Directors are responsible for the governance of IHMM, including establishing the overall direction of IHMM, the appointment of the Executive Director, policy-making, and financial management.

Excellence in EHS Management Award
The Excellence in EHS Management Award recognizes an individual who has excelled in their role as an EHS manager. The Institute for Hazardous Materials Management [IHMM] will present the award at the annual National Safety Council Expo.
The honoree will receive a commemorative plaque and be recognized in a press release and IHMM member communications. Travel expenses to the award ceremony will be subsidized. If traveling from overseas IHMM will pay travel expenses from the nearest port of entry.
Nominations will be accepted from March through July of each year and the presentation to the winner will be in conjunction with the National Safety Council Congress and Expo [Sept 13-19, 2024 in Orlando]

IHMM Signs Letter Opposing Reductions in OSH Worker’s Pay
The IHMM Government Affairs Committee has agreed to sign a coalition letter opposing reductions in pay for IH and OSH employees.
Why IHMM Is Interested in This Act – Protecting CSHMs, CSMPs, and ASHMs in government
As the attached letter states, part of the concern and reason we signed onto this letter is that “if VA’s proposed pay downgrade moves forward, it could inspire other agencies to reduce the pay of industrial hygienists and other occupational and environmental health and safety workers they employ. The likely result of such a scenario would be a weakening of the entire Federal government’s ability to protect workers and their communities from health and safety hazards, as it will likely take longer and become harder to find and hire employees for these critical positions; this action runs counter to the intended outcomes of the consistency review process.”

The Dr. John H Frick Memorial IHMM Scholarship Program – Deadline 10/18/2024
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

IHMM – 26 Fellows Are Mentors
IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to engage both 26 IHMM Fellows as Mentors and anyone who seeks some assistance as Mentees.
Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities. This article from ASAE magazine outlines how a mentoring program can become more successful – engagement!
IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.
IHMM Proposes Changes in Government Recognition of Credentials
IHMM submitted comments on OSHA Advisory Committee on Construction Safety and Health (ACCSH): Notice of Meetings concerning OSHA-2024-0002-0007, and highlighted the creation of IHMM’s Certified Pandemic Preparedness Specialist [CPPS] credential.
State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation, work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.
Beltway Buzz – Ogletree Deakins
OSHA’s Walkaround Reg in Effect. The Occupational Safety and Health Administration’s (OSHA) walkaround rule takes effect today, May 31, 2024. The controversial rule, which allows third parties to access employers’ private property while accompanying an OSHA official during a workplace safety inspection, is the subject of both a legal challenge and a Congressional Review Act resolution.
Senate Republican: Administration’s Labor Policies Put Politics Over People. This week, Senator Bill Cassidy (R-LA) released a report, titled, “How Biden’s Labor Agenda Puts Politics Over People: Weaponizing the Federal Government to Benefit Political Backers at the Expense of American Workers.” The report criticizes many of the administration’s policy prescriptions that should be familiar to readers of the Buzz. It argues that the U.S. Department of Labor’s (DOL) independent contractor regulation deprives workers of opportunity and flexibility, the National Labor Relations Board’s (NLRB) joint-employer rule undermines the franchise business model, and the overtime regulation “will destroy jobs and make it harder for nonprofits to provide services.” Additionally, according to the report, the administration is providing handouts to labor unions; the report cites an August 2023 Board decision, OSHA’s walkaround regulations, and the administration’s project labor agreement and Davis-Bacon Act regulations. Should a new administration occupy the White House in 2025, the report could serve as a potential roadmap for labor policy reversals.
Republican Bill Addresses College Athletes’ Employment Status. Republicans in the U.S. House of Representatives have introduced the Protecting Student Athletes’ Economic Freedom Act, which clarifies that “a student athlete may not be considered an employee of an institution, conference, or association.” The debate concerning whether graduate students and student athletes should be classified as “employees” has been going on for years at the NLRB. Most recently, in February 2024, the Board’s Boston regional office ruled that men’s basketball players at Dartmouth were “employees” under the National Labor Relations Act.
House Republicans Push Back on White House Pension Initiative. The Buzz recently discussed a White House event in which five major pension plans agreed to “encourage their portfolio companies to remain neutral when workers seek to exercise the freedom to join together in a union; and when applicable, enter into neutrality agreements with labor organizations that include voluntary or card-check recognition, reasonable timelines to first contract, and a commitment to non-interference in union organizing.” Well, Republican leaders on the House Committee on Education and the Workforce aren’t too happy with the situation and are exploring whether the funds are violating federal retirement law. Representatives Virginia Foxx (R-NC), chair of the committee, and Bob Good (R-VA) recently sent a letter to Acting Secretary of Labor Julie Su seeking “documents and information relating to the Department of Labor’s (DOL) involvement in efforts to use pension funds to promote labor union interests.” The letter argues that “diverting pension fund assets to promote collective bargaining is contrary to statutory protections for pension funds subject to the Employee Retirement Income Security Act of 1974 (ERISA).”
Foxx Wants Union Transparency. The Buzz has covered recent Republican actions on Capitol Hill to seek more accountability and transparency from labor unions. In keeping with that theme, this week Representative Foxx introduced the “Union Members Right to Know Act” (H.R. 8573). The bill would amend the Labor-Management Reporting and Disclosure Act of 1959 to require labor unions to notify members of their right to be non-members and refrain from funding union activity unrelated to collective bargaining, contract administration, and grievance adjustment. Unions would also be required to notify members of their right to seek “a reasonable accommodation, based on the religious beliefs or practices of the individual, not to pay dues or fees to the labor organization.” Various iterations of this concept have been floated in legislative form over the years but have obviously never been enacted.

