The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.
76% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

At Midway Point, Biden Faces Major Tests On EPA Regulatory Agenda
Midway through President Joe Biden’s term, his administration is facing major political and legal tests as officials work to advance their ambitious regulatory agenda for environmental and climate policy.
Biden took office in 2021 working quickly to sign a series of executive orders aimed at reversing a suite of Trump-era deregulatory policies and replacing them with plans for tough new environmental and climate regulations.
EPA and other agencies are now working to craft those new rules addressing greenhouse gases, water and air quality, PFAS and other industrial chemicals as well as measures to improve permitting.
The administration is also ramping up efforts to address environmental justice concerns, such as increasing use of cumulative risk analysis.
But as Inside EPA’s Outlook 2023 details, officials are also grappling with a series of difficult decisions as they implement the Inflation Reduction Act, one of the president’s signature legislative accomplishments.
The administration is also facing pushback from industry and continued turmoil with environmentalists.
Officials are also facing new political tests as House Republicans prepare an aggressive oversight agenda of EPA and other agencies’ policies. And they are also bracing for upcoming rulings from the conservative Supreme Court regarding clean water and other regulatory issues that could further limit their regulatory authority.

D.C. Circuit Dismisses Industry Challenge To EPA’s PFOA, PFOS Levels
The U.S. Court of Appeals for the District of Columbia Circuit has dismissed the chemical industry’s challenge to EPA’s Safe Drinking Water Act (SDWA) interim health advisory levels (HALs) for the two most-studied PFAS, backing an EPA motion to dismiss the suit before even reaching the merits.
“Petitioner has failed to carry its burden of establishing standing,” the court says in its brief Jan. 23 per curiam order in American Chemistry Council (ACC) v. EPA. “Despite relying on associational standing, petitioner has neither alleged that the challenged conduct affects all of its members nor identified any specific member who would have standing to pursue this action.”
The order continues, “Although petitioner has pointed to alleged harm facing an indirect subsidiary of one of its members, it has not shown that the member itself is suffering any injury or would have standing to sue based on the subsidiary’s alleged injury. . . . Nor has petitioner demonstrated a ‘substantial probability’ that the agency actions challenged here caused the litigation costs that some of its members allegedly face in having to defend against a separate lawsuit.”
The order also dismisses environmentalists’ motion to intervene in the litigation as moot and directs the court clerk to “withhold issuance of the mandate herein until seven days after resolution of any timely petition for rehearing or petition for rehearing en banc.”
The D.C. Circuit’s dismissal of ACC’s challenge comes as the 3rd Circuit is continuing to weigh whether the Chemours Co. can proceed with a similar challenge to a HAL for GenX chemicals, a third type of per- and polyfluoroalkyl substances (PFAS) for which EPA issued SDWA advisory levels.

Regan Said To Be Eyeing Early Departure As Regulatory Agenda Ramps Up
As EPA ramps up its regulatory agenda, Administrator Michael Regan is said to be seriously considering leaving the agency he has led for the first two years of the Biden administration and has been exploring options outside of the federal government, according to a press report, though an agency spokesperson is denying it.
Citing four unnamed sources, Reuters reported Jan. 26 that Regan has been thinking seriously about departing and has been exploring options outside the Biden administration but has not made any decisions.
“No plans imminently, but I do know it’s been on the radar screen for the past few weeks,” one source told the outlet.
EPA did not respond to a request for comment from Inside EPA on Regan’s plans but Regan aide and agency spokeswoman Maria Michalos told Reuters, “The administrator doesn’t have any plans to step down. He’s committed to continuing to advance President [Joe] Biden’s historic climate and environmental agenda.”
Regan is the first Black man to lead the agency and he has focused on Biden’s priorities of addressing environmental justice (EJ) and climate change.
His potential departure comes at a particularly busy time for EPA, which is flush with billions of dollars in new funding through the Bipartisan Infrastructure Law and the Inflation Reduction Act to address climate change and EJ. Further, EPA is set to issue dozens of high-profile rulemakings this year, especially addressing air pollution and greenhouse gas emissions.

