IHMM, ASSP, AIHA, NSC, ISEA, and Others in Coalition for OSHA Funding

IHMM is part of a 25-organization coalition seeking to inform congressional appropriators about the importance of OSHA funding. This is the time of year when Congressional appropriations committees begin deliberating on the FY2025 budget cycle and writing appropriations bills. Given recent actions in Washington, we got together to craft a communication to help them understand the need to adequately fund OSHA.

This letter has been circulating among IHMM’s Board and Government Affairs Committee since last Thursday, with a deadline of Tuesday the 25th for final comments and authorization to sign.

Anticipating significant tax legislation in 2025, ASAE has launched the Community Impact Coalition — a unified initiative dedicated to educating the 119th Congress about the social and economic benefits of associations, charities, and other tax-exempt organizations.

The Community Impact Coalition is a national group formed this year to represent the non-profit community in light of unprecedented attempts to find new sources of federal revenue to finance tax reform.

The Community Impact Coalition is committed to ensuring lawmakers understand the value of 501(c) organizations and advocating against proposals that would eliminate their tax-exempt status. A wide range of trade associations, charities, and professional societies support the Community Impact Coalition, among them the Institute of Hazardous Materials Management [IHMM].

The Dr. John H Frick Memorial IHMM Scholarship Program – Accepting Applications in September 2025

The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.

IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

IHMM Proposes Changes in Government Recognition of Credentials

  1. IHMM has joined SWANA in a statement on end-of-life hazmat protocols
  2. IHMM is circulating a letter to Congressional appropriators encouraging OSHA funding for FY2025.
  3. IHMM is circulating a letter with the Intersociety Forum [ISF] to communicate to the new Administration the value of the EHS communities of practice.
  4. IHMM has filed comments in the OSHA proposed Heat rule, underscoring IHMM’s commitment to bringing our SMEs expertise to an important public policy issue as well as highlighting the value of our certifications and those who hold them.
  5. IHMM has filed comments on the OMB Inquiry concerning the EPA and DOL proposed regulatory measures concerning Methylene Chloride on December 13, 2024.
  6. IHMM Sent a letter to the U.S. Department of the Interior, National Park Service, concerning the uses of professionally credentialed persons performing work for the Park Service.
  7. IHMM Signs Letter Opposing Reductions in OSH Worker’s Pay – The IHMM Government Affairs Committee has agreed to sign a coalition letter opposing reductions in pay for IH and OSH employees. Here is the coalition letter we signed.

  1. IHMM submitted comments on OSHA Advisory Committee on Construction Safety and Health (ACCSH): Notice of Meetings concerning OSHA-2024-0002-0007, and highlighted the creation of IHMM’s Certified Pandemic Preparedness Specialist [CPPS] credential.
  2. State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation, work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.

Beltway Buzz – Ogletree Deakins

DEI EOs “Unblocked.” T. Scott Kelly and Zachary V. Zagger have the details on a decision by the U.S. Court of Appeals for the Fourth Circuit that will allow the federal government to enforce its DEI-related executive orders (EO) (EO 14151 and EO 14173) while a decision on the merits awaits appeal. This means that the federal government can once again, for example, require federal contractors to certify that they do not operate diversity, equity, and inclusion (DEI) programs that violate federal antidiscrimination laws. It also means that the U.S. attorney general can pursue legal challenges to private-sector DEI programs “that constitute illegal discrimination or preferences.” Other legal challenges to the DEI executive orders are still pending.

EEOC Issues Technical Assistance on DEI. The U.S. Equal Employment Opportunity Commission (EEOC) this week issued two technical assistance documents, “What You Should Know About DEI-Related Discrimination At Work” and “What To Do If You Experience Discrimination Related To DEI At Work.” The first document, in particular, cautions employers that an “initiative, policy, program, or practice may be unlawful if it involves an employer or other covered entity taking an employment action motivated—in whole or in part—by race, sex, or another protected characteristic.” The document then provides examples of DEI-related workplace policies and practices that the EEOC believes may violate Title VII of the Civil Rights Act of 1964. In addition to discrimination in hiring, firing, and compensation, the document notes that job duties, access to training, mentorship programs, and employee resource groups should also not be motivated in whole or in part on race, sex, or other protected characteristics. Nonnie L. Shivers has the specifics.