Professional Certification Coalition
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis. The PCC has compiled several “Watchlists” identifying and analyzing provisions in pending legislation at both the state and federal level that, under applicable rules, may still be enacted in the current legislative session. Depending on the carry-over rules in the relevant legislature, the charts listing current legislation may include bills introduced in a prior year. In addition, the PCC compiles each year a chart of enacted legislation that affects certification. The charts include hyperlinks to every bill or executive order. Note that the Watchlist and the Enacted Legislation document do not include profession-specific legislation and do not include regulatory initiatives. The charts will be updated as needed based on new developments.

Tomorrow’s Workforce Coalition
We are thrilled to share that 807 organizations have now joined the Tomorrow’s Workforce Coalition!
Our association community created the Tomorrow’s Workforce Coalition to advocate for legislation that would help strengthen the economy now and into the future: the bipartisan, bicameral Freedom to Invest in Tomorrow’s Workforce Act (S. 722 / H.R. 1477). This commonsense bill would allow people to use 529 savings plans funds to help pay for job training and credentials, such as licenses and certifications, and shift the 529 paradigm from “college savings plans” to “career savings plans.”
The Tomorrow’s Workforce Coalition remains hard at work to help build support for the Freedom to Invest in Tomorrow’s Workforce Act (H.R. 1477 / S. 722), and things are moving along nicely:
- 807 member organizations comprise the Tomorrow’s Workforce Coalition.
- 135 Members of Congress cosponsor the House bill (80 Republicans / 55 Democrats).
- 24 Senators* cosponsor S. 722 (11 Democrats / 12 Republicans / 1 Independent).
*The Senate bill has its first Democratic cosponsor on the Senate Finance Committee! The newest cosponsor isn’t listed online yet, but we’ll share more information once everything is official.

Important Stories for IHMM Certificants
Implementing Statutory Addition of Certain Per- and Polyfluoroalkyl Substances (PFAS) to the Toxics Release Inventory Beginning With Reporting Year 2024
The Environmental Protection Agency (EPA) is updating the list of chemicals subject to toxic chemical release reporting under the Emergency Planning and Community Right-to-Know Act (EPCRA) and the Pollution Prevention Act (PPA). Specifically, this action updates the regulations to identify seven per- and polyfluoroalkyl substances (PFAS) that must be reported pursuant to the National Defense Authorization Act for Fiscal Year 2020 (FY2020 NDAA) enacted on December 20, 2019. As this action is being taken to conform the regulations to a Congressional legislative mandate, notice and comment rulemaking is unnecessary.

