IHMM, ISF Advocacy for U.S. Chemical Board Funding
As we reported last week, the Trump Administration has proposed to close the U.S. Chemical Safety Board [CSB].
IHMM met with the Intersociety Forum last week and presented the attached letters for the roughly 50 other organizations in the ISF to sign on as well. That process started today. AIHA will sign on, and Larry Sloan is joining me to ask others to do the same.
If anyone has any issues with these letters, which are identical except for the addressees, please let me know by Friday, August 15, 2025.

The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

PHMSA’s ANPRM: Mandatory Regulatory Reviews – IHMM Seeks Certificant Input
Deadline: July 31, 2025
On June 4, 2025, the Department of Transportation (DOT) issued an Advance Notice of Proposed Rulemaking (ANPRM) – Hazardous Materials: Mandatory Regulatory Reviews to Unleash American Energy and Improve Government Efficiency.
Summary: PHMSA is publishing this advance notice of proposed rulemaking (ANPRM) to solicit stakeholder feedback on whether to repeal or amend any requirements in the Hazardous Materials Rulemaking Procedures and Program Procedures, or the Hazardous Materials Regulations to eliminate undue burdens on the identification, development, and use of domestic energy resources and to improve government efficiency.
This ANPRM supports opportunities to identify widely used hazardous material special permits with established safety records for conversion into deregulatory provisions with broader applicability.

Lithium Battery Air Safety Advisory Committee Concludes
The Lithium Battery Air Safety Advisory Committee (Committee) was disbanded on May 9, 2025, as required by statute. The Committee met biannually for five years and facilitated communication between the Department and representatives from a diverse group of lithium battery stakeholders, including battery and product manufacturers, air carriers, pilots, and shippers.
The Committee provided a forum for discussing new technologies and transportation safety practices, receiving feedback for discussions at international forums, and offered mechanisms to increase awareness of relevant transport requirements and incidents involving lithium batteries in air transport.
PHMSA extends its appreciation to the members of the Committee whose expert insights, collaborative spirit, and commitment to safety provided outputs that have informed policy and helped advance practical solutions to complex safety challenges.

Hazardous Materials Deregulatory NPRMs
On July 1, 2025, PHMSA published 17 new Notice of Proposed Rulemaking (NPRM) documents in the Federal Register. These NPRMs are part of a DOT-led effort to eliminate outdated, unnecessary, and overly burdensome regulatory requirements within the Hazardous Materials Regulations (HMR). The comment period for these NPRMs closes on September 2, 2025. This list of NPRMs includes:
- HM-268A: Reducing Burdens on Domestic Aerosol Shippers Proposes to revise the aerosol definition in § 171.8 to remove the requirement that it contain a liquid, powder, or paste. This would let small quantities of gas be shipped in aerosol containers instead of more costly cylinders or needing a special permit, aligning with international standards—helping U.S. companies compete globally.
- HM-268B: Reducing Costs to Domestic Shippers and Carriers of Limited Quantities Proposes allowing a smaller limited quantity marking in § 172.315(a)(2), reducing packaging and labeling costs and helping carriers move more packages per trip.
- HM-268C: Reducing Burdens on Domestic Companies Using Battery-Powered Equipment in Trades Proposes updating § 173.6 to increase the amount of lithium batteries allowed under the Materials of Trade (MOTs) exception. This would help companies using battery-powered equipment, like landscapers, to transport needed tools.
- HM-268D: Hazardous Materials: Reducing Burdens to Domestic Carriers Proposes allowing emergency response information to be displayed electronically, removing the current requirement for printed copies and easing compliance for shippers.
- HM-268E: Remove Redundant List of U.S. EPA CERCLA Hazardous Substances Proposes referencing the
40 CFR § 302.4 hazardous substance list instead of duplicating it, eliminating 27 pages of duplicative regulatory text in the 49 CFR. - HM-268F: Reducing Burdens by Allowing Continued Use of DOT Special Permit Packaging Proposes allowing the continued use of DOT special permit packaging for its full lifespan, even if the permit is not renewed or the original holder no longer exists.
- HM-268G: Improving Efficiencies for Special Permits and Approvals Renewals Proposes removing the rule requiring special permit renewal applications sixty days before expiration. This would reduce paperwork and allow permit use provided the renewal is filed before expiration.
- HM-268H: Modernizing Payments to and From America’s Bank Account Proposes requiring electronic payment for registration fees, eliminating outdated provisions allowing certified checks to improve payment efficiency.
- HM-268I: Removing Paperwork Burdens on Domestic Motor Carriers Proposes removing the requirement in § 107.620 for motor and vessel carriers to carry paper copies of their registration. Digital verification would be allowed as an additional option, reducing unnecessary paperwork.
- HM-268J: Reduce Training Burdens for American Farmers Proposes raising the income threshold for farmers exempt from security training from $500,000 to $825,000 to reflect inflation and ease burdens on small and mid-size farms.
- HM-268K: Removing Burdensome Rail Reporting Requirements Proposes removing outdated rail regulations and reporting requirements, such as references to steam-era materials and unnecessary reporting to non-federal groups like the Bureau of Explosives.
- HM-268L: Adopt DOT Special Permits 12412 and 11646 into the HMR Proposes adopting special permits allowing DOT-specification intermediate bulk containers (IBC) and drums to be unloaded while still on transport vehicles when specific safety control measures are followed, easing burdens for various small businesses.
- HM-268M: Adopt DOT-SP 21287 into the HMR Proposes adopting a special permit allowing small refrigerating machines with low-risk flammable gases (A2L) to be transported like non-flammable refrigerant gasses, easing compliance burdens.
- HM-268N: Adopt DOT-SP 21379 into the HMR Proposes adopting a special permit allowing large refrigerating systems with A2L gases to be transported under the same rules as systems using non-flammable refrigerant gases, reducing compliance burdens.
- HM-268O: Adopt DOT-SP 14175 into the HMR Proposes extending the requalification interval for certain gas cylinders from 5 to 10 years, reducing testing costs for companies using these cylinders.
- HM-268P: Adopt DOT-SP 21478 into the HMR Proposes allowing empty IBCs with only residue to be transported like non-bulk packages, reducing costs for the IBC reconditioning industry.
- HM-268Q: Allow Fireworks Certification Agencies (FCAs) to Approve Professional Fireworks Proposes allowing
FCAs to approve both consumer and professional fireworks, speeding up approvals and easing the workload on federal staff.

