IHMM Certificant Spotlight – David Cohen, CHMM
What or who motivated you to earn an IHMM credential?
My motivation goes back to where I started, behind the wheel of a 26-foot box truck as a Lab Pack Chemist in Washington, D.C. Every day taught me responsibility, safety, and patience. One afternoon, as I got out of the back of the truck, I met a man outside a government building who told me he had once been a Lab Pack Chemist too. He was further along in his career, in a crisp white shirt, and that moment stuck with me. It showed me there was a path forward beyond the truck cab. Years later, when I helped open a new office in Seattle, I knew I wanted to be recognized as a trusted expert who could lead with confidence. The CHMM became the symbol of that next step, growing from hands-on fieldwork to leadership in hazardous materials management.
Are there any opportunities you’re looking forward to as a result of earning an IHMM credential?
The CHMM isn’t just a credential; it feels like a launchpad. I am currently pursuing my MBA part-time at the University of Florida. Over the last decade, I’ve guided clients through DOT (49 CFR), RCRA (40 CFR), and the full maze of regulations. What excites me most is helping companies see “waste” differently. When something they once paid to dispose of suddenly becomes a resource, costs go down, opportunities open up, and they contribute to the circular economy. That shift is powerful. I also want to inspire others in this field. That’s why I co-founded the Gainesville EHS & Sustainability Meetups, a space where professionals, students, and community members come together to share ideas and best practices.

IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as enabling mentees signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.
Beltway Buzz – Ogletree Deakins
The Latest on Government Funding. Republicans and Democrats this week rolled out two competing proposals to extend government funding beyond the current September 30, 2025, deadline. As the majority in the U.S. Congress, Republicans obviously favor their proposal and passed it in the U.S. House of Representatives by a vote of 217–212 earlier today. The bill would extend current funding (which itself has been extended since the Biden administration) through November 21, 2025 (the final day that lawmakers are scheduled to be in Washington, D.C., before heading home for the Thanksgiving break). Congress is not scheduled to be in Washington, D.C., for the week beginning September 22, 2025, when all eyes will be on the U.S. Senate, which must do its part to avoid a shutdown. More on the potential impacts of a shutdown can be found here and here.
NLRB Challenges NY Labor Statute. After warning state governments that legislation granting local agencies control over certain private-sector labor matters is preempted by federal law, National Labor Relations Board (NLRB) Acting General Counsel William B. Cowen has sued the State of New York over the recent enactment of S.8034A. The new law, which was enacted on September 5, 2025, authorizes the New York Public Employment Relations Board to preside over private-sector union representation elections and unfair labor practice cases. The NLRB’s legal challenge argues that the New York law is unlawful because it “creates a parallel regulatory system that undermines the federal labor policy Congress designed to be national in scope.” The New York law—as well as similar efforts in California and Massachusetts—is a response to what local lawmakers view as unacceptable inactivity at the NLRB, due to its lack of quorum. Thomas M. Stanek and Zachary V. Zagger have the details.
House Labor Committee Advances Workplace Bills. This week, the U.S. House of Representatives’ Committee on Education and the Workforce advanced the following bills:
- The Tribal Labor Sovereignty Act of 2025 (H.R. 1723). The bill amends the National Labor Relations Act to exempt Indian tribes and “any enterprise or institution owned and operated by an Indian tribe and located on its Indian lands” from the Act’s scope of coverage. A version of the bill passed the House in 2018.
- The Balance the Scales Act (H.R. 2958). This bill, which was the subject of a congressional hearing in July 2025, would limit the use of “common interest agreements” by the EBSA.
- The Michael Enzi Voluntary Protection Program Act (H.R. 2844) would require the DOL to establish a voluntary protection program (VPP) allowing employers to voluntarily commit to “establish[ing] comprehensive safety and health management systems” and would require the Occupational Safety and Health Administration (OSHA) to set aside at least 5 percent of its budget allocation to implement the program.

