The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.
76% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

IHMM has produced a crosswalk between 40 CFR § 312.10 Definitions and the CHMM Blueprint that documents how the EPA regulation aligns with the CHMM Blueprint and demonstrates that in each instance the blueprint meets or exceeds 40 CFR § 312.10 Definitions. The EPA definition of an Environmental Professional is in the Federal Register dated November 1, 2005 at page 66080. On that page is the instruction to private certifications being considered Environmental Professionals and how to compare 40 CFR § 312.10 to the certification.
IHMM-AHMP 45 in 5 Credential Recognition During Its First 18 Months
Mark Bruce and Gene Guilford launched 45 in 5 in January 2021, so about 18 months ago. The “45” was a target to add 45 states recognizing our credentials, as we had 5 at the time, and the “5” was for 5 years. How are we doing after the first 18 months? Note: IHMM intends on engaging in this work on behalf of ALL of our credentials.

After having Connecticut, New York, Pennsylvania, Washington, and Indiana, we added Nebraska, Colorado, Minnesota, Arkansas, Oklahoma, Ohio, and California. By the fall of 2021, the group wanted us to focus on federal agencies, so we embarked on some research to add to the 9 agencies that already recognized the CHMM.
The states highlighted in yellow in the map above are where we have legal research being conducted now.
U.S. Small Business Administration Recognizes the IHMM CHMM
SBA’s environmental policies and procedures apply to all SBA Lenders on all 7(a) and 504 loan programs, except where otherwise indicated. For 7(a) loans, failure to comply with the provisions of this paragraph may result in a denial of SBA’s guaranty. Prudent lending practices may dictate additional Environmental Investigations or safeguards. These policies are embodied in SBA SOP 50 10 6, Lender and Development Company Loan Program.
Appendix 4 of the SBA SOP requires that an “Environmental Professional,” as defined by 40 CFR §312.10, perform the Phase 1 or Phase II environmental assessments that may be required prior to closing an SBA-backed loan.
U.S. Army Corps of Engineers Recognizes IHMM CSHM
The U.S. Army Corps of Engineers (USACE) Safety and Health Requirements Manual (EM 385-1-1) is the gold standard for Safety and Occupational Health regulations. The manual holds a long history dating back to 1941 and is designed to facilitate the standardization of all safety programs. The EM 385-1-1 prescribes the safety and health requirements for all Corps of Engineers activities and operations. The USACE is soliciting comments on the proposed revisions to EM 385-1-1. USACE intends to update the manual and periodically thereafter, to reflect such public input, experience, and innovation. The agency will address significant comments received in the next revision of this manual.
USACE EM 385-1-1 is undergoing revisions and recognizes the IHMM Certified Safety and Health Manager [CSHM] credential.
IHMM is submitting comments to the proposed revisions to the EM 385-1-1 to also include the CSMP and CHMM credentials. Comments were due by June 13, 2022 and you will find IHMM’s comments here.
IHMM Seeks New York Dept of Labor Recognition for the CSHM and CSMP
Institute of Hazardous Materials Management [IHMM] is working with the New York State Department of Labor concerning NYS Form SH 890 [4-15] and the references the form makes concerning certain ICR 59 Workplace Safety and Loss Prevention Safety Consultation certifications referenced in Section V, Section VI, and Section VIII of that document and throughout the rest of SH 890 [4-15]
While IHMM has high regard for the CSP, CIH, and other certifications mentioned in SH 890 [4-15], we find that there are two workplace safety and loss prevention certifications missing in the current form. IHMM brought to their attention the Certified Safety and Health Manager® [CSHM®] and Certified Safety Management Practitioner® [CSMP®] credentials.
IHMM thanks Anthony Dellisola, CSHM, for bringing this to our attention. In every instance where we find agencies of government have overlooked our credentials we will work with all of them to bring them up-to-date.
ASTM International Revises Key Standard for Limited Environmental Due Diligence
ASTM International’s environmental assessment, risk management and corrective action committee (E50) has revised its standard practice for limited environmental due diligence.
The standard practice for limited environmental due diligence: transaction screen process (E1528) was first published in 1993 as a way for current or prospective property owners to gather information about potential environmental risks associated with a property believed to present a low risk of potential environmental concerns.
As the standard was designed to be used by non-professionals, part of the revision process included efforts to modernize the standard and make the transaction screen more broadly accessible. Additional revisions include:
- A completely rewritten questionnaire and guide section;
- A revised appendix with new photographs to help preparers fill out the questionnaire; and
- Changes to wording within the standard itself to better highlight the fact it provides no Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) liability protection.
E1528 was developed in tandem with another standard aimed at defining “good commercial and customary practice” for conducting environmental site assessments (E1527), which was also recently revised. In contrast to E1528, E1527 establishes standards for eligibility for CERCLA liability protection.

