The IHMM Associate Safety and Health Manager™ [ASHM™] credential demonstrates a personal commitment to professional excellence in advancing the global environmental, health, and safety communities of practice. Earning recognition as an ASHM demonstrates a high level of knowledge, expertise, and excellence in workplace safety management.
There are new, unique features of the ASHM, as follows:
- Your ASHM is only a transitional credential active for 4 years from the date of issuance, during which time you will need to take the CSHM examination. If you do not take the CSHM within the 4 years, then after 4 years your ASHM is decertified. You may take the CSHM examination in as little as 2 years from your date of ASHM certification.

IHMM Launches New Certified Safety Management Practitioner™ [CSMP™] Exam
The Certified Safety Management Practitioner [CSMP] Scheme Committee, chaired by Kirk Rains, CSMP, is pleased to announce that it has completed and launched a new CSMP examination. The committee completed its total revision of the CSMP blueprint in February of 2022 and now releases its new exam aligned with the new blueprint. Congratulations to the CSMP Scheme Committee for completing a long but important process to bring the CSMP credential up-to-date!
Over in IHMM’s Foundation, HMS, we have added education and training programs specifically for the CSMP credential, all with IHMM’s recertification certification maintenance points [CMPs] assigned. You can learn more about the courses IHMM has for the CSMP here.

On December 3, 1984 the Institute of Hazardous Materials Management was created with the Certified Hazardous Materials Manager® [CHMM®] credential. John H. Frick, Harold M. Gordon, John J. McCambridge, and Richard A. Young created what would become an Institute that offers 11 professional credentials across Hazardous Materials/Dangerous Goods and EHS Work Place Safety communities of practice in all 50 of the United States and 85 other countries.

Excellence in EHS Management Award – LAST CHANCE TO NOMINATE!
The Excellence in EHS Management Award recognizes an individual who has excelled in their role as an EHS manager. The Institute for Hazardous Materials Management [IHMM] will present the award at the annual National Safety Council Expo.
The honoree will receive a commemorative plaque and be recognized in a press release and IHMM member communications. Travel expenses to the award ceremony will be subsidized. If traveling from overseas IHMM will pay travel expenses from the nearest port of entry.

The Dr. John H Frick Memorial IHMM Scholarship Program – Deadline 10/18/2024
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

IHMM – 26 Fellows Are Mentors
IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to engage both 26 IHMM Fellows as Mentors and anyone who seeks some assistance as Mentees.
Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities. This article from ASAE magazine outlines how a mentoring program can become more successful – engagement!
IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

