IHMM is part of a 25-organization coalition seeking to inform congressional appropriators about the importance of OSHA funding. This is the time of year when Congressional appropriations committees begin deliberating on the FY2025 budget cycle and writing appropriations bills. Given recent actions in Washington, we got together to craft a communication to help them understand the need to adequately fund OSHA.
This letter has been circulating among IHMM’s Board and Government Affairs Committee since last Thursday, with a deadline of Tuesday the 25th for final comments and authorization to sign.

IHMM Joins Community Impact Coalition in Washington
Anticipating significant tax legislation in 2025, ASAE announced today the launch of the Community Impact Coalition — a unified initiative dedicated to educating the 119th Congress about the social and economic benefits of associations, charities, and other tax-exempt organizations.
The Community Impact Coalition is a national group formed this year to represent the non-profit community in light of unprecedented attempts to find new sources of federal revenue to finance tax reform.
The Community Impact Coalition is committed to ensuring lawmakers understand the value of 501(c) organizations and advocating against proposals that would eliminate their tax-exempt status. A wide range of trade associations, charities, and professional societies support the Community Impact Coalition, among them the Institute of Hazardous Materials Management [IHMM].

The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

IHMM Proposes Changes in Government Recognition of Credentials
- IHMM is circulating a letter to Congressional appropriators encouraging OSHA funding for FY2025.
- IHMM is circulating a letter with the Intersociety Forum [ISF] to communicate to the new Administration the value of the EHS communities of practice.
- IHMM has filed comments in the OSHA proposed Heat rule, underscoring IHMM’s commitment to bringing our SMEs expertise to an important public policy issue as well as highlighting the value of our certifications and those who hold them.
- IHMM has filed comments on the OMB Inquiry concerning the EPA and DOL proposed regulatory measures concerning Methylene Chloride on December 13, 2024.
- IHMM Sent a letter to the U.S. Department of the Interior, National Park Service, concerning the uses of professionally credentialed persons performing work for the Park Service.
- IHMM Signs Letter Opposing Reductions in OSH Worker’s Pay – The IHMM Government Affairs Committee has agreed to sign a coalition letter opposing reductions in pay for IH and OSH employees. Here is the coalition letter we signed.
4. IHMM submitted comments on OSHA Advisory Committee on Construction Safety and Health (ACCSH): Notice of Meetings concerning OSHA-2024-0002-0007, and highlighted the creation of IHMM’s Certified Pandemic Preparedness Specialist [CPPS] credential.
5. State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation, work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.