Regulatory Updates

Dept of Labor – OSHA – July 1 FR – IHMM Collects Comments
On July 1, 2025, the U.S. Department of Labor’s Occupational Safety and Health Administration [OSHA] published 4 rulemakings for public comment. IHMM is requesting certificant input into whether we should submit comments on one or more of these proposal rulemakings and what we should submit. Each proposed rulemaking is briefly described below. The newly extended deadline is November 1, 2025.

USDOL – OSHA – Rescission of Coordinated Enforcement Regulations
Deadline: November 1, 2025
The Department of Labor (the Department or DOL) proposes to remove the regulations that set forth the procedures within the Department for the coordination of enforcement activities by the Wage and Hour Division (WHD), the Occupational Safety and Health Administration (OSHA), and the Employment and Training Administration (ETA) relating to migrant farmworkers. The Department is proposing this removal because these regulations limit the Department’s discretion, impose unnecessary and duplicative internal procedures, and prevent the Department’s agencies from coordinating with regard to migrant farmworkers in more efficient, effective ways. USDOL – OSHA – Construction Illumination Standards
Deadline: November 1, 2025
OSHA is seeking comment on fully rescinding the construction illumination rules found in 29 CFR 1926.26 and 1926.56, citing that current lighting standards are “not reasonably necessary” to reduce significant risk. The Federal Register notice is here.

The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced on March 12, 2025, that its Office of Hazardous Materials Safety (OHMS) will host four public meetings during 2025 in advance of certain international meetings. The third meeting will be held in preparation of the 30th session of the ICAO DGP (DGP/30) scheduled for October 6 – 10, 2025, in Montreal, Canada. The fourth meeting will be held in preparation of the 67th session of the UNSCOE TDG scheduled for November 24 – December 3, 2025, in Geneva, Switzerland. PHMSA will solicit public input on current proposals for each of these meetings. PHMSA states that each public meeting will take place approximately two weeks preceding the international meeting at the headquarters for the Department of Transportation in Washington, D.C.

AIHA Releases Second Edition of Healthier Workplaces and Schools eBook
AIHA has released the updated and streamlined version of its Healthier Workplaces and Schools eBook. This free download is designed to help workplace decision-makers properly assess their specific risks and includes a practical approach to help mitigate the risk of spreading airborne infectious diseases in workplace settings, a risk assessment quiz to determine an organization’s risk of airborne virus transmission among workers, and specific actions to help manage these risks.
We encourage you to download, utilize, and share as the cold/flu/airborne illness season begins.

Federal Government Shutdown Looms – September 22 Update
On September 19th, the U.S. House of Representatives narrowly passed a short-term continuing resolution (CR) 217-212 to fund the government through November 21, keeping spending at current levels.
The bill then moved to the Senate, where on September 21st it failed by a 44-48 vote—falling short of the 60 votes needed to overcome a filibuster. Only one Democrat, Senator John Fetterman, joined Republicans in supporting it; two Republicans—Lisa Murkowski and Rand Paul—voted against.
Democrats in the Senate also offered a competing CR that included extensions for health care subsidies and Medicaid protections, but it too failed in party-line fashion.
Prospects going forward: With the Senate rejecting both the House CR and the Democratic alternative, the risk of a government shutdown increases as the current funding expires on September 30. Negotiations are expected to continue, and there may be another vote right before the deadline in hopes of getting enough Democratic votes or concessions to break the impasse.

US EPA Use of 5-Copy Manifests After January 22, 2025
EPA is announcing updated guidance regarding the use of old 5-copy paper manifest forms following the third rule’s effective date of January 22, 2025. EPA will accept 5-copy paper manifest forms until further notice. EPA will provide a 90-day advance notice of when they intend to cease acceptance of the 5-copy forms. Please find the updated guidance on their e-Manifest website.

EU May Miss UN Deadline on Emissions-Cutting Targets
The European Union is currently facing internal divisions that are delaying its submission of updated climate targets for 2035 and 2040 to the UN. Some member states, especially in Eastern Europe, are hesitant to commit to more aggressive emissions cuts due to concerns about economic and industrial impacts. This delay could weaken the EU’s standing ahead of upcoming climate talks (COP30).

IHMM Foundation Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