IHMM Proposes Changes in Government Recognition of Credentials
IHMM Signs Letter Opposing Reductions in OSH Worker’s Pay – The IHMM Government Affairs Committee has agreed to sign a coalition letter opposing reductions in pay for IH and OSH employees. Here is the coalition letter we signed.
IHMM submitted comments on OSHA Advisory Committee on Construction Safety and Health (ACCSH): Notice of Meetings concerning OSHA-2024-0002-0007, and highlighted the creation of IHMM’s Certified Pandemic Preparedness Specialist [CPPS] credential.
State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation, work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.
Beltway Buzz – Ogletree Deakins
Biden Out, Harris In. On July 21, 2024, President Joe Biden announced that he would not run for a second term. Vice President Kamala Harris is now the presumptive Democratic nominee going into the November elections, which are 102 days away. Here is what we know about Vice President Harris, gleaned mostly from her presidential campaign and 2017-2021 time in office as senator from California.
- Traditional Labor. Labor unions are already lining up behind Harris, and the AFL-CIO has endorsed her, calling her “a true partner in leading the most pro-labor administration in history.” Harris chaired the White House Task Force on Worker Organizing and Empowerment, which was instructed to “identify statutory, regulatory, or other changes that may be necessary to make policies, practices, and programs more effective means of supporting worker organizing and collective bargaining.” Harris also cosponsored the Protecting the Right to Organize Act of 2019 (PRO Act) during her time in the U.S. Senate.
- Equal Pay. In 2019, while running for president, Harris advocated for a plan that would require employers to obtain an “Equal Pay Certification” that would require employers to “demonstrate they have eliminated pay disparities between women and men who are doing work of equal value.” Companies that fail to comply would “be fined 1% of their profits for every 1% wage gap they allow to persist for work of equal value.” Harris would impose this plan on federal contractors via executive order if the U.S. Congress does not pass a bill.
- Paid Leave. Harris was a cosponsor of the Family and Medical Insurance Leave (FAMILY) Act, which is a version of the Family and Medical Leave Act (FMLA) that would provide paid leave.
- Immigration. Harris was a cosponsor of the Development, Relief, and Education for Alien Minors (DREAM) Act, which would provide a path to lawful permanent residency for certain undocumented immigrants who were brought to the United States as children.
NLRB News. It was a busy week for traditional labor-related matters.
- NLRB Finalizes “Fair Choice” Rule. On July 26, 2024, the National Labor Relations Board (NLRB) issued its final “Fair Choice–Employee Voice Final Rule.” The rule rescinds a 2020 NLRB rule and, despite its name, takes away secret ballot elections from employees in certain situations. More specifically:
- The final rule restores the NLRB’s “blocking charge” policy, which allows unions to delay or postpone elections by making unfair labor practice allegations against employers. This blocking charge policy frustrates employee free choice by delaying or denying employees access to secret ballot elections. Unions use this strategy most effectively in decertification elections to deny employees the opportunity to remove the union as their bargaining representative.
- The rule also prohibits employees from voting in an NLRB-supervised secret ballot election to determine whether there is majority support in situations in which the employer voluntarily recognizes the union as the exclusive bargaining representative.
- The rule undercuts employee free choice in the construction industry by allowing Section 8(f) prehire agreements to be converted to Section 9(a) agreements even without positive evidence of majority employee support.
The rule becomes effective September 30, 2024. The rule is also potentially eligible for rescission by the 119th Congress pursuant to the Congressional Review Act.
- NLRB Withdraws Joint-Employer Appeal. Late last week, the NLRB withdrew its appeal of the March 8, 2024, decision by the U.S. District Court for the Eastern District of Texas vacating the Board’s 2023 joint-employer rule. This means that the Board’s 2020 joint-employer rule, which requires substantial control over essential employment terms for joint-employment status, remains in place.
- Chair McFerran’s Renomination. The business community continues to keep a watchful eye on a potential hearing and/or confirmation vote on the renomination of NLRB Chair Lauren McFerran. On August 1, 2024, the U.S. Senate Committee on Health, Education, Labor and Pensions (HELP) will vote on the nominations of McFerran and Joshua L. Ditelberg to be members of the NLRB (as well as Mark G. Eskenazi to be a member of the Occupational Safety and Health Review Commission). Next week is the Senate’s last week in D.C. before breaking for its scheduled August recess. So if the HELP Committee advances the nominees, a full Senate vote isn’t expected until at least September.
Pennsylvania Court Rejects Motions to Enjoin FTC’s Non-compete Ban. This week, the U.S. District Court for the Eastern District of Pennsylvania rejected a tree service company’s motion to enjoin and stay the effective date of the Federal Trade Commission’s (FTC) rule banning non-compete agreements. The court rejected the plaintiff’s arguments “that the FTC lacks substantive rulemaking authority under its enabling statute, that the FTC exceeded its authority, and that Congress unconstitutionally delegated legislative power to the FTC.” The ruling sets the stage for a potential circuit split, as earlier this month, the U.S. District Court for the Northern District of Texas enjoined the rule as applied to the particular plaintiffs. EPA Begins 90-Day Comment Period on Proposed High-Priority Substance Designations for Five Chemicals
The U.S. Environmental Protection Agency (EPA) announced on July 25, 2024, that it is proposing to designate acetaldehyde, acrylonitrile, benzenamine, vinyl chloride, and 4,4-methylene bis(2-chloroaniline) (MBOCA) as high-priority substances (HPS) for risk evaluation under the Toxic Substances Control Act (TSCA). 89 Fed. Reg. 60420. EPA is providing a 90-day comment period, during which interested persons may submit comments on the proposed designations of these chemicals as HPSs for risk evaluation. EPA states that it is interested in comments that would inform the exposure and hazard assessments and the identification of conditions of use (COU) for these chemicals.
Comments are due October 23, 2024.
As reported in our December 27, 2023, memorandum, in December 2023, EPA began the process to prioritize these five chemicals for risk evaluation. EPA requested relevant information for each, including but not limited to, the chemical’s hazard and exposure potential; the chemical’s persistence and bioaccumulation; potentially exposed or susceptible subpopulations relevant to the prioritization; whether there is any storage of the chemical near significant sources of drinking water; the chemical’s COUs or significant changes in COUs, including information regarding trade names; the chemical’s production volume or significant changes in production volume; and any other information relevant to the potential risks of the chemical that might be relevant to the designation of the chemical’s priority for risk evaluation. Professional Certification Coalition
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis. The PCC has compiled several “Watchlists” identifying and analyzing provisions in pending legislation at both the state and federal level that, under applicable rules, may still be enacted in the current legislative session. Depending on the carry-over rules in the relevant legislature, the charts listing current legislation may include bills introduced in a prior year. In addition, the PCC compiles a chart of enacted legislation that affects certification each year. The charts include hyperlinks to every bill or executive order. Note that the Watchlist and the Enacted Legislation document do not include profession-specific legislation and do not include regulatory initiatives. The charts will be updated as needed based on new developments.

