IHMM Proposes Changes in Government Recognition of Credentials
IHMM Signs Letter Opposing Reductions in OSH Worker’s Pay – The IHMM Government Affairs Committee has agreed to sign a coalition letter opposing reductions in pay for IH and OSH employees. Here is the coalition letter we signed.
IHMM submitted comments on OSHA Advisory Committee on Construction Safety and Health (ACCSH): Notice of Meetings concerning OSHA-2024-0002-0007, and highlighted the creation of IHMM’s Certified Pandemic Preparedness Specialist [CPPS] credential.
State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation, work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.

EPA Begins 90-Day Comment Period on Proposed High-Priority Substance Designations for Five Chemicals
The U.S. Environmental Protection Agency (EPA) announced on July 25, 2024, that it is proposing to designate acetaldehyde, acrylonitrile, benzenamine, vinyl chloride, and 4,4-methylene bis(2-chloroaniline) (MBOCA) as high-priority substances (HPS) for risk evaluation under the Toxic Substances Control Act (TSCA). 89 Fed. Reg. 60420. EPA is providing a 90-day comment period, during which interested persons may submit comments on the proposed designations of these chemicals as HPSs for risk evaluation. EPA states that it is interested in comments that would inform the exposure and hazard assessments and the identification of conditions of use (COU) for these chemicals.
Comments are due October 23, 2024.
As reported in our December 27, 2023, memorandum, in December 2023, EPA began the process to prioritize these five chemicals for risk evaluation. EPA requested relevant information for each, including but not limited to, the chemical’s hazard and exposure potential; the chemical’s persistence and bioaccumulation; potentially exposed or susceptible subpopulations relevant to the prioritization; whether there is any storage of the chemical near significant sources of drinking water; the chemical’s COUs or significant changes in COUs, including information regarding trade names; the chemical’s production volume or significant changes in production volume; and any other information relevant to the potential risks of the chemical that might be relevant to the designation of the chemical’s priority for risk evaluation. Professional Certification Coalition
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis. The PCC has compiled several “Watchlists” identifying and analyzing provisions in pending legislation at both the state and federal level that, under applicable rules, may still be enacted in the current legislative session. Depending on the carry-over rules in the relevant legislature, the charts listing current legislation may include bills introduced in a prior year. In addition, the PCC compiles a chart of enacted legislation that affects certification each year. The charts include hyperlinks to every bill or executive order. Note that the Watchlist and the Enacted Legislation document do not include profession-specific legislation and do not include regulatory initiatives. The charts will be updated as needed based on new developments.

NIOSH Mental Health Resources
NIOSH launched an Impact Wellbeing Guide: Taking Action to Improve Healthcare Worker Wellbeing. This Guide offers six concrete Action Steps that hospital leaders can take to accelerate or supplement professional well-being efforts in their hospitals. It was developed in partnership with the Dr. Lorna Breen Heroes Foundation and tested in six CommonSpirit hospitals across the U.S.
Government Shutdown Threat Looms in September
The House adjourned last Thursday until mid-September with only five of 12 annual spending passed, ensuring that a short-term continuing resolution will be needed to avoid a government shutdown at the end of September.
What’s next: The Senate hasn’t passed any spending bills and will be adjourned next week. Speaker Mike Johnson (R-LA) vowed earlier in the year not to pass any more stopgap funding bills but will have little choice when Congress is back in session.
- Johnson has reportedly not decided whether he prefers the House to pass a CR until December or January.
Some House conservatives want to push it to January when they hope former President Trump will be back in office.
What they’re saying: “There’s a lot of different ideas on the table and we’re trying to work through that – what makes the most sense,” Johnson said. “There’s good arguments for different approaches.”
Transport Canada has begun rolling out its ‘TDG Online’ platform
Transport Canada has begun rolling out its ‘TDG Online’ platform, which will act as a web portal for everything to do with the transport of dangerous goods. The platform has started with one service, the Canutec Registration System, which allows dutyholders to register for and use Canutec’s free 24/7 emergency telephone number on dangerous goods shipping documents.
TDG Online also includes two user guides to explain how to set up the accounts needed to use the platform and how to navigate the platform. Other services will become available in due course. Full details can be found here.

