In Memoriam

Allen Roy Frederick, CHMM

We are sad to report that Allen Frederick, CHMM, and founder of COCHMM, passed away.  He had a tremendous career, and was passionate about our organization.  He was also involved at the national level.  His career spanned consulting, Ohio EMA, the Defense Logistics Agency, and education.  He was an adjunct instructor at CSCC for many years.  On a personal level, he was a wonderful friend.

Allen Roy Frederick of Logan, Ohio, was born in Akron, Ohio, on September 3, 1949, and departed from us too soon on February 21, 2026, while at the OSU Ross Heart Hospital, Columbus, OH. His body could no longer fight all the health issues he was facing.

Allen was preceded in death by his mother, Cosma Frederick Ryan, his father, Albert S. Frederick, Sr, his stepfather Edward Ryan, his sister JoAnn Frederick James, and his son Keith Shannon Frederick.

Allen was an active member, volunteer and staunch supporter of The Tree Church, Lancaster, OH, and most recently, the first Tree Church campus in Logan, OH. Allen was a graduate of Franklin University, Columbus, and served in both the US Navy and the US Army. He retired from the DLA Training Center in Columbus, was an adjunct instructor at Columbus State Community College and was employed for many years as a safety trainer and consultant with Lancaster Safety Consulting, Inc. in Wexford, PA.

Special thanks and blessings to the truly wonderful staff of the Cardiac Critical Care unit at the OSU Ross Heart Hospital, especially Dr. CJ Botti whose care and compassion will never be forgotten.

IHMM Begins Review of PHMSA NPRM HM-215R to amend the U.S. Hazardous Materials Regulations

Federal Register  Deadline April 13, 2026

According to the Federal Register from February 10, 2026, PHMSA issued NPRM HM-215R to amend the U.S. Hazardous Materials Regulations (HMR; 49 C.F.R. Parts 171–180) to maintain statutory alignment with updated international dangerous goods standards, as directed by 49 U.S.C. § 5120.

Senate Committee Examines Draft TSCA Legislation, Focusing on New Chemical Review

The Senate Committee on Environment and Public Works (EPW) held a hearing on a discussion draft of S.__, the Toxic Substances Control Act Fee Reauthorization and Improvement Act of 2026 (Discussion Draft) on March 4, 2026. The Committee’s one-pager on the Discussion Draft notes that since the Toxic Substances Control Act (TSCA) was enacted 50 years ago, the U.S. Environmental Protection Agency’s (EPA) “approval process for new chemicals has not been substantively improved. The current process is both uncertain and costly, hindering America’s economic competitiveness by discouraging the development and commercialization of new, innovative chemicals.” The bill would make targeted reforms to EPA’s new chemical approval process to establish clear rules to make EPA’s chemical review process safe and efficient; prioritize resources where the science is hardest; make the chemical review process more predictable; and enable key sectors to compete in the global marketplace

House GOP to Pursue Second Reconciliation Bill

House Republican leaders are considering pursuing a second budget reconciliation package this year following discussions at a recent leadership retreat in Florida. However, significant questions remain about what policies the package would include and how lawmakers would offset its cost.

Meanwhile, Ways and Means Committee Chair Jason Smith (R-MO) has voiced skepticism about pursuing a second reconciliation package, reiterating his view that there was likely only enough political momentum for one major bill this Congress. Nonetheless, coming out of their retreat, we know that a new bill is at least possible.

“I’ve said it all along that we need one big reconciliation [bill] because I didn’t see a path that there was enough juice for two, and I still stand by that,” Smith said.

The Republican Study Committee is pushing hard for another reconciliation bill.

The RSC’s Reconciliation 2.0 Framework outlines a conservative roadmap to:

  • Lower housing, health care, and energy costs

  • Eliminate wasteful government spending

  • Restore fiscal discipline and achieve deficit reduction

  • Make affordability reforms permanent through reconciliation

  • Here is the full text of the GOP plan

For associations and other tax-exempt organizations, any additional reconciliation effort could present another vehicle for tax policy changes, making the issue one to watch in the months ahead. Frankly, that’s the only reason we pay close attention to reconciliation legislation – as it could contain new or higher taxes that may impact the non-profit community. 

Withdrawal of 2023 Standard for Determining Joint Employer Status

On October 27, 2023, the Board published a final rule (2023 Rule) that rescinded and replaced a prior rule regarding the standard for determining joint employer status under the National Labor Relations Act. On March 8, 2024, the U.S. District Court for the Eastern District of Texas issued an order vacating the 2023 Rule. The Board is therefore revising its rules and regulations to replace the vacated regulatory text with the previous version of its rules that remain in effect due to the vacatur.

IHMM Issues Comprehensive Overview of DG Shipping in Maritime and Air in the Middle East

United States Tells Americans to Leave the Middle East

U.S. Secretary of State Marco Rubio and the U.S. Department of State have issued an urgent directive for American citizens to leave much of the Middle East immediately because of escalating military conflict and serious security risks.

The advisory instructs U.S. citizens to “DEPART NOW” using commercial transportation where available, while the U.S. government works to arrange limited charter or military evacuation assistance as conditions allow.

Environmental News for This Week: March 2-10, 2026

During the week of March 2–10, 2026, the U.S. environmental regulatory landscape was characterized by consequential EPA rulemakings and intensifying federal-state climate litigation dynamics.

Most prominently, EPA finalized a new rule governing emissions from large municipal waste combustors, updating limits for nine pollutants for the first time in roughly two decades. The rule tightens certain emission thresholds relative to older standards but is less stringent than earlier proposals, leaving regulated facilities to reassess compliance obligations and capital planning.