Tomorrow’s Workforce Coalition – Senate Action On IHMM-Supported Legislation
In related legislative news, the Senate Appropriations Committee included ASAE-drafted language in its Veterans Administration funding bill to study the prevalence and impact of high-quality postsecondary credentials among military veterans.
Here is the language:
Postsecondary Credentials Among Veterans.—The Committee directs the Comptroller General to report on the prevalence of high-quality postsecondary credentials among veterans. The report shall include the number of veterans who hold a high-quality postsecondary credential, the number of those veterans who obtained such a credential during their military service, the number of those veterans who obtained such a credential after their military service, an earning comparison between veterans with and without such credentials who are working in similar industries and occupations, the rate of business ownership among veterans with and without such credentials, the average cost and time needed for veterans to obtain such credentials, and recommendations for how to increase veterans’ access to such credentials. The Comptroller General shall consider credentials that are: (i) included on a State list described in section 122(d) of the Workforce Innovation and Opportunity Act 28 (29 U.S.C. 3152(d)); (ii) in compliance with the quality assurance requirements for a credentialing program under 10 U.S.C. 2015(c) (i.e., the COOL directory); (iii) approved by the State approving agency according to the Department of Veterans Affairs WEAMS database; (iv) accredited by the Institute for Credentialing Excellence, the National Commission on Certifying Agencies, the American National Standards Institute, or other reputable accrediting bodies; and (v) meet other standards for quality determined by the Departments. The Comptroller General shall provide a report to the Committees on Appropriations of both houses of Congress no later than 1 year after the enactment of this act.

NIOSH Mental Health Resources
NIOSH launched an Impact Wellbeing Guide: Taking Action to Improve Healthcare Worker Wellbeing. This Guide offers six concrete Action Steps that hospital leaders can take to accelerate or supplement professional well-being efforts in their hospitals. It was developed in partnership with the Dr. Lorna Breen Heroes Foundation and tested in six CommonSpirit hospitals across the U.S.
Government Shutdown Threat Looms in September
The House adjourned last Thursday until mid-September with only five of 12 annual spending passed, ensuring that a short-term continuing resolution will be needed to avoid a government shutdown at the end of September.
What’s next: The Senate hasn’t passed any spending bills and will be adjourned next week. Speaker Mike Johnson (R-LA) vowed earlier in the year not to pass any more stopgap funding bills but will have little choice when Congress is back in session.
- Johnson has reportedly not decided whether he prefers the House to pass a CR until December or January.
Some House conservatives want to push it to January when they hope former President Trump will be back in office.
What they’re saying: “There’s a lot of different ideas on the table and we’re trying to work through that – what makes the most sense,” Johnson said. “There’s good arguments for different approaches.”
EPA Finalizes Changes to the e-Manifest Regulations
On July 26, 2024, EPA finalized amendments to the manifest regulations for shipments of hazardous waste and polychlorinated biphenyls that are transported for treatment, storage, and disposal.
This rule is intended to reduce the reporting burden on industry and states, increase information availability, improve compliance monitoring, and prepare for future potential integration with biennial reporting requirements. EPA aims to modernize and streamline the manifest process, increasing expected benefits of the e-Manifest system and encouraging further adoption of electronic manifests through increased utility of the system.
OSHA Emergency Response Standard Hearing
The Occupational Safety and Health Administration (OSHA) issued a notice scheduling an informal public hearing on its proposed rule ‘‘Emergency Response Standard’’ mentioned in the email below. The public hearing will begin on November 12, 2024, at 9:30 a.m., Eastern Time (ET), and will be held virtually. Information on how to access the informal hearing will be posted shortly at https://www.osha.gov/emergency-response/rulemaking.

The End of the Chevron Doctrine and the Reassertion of Judicial Primacy in Reviewing Federal Regulatory Actions

National Emission Standards for Hazardous Air Pollutants From Hazardous Waste Combustors Malfunction and Electronic Reporting Amendments
The Environmental Protection Agency (EPA) is proposing to amend the National Emission Standards for Hazardous Air Pollutants (NESHAP) from Hazardous Waste Combustors (HWC) to remove the exemptions and revise other provisions associated with emission standard exemptions for periods of malfunction, to add electronic reporting provisions, to amend emergency safety vent provisions, and to correct other minor provisions. The removal of the exemption for periods of malfunction is predicated on the previous vacatur of emission standard exemptions for periods of startup, shutdown, and malfunction (SSM) from the applicable general provisions. We are also proposing to remove or revise some associated requirements that are unnecessary, inappropriate, or redundant in the absence of the malfunction exemption, such as in recordkeeping and reporting. Emission standards will apply during periods of malfunction as required under the Clean Air Act (CAA). The addition of electronic reporting provisions will provide for simplified reporting by sources and will enhance the availability of data on sources to the EPA and the public. In addition, the EPA is proposing amendments to emergency safety vent provisions and one correction to the rule to correct an inadvertent error in the Code of Federal Regulations (CFR) related to the use of Method 23 to determine compliance with the dioxin and furan standards.