EPA Finalizes Changes to the e-Manifest Regulations
On July 26, 2024, EPA finalized amendments to the manifest regulations for shipments of hazardous waste and polychlorinated biphenyls that are transported for treatment, storage, and disposal.
This rule is intended to reduce the reporting burden on industry and states, increase information availability, improve compliance monitoring, and prepare for future potential integration with biennial reporting requirements. EPA aims to modernize and streamline the manifest process, increasing expected benefits of the e-Manifest system and encouraging further adoption of electronic manifests through increased utility of the system.
OSHA Emergency Response Standard Hearing
The Occupational Safety and Health Administration (OSHA) issued a notice scheduling an informal public hearing on its proposed rule ‘‘Emergency Response Standard’’ mentioned in the email below. The public hearing will begin on November 12, 2024, at 9:30 a.m., Eastern Time (ET), and will be held virtually. Information on how to access the informal hearing will be posted shortly at https://www.osha.gov/emergency-response/rulemaking.
To testify or question witnesses at the hearing, interested persons must electronically submit their notice by September 27, 2024. Please see the Federal Register Notice (Docket Number OSHA-2007-0073) and https://www.osha.gov/emergency-response/rulemaking for additional details.
National Emission Standards for Hazardous Air Pollutants From Hazardous Waste Combustors Malfunction and Electronic Reporting Amendments
The Environmental Protection Agency (EPA) is proposing to amend the National Emission Standards for Hazardous Air Pollutants (NESHAP) from Hazardous Waste Combustors (HWC) to remove the exemptions and revise other provisions associated with emission standard exemptions for periods of malfunction, to add electronic reporting provisions, to amend emergency safety vent provisions, and to correct other minor provisions. The removal of the exemption for periods of malfunction is predicated on the previous vacatur of emission standard exemptions for periods of startup, shutdown, and malfunction (SSM) from the applicable general provisions. We are also proposing to remove or revise some associated requirements that are unnecessary, inappropriate, or redundant in the absence of the malfunction exemption, such as in recordkeeping and reporting. Emission standards will apply during periods of malfunction as required under the Clean Air Act (CAA). The addition of electronic reporting provisions will provide for simplified reporting by sources and will enhance the availability of data on sources to the EPA and the public. In addition, the EPA is proposing amendments to emergency safety vent provisions and one correction to the rule to correct an inadvertent error in the Code of Federal Regulations (CFR) related to the use of Method 23 to determine compliance with the dioxin and furan standards.

OSHA Heat Standard Coming
The Occupational Safety and Health Administration (OSHA) has released a proposed rule that would protect approximately 36 million workers in indoor and outdoor work settings from extreme heat. The proposed rule would require employers to develop an injury and illness prevention plan to control heat hazards in workplaces affected by excessive heat. Among other things, the plan would require employers to evaluate heat risks and — when heat increases risks to workers — implement requirements for drinking water, rest breaks and control of indoor heat. It would also require a plan to protect new or returning workers unaccustomed to working in high heat conditions.
Perhaps the biggest takeaway is a new requirement that affected employers (there’s a list of exemptions, which are mostly office and telework employee related) must develop and deploy a written heat safety plan. Once the formal proposal is published, there will be a comment period and plenty of opportunity to provide feedback to OSHA before any rule is finalized.
Attention Transporters of Hazardous Materials: PHMSA Proposes Registration Fee Updates
PHMSA
In an NPRM, the agency, to account for what it contends are increased transport of hazardous materials as well as what it says are the burdens such transport places on first responders, proposes updates to the registration fees under the statutorily mandated registration and fee assessment program for persons who transport, or offer for transportation, certain categories and quantities of hazardous materials.
PHMSA’s proposed rulemaking would increase the annual fee by $125 for those registrants qualifying as a small business or not-for-profit organization (an increase from $250 to $375) and those registrants not qualifying as a small business or not-for-profit organization by $425 (an increase from $2,575 to $3,000).
Other proposed amendments in the NPRM include:
- Implementing an electronic-only registration fee payment process, based on changes to the payment processes implemented by the Department of Treasury
- Revising requirements to clarify that a Certificate of Registration may be carried in either electronic or paper form, for both motor carriers and those who transport hazardous materials by vessel.
The proposed update to fees will generate the estimated $6.4 million dollars necessary to fund PHMSA’s Hazardous Materials Emergency Preparedness (HMEP) grants program at newly authorized levels in accordance with the Infrastructure Investment and Jobs Act (2021).