EPA’s broader rollback of prior mercury-emission standards affecting coal-fired power plants continued to generate regional and industry reactions, particularly in coal-producing states that view the change as preserving plant viability, while environmental groups warn of increased toxic-air exposure and likely litigation under the Clean Air Act.

Simultaneously, federal deregulatory moves—especially the earlier repeal of the greenhouse-gas “endangerment finding”—are catalyzing state-level climate responses, including litigation and new statutes designed to impose liability for climate damages on major emitters.

Implications: regulated entities face a complex compliance environment marked by shifting federal air-pollution standards, heightened state regulatory activism, and expanding climate-related litigation exposure across multiple jurisdictions.

Workplace Safety News This Week: March 2 – 10, 2026

For the week of March 2–10, 2026, several developments in federal workplace safety policy and enforcement emerged from the U.S. Department of Labor, the Occupational Safety and Health Administration, and the National Institute for Occupational Safety and Health, reflecting continued focus on enforcement, regulatory implementation, and research capacity.

OSHA enforcement actions during the period continued to emphasize persistent high-risk hazards, particularly falls in construction, trenching violations, and machine-guarding failures, which remain among the agency’s most frequently cited violations. Several enforcement announcements involved employers cited following serious injuries or fatalities, reinforcing OSHA’s ongoing reliance on targeted inspections and the Severe Violator Enforcement Program to address repeat or willful noncompliance.

From a regulatory standpoint, OSHA continued outreach and compliance preparation related to the revised Hazard Communication Standard, including guidance to chemical manufacturers and downstream employers regarding labeling, safety data sheet updates, and training obligations associated with phased implementation deadlines in 2026.

Meanwhile, NIOSH activity during the week focused on sustaining research programs following restored FY-2026 funding levels. Agency communications emphasized continued work on occupational exposure limits, respiratory protection technologies, and fall-prevention research, particularly in the construction sector.

Taken together, federal workplace safety developments during this period reflect steady enforcement activity, continued regulatory transition planning, and reaffirmed investment in occupational health research supporting national worker protection efforts.

What is a Safety Stand-Down?

A Safety Stand-Down is a voluntary event for employers to talk directly to employees about safety. Any workplace can hold a stand-down by taking a break to focus on “Fall Hazards” and reinforcing the importance of “Fall Prevention”. Employers of companies not exposed to fall hazards can also use this opportunity to have a conversation with employees about the other job hazards they face, protective methods, and the company’s safety policies and goals. It can also be an opportunity for employees to talk to management about falls and other job hazards they see.

In the coming weeks, IHMM will be making materials available for the Falls 2026 Campaign!   In addition, IHMM is looking for 2 volunteers, each from a different construction company, who can tell a great story about how they prevent falls in construction.

As we enter a new year, encourage your members to recommit to safety and health. Invite them to make it a New Year’s resolution to reset their safety and health program and take time for proactive planning.

One way to recommit to safety and health is to recognize workers when they meet or exceed safety and health goals. This year, Safe + Sound Week is August 10–16, 2026, with a focus on safety and health recognition programs.

This focus gives associations and trade groups a platform to:

  • Demonstrate leadership across your sector by highlighting practices of employers and workers who get it right.
  • Engage member organizations with practical tools.
  • Show the value of safety and health.
  • Target issues that matter most in your industries.

Week of March 2 -March 10, 2026

The week was defined less by sweeping new treaty text than by implementation, enforcement, and transport-security shocks. In the United States, PHMSA’s international-harmonization docket remained the central federal rulemaking item, while its fuel-transport burden-reduction rule was already in effect. In Europe, ADR 2025 remained the settled road baseline, but UNECE and OTIF were actively feeding the next RID/ADR/ADN cycle with March meeting papers on battery vehicles, packaged vehicles, and tank inspections. In Asia and Africa, formal legislation was quieter, but carrier acceptance rules, aviation battery controls, tanker security incidents, and convoy-risk management materially raised the practical compliance bar. In Central and South America, the most important developments were government enforcement and traceability measures rather than new regional texts, especially in Colombia and Mexico.

United States: PHMSA’s harmonization agenda remains the main legal signal

For U.S. operators, the most consequential live item remained PHMSA’s HM-215R NPRM, “Hazardous Materials: Harmonization With International Standards.” That proposal would update the HMR to reflect newer international rules on proper shipping names, hazard classes, packing groups, special provisions, packaging authorizations, air quantity limits, and vessel stowage. Comments remain due April 13, 2026, so the docket is still very much active during this reporting week. At the same time, PHMSA’s HM-265 final rule on reducing unnecessary burdens in fuel transportation is already effective, meaning domestic fuel carriers should now be auditing shipping-paper language, training references, and internal compliance matrices against the revised text. PHMSA’s separate ANPRM on modernizing hazardous-materials rules for space operations also reached an important procedural point, with the comment period closing on March 4, 2026. Collectively, these items show PHMSA moving on two tracks at once: near-term harmonization with ICAO/IMDG/UN norms, and longer-term modernization for new transport sectors.

Legally, that means U.S. shippers—especially exporters—should not treat the HMR as a closed domestic system. PHMSA is signaling that functional alignment with international dangerous-goods practice is increasingly the expected standard, particularly for batteries, multimodal consignments, and specialized operations. Even before final adoption, the harmonization proposal is the clearest indicator of where enforcement and compliance expectations are headed.