Revised Z359 Standard Provides Guidance on Managed Fall Protection Programs
ANSI/ASSP Z359.2-2023, “Minimum Requirements for a Comprehensive Managed Fall Protection Program,” sets the baseline for all fall protection programs. OSHA Heat Standard Coming
The Occupational Safety and Health Administration (OSHA) has released a proposed rule that would protect approximately 36 million workers in indoor and outdoor work settings from extreme heat. The proposed rule would require employers to develop an injury and illness prevention plan to control heat hazards in workplaces affected by excessive heat. Among other things, the plan would require employers to evaluate heat risks and — when heat increases risks to workers — implement requirements for drinking water, rest breaks and control of indoor heat. It would also require a plan to protect new or returning workers unaccustomed to working in high heat conditions.
Perhaps the biggest takeaway is a new requirement that affected employers (there’s a list of exemptions, which are mostly office and telework employee related) must develop and deploy a written heat safety plan. Once the formal proposal is published, there will be a comment period and plenty of opportunity to provide feedback to OSHA before any rule is finalized.
Attention Transporters of Hazardous Materials: PHMSA Proposes Registration Fee Updates
PHMSA
In an NPRM, the agency, to account for what it contends are increased transport of hazardous materials as well as what it says are the burdens such transport places on first responders, proposes updates to the registration fees under the statutorily mandated registration and fee assessment program for persons who transport, or offer for transportation, certain categories and quantities of hazardous materials.
PHMSA’s proposed rulemaking would increase the annual fee by $125 for those registrants qualifying as a small business or not-for-profit organization (an increase from $250 to $375) and those registrants not qualifying as a small business or not-for-profit organization by $425 (an increase from $2,575 to $3,000).
Other proposed amendments in the NPRM include:
- Implementing an electronic-only registration fee payment process, based on changes to the payment processes implemented by the Department of Treasury
- Revising requirements to clarify that a Certificate of Registration may be carried in either electronic or paper form, for both motor carriers and those who transport hazardous materials by vessel.
The proposed update to fees will generate the estimated $6.4 million dollars necessary to fund PHMSA’s Hazardous Materials Emergency Preparedness (HMEP) grants program at newly authorized levels in accordance with the Infrastructure Investment and Jobs Act (2021).

Notice of Public Meetings: International Standards on the Transport of Dangerous Goods
PHMSA’s OHMS will be hosting public forums in advance of four international meetings to allow the public to give input on current proposals being considered by the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP) and the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG). The international meetings include:
- ICAO TDG Working Group 24 (WG/24), tentatively scheduled for October, in Montreal, Canada.
- The 65th session of the UNSCOE TDG, scheduled for November 25 to December 3, 2024, in Geneva, Switzerland.
Each of these public meetings will be held approximately two weeks before the corresponding international meeting at U.S. Department of Transportation (DOT) Headquarters in Washington, DC (1200 New Jersey Avenue SE, West Building), with a remote participation option available. Specific information for each meeting, including date, time, conference call-in number, and details for advance registration will be posted when available on PHMSA’s website under “Upcoming Events.”
2024-2025 Hazardous Materials Registration Brochure
Offerors and transporters of certain quantities and types of hazardous materials are required to file an annual registration statement with DOT and pay a designated fee. These fees are used to fund PHMSA’s Emergency Preparedness grants, which support hazardous materials emergency response planning and training activities by states, local governments, and Native American Tribes.
This brochure, updated for the 2024-2025 registration year, details PHMSA’s Hazmat Registration program by explaining who must register, and when and how to register, and providing key dates, registration cost, and other important information.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?
HMS has made that simple and easy.

The system will then generate all of the courses on the HMS E&T platform with IHMM CMPs already attached.
The next developments by the HMS E&T committee will refine available courses’ CMPs by individual credential!
HMS Certified Dangerous Goods Professional [CDGP] Exam Prep
The Columbia Southern University/HMS CDGP prep course is found here on the Hazardous Materials Society [HMS] education and training website > https://hazmatsociety.org/training/ce-1112-cdgp-exam-prep/2022-02-02/
The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