Secretary of State Asserts Control Over Immigration Rulemaking Process. On March 14, 2025, Secretary of State Marco Rubio published a notice in the Federal Register that will likely have a significant impact on the Trump administration’s immigration-related rulemaking protocols. In the notice, Secretary Rubio states that his primary foreign affairs duty is “to protect the people of the United States from any threats originating from foreign actors or from foreign soil” which includes policies related to the “protection and travel of U.S. citizens overseas, visa operations and visa issuance.” Rubio concludes with the following:

I hereby determine that all efforts, conducted by any agency of the federal government, to control the status, entry, and exit of people, and the transfer of goods, services, data, technology, and other items across the borders of the United States, constitute a foreign affairs function of the United States under the Administrative Procedure Act, 5 U.S.C. 553, 554. (Emphasis added.)

The “foreign affairs” exemption in the Administrative Procedure Act allows the federal government to avoid the normal notice and comment requirements of the rulemaking process. The U.S. Department of State has claimed this exemption regularly over the years, usually when going through the standard rulemaking process would result in some undesirable international consequence. Moreover, during Donald Trump’s first presidency, the administration also claimed this exemption relating to certain policy changes but was rejected by at least two federal courts. Secretary Rubio’s notice, at least on its face, would try to expand the use of this exemption beyond the State Department and extend it to other agencies involved in immigration rulemaking processes, such as the U.S. Department of Labor (DOL) and U.S. Citizenship and Immigration Services (USCIS).

Democratic FTC Commissioners Fired. This week, President Trump fired Alvaro Bedoya and Rebecca Kelly Slaughter, the two remaining Democratic commissioners on the Federal Trade Commission (FTC). FTC Chair Andrew Ferguson and fellow Republican Melissa Holyoak remain on the Commission, which can still bring cases, even with three vacant commissioner seats. Like the firings of NLRB member Gwynne Wilcox and EEOC commissioners Charlotte Burrows and Jocelyn Samuels, the removal of Bedoya and Slaughter is a further example of the administration’s efforts to assert executive branch authority over federal agency commissions and boards.

Trump Rescinds More Biden-Era EOs. On March 14, 2025, President Trump issued an executive order entitled, “Additional Rescissions of Harmful Executive Orders and Actions,” which rescinds eighteen executive orders, memoranda, and determinations issued by President Joe Biden. The rescinded EOs relating to employment policy are as follows:

  • “Increasing the Minimum Wage for Federal Contractors” (EO 14026, April 27, 2021). This EO set the minimum wage applicable to covered federal contractor employees at $17.75 per hour as of the beginning of this year (pursuant to a provision that provides for annual increases based on the Consumer Price Index). However, President Barack Obama’s Executive Order 13658, which also increases the minimum wage for covered contractors, remains in place. While still unclear at this time, federal minimum wage requirements could be $7.25 per hour or $13.30 per hour, depending on whether the contract was covered under the Biden or Obama EO. Clarification from the DOL on this would be helpful.
  • “Advancing Worker Empowerment, Rights, and High Labor Standards Globally” (Presidential Memorandum, November 16, 2023). This memorandum encouraged the promotion of workers’ rights (e.g., collective bargaining, safe workplaces, wage and hour protections, and prohibiting forced labor ) as they related to the United States’ “foreign, international development, trade, climate, and global economic policy priorities.”
  • “Scaling and Expanding the Use of Registered Apprenticeships in Industries and the Federal Government and Promoting Labor-Management Forums” (EO 14119, March 6, 2024 ). This EO directed federal agencies to promote opportunities to contract with employers that participated in union-supported registered apprenticeship programs.
  • “Investing in America and Investing in American Workers” (EO 14126, September 6, 2024). This EO encouraged federal agencies to include certain labor and employment standards in federal grants and contracts. This came to be known colloquially as the “Good Jobs” executive order.

FMCS on the Brink. Also, on March 14, 2025, President Trump issued an executive order entitled, “Continuing the Reduction of the Federal Bureaucracy,” that “continues the reduction in the elements of the Federal bureaucracy that the President has determined are unnecessary.” The Federal Mediation and Conciliation Service (FMCS) is one of seven agencies ordered to eliminate its “non-statutory components and functions … to the maximum extent consistent with applicable law.” Pursuant to the EO, the FMCS (as well as the other agencies listed) must “submit a report to the Director of the Office of Management and Budget confirming full compliance with this order and explaining which components or functions of the governmental entity, if any, are statutorily required and to what extent” by March 21, 2025. The FMCS homepage currently displays the following message: “We are reviewing recent Executive Orders for immediate implementation. The requirements outlined in these orders may affect some services or information currently provided on this website.”

Amanda Wood Laihow is Acting Administrator of OSHA

Amanda Wood Laihow is the new acting head of OSHA, according to the agency’s revised organizational chart.

OSHA updated the chart on March 12, one day after Lori Chavez-DeRemer was sworn in as labor secretary. Laihow had been serving as OSHA’s deputy assistant secretary since February.