NPDES BASIC PERMIT WRITERS’ COURSE
Virtual Guided Learning

The U.S. EPA is pleased to announce the opening of registration for the the National Pollutant Discharge Elimination System (NPDES) Basic Permit Writers’ Virtual Guided Learning Course starting on August 18, 2022, with an afternoon session running for five weeks.
The objective of this course is to provide the basic regulatory framework and technical considerations that support the development of wastewater discharge permits required under the NPDES program. The course was designed for permit writers with about six months to one year of experience in the NPDES program, but experienced permit writers wanting a refresher course and other water program staff or interested parties wanting to learn more about the NPDES program also are welcome.
The 5-week course will begin on Thursday, August 18, 2022. Participants should anticipate a time commitment of approximately 8-10 hours per week and should seek supervisor approval before signing up. The course is scheduled to conclude on September 22nd, however a “rain date” of September 29th should be reserved by the participants in case of technical issues.
Each week, participants will have assigned “homework” consisting of NPDES online modules and permit exercises. These modules and exercises will then be discussed in a live virtual classroom setting on Tuesday and Thursday of each week. Participants will have the opportunity to join live office hour discussions with instructors and other participants each Tuesday as well.
Microsoft Teams will be utilized for the virtual classroom and can be accessed through the desktop application or a web browser. Course materials will be provided electronically on the Microsoft Teams classroom site for download by the participants prior to the start date.
As a foundational course, the training does not address in detail specialized topics such as industrial and municipal stormwater, concentrated animal feeding operations, and pesticide discharges. On July 26, 2022, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published the final ruling on Hazardous Materials: Harmonization with International Standards rulemaking, HM-215P. EPA Requires TRI Reporting for Five Additional PFAS
The U.S. Environmental Protection Agency (EPA) issued a final rule on July 18, 2022, updating the list of chemicals subject to toxic chemical release reporting under the Emergency Planning and Community Right-to-Know Act (EPCRA) and the Pollution Prevention Act (PPA). 87 Fed. Reg. 42651. The final rule updates the regulations to identify five per- and polyfluoroalkyl substances (PFAS) that must be reported pursuant to the National Defense Authorization Act for Fiscal Year 2020 (NDAA) enacted on December 20, 2019. According to EPA, as this action is being taken to conform the regulations to a Congressional legislative mandate, notice and comment rulemaking is unnecessary. The final rule will be effective August 17, 2022. For more information, please read the full memorandum.

EPA CSO Tools Published on Website
EPA has posted beta versions of three CSO tools that are intended to help communities with combined sewer overflows and permitting authorities with the planning and management of different aspects of CSO programs. Links to the tools can be found below:
- Long-Term Control Plan (LTCP) Review Checklist: Checklist designed to help CSO permittees and NPDES authorities determine if LTCPs meet the requirements of the CWA and CSO Control Policy, and conform with EPA guidance on developing LTCPs.
- Post-Construction Compliance Monitoring (PCCM) Checklist: Checklist designed to help CSO permittees and NPDES authorities develop and evaluate PCCM programs to meet the requirements of the CWA and CSO Control Policy, and conform with EPA guidance on PCCM.
- Combined Sewer Overflow (CSO) Model for Small Communities: Planning tool for small CSO communities that want a reasonably simple approach for estimating a CSO occurrence, as well as treated or untreated CSO volume over a 24-hour period, and have limited resources to invest in more advanced CSO monitoring and modeling.
Each tool consists of an interactive spreadsheet, fact sheet or user guide, and two recorded trainings (with the third coming soon). These tools, which are currently in beta test versions, do not present new or changed requirements but rather attempt to help break down information in a more digestible and interactive fashion. EPA is requesting feedback via web form on how to further improve the utility of these tools in the future. Please submit your suggestions by December 31, 2022.

IHMM Launches Scholarship Program
IHMM is pleased to announce the launch of the IHMM Scholarship program.
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

The workshop curriculum is in accordance with 49 CFR § 172.704 for General Awareness, Function-Specific, Safety, and Security Awareness training requirements.