House Budget Resolution: No Tax on Tips? Nope. This week, the U.S. House of Representatives passed a budget resolution, a critical step in Republican lawmakers’ plan to use the budgetary reconciliation process to score legislative wins on taxes, the border, defense spending, and energy production. But this is just a first step in what is expected to be an arduous legislative process: both the U.S. Senate and House must agree on the same budget resolution before the individual legislative committees in each chamber can begin drafting legislation as instructed by such a resolution. Accordingly, despite some internet rumors to the contrary, the House-passed budget resolution does not—by itself—eliminate taxes on overtime pay or tipped wages.
Regulatory EO Asserts More Control Over Independent Agencies. On February 18, 2025, President Trump issued an executive order (EO), entitled, “Ensuring Accountability for all Agencies.” The EO strengthens President Trump’s authority over the executive branch—particularly over independent agencies such as the National Labor Relations Board (NLRB), U.S. Equal Opportunity Commission (EEOC), and Federal Trade Commission—by ordering the following:
- Independent agencies will be required to submit proposed and final rules to the White House’s Office of Information and Regulatory Affairs (OIRA) for review. (Some agencies, such as the EEOC, already submit their rules for review by OIRA.)
- The director of the Office of Management and Budget (OMB) will set “performance standards and management objectives for independent agency heads” and the director will also be required to “report periodically to the President on their performance and efficiency in attaining such standards and objectives.”
- The OMB director is required to consult with agency chairs about their spending to prohibit them “from expending appropriations on particular activities, functions, projects, or objects, so long as such restrictions are consistent with law.”
- The heads of agencies must “regularly consult with and coordinate policies and priorities” with the White House and submit strategic plans to OMB for approval.
- A White House Liaison will be established within each independent agency.
- Executive branch agencies—including independent agencies—are prohibited from advancing any policy “that contravenes the President or the Attorney General’s opinion on a matter of law.”
Along with the terminations of EEOC and NLRB members, the EO is an effort to align the policy objectives of independent agencies with those of the White House.
DOL Nominee News. This week, the Senate Committee on Health, Education, Labor and Pensions (HELP) voted to approve Lori Chavez-DeRemer’s nomination to be secretary of labor by a vote of 14–9. Senator Rand Paul (R-KY) voted “no,” while Democratic Senators Maggie Hassan (NH), John Hickenlooper (CO), and Tim Kaine (VA) voted in favor of the nomination. Chavez-DeRemer’s nomination is now teed up for a vote on the Senate floor. The bipartisan nature of the committee vote indicates that Chavez-DeRemer has a good chance of being confirmed.
Additionally, the HELP Committee held a hearing to examine the nomination of Keith Sonderling to be deputy secretary of labor. The committee will vote on Sonderling’s nomination on March 6, 2025.
FTC to Begin “Labor Markets Task Force.” According to media reports, Federal Trade Commission (FTC) Chair Andrew Ferguson announced at a recent event that the FTC will initiate a “labor markets task force.” The task force will reportedly focus on noncompete agreements, as well as no-hire and no-poach contracts. In June 2024, Ferguson voted against the FTC’s non-compete rule while writing, “Whatever the Final Rule’s wisdom as a matter of public policy, it is unlawful. Congress has not authorized us to issue it. The Constitution forbids it. And it violates the basic requirements of the Administrative Procedure Act.” The Buzz will be monitoring this situation as it develops.
DHS to Require Registration, Fingerprinting. U.S. Citizenship and Immigration Services (USCIS) announced that it is resuscitating a provision of the Immigration Nationality Act that will require all individuals “14 years of age or older who were not fingerprinted or registered when applying for a U.S. visa and who remain in the United States for 30 days or longer” to apply for registration and fingerprinting. After doing so, proof of this registration must be carried at all times by such individuals who are over the age of eighteen. The requirement dates back to World War II, but an eventual lack of an operable implementation procedure resulted in the abandonment of the policy. Individuals who will not have to register under this policy include, but are not limited to, lawful permanent residents, individuals with work permits, and visa holders with an arrival/departure record (Form I-94). Individuals who will have to register include the undocumented, previously registered children who turn fourteen, those present in the United States pursuant to programs such as Deferred Action for Childhood Arrivals or Temporary Protected Status who do not have work permits, and Canadians who arrive via land ports of entry. According to the announcement, the U.S. Department of Homeland Security (DHS) “will soon announce a form and process for aliens to complete the registration requirement.”

SUMMARY:
This interim final rule removes the Council on Environmental Quality (CEQ) regulations implementing the National Environmental Policy Act (NEPA) from the Code of Federal Regulations. In addition, this interim final rule requests comments on this action and related matters to inform CEQ’s decision making.

IHMM Submits Comments on the OSHA Proposed Heat Rule
The Occupational Safety and Health Administration (OSHA) has released a proposed rule that would protect approximately 36 million workers in indoor and outdoor work settings from extreme heat. The proposed rule would require employers to develop an injury and illness prevention plan to control heat hazards in workplaces with excessive heat. The plan would require employers to evaluate heat risks and — when heat increases risks to workers — implement requirements for drinking water, rest breaks, and control of indoor heat. The agency published an ICR related to its Methylene Chloride standard. This chemical is hazardous but widely used in industry, so OSHA closely monitors safety standards. The regulation of methylene chloride, also known as dichloromethane (DCM), is primarily governed by the U.S. Environmental Protection Agency (EPA) under the Toxic Substances Control Act (TSCA).

Professional Certification Coalition
Congress has started working and among our priorities is the Freedom to Invest in Tomorrow’s Workforce Act that we started in the last Congress. This legislation would allow IRS 529 plans to use proceeds for certain certification-related expenses. We expect that bill to be introduced the first week of February, and we have also received strong signals that the legislation will be in the coming reconciliation package. Very hopeful signs.
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis.
IHMM will participate in the March 5, 2025, Member Meeting and Capitol Hill Advocacy Day.