Dept of Labor – OSHA – July 1 FR – IHMM Collects Comments
On July 1, 2025, the U.S. Department of Labor’s Occupational Safety and Health Administration [OSHA] published 4 rulemakings for public comment. IHMM is requesting certificant input into whether we should submit comments on one or more of these proposal rulemakings and what we should submit. Each proposed rulemaking is briefly described below.

USDOL – OSHA – Rescission of Coordinated Enforcement Regulations
Deadline: September 2, 2025
The Department of Labor (the Department or DOL) proposes to remove the regulations that set forth the procedures within the Department for the coordination of enforcement activities by the Wage and Hour Division (WHD), the Occupational Safety and Health Administration (OSHA), and the Employment and Training Administration (ETA) relating to migrant farmworkers. The Department is proposing this removal because these regulations limit the Department’s discretion, impose unnecessary and duplicative internal procedures, and prevent the Department’s agencies from coordinating with regard to migrant farmworkers in more efficient, effective ways. PHMSA Announces Public Meetings For International Standards On The Transport Of Dangerous Goods
The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced on March 12, 2025, that its Office of Hazardous Materials Safety (OHMS) will host four public meetings during 2025 in advance of certain international meetings. The second meeting will be held in preparation of the 66th session of the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) scheduled for June 30 – July 4, 2025, in Geneva, Switzerland. The third meeting will be held in preparation of the 30th session of the ICAO DGP (DGP/30) scheduled for October 6 – 10, 2025, in Montreal, Canada. The fourth meeting will be held in preparation of the 67th session of the UNSCOE TDG scheduled for November 24 – December 3, 2025, in Geneva, Switzerland. PHMSA will solicit public input on current proposals for each of these meetings. PHMSA states that each public meeting will take place approximately two weeks preceding the international meeting at the headquarters for the Department of Transportation in Washington, D.C.

NEPA Narrowed: Implications of the Supreme Court’s Uinta Basin Railway Decision
The Supreme Court’s Seven Counties decision narrows NEPA’s scope by limiting required environmental reviews to impacts within an agency’s regulatory authority. This decision will likely shift, rather than eliminate, litigation risk and reinforces the role of state and local laws in shaping project outcomes.
Considered the “Magna Carta” of environmental law, the National Environmental Policy Act (NEPA) requires that agencies incorporate environmental considerations into major federal actions. While NEPA does not impose substantive environmental constraints on federal projects, it does require that agencies take a “hard look” at the potential impacts of projects and engage in a transparent decision-making process. Over time, litigation has expanded the scope and complexity of environmental reviews, which has prolonged the process and elevated compliance costs. This has raised the question of whether NEPA has evolved from a public disclosure law to a tool used to block projects altogether. This tension was central to the May 2025 decision in Seven County Infrastructure Coalition v. Eagle County, in which the Supreme Court addressed the question of how far agencies must go when evaluating the environmental effects of major federal infrastructure in the NEPA review process.

2025 has been a busy year for extended producer responsibility (EPR) policy, especially for packaging and paper products. States have enacted new EPR programs and laws to assess the need for EPR. Funding the Future

Most of us would agree that this year has been a trying one. Drastic cuts to NIOSH and the continuing threats to the agency’s funding jeopardize, among other things, the Education and Research Centers that support so many students in industrial hygiene and occupational and environmental health and safety. So it was especially heartening to learn earlier this month that the Board of Certified Safety Professionals (BCSP) Foundation was making an extremely generous donation of $325,000 to the American Industrial Hygiene Foundation.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

IHMM Foundation Certified Dangerous Goods Professional [CDGP] Exam Prep
The Columbia Southern University/HMS CDGP prep course is found here on the IHMM Foundation website > https://hazmatsociety.org/training/ce-1112-cdgp-exam-prep/2022-02-02/
The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