Senate Scrambles Ahead of Summer Escape. While members of the U.S. House of Representatives returned home for the August congressional recess, the U.S. Senate remained in Washington, D.C., this week to wrap up some legislative business before taking a break. This week, the Senate passed legislation providing assistance to veterans exposed to toxic substances, and it also ratified North Atlantic Treaty Organization (NATO) membership for Finland and Sweden. Additionally, Democratic leaders huddled to hammer out final details of the Inflation Reduction Act of 2022 (IRA), the $739 billion reconciliation package that addresses tax reform, climate change, and healthcare costs. Way back when, the IRA was known as the Build Back Better Act (a measure that never passed the Senate), and it was the legislative vehicle for a number of proposals, including plans to enact a federal paid leave program and increase penalties for violations of federal labor laws. While those provisions are not in the IRA, the bill does include Davis-Bacon Act-like prevailing wage requirements tied to tax credits for certain energy-related construction projects. The Senate is expected to vote on the legislation this weekend.
HHS Proposes Nondiscrimination Rule. On August 4, 2022, the U.S. Department of Health and Human Services’ (HHS) Centers for Medicare & Medicaid Services and Office for Civil Rights issued a notice of proposed rulemaking—entitled “Nondiscrimination in Health Programs and Activities”—to amend the implementing regulation for section 1557 of the Affordable Care Act (ACA) regarding nondiscrimination in the delivery of healthcare services. The proposed rule would largely revert to a 2016 regulation that was subsequently revised in 2020. (Both the 2016 and 2020 iterations have been the subject of multiple legal challenges.) According to an HHS fact sheet, and consistent with the Supreme Court of the United States’ decision in Bostock v. Clayton County, Georgia, “[t]he proposed rule codifies protections against discrimination on the basis of sex as including discrimination on the basis of sexual orientation and gender identity.” Comments are due on or before October 3, 2022.
Senate Committee Releases Spending Targets for Labor and Employment Agencies. Late last week, the U.S. Senate Committee on Appropriations released its fiscal year (FY) 2023 bill for Labor, Health and Human Services, Education, and Related Agencies. The bill contains the following funding levels:
- Occupational Safety and Health Administration (OSHA)—$680 million, an increase of $68 million or 11 percent.
- Wage and Hour Division (WHD)—$288 million, an increase of $37 million or 14.8 percent.
- Employee Benefits Security Administration (EBSA)—$218 million, an increase of $32 million or 17.4 percent.
- Office of Federal Contract Compliance Programs (OFCCP)—$120,500,000, an increase of slightly more than $12 million. The accompanying explanatory statement notes, “The Committee is particularly supportive of OFCCP efforts and plans to advance pay equity where significant gender pay inequity persists, leaving full-time working women paid approximately 83 cents of every dollar paid to men, with even larger gaps for working women of color.”
- National Labor Relations Board (NLRB)—$319 million, an increase of $45 million or 16.4 percent. The accompanying explanatory statement notes, “The recommended increase in funding will allow the Agency to rebuild its field staffing level after years of decline, and consistent with prior directives of this Committee.”
Unlike its companion bill in the U.S. House of Representatives, the Senate funding bill does not contain language requiring the NLRB to develop a means for electronic or remote voting for union representation elections. With current federal government funding set to expire on September 30, 2022, the U.S. Congress is expected to turn its attention to appropriations upon returning to Washington, D.C., in early September.
EEOC: New SEP on the Way? The U.S. Equal Employment Opportunity Commission (EEOC) announced this week that on August 22, 2022, in Buffalo, New York, it will hold a listening session titled, “Advancing Racial and Economic Justice in the Workplace.” The session is the first of three meetings the EEOC will hold “to receive public input regarding priorities and activities that should be included in its Strategic Enforcement Plan [SEP] for the next five years.” After the conclusion of the final listening sessions, both in Washington, D.C. (on August 30, 2022, and September 12, 2022), the Commission “will consider the feedback from these sessions and any written input to develop a proposed SEP that will be approved by a vote of the full Commission.” The development of a new SEP will present a significant opportunity for stakeholders to comment on the EEOC’s enforcement priorities. The last SEP was adopted in the fall of 2016.

Every IHMM certification that requires an examination has a section of its website entitled Examination Preparation.
Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.
You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 356 CHMM applicants IHMM had on May 31, 2022, all 356 looking for CHMM prep courses could see and chose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 356 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.
Earning Certification Maintenance Points [CMPs] is illustrated under Recertification of Your Credential, that includes the Recertification Claims Manual – Appendix A, that details all of the ways a certificant may earn CMPs > https://ihmm.org/recertification-claims/
Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?

HMS Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).

Applications for the 2022 HMS Scholarship Awards Now Open
The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
DEADLINE TO SUBMIT SCHOLARSHIP AWARD APPLICATIONS IS December 1, 2022. All submissions and associated materials must be submitted using the online form.
Scholarship Winners Will Be Announced at the HMS Annual Meeting.