EPA opens comment on proposed PM2.5 standards
EPA has published its proposal to tighten federal air quality standards for fine particulate matter (PM2.5) in the Federal Register Jan. 27, opening a 60-day public comment period for input on the controversial plan.
The agency will take comment through March 28 and will likely receive numerous comments from environmentalists and possibly some states seeking to strengthen the plan, while industry groups may oppose any tightening of the national ambient air quality standards (NAAQS) for PM2.5 as unwarranted.
EPA will also separately announce a date for a public hearing on the plan, the agency says.
The proposal, released to the public Jan. 6, would tighten the “primary,” health-based limit for PM2.5 from 12 micrograms per cubic meter (ug/m3) down to a tougher limit in the range of 9 ug/m3 to 10 ug/m3. EPA also solicits comment on a tighter limit as tough as 8 ug/m3 and a weaker limit as high as 11 ug/m3.
EPA does not propose to tighten the daily PM2.5 primary limit of 35 ug/m3, disappointing environmental groups and states that pressed for a tougher limit as low as 25 ug/m3.
Environmentalists are also lobbying EPA to set the annual limit at the lowest end of the range under consideration, at 8ug/m3, pointing to the high public health costs of harm done by PM2.5.

ECHA adds nine hazardous chemicals to Candidate List
The Candidate List of substances of very high concern now contains 233 entries for chemicals that can harm people or the environment. Companies are responsible for managing the risks of these chemicals and must also give their customers and consumers information to use them safely.
Helsinki, 17 January 2023 – ECHA has added nine chemicals to the Candidate List because of their hazardous properties. They are used for example in flame retardants, paints and coatings, inks and toners, coating products, plasticisers and in the manufacture of pulp and paper.

US Department of Labor reminds certain employers to submit required 2022 injury and illness data by March 2, 2023
The U.S. Department of Labor’s Occupational Safety and Health Administration is reminding employers that the agency is collecting calendar year 2022 Form 300A data. Employers must submit the form electronically by March 2, 2023.
Establishments under Federal OSHA jurisdiction can use the ITA Coverage Application to determine if they are required to electronically report their injury and illness information to OSHA. Establishments under State Plan jurisdiction should contact their State Plan.
Employers must connect their Injury Tracking Account to a Login.gov account to submit their 2022 workplace injury and illness data. Watch the video to learn how.

In 2019 Mark Bruce from AHMP and Gene Guilford from IHMM worked on a project to get the Commonwealth of Pennsylvania to recognize the CHMM and CDGT credentials. With Mark’s work on the ground in Pennsylvania, we succeeded.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
In January 2021 Mark at AHMP and Gene at IHMM has launched 45 in 5, getting the other 45 states to recognize our credentials in 5 years. If we can find a volunteer like Mark in other states [see above] we can work with those volunteers on crafting the right message to the right agencies in state governments across the country. If we find enough volunteers we can get this done in less than 5 years.
In January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together
IHMM Scholarship Program
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

IHMM – 26 Fellows Are Mentors
IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to provide instruction to the more than 75 IHMM Fellows in becoming mentors.
Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities.
IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

