The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.
76% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

IHMM and American Industrial Hygiene Association Sign Memorandum of Understanding
The two organizations will collaborate on planning, developing, and disseminating joint occupational and environmental health education programs
Rockville, Maryland. (March 13, 2023) – IHMM has signed a Memorandum of Understanding with the American Industrial Hygiene Association, entering a three-year agreement to enhance and promote the roles of professionals in fields represented by both organizations: that is, occupational and environmental health and safety and hazardous materials management. The MoU inaugurates a partnership that aims to advance the professionalism and practice of hazardous materials management, workplace health and safety, and industrial hygiene. Specifically, the two organizations will collaborate on planning, developing, and disseminating joint occupational and environmental health education programs and will also promote their partner’s products and services to their respective members.
“We’re delighted to take this important step to formalize an existing and productive relationship between AIHA and IHMM,” said Lawrence D. Sloan, AIHA’s CEO. “This agreement provides new opportunities to strengthen our cooperation in continued education and certification maintenance for Certified Industrial Hygienists and IHMM professionals.”
According to the Executive Director of IHMM, Eugene A. Guilford Jr., CAE, several of the organization’s credential blueprints have industrial hygiene components. These include the Certified Hazardous Materials Manager, Certified Hazardous Materials Practitioner, Certified Safety and Health Manager, and Certified Safety Management Practitioner credentials. “Our credentials are stronger for access to AIHA’s education and training assets,” he said.

Hundreds of Incidents of Lost Nuclear and Radioactive Material Logged in Latest CNS Trafficking Database
The latest edition of the Global Incidents and Trafficking Database, produced by the James Martin Center for Nonproliferation Studies (CNS) exclusively for NTI, documents 352 incidents of nuclear and radiological material outside of regulatory control between 2020-2021. The Global Incidents and Trafficking Database is the only publicly available account of incidents involving nuclear and other radioactive materials. It aims to give researchers and policymakers a comprehensive picture of the amount and types of incidents that occur, from which they can develop data-driven policy solutions. CNS has logged more than 1,500 global incidents since the database was launched in 2013, emphasizing that the security of nuclear and radioactive materials remains a persistent global safety and security concern.

USDOT’s Federal Railroad Administration Announces New Safety Initiative with a Focus on Hazardous Materials
Federal Railroad Administration (FRA) Administrator Amit Bose today announced a national initiative for focused inspections on routes that carry high-hazard flammable trains (HHFTs) and other trains carrying large volumes of hazmat commodities. Working with USDOT’s Pipeline and Hazardous Materials Safety Administration (PHMSA), FRA will identify these routes and prioritize them for inspection beginning immediately. The inspections will start in East Palestine, Ohio, and expand to communities nationwide.
FRA inspectors, using a combination of human visual inspections and technology, will assess the overall condition of rail infrastructure as well as railroads’ compliance with FRA regulatory requirements governing track. Information will be shared with railroads as well as rail labor organizations, and it will be periodically published for the public to increase transparency.
“Safety is always our number one priority, and the Norfolk Southern derailment reminds us of the importance of ensuring no industry can put its profits over the safety of its workers and the communities it serves,” said Transportation Secretary Pete Buttigieg. “As our investigators continue their work to support NTSB’s investigation, we are also taking additional steps right now to prevent future disasters and we insist that the rail industry do the same.”

White House Threatens Veto Of WOTUS Repeal Measure, Touting ‘Clear Rules’
The White House is threatening to veto the Congressional Review Act (CRA) resolution targeting EPA and the Army Corps of Engineers’ new definition of “waters of the United States” (WOTUS), highlighting the policy’s “clear rules of the road” for Clean Water Act (CWA) jurisdiction as the repeal heads toward a House floor vote this week.
“The final rule provides clear rules of the road that will help advance infrastructure projects, economic investments, and agricultural activities — all while protecting water quality,” reads a March 6 statement of administration policy (SAP) targeting the WOTUS disapproval resolution, known as H.J. Res. 27. “The rule reestablishes critical protections for the nation’s vital water resources by returning to the longstanding 1986 regulations with appropriate updates, exclusions, and streamlining clarifications.”
It concludes, “If Congress were to pass H.J. Res. 27, the President would veto it.”
The House, in a bipartisan vote, has approved a Congressional Review Act (CRA) resolution aimed at scrapping EPA and the Army Corps of Engineers’ new rule defining “waters of the United States,” setting up a vote in the Senate next week and a likely test of President Joe Biden’s promise to veto the measure if it reaches his desk.
The resolution passed the House on a 227-198 vote on March 9, with nine Democrats joining the GOP to vote in favor of repeal — while one Republican opposed it.
Because all 49 Senate Republicans are supporting the resolution, it would need support from just two more senators — Democrats or Independents — to pass. The Senate Democrats already have one switch to vote with Republicans [Manchin], one undecided [Tester], and two Senators out with illness [Feinstein and Fetterman].
However, CRA resolutions are still subject to the presidential veto and this resolution is not expected to get enough support to override a veto.