This final rule is effective June 17, 2024.
Attention Transporters of Hazardous Materials: PHMSA Proposes Registration Fee Updates; OSHA to Hold Public Meeting on UN GHS Standards

In an NPRM, the agency, in order to account for what it contends are increased transport of hazardous materials as well as what it says are the burdens such transport places on first responders, proposes updates to the registration fees under the statutorily mandated registration and fee assessment program for persons who transport, or offer for transportation, certain categories and quantities of hazardous materials. Comments are due no later than August 22nd, 2024. See details and how to comment here.

The agency will conduct a virtual public meeting on June 11, 2024, in advance of the 46th session of the United Nations Sub-Committee of Experts on the Globally Harmonized System of Classification and Labelling of Chemicals (UNSCEGHS) to be held as an in-person meeting July 3–5, 2024, in Geneva, Switzerland. OSHA, along with the U.S. Interagency Globally Harmonized System of Classification and Labelling of Chemicals (GHS) Coordinating Group, plans to consider the comments and information gathered at the June 11, 2024, public meeting when developing the U.S. Government positions for the UNSCEGHS meeting July 3–5, 2024.

OSHA HCS Amendments Primarily Align with GHS Rev 7
OSHA issued a final rule on May 20, 2024, that amends the Hazard Communication Standard (HCS) to conform to the Globally Harmonized System of Classification and Labeling of Chemicals (GHS), primarily Revision 7 (Rev 7), address issues that arose during the implementation of the 2012 update to the HCS, and provide better alignment with other U.S. agencies and international trading partners while enhancing the effectiveness of the standard. 89 Fed. Reg. 44144. OSHA states that, consistent with Executive Order 13563 and the Regulatory Flexibility Act, which call for assessment and, where appropriate, modification and improvement of existing rules, OSHA has reviewed the existing HCS. OSHA states that it determined that the revisions in the final rule “will enhance the effectiveness of the HCS by ensuring employees are appropriately apprised of the chemical hazards to which they may be exposed, thus reducing the incidence of chemical-related occupational illnesses and injuries.” The modifications to the HCS include revised criteria for classification of certain health and physical hazards, revised provisions for updating labels, new labeling provisions for small containers, new provisions related to trade secrets, technical amendments related to the contents of safety data sheets (SDS), and related revisions to definitions of terms used in the standard. The final rule will be effective July 19, 2024. For more information on the modifications to the HCS and our Commentary, please read the full memorandum.
EPA Releases Draft Risk Evaluation Documents for DIDP and DINP for Public Comment and Peer Review
EPA announced on May 20, 2024, the availability of and solicited public comment on the draft manufacturer-requested risk evaluation (MRRE) for di-isodecyl phthalate (DIDP) and the draft physical chemical, fate, and hazard assessments for di-isononyl phthalate (DINP) prepared under TSCA. 89 Fed. Reg. 43847. In its May 17, 2024, press release, EPA states that it preliminarily determined that all but one of the uses of DIDP that EPA evaluated under TSCA do not contribute to unreasonable risk to human health. Additionally, EPA preliminarily determined that DINP causes liver damage at lower concentrations than DIDP, and unlike DIDP, could cause cancer at higher levels of exposure. Comments on the draft documents are due July 19, 2024. For more information on the next steps in the peer review process and our commentary, please read the full memorandum.

NIOSH Mental Health Resources
NIOSH launched an Impact Wellbeing Guide: Taking Action to Improve Healthcare Worker Wellbeing. This Guide offers six concrete Action Steps that hospital leaders can take to accelerate or supplement professional well-being efforts in their hospitals. It was developed in partnership with the Dr. Lorna Breen Heroes Foundation and tested in six CommonSpirit hospitals across the U.S.