Tomorrow’s Workforce Coalition – Senate Action On IHMM-Supported Legislation
The Coalition supports the bipartisan, bicameral Freedom to Invest in Tomorrow’s Workforce Act (H.R. 1151), which would expand qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications; it would provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes or alternative career pathways.
We are excited to inform you that Sen. Amy Klobuchar (D-MN) introduced the Freedom to Invest in Tomorrow’s Workforce Act in the Senate! Sen. Klobuchar was joined by Sens. Roger Marshall (R-KS), Peter Welch (D-VT), and Susan Collins (R-ME). The bill number is S. 756. We are so excited that we now have a bipartisan version of our bill introduced in the Senate, following the introduction of the bill in the House (H.R. 1151) earlier this month. The House version is already gaining significant traction, with at least 48 cosponsors (29 Republican, 19 Democratic) supporting the bill (we say “at least” because we are aware of a few other offices that have committed to cosponsoring the bill but haven’t been officially added). Having broad bicameral and bipartisan support puts the legislation in a strong position to advance through the legislative process this year. We will continue to provide pertinent updates to you related to the bill and, as always, welcome your organization’s advocacy efforts to cultivate support for it.
The Tomorrow’s Workforce Coalition is very much a part of this race! We have been meeting with key lawmakers and staff to ensure that the Freedom to Invest in Tomorrow’s Workforce Act is included in the tax package. ASAE and TWC staff have been working with bill sponsors in the House and Senate to identify new co-leads before the bill’s reintroduction, and an announcement on these co-leads will be made over the next few weeks.

What Congress Has Done and What Congress Has Left to Do
The House and Senate are in this week. The major policy question is what will emerge from the Budget Reconciliation process, an effort by Republicans to fast-track around Democrats and put their spending and taxation priorities into law.
Senate Republicans advanced a budget resolution out of the upper chamber on a 52-48 vote, but it doesn’t include everything that Trump has demanded. (They intend to move a second resolution with the rest of his priorities.) Now House Republicans will try to pass their own Budget resolution. This one will contain almost all their priorities in one bill. The Senate held off on the more divisive stuff until later, but the House will try to swallow it in one big gulp. The big question is whether they can do so without splitting the party and killing the resolution. We will find out in votes they hold this week.
Another rapidly approaching crossroads is the Fiscal Year 2025 appropriations bills. FY 2025 started on October 1, but Republicans prevented the adoption of bills to appropriate (i.e. direct the spending of) funds. The government has been running on autopilot under a “continuing resolution,” which more or less kept funding levels at the FY 2024 level. But that continuing resolution ends on March 14th, and Congress must pass the appropriations bills to keep the government open.

Nationwide Recovery of Radioactive Devices by Los Alamos National Lab hits Major Milestone
Partnership helps mitigate risk of terrorist attacks using a “dirty bomb”
Two Los Alamos National Laboratory teams that travel nationwide recovering potentially harmful radioactive material from devices at hospitals, universities, and research facilities completed a momentous milestone in January — their 100th shipment of such material since the partnership began in 2019.
Since then, the teams have removed 190,023 curies — units of radioactivity — of material from across the United States in sealed sources, disposing of the material at Department of Energy facilities. These recovery and disposal missions enhance national security by preventing the material from being stolen, smuggled, and used in acts of terrorism.
“Since our first shipment three-and-a-half years ago, we’ve completed 100 shipments,” said Wade Weyerman of Los Alamos’s Repository Science and Operations division, noting that safety is the team’s top priority.

The firm exited the Net Zero Asset Managers (NZAM) climate coalition and scaled back on diversity, equity, and inclusion (DEI) policies. These actions follow campaigns against ESG led by oil-and-gas lobbyists and other conservative entities, resulting in state laws and lawsuits targeting BlackRock. - Montana Youths Win Landmark Climate Lawsuit