Biden Seeks 19 Percent Hike In FY24 To Boost ‘Critical Capacity’ At EPA
The Biden administration is pitching Congress on a $1.9 billion, or 19 percent, boost in EPA’s budget in fiscal year 2024 that would add 2,400 new staff to restore “critical capacity” at the agency while also strengthening the ability to address a range of environmental and climate-related priorities.
The top-line funding boost for EPA — detailed in President Joe Biden’s FY24 budget request released March 9 — faces an uphill climb on Capitol Hill given expected clashes throughout the year between the White House and Republican lawmakers over the debt ceiling and spending priorities more broadly.
But the Biden proposal nonetheless offers a statement of the administration’s priorities and how it plans to address a range of environmental issues as a result of Trump-era cuts at EPA.
“Staffing reductions under the previous administration continue to undermine the agency’s ability to carry out its mission to protect clean air and water, tackle the climate crisis, and promote environmental justice,” says the summary for EPA’s portion of the budget request.
It seeks 2,400 additional full-time equivalents (FTEs) relative to 2022 levels, bringing the agency’s total staffing to over 17,000 FTE, “to help rebuild the agency’s capacity.”
Such a move would partially respond to recent calls by a major EPA staff union to increase new hiring at the agency and enhance retention.

Senators Press EPA On Cleanup Approach, Transparency After Ohio Spill
Members of the Senate Environment and Public Works (EPW) Committee used the first congressional hearing on the East Palestine, OH, train derailment and chemical spill to question EPA on its plans to remove and dispose of contaminated soil from the site, as well as what Republicans said has been a failure to communicate possible community risks.
“What happens [if] the very toxic dirt that we just dug out of the ground begins to seep back into the ground causing problems for the air and water for the residents of East Palestine?” Sen. J.D. Vance (R-OH) asked during a March 9 EPW hearing on the derailment and cleanup. “We need leadership, we need the EPA to get on the ground and aggressively get this stuff out of East Palestine into properly licensed facilities.”
While Vance — who was at the hearing as a witness rather than a committee member — appeared on a separate panel from EPA Region 5 Administrator Debra Shore, she also faced questions on the cleanup from other lawmakers, including EPW ranking member Sen. Shelley Moore Capito (R-WV), who said EPA has stopped sending hazardous waste to facilities that were already accepting it, with no explanation.
In response, Shore said waste had been taken from the accident site as recently as the previous day, and is being transported to “a number of facilities that have the capacity to receive waste and have contracts with Norfolk Southern, and then have gone through our due diligence and a compliance review.”
EPW Chairman Sen. Tom Carper (D-DE) praised EPA’s response, however. “It’s worth noting that the Biden administration has been on the ground from day one,” Carper said.

In 2019 Mark Bruce from AHMP and Gene Guilford from IHMM worked on a project to get the Commonwealth of Pennsylvania to recognize the CHMM and CDGT credentials. With Mark’s work on the ground in Pennsylvania, we succeeded.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
In January 2021 Mark at AHMP and Gene at IHMM has launched 45 in 5, getting the other 45 states to recognize our credentials in 5 years. If we can find a volunteer like Mark in other states [see above] we can work with those volunteers on crafting the right message to the right agencies in state governments across the country. If we find enough volunteers we can get this done in less than 5 years.
In January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together
IHMM Scholarship Program
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

IHMM – 26 Fellows Are Mentors
IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to engage both 26 IHMM Fellows as Mentors and anyone who seeks some assistance as Mentees.
Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities. This article from ASAE magazine outlines how a mentoring program can become more successful – engagement!
IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