Notice of Public Meetings: International Standards on the Transport of Dangerous Goods
PHMSA’s OHMS will be hosting public forums in advance of four international meetings to allow the public to give input on current proposals being considered by the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP) and the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG). The international meetings include:
- ICAO TDG Working Group 24 (WG/24), tentatively scheduled for October, in Montreal, Canada.
- The 65th session of the UNSCOE TDG, scheduled for November 25 to December 3, 2024, in Geneva, Switzerland.
Each of these public meetings will be held approximately two weeks before the corresponding international meeting at U.S. Department of Transportation (DOT) Headquarters in Washington, DC (1200 New Jersey Avenue SE, West Building), with a remote participation option available. Specific information for each meeting, including date, time, conference call-in number, and details for advance registration will be posted when available on PHMSA’s website under “Upcoming Events.”

Fiscal Year 2025 Appropriations Outlook
Another congressional appropriations season is upon us, and the Fiscal Year 2025 debate is shaping up to be a vigorous one, much like last year’s. The roles are reversed, however: this year, the House of Representatives has passed most of its appropriations bills quickly, in sharp contrast to last year when the process was fraught with disagreement that prevented many bills from getting to the floor for a long time. The Senate, which was the quicker of the two chambers last year, is now taking its time to pass appropriations bills.
IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

ASSP Standards-Based Education
The American Society of Safety Professionals (ASSP) will host a third installment of its workplace safety education series called “Stand Up for Standards.” A live two-hour webinar on safety management systems will take place at 11 a.m. CT on March 29, helping safety and health professionals create a road map for identifying hazards and eliminating risks to improve organizational performance.
“Stand Up for Standards: ANSI/ASSP Safety Management Systems” will provide an overview and implementation practices for the ANSI/ASSP Z10.0-2019 standard.
Safety experts Amy Timmerman, M.S., CSP, CHES, Danyle Hepler, CSP, CESCO, CPEA, Joe Wolfsberger, M.S., CSP, CIH, and Greg Zigulis, CSP, CIH, CHSP, will share real-world experiences and practical guidance to help attendees reduce injuries, illnesses and fatalities on work sites across various industries.

CHEMTREC, HMS Training Partner, Adds Courses for IHMM Certificants
This week CHEMTREC has added its HAZWOPER 8-hour Refresher Training to the HMS Daily Training schedule. This HAZWOPER 8-hour Refresher Training is designed for individuals who need to refresh their existing 24-hour or 40-hour HAZWOPER certification. This course meets the requirements outlined in OSHA 29 CFR 1910.120 for 8 (eight) hours of annual refresher training for workers involved in the transport, storage, or handling of hazardous materials or hazardous waste.

Every IHMM certification that requires an examination has a section of its website entitled Examination Preparation.
Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.
You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 420 CHMM applicants IHMM had on July 30, 2024, all 420 applicants looking for CHMM prep courses could see and choose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 420 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.
Earning Certification Maintenance Points [CMPs] is illustrated under Recertification of Your Credential, that includes the Recertification Claims Manual – Appendix A, that details all of the ways a certificant may earn CMPs > https://ihmm.org/recertification-claims/
Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?
HMS has made that simple and easy.

- Scroll down until you see a row of buttons…click on the CMPs button
The system will then generate all of the courses on the HMS E&T platform with IHMM CMPs already attached.
The next developments by the HMS E&T committee will refine available courses’ CMPs by individual credential!
HMS Certified Dangerous Goods Professional [CDGP] Exam Prep
The Columbia Southern University/HMS CDGP prep course is found here on the Hazardous Materials Society [HMS] education and training website > https://hazmatsociety.org/training/ce-1112-cdgp-exam-prep/2022-02-02/
The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