On February 22, 2025, UPMC Memorial Hospital in Shiloh, Pennsylvania, became the scene of a tragic shooting and hostage situation. Diogenes Archangel-Ortiz, armed with a semi-automatic pistol, entered the hospital’s intensive care unit (ICU), taking staff members hostage. The confrontation resulted in the deaths of Archangel-Ortiz and West York Borough Police Officer Andrew Duarte. Five others, including two police officers, a doctor, a nurse, and a custodian, sustained injuries but are reported to be in stable condition. NPRM: Advancing Safety of Highway, Rail, and Vessel Transportation
Deadline: April 28, 2025
On October 28, HM-265 Notice of Proposed Rulemaking (NPRM) titled “Hazardous Materials: Advancing Safety of Highway, Rail, and Vessel Transportation” was published to the Federal Register. This NPRM proposes amendments to improve the safety and efficiency of hazardous materials transported by highway, rail, and vessel, as well as several amendments for all modes of transportation. Specifically, some of the proposed amendments include:
• Adopting the 2017 Rail Safety Advisory Committee Hazardous Materials Issues Working Group recommendations
• Removing the delegation to the Association of American Railroads as the sole source for tank car design approvals and tank car facility quality assurance program approvals
• Revising the UN ID number marking requirements for motor carriers who transport different types of petroleum distillate fuels (e.g., gasoline and diesel fuel) in multiple trips in the same day
• Updating cargo tank manufacture and inspection requirements to address safety deficiencies noted during inspections
• Removing the requirement for security awareness training for hazmat employees who manufacture packagings and do not come into contact with hazardous materials in transport.
As with any NPRM, PHMSA needs your input! We’ve extended the comment period, meaning that all comments must be received by April 28, 2025.
Notice to Public Safety Answering Points (PSAP, e.g., 9-1-1 call centers)
Starting on June 24, 2025, the six Class I railroads are required to begin complying with the requirements of the HM-263 Real-Time Train Consist Information final rule.
This rule requires that, for any accident involving a train transporting hazardous material, or any incident involving the release or suspected release of hazardous materials from a car on a train, railroads must make a telephone call to the primary Public Safety Answering Point (PSAP) informing them of the incident or accident. Then, the railroad must transmit train consist information directly to the primary PSAP, in a form that the PSAP is able to receive and use.
Train consist information includes:
- The railroad’s designated emergency response point of contact (including contact phone number)
- the position in the train and contents of each hazardous material rail car, listed by reporting mark and number
- The point of origin and destination of the train
- Shipping paper information (e.g., UN ID number, proper shipping name, hazard class, packing group, technical name (if applicable), number and type of packages
- Emergency response information required by § 172.602(a) of this subchapter.
This information is critical for first responders to protect themselves and their communities during the initial stages of a response to a train accident or incident involving hazardous materials.

Supporting Neurodiversity in the Workplace
You might know someone who is neurodivergent—someone whose brain doesn’t work the way most people’s brains work. This person could be a family member, spouse, friend, or colleague. Or you yourself may be neurodivergent.
According to Cleveland Clinic, “neurodiversity” and related words, such as “neurodiverse” and “neurodivergent,” are non-medical terms that may encompass different social preferences, ways of learning, ways of communicating, and ways of perceiving the environment. The broad umbrella of neurodivergence may include people with autism spectrum disorder, attention deficit hyperactive disorder, Down syndrome, dyscalculia, dyslexia, bipolar disorder, sensory processing disorders, and other conditions. Famous people who are neurodivergent include actor Sir Anthony Hopkins, singer Florence Welch, and Olympic gymnast Simone Biles.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

IHMM and HMS Tie Exam Preparation Together for Applicants
Every IHMM certification that requires an examination has a section of its website entitled Examination Preparation.
Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.
You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 480 CHMM applicants IHMM had on December 31, 2024, all 480 applicants looking for CHMM prep courses could see and choose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 480 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.
Earning Certification Maintenance Points [CMPs] is illustrated under Recertification of Your Credential, that includes the Recertification Claims Manual – Appendix A, that details all of the ways a certificant may earn CMPs > https://ihmm.org/recertification-claims/
Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?
HMS has made that simple and easy.
- Go to https://hazmatsociety.org/education-training/
- Scroll down until you see a row of buttons…click on the CMPs button
The system will then generate all of the courses on the HMS E&T platform with IHMM CMPs already attached.
The next developments by the HMS E&T committee will refine available courses’ CMPs by individual credential!
HMS Certified Dangerous Goods Professional [CDGP] Exam Prep
The Columbia Southern University/HMS CDGP prep course is found here on the Hazardous Materials Society [HMS] education and training website > https://hazmatsociety.org/training/ce-1112-cdgp-exam-prep/2022-02-02/
The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