Laihow joins longtime OSHA staffer Scott Ketcham as deputy assistant secretary. She’ll oversee the following directorates:

EPA Reopens Comment Period On Proposed Risk Management Rule For PV29

Deadline: April 29, 2025

On March 4, 2025, EPA announced that it is reopening the comment period for the January 2025 proposed rule to address the unreasonable risk of injury to human health presented by the Color Index (C.I.) Pigment Violet 29 (PV29) under its conditions of use (COU) as documented in EPA’s January 2021 risk evaluation and September 2022 revised risk determination.

Senate Approves Keith Sonderling’s Nomination as Deputy Labor Secretary

Keith Sonderling is the new deputy labor secretary, after the Senate confirmed his nomination with a 53-46 party-line vote on March 12.

Sonderling was most recently the senior advisor to acting labor secretary Vince Micone, until Lori Chavez-DeRemer was sworn in as labor secretary on March 11.

During his Feb. 27 confirmation hearing, Sonderling was asked about his firsthand knowledge of the Department of Government Efficiency’s access to Department of Labor data.

EPA Will Revise WOTUS Rule, Issues Joint Guidance

EPA announced on March 12, 2025, that it will work with the U.S. Army Corps of Engineers to deliver on President Trump’s promise to review the definition of “waters of the United States” (WOTUS). According to EPA, the agencies “will move quickly to ensure that a revised definition follows the law, reduces red-tape, cuts overall permitting costs, and lowers the cost of doing business in communities across the country while protecting the nation’s navigable waters from pollution.” EPA will begin its review by obtaining input from stakeholders “who were sidelined during the previous administration.” EPA will seek targeted information on the key challenges and will also undertake a rulemaking process to revise the 2023 definition of WOTUS “with a focus on clarity, simplicity and improvements that will stand the test of time.”

On March 12, 2025, EPA and the Department of the Army issued joint guidance to field staff on implementation of “continuous surface connection” consistent with the U.S. Supreme Court’s May 25, 2023, decision in Sackett v. EPA. The agencies also released a pre-publication version of a Federal Register notice publicizing a series of six listening sessions and a 30-day recommendations docket to solicit feedback on key aspects of the definition of WOTUS. The comment period will begin when the notice is published in the Federal Register.

Acting Head of FMCSA Out After Just 2 Weeks on the Job

Adrienne Camire is no longer acting and deputy administrator of the Federal Motor Carrier Safety Administration, after spending about two weeks on the job.

No reason was given for the departure of Camire, who served as chief counsel for the Federal Highway Administration during President Donald Trump’s first term. FMCSA didn’t immediately respond to a request for comment.

The Department of Transportation appointed Camire to the new positions on March 7. However, Camire wasn’t listed on the agency’s leadership page after online updates made March 19.

A press release announcing her appointment has been removed from the DOT website. A Jan. 31 release naming her as an FMCSA senior advisor remains.

The FMCSA leadership page shows Sue Lawless as the agency’s executive director and chief safety officer and Jesse Elison as chief counsel.

IHMM Submits Comments on the OSHA Proposed Heat Rule

The Occupational Safety and Health Administration (OSHA) has released a proposed rule that would protect approximately 36 million workers in indoor and outdoor work settings from extreme heat.  The proposed rule would require employers to develop an injury and illness prevention plan to control heat hazards in workplaces with excessive heat. The plan would require employers to evaluate heat risks and — when heat increases risks to workers — implement requirements for drinking water, rest breaks, and control of indoor heat. It would also require a plan to protect new or returning workers unaccustomed to working in high-heat conditions.

IHMM initiated collecting comments from its Government Affairs Committee, CSHMs, CSMPs, CHMMs, and CSMPs concerning this proposed regulation and filed the comments linked above on January 13, 2025.

As always, the initial portion of the IHMM comments discusses the strengths of its credentials and those who hold them, the required professional development that leads to recertification every five years, and the education and training provided to our credential holders through our Foundation.

Trump Taps Derek Barrs to Head FMCSA

President Donald Trump has nominated Derek Barrs to lead the Federal Motor Carrier Safety Administration.

Barrs served as chief of the Florida Highway Patrol from January 2001 to January 2020, after spending a decade as deputy sheriff in the Madison County (FL) Sheriff’s Office. He joined HNTB Corp., a transportation infrastructure organization, in January 2020 as associate vice president.

Barrs also is part of the American Trucking Associations’ Law Enforcement Advisory Board. He has held multiple roles with the Commercial Vehicle Safety Alliance, an ATA press release states.

Barrs’ nomination is with the Senate Commerce, Science and Transportation Committee. A nomination hearing date has yet to be listed on the committee’s website.