Retiring? IHMM Invites You to Become an Emeritus
You may have decided, after a long and successful career, to retire from active daily duty. Congratulations. That doesn’t mean you have to completely disengage from your profession. IHMM is pleased to offer Emeritus status to all certificants who will no longer be actively engaged in their communities of practice but who still want to stay in touch. House of Representatives: Standing Room Only. On March 7, 2023, Jennifer McClellan (D-VA) was sworn in as a member of the U.S. House of Representatives after winning a special election last month to fill a seat that had been left vacant with the passing of Representative Donald McEachin, the late congressman from Virginia’s Fourth Congressional District, which encompasses the city of Richmond. McClellan is the first Black woman to represent Virginia in the U.S. Congress. This is the first time since September 2019 that the House has had its full complement of 435 members (222 Republicans and 213 Democrats).
POTUS Releases 2024 Budget. On March 9, 2023, President Biden released his budget request for fiscal year 2024—the first step in the annual appropriations dance that will play out over the coming months. With a divided Congress, it is unlikely that any final spending bill will meet the president’s demands, but the budget signals Democrats’ priorities for policy debates going forward. For example, the president’s budget calls for paid family and medical leave (up to twelve weeks) and paid sick leave (seven job-protected days)—proposals that are likely to be the subjects of various legislative efforts in the future. One other point about the budget: Republicans’ slim majority in the House, coupled with the turmoil surrounding Representative Kevin McCarthy’s ascendancy to Speaker of the House, increases the chances of a government shutdown after the current fiscal year closes on September 30, 2023.
FTC Extends Comment Deadline for Noncompete Ban Proposal. This week, the Federal Trade Commission (FTC) announced that it would extend the public comment period for its proposal to ban noncompete agreements between employers and workers. Comments were originally due by March 20, 2023, but they will now be due by April 19, 2023. In concurring with the decision to extend the comment deadline, departing Republican commissioner Christine Wilson wrote, “Given that the proposed rule is a departure from hundreds of years of precedent and would prohibit conduct that 47 states allow, I would have supported extending the public comment by 60 days.”
Senate Committee Hearing Pushes PRO Act. On March 8, 2023, the U.S. Senate Committee on Health, Education, Labor and Pensions (HELP) held a hearing entitled, “Defending the Right of Workers to Organize Unions Free from Illegal Corporate Union-Busting.” The sometimes fiery hearing featured testimony from big labor presidents Liz Shuler (AFL-CIO), Mary Kay Henry (Service Employees International Union), and Sean O’Brien (International Brotherhood of Teamsters). Former National Labor Relations Board (NLRB) Chairman John Ring and Mark Mix, who is president of both the National Right to Work Committee and the National Right to Work Legal Defense Foundation, also appeared as witnesses.
The union witnesses and their political allies spent much of the hearing criticizing employers and characterizing lawful employer conduct as “union busting.” The same witnesses called for passage of the Protecting the Right to Organize (PRO) Act, a higher minimum wage, federal contractor blacklisting, and a sweeping joint-employer standard. In response, Ring argued in his written testimony that the PRO Act would “detrimentally affect employee free choice and stifle basic democratic rights to a secret ballot and free debate, impose collective bargaining agreements on parties, wholly change how employers structure their business operations, and incentivize more strikes, picketing and secondary boycotts.”
Republican Senator Seeks Answers From NLRB. While this week’s HELP Committee hearing focused on potential legislative efforts in the area of traditional labor relations, the committee’s ranking member, Senator Bill Cassidy (R-LA), sent a letter to NLRB Chair Lauren McFerran and NLRB General Counsel Jennifer Abruzzo raising concerns related to “possible misconduct and lack of neutrality in litigation against prominent employers.” Specifically, the letter asked the NLRB chair and general counsel about actions they are taking to address “allegations of Board employee misconduct or interference in representation elections” that may have influenced election outcomes in favor of labor unions. Cassidy also expressed concern that “through a series of decisions and initiatives from the general counsel’s office, the Board has weaponized its enforcement powers to target prominent employers.”
NLRB and CFPB: A Marriage Made in … D.C. On March 7, 2023, the NLRB and the Consumer Financial Protection Bureau (CFPB) announced an information sharing agreement and partnership between the two agencies “to address practices that harm workers in the ‘gig economy’ and other labor markets.” According to the CFPB, the agency partnership will focus on “employer driven debt” that allegedly results from employee expenses related to “employer-mandated training or equipment,” as well as potential Fair Credit Reporting Act violations related to worker productivity monitoring. As the Buzz has previously reported, General Counsel Abruzzo has entered into similar partnerships with the U.S. Equal Employment Opportunity Commission, the U.S. Department of Labor, the Internal Revenue Service, the U.S. Department of Justice’s Antitrust Division, and the Federal Trade Commission.

HMS Launches New Certified Safety Management Practitioner® [CSMP®] Exam Prep Course
The Hazardous Materials Society is pleased to announce that it is launching a new CSMP examination prep course. The CSMP prep course follows the launch in 2021 of the successful CSHM prep course in an agreement with VUBIZ.
The CSMP exam prep course is available on demand online, and is linked in the schedule below as well as on the IHMM CSMP website and under the CSMP hotbutton CSMP PREP on the HMS Education and Training webpage.
AIHA, HMS Training Partner, Adds Courses for IHMM Certificants
American Industrial Hygiene Association [AIHA] an HMS training partner, has added its first of many courses approved in advance for earning IHMM recertification certification maintenance points. These workshops are offered with U.S. DOT PHMSA HMIT (Hazardous Materials Instructor Training) Grant support to the National Partnership for Environmental Technology Education (National PETE). This training is FREE for employees and federal, state, county, and local government employees involved in DOT HazMat Shipping, Receiving and Handling via Ground, Air, and Vessel Transportation.
The workshop curriculum is in accordance with 49 CFR § 172.704 for General Awareness, Function-Specific, Safety, and Security Awareness training requirements. Class size is limited to 10-15 students with mask/social distancing protocols, so act fast. Minimum of 6 attendees is needed to confirm the class.

Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.
You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 397 CHMM applicants IHMM had on August 31, 2022, all 397 looking for CHMM prep courses could see and chose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 397 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.

HMS Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