Retiring? IHMM Invites You to Become an Emeritus
You may have decided, after a long and successful career, to retire from active daily duty. Congratulations. That doesn’t mean you have to completely disengage from your profession. IHMM is pleased to offer Emeritus status to all certificants who will no longer be actively engaged in their communities of practice but who still want to stay in touch. POTUS Re-ups Labor Nominees. This week, President Biden renominated Jessica Looman to serve as administrator of the U.S. Department of Labor’s (DOL) Wage and Hour Division and José Javier Rodriguez to serve as assistant secretary of labor and head of the Employment and Training Administration (ETA). Both Looman and Rodriguez were previously nominated in the 117th Congress, but they were obviously not confirmed before the congressional session adjourned. Looman has been serving in an acting capacity as the de facto administrator since the beginning of the Biden administration. If confirmed, Looman will play an important role in the DOL’s pending changes to the overtime rules and independent contractor test under the Fair Labor Standards Act.
Federal Contractors: Are You on the List? Late last week, the Office of Federal Contract Compliance Programs released its Corporate Scheduling Announcement List of federal contractors and subcontractors that are subject to compliance reviews. According to OFCCP, this time around, “OFCCP selected federal contractors and subcontractors that are required to maintain an Affirmative Action Program (AAP) but did not complete their mandatory annual certification in the OFCCP Contractor Portal as of December 1, 2022.” Cameron W. Ellis and Lauren B. Hicks have all the details.
EEOC Updates Resource on Accommodating Individuals With Hearing Disabilities. On January 24, 2023, the U.S. Equal Employment Opportunity Commission (EEOC) announced updates to its resource document, “Hearing Disabilities in the Workplace and the Americans with Disabilities Act [ADA].” According to a press release from the Commission, “The document outlines how certain pre- and post-job offer disability-related questions can violate the ADA, describes easy-to-access technologies that can make providing a reasonable accommodation for a hearing disability free or low-cost, addresses employer concerns about safety, and shares realistic scenarios of potential discrimination.”
FTC Mission Creep? The Federal Trade Commission’s (FTC) proposal to ban noncompete agreements continues to be a major topic of debate in Washington, D.C. In fact, one of the arguments that the business community is making against the proposal—that allowing the FTC to regulate in this area would open the floodgates to allow the Commission to intervene in countless commercial issues—is already beginning to materialize. Recently, fifty Democratic senators and representatives sent a letter to President Biden asking the administration to take action to address “soaring rent prices.” The letter urges the president to direct “the Federal Trade Commission to issue new regulation defining excessive rent increases as a practice that unfairly affects commerce and enforce action against unfair rent gouging practices.” Of course, the FTC has taken no action on this issue, but the letter is indicative of legislators’ views on the role of the agency. Comments on the FTC’s proposed noncompete ban are due on March 20, 2023.
PBGC Finalizes Withdrawal Liability Rule Relating to SFA Recipients. On January 26, 2023, the Pension Benefit Guaranty Corporation (PBGC) published a final rule, effective immediately, relating to withdrawal liability from multiemployer pension plans that receive special financial assistance (SFA) pursuant to the American Rescue Plan Act of 2021. The rule addresses an outstanding issue that PBGC left open for comment following finalization of the underlying SFA rule in July 2022. The rule creates a process by which “a plan sponsor may request an exception from the withdrawal liability conditions by demonstrating to the satisfaction of PBGC that the exception lessens the risk of loss to plan participants and beneficiaries and does not increase expected employer withdrawals.”
GAO Details Pandemic UI Fraud. A recent report from the Government Accountability Office (GAO) finds that from March 2020 through March 2022 the DOL potentially paid out “over $60 billion in fraudulent UI [unemployment insurance] payments.” The report echoes a September 2022 report from the DOL’s Office of Inspector General that detailed the ETA’s payment of more than $45 billion in pandemic-related unemployment insurance payments. The report concludes, “Without an antifraud strategy, DOL is not able to ensure that it is addressing the most significant fraud risks facing the UI system.” As part of its recommendations, the GAO encourages the DOL “to design and implement an antifraud strategy for UI based on a fraud risk profile.”

These workshops are offered with U.S. DOT PHMSA HMIT (Hazardous Materials Instructor Training) Grant support to the National Partnership for Environmental Technology Education (National PETE). This training is FREE for employees and federal, state, county, and local government employees involved in DOT HazMat Shipping, Receiving and Handling via Ground, Air, and Vessel Transportation.
The workshop curriculum is in accordance with 49 CFR § 172.704 for General Awareness, Function-Specific, Safety, and Security Awareness training requirements. Class size is limited to 10-15 students with mask/social distancing protocols, so act fast. Minimum of 6 attendees is needed to confirm the class.

Course Length: Thirty (30) hours of guided coursework completed over 5-weeks (participants work independently on their own time, but must meet required, paced milestones).

The global hazardous materials safety system depends heavily on the training of employees responsible for preparing, loading, unloading and transporting these commodities around the world. This course, coming soon to FSW, will provide tools and guidance on how to plan, develop and deliver a hazardous materials training program for your company’s employees.
Whether you are trying to improve your skillset for the job that you have, or trying to increase your capabilities for your next job, this course will help you play an integral role in the safe transport of goods around the world. In addition to hazmat general awareness training, this course will provide guidance on adult learning philosophies, course development tools and evaluating your company’s operations to meet the regulatory requirements for hazmat training.

Every IHMM certification that requires an examination has a section of its website entitled Examination Preparation.
Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.
You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 397 CHMM applicants IHMM had on August 31, 2022, all 397 looking for CHMM prep courses could see and chose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 397 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.
Earning Certification Maintenance Points [CMPs] is illustrated under Recertification of Your Credential, that includes the Recertification Claims Manual – Appendix A, that details all of the ways a certificant may earn CMPs > https://ihmm.org/recertification-claims/
Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?

HMS Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).

Applications for the 2023 HMS Scholarship Awards Now Open
The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
DEADLINE TO SUBMIT SCHOLARSHIP AWARD APPLICATIONS IS December 1, 2023. All submissions and associated materials must be submitted using the online form.
Scholarship Winners Will Be Announced at the HMS Annual Meeting.