IHMM Filed Comments – Agency Information Collection Activities; Submission for OMB Review; Comment Request; Methylene Chloride Standard

The agency published an ICR related to its Methylene Chloride standard. This chemical is hazardous but widely used in industry, so OSHA closely monitors safety standards. The regulation of methylene chloride, also known as dichloromethane (DCM), is primarily governed by the U.S. Environmental Protection Agency (EPA) under the Toxic Substances Control Act (TSCA).

These regulations aim to protect public health and the environment by reducing exposure to this hazardous chemical.

Professional Certification Coalition

Congress has started working and among our priorities is the Freedom to Invest in Tomorrow’s Workforce Act that we started in the last Congress. This legislation would allow IRS 529 plans to use proceeds for certain certification-related expenses. We expect that bill to be introduced the first week of February, and we have also received strong signals that the legislation will be in the coming reconciliation package. Very hopeful signs.

IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis.

IHMM will participate in the March 5, 2025, Member Meeting and Capitol Hill Advocacy Day.

Tomorrow’s Workforce Coalition Surpasses 900 Member Organizations

WASHINGTON— The Tomorrow’s Workforce Coalition, led by the American Society of Association Executives (ASAE), and the Professional Certification Coalition (PCC), and on which IHMM is a member of the TWC Steering Committee, recently surpassed 900 member organizations that represent more than 50 different industries across the country.

The Tomorrow’s Workforce Coalition supports the bipartisan, bicameral Freedom to Invest in Tomorrow’s Workforce Act (S. 756 / H.R. 1151), which would expand qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications; it would provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes or alternative career pathways.

“We’re proud to announce that over 900 organizations have united as part of the Tomorrow’s Workforce Coalition,” said ASAE President and CEO Michelle Mason, FASAE, CAE. “The Freedom to Invest in Tomorrow’s Workforce Act is a powerful, bipartisan solution that gives workers of all backgrounds, skill levels, and ages the opportunity to invest in their professional growth. The diverse support from organizations across numerous industries sends a clear message: the private sector is ready to champion workers pursuing career advancement, mid-career transitions, or alternative pathways. ASAE will be holding its annual legislative fly-in later this month. Participants from across the nonprofit sector will hold 100+ meetings with Members of Congress advocating for the passage of the Freedom to Invest in Tomorrow’s Workforce Act. Throughout 2025, the Coalition’s 900+ members will continue to make their voices heard on this important issue.

H.R. 1151 has 84 co-sponsors in the House. S 756 has 3 co-sponsors in the Senate. IHMM’s Executive Director Gene Guilford, CAE was on Capitol Hill two weeks ago working with the coalition on meeting with Members of Congress to co-sponsor the legislation.

Significant Environmental Stories Have Dominated This Week

This week, significant developments in EPA and environmental policy include sweeping regulatory rollbacks initiated by EPA Administrator Lee Zeldin under the Trump administration. These actions target a wide array of environmental protections and are poised to reshape how environmental regulations are enforced in the United States.

Key points of the rollback include:

  • The proposed rescission of 31 environmental rules, including those that govern greenhouse gas emissions, are cited as underpinning the U.S.’s climate policy.

  • Specific targets for rollback include restrictions on air pollution from fossil fuel-fired power plants and vehicle emissions standards, which the current administration describes as overreaching mandates.

Advocacy in a Time of Unprecedented Change

In two short months, the new presidential administration has initiated tremendous changes across many areas of the federal government. Some changes, directly or indirectly, will affect (or are already affecting) AIHA. The impact of other changes is not immediately apparent, and some may not survive legal challenges that will take time to play out. Since advocacy is a key pillar of AIHA’s strategic plan, I want to briefly describe how AIHA is responding to developments such as President Trump’s executive orders on federal grants and DEI, and recent changes on our staff.

IHMM Credential Recognition

The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/

In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.

  • We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
  • We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
  • We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].

in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.

Here’s what we ask each volunteer to do:

  • Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions.
  • Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together.

HMS Makes Finding Courses to Earn CMPs Easy

Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.

Earning Certification Maintenance Points [CMPs] is illustrated under Recertification of Your Credential, that includes the Recertification Claims Manual – Appendix A, that details all of the ways a certificant may earn CMPs > https://ihmm.org/recertification-claims/

Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?

HMS has made that simple and easy.

  1. Go to https://hazmatsociety.org/education-training/
  2. Scroll down until you see a row of buttons…click on the CMPs button

The system will then generate all of the courses on the HMS E&T platform with IHMM CMPs already attached.

The next developments by the HMS E&T committee will refine available courses’ CMPs by individual credential!