EPA has been using its Toxic Substances Control Act (TSCA) Section 8 authorities in new and different ways. These TSCA reporting obligations have been of interest to stakeholders, raising many good questions and interest in understanding why EPA is seeking information, how it relies upon the information it receives, and what is in scope under the various reporting obligations. We here at Bergeson & Campbell, P.C. think it is timely to schedule a webinar on TSCA Section 8 authorities and how EPA is implementing these authorities to assist in achieving TSCA goals.
We intend to address TSCA Sections 8(a), 8(c), 8(d), and 8(e), reminding participants about chemical data reporting (CDR), describing the per- and polyfluoroalkyl substance (PFAS) data reporting rule, and discussing EPA’s consideration of a tiered data reporting (TDR) rule.
B&C appreciates that EPA is working hard to reach out to traditional and non-traditional TSCA stakeholders. Introducing AIHA’s Military and Uniformed Services Support Committee
Walking around AIHA Connect, AIHA’s annual conference, it’s easy to spot the many uniformed military service members attending and, in many cases, leading professional development courses (PDCs), pop-up educational sessions, and volunteer group meetings. This observation, combined with the results from our 2023 membership survey, indicated that the government and military comprises our second-highest membership industry group, which led us to ask, “How can we better serve the military community?”
Conducting a deeper analysis, we discovered interesting data that indicated we were on to something.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

You may have decided, after a long and successful career, to retire from active daily duty. Congratulations. That doesn’t mean you have to completely disengage from your profession. IHMM is pleased to offer Emeritus status to all certificants who will no longer be actively engaged in their communities of practice but who still want to stay in touch. ASSP Standards-Based Education
The American Society of Safety Professionals (ASSP) will host a third installment of its workplace safety education series called “Stand Up for Standards.” A live two-hour webinar on safety management systems will take place at 11 a.m. CT on March 29, helping safety and health professionals create a road map for identifying hazards and eliminating risks to improve organizational performance.
“Stand Up for Standards: ANSI/ASSP Safety Management Systems” will provide an overview and implementation practices for the ANSI/ASSP Z10.0-2019 standard.
Safety experts Amy Timmerman, M.S., CSP, CHES, Danyle Hepler, CSP, CESCO, CPEA, Joe Wolfsberger, M.S., CSP, CIH, and Greg Zigulis, CSP, CIH, CHSP, will share real-world experiences and practical guidance to help attendees reduce injuries, illnesses and fatalities on work sites across various industries.

CHEMTREC, HMS Training Partner, Adds Courses for IHMM Certificants
This week CHEMTREC has added its HAZWOPER 8-hour Refresher Training to the HMS Daily Training schedule. This HAZWOPER 8-hour Refresher Training is designed for individuals who need to refresh their existing 24-hour or 40-hour HAZWOPER certification. This course meets the requirements outlined in OSHA 29 CFR 1910.120 for 8 (eight) hours of annual refresher training for workers involved in the transport, storage, or handling of hazardous materials or hazardous waste.

Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.
You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 419 CHMM applicants IHMM had on April 9, 2024, all 419 applicants looking for CHMM prep courses could see and choose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 419 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.
Earning Certification Maintenance Points [CMPs] is illustrated under Recertification of Your Credential, that includes the Recertification Claims Manual – Appendix A, that details all of the ways a certificant may earn CMPs > https://ihmm.org/recertification-claims/
Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?
HMS has made that simple and easy.

- Scroll down until you see a row of buttons…click on the CMPs button
The system will then generate all of the courses on the HMS E&T platform with IHMM CMPs already attached.
The next developments by the HMS E&T committee will refine available courses’ CMPs by individual credential!
HMS Certified Dangerous Goods Professional [CDGP] Exam Prep
The Columbia Southern University/HMS CDGP prep course is found here on the Hazardous Materials Society [HMS] education and training website > https://hazmatsociety.org/training/ce-1112-cdgp-exam-prep/2022-02-02/
The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
