action at the site has become a test case of the Biden administration’s commitment to environmental justice, following the restart of the plant under the Trump administration and a subsequent series of releases of harmful air pollutants.
But the case is also a test of EPA’s reactivation policy “that EPA has consistently applied over three decades,” yet which the Trump administration disparaged, without actually rescinding, according to an EPA legal analysis.

These workshops are offered with U.S. DOT PHMSA HMIT (Hazardous Materials Instructor Training) Grant support to the National Partnership for Environmental Technology Education (National PETE).

The workshop curriculum is in accordance with 49 CFR § 172.704 for General Awareness, Function-Specific, Safety, and Security Awareness training requirements.

Lame-Duck Debt Ceiling Deal Unlikely
The White House has largely conceded that a bipartisan debt ceiling hike is unlikely to happen during the lame-duck session that runs through late December, setting the stage for a highly partisan confrontation with the House GOP majority next year.
Senior administration officials also say they don’t have the 50 Democratic votes in the Senate needed to raise the debt ceiling through the budget reconciliation process, thereby avoiding a Republican filibuster. Likely opposition could come from Sen. Joe Manchin (D-WV) and possibly other centrist Democrats who believe that debt ceiling hikes should be bipartisan.
House Republicans have been emboldened to use the debt limit as leverage to secure discretionary spending cuts or entitlement reforms. A White House spokesperson said that congressional Republicans will bear the blame for using the debt limit for political gain. “The debt ceiling should never be a matter of political brinksmanship,” the spokesperson told POLITICO. “Congress must once again responsibly address the debt ceiling before its expiration.”
Administration officials expect the Treasury Department to run out of room to keep borrowing money by June. The U.S. government has never defaulted on its debts, but failure to boost the $31.4 trillion borrowing cap would potentially crash markets around the world, send interest rates far higher than they already are and push the economy into a deep recession.
Senate Minority Leader Mitch McConnell (R-KY) and Sens. Mike Braun (R-IN) and James Lankford (R-OK) all said recently it was extremely unlikely that a debt limit deal can be reached over the next few weeks.
Congress Faces Dec. 16 Funding Deadline
Democrats on the House and Senate Appropriations committees continue to put together FY 2023 spending bills but, with the current CR expiring Dec. 16, another stopgap funding measure appears likely to avoid a government shutdown.
Bipartisan negotiations on an omnibus FY 2023 spending package have been stalled for months, with House and Senate appropriators unable to agree on even a topline figure for overall spending and many lawmakers waiting to see the outcome of this fall’s midterm elections to see what leverage they may have in the next Congress.
Senate Majority Leader Chuck Schumer (D-NY) told reporters last week he has prepared his caucus for “heavy work” and “long hours” over the few weeks remaining until government funding expires.
The impending retirements of the Senate’s top two negotiators, Appropriations Committee Chairman Patrick Leahy (D-VT) and ranking member Richard Shelby (R-AL), figure to complicate spending discussions as well.

The HMS began voting for its 2022 slate of directors on November 9th and halted it when there was a problem with the ballot. As soon as the problem is rectified, the voting started again and will continue until December 16th. HMS is IHMM’s Foundation, providing education, training, networking, affinity programs and other support exclusively for IHMM certificants.

Every IHMM certification that requires an examination has a section of its website entitled Examination Preparation.
Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.
You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 397 CHMM applicants IHMM had on August 31, 2022, all 397 looking for CHMM prep courses could see and chose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 397 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.
Earning Certification Maintenance Points [CMPs] is illustrated under Recertification of Your Credential, that includes the Recertification Claims Manual – Appendix A, that details all of the ways a certificant may earn CMPs > https://ihmm.org/recertification-claims/
Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?
HMS has made that simple and easy.

- Scroll down until you see a row of buttons…click on the CMPs button
The system will then generate all of the courses on the HMS E&T platform with IHMM CMPs already attached.
The next developments by the HMS E&T committee will refine available courses’ CMPs by individual credential!
HMS Certified Dangerous Goods Professional [CDGP] Exam Prep
The Columbia Southern University/HMS CDGP prep course is found here on the Hazardous Materials Society [HMS] education and training website > https://hazmatsociety.org/training/ce-1112-cdgp-exam-prep/2022-02-02/
The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).

Applications for the 2022 HMS Scholarship Awards Now Open
The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
DEADLINE TO SUBMIT SCHOLARSHIP AWARD APPLICATIONS IS December 1, 2022. All submissions and associated materials must be submitted using the online form.
Scholarship Winners Will Be Announced at the HMS Annual Meeting.

One of the most important projects of the Hazardous Materials Society is our Scholarship Program.
HMS wants to make it as easy as possible for those who cannot always afford to participate in pursuing certification, or keeping up with professional development, or attending great conferences and receiving outstanding training. HMS does not solicit contributions from the general public. HMS does ask IHMM’s certificants and their companies and our education and training vendors to consider a contribution.
