Rich Cartwright, CHMM
We are deeply saddened to learn of Rich Cartwright’s passing. Our sincerest condolences go out to Rich’s family and many friends in communities of practice far and wide that Rich touched over more than 40 years as an environmental professional.
Rich was one of the original Certified Hazardous Materials Managers [CHMM] in March of 1985.
A leader in the environmental and association fields for more than 40 years, Rich held positions with the Alliance of Hazardous Materials Professionals [AHMP], the Institute of Hazardous Materials Management [IHMM], Senior Vice President and Owner at MECX, family man, mentor and friend to thousands who knew him and helped. His endless contributions to the Hazardous Materials Management (HMM) Industry and the fact that he was a recipient of the prestigious, “Pete Cook Founders Award” for distinguished lifetime leadership, dedicated service and professional achievement within the HMM profession, made him the ideal go-to person for anyone wanting to succeed in the profession.
Rich Cartwright was a consummate networking professional. His enthusiasm in connecting people in the environmental world is unmatched in anyone’s experience. The connections he makes benefit everyone involved.
Rich will be sadly missed by everyone who knew him and had the pleasure of working with him. The family is planning a Celebration of Life in June. More information and details will be shared soon.

Thanks to the continued efforts of the Tomorrow’s Workforce Coalition, the Institute for Credentialing Excellence (ICE), the Professional Certification Coalition (PCC), and the American Society of Association Executives (ASAE), the Freedom to Invest in Tomorrow’s Workforce Act has been reintroduced in the Senate and the House of Representatives!
The Freedom to Invest in Tomorrow’s Workforce Act would expand qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications. It would provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes, or alternative career pathways.

IHMM and Coalition Takes the Field as Congress Prepares for a Tax Showdown!
The action is heating up — and IHMM is right in the thick of it!
Our Call to Action for all U.S.-based certificants to contact their House and Senate members this week comes at a pivotal moment. Thanks to our work with coalition partners like the Community Impact Coalition and Tomorrow’s Workforce Coalition, we’ve learned that the House Ways and Means Committee could begin marking up major tax legislation around May 10-12, 2025. Six key members of Congress from both chambers are already scrambling to bridge major differences between the House and Senate.
Make no mistake — aiming for a Memorial Day passage is a Hail Mary play. As anyone who’s been through these battles knows, tax bills are packed with high-stakes fights — and this one is no different. Extending the 2017 tax code alone would cost $4.6 trillion! Add to that proposals for new tax breaks for tip workers, overtime earners, Social Security recipients, expansions of the SALT deduction, a massive $100 billion boost for immigration enforcement, and countless other “Christmas tree ornaments” dangling off this bill — and you’ve got a recipe for fireworks.
But here’s where the real battle lies — how to pay for it all. The proposed $6 trillion addition to the national debt is a political landmine, with shaky “pay-fors” that range from spending cuts and tariff revenues to, frankly, some smoke and mirrors accounting. And the divisions aren’t just between Republicans and Democrats — they’re inside both parties and between the House and Senate themselves.
That’s why IHMM is here, locked in, leading alongside our coalition partners.
We’re fighting to protect the nonprofit sector from threats like stripping away 501(c) tax exemptions or slapping nonprofits with business tax rates. At the same time, we’re pushing for smart reforms — like streamlining IRS 529 savings plans to make it easier and more affordable for professionals to seek and maintain certifications.
This is why IHMM is engaged. This is why your voice matters.

IHMM, NSC Coalition Letter to Congressional Appropriators – OSHA FY2026
Each year, with input from several associated stakeholders, including IHMM, the National Safety Council develops an occupational safety and health congressional appropriations letter for organizations to sign. Given the state of play, this year’s letter focuses on OSHA funding at the FY25 level ($655.5 million) and the restoration of critical NIOSH programs. The letter is attached.

IHMM and SWANA Join In a Statement on End-Of-Life Management
IHMM has joined the Solid Waste Association of North America [SWANA] to raise awareness of the need for safety and responsible end-of-life management of hazardous products. As described in the press release, the waste and resource management industry is struggling with the frequent fires and explosions caused by batteries, marine flares, compressed gas cylinders, and other products. The goal of the statement is to raise awareness about the need for safe handling of these items and to invite producers and policymakers to work with us on solutions for labeling, design, and responsible end-of-life management.

IHMM and the Community Impact Coalition in Washington
With Congress beginning to work on tax legislation in 2025, ASAE has launched the Community Impact Coalition — a unified initiative dedicated to educating the 119th Congress about the social and economic benefits of associations, charities, and other tax-exempt organizations. IHMM is a member of the Steering Committee of the Coalition.
The Community Impact Coalition is a national group of 99 organizations formed this year to represent the non-profit community in light of unprecedented attempts to find new sources of federal revenue to finance tax reform.
The Community Impact Coalition is committed to ensuring that lawmakers understand the value of 501(c) organizations and advocating against proposals that would eliminate their tax-exempt status. A wide range of trade associations, charities, and professional societies support the Community Impact Coalition, among them the Institute of Hazardous Materials Management [IHMM].

The Dr. John H Frick Memorial IHMM Scholarship Program – Accepting Applications in September, 2025
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

4. IHMM submitted comments on OSHA Advisory Committee on Construction Safety and Health (ACCSH): Notice of Meetings concerning OSHA-2024-0002-0007, and highlighted the creation of IHMM’s Certified Pandemic Preparedness Specialist [CPPS] credential.
5. State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation, work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.

Beltway Buzz – Ogletree Deakins
Congress Out, Agenda Delayed. The U.S. Congress is currently in the second week of its spring break recess and will return to Washington, D.C., on April 28, 2025. Upon returning, Republican leaders are expected to move forward with their budget reconciliation package that is expected to address military spending, energy production, taxes, and immigration. The Buzz will also be monitoring potential U.S. Senate confirmation hearings for individuals nominated to lead labor and employment–related agencies. President Donald Trump has nominated individuals to lead the U.S. Department of Labor’s (DOL) Occupational Safety and Health Administration and Wage and Hour Division, as well as the General Counsel’s office of the National Labor Relations Board, but those nominees have not yet had their Senate confirmation hearings.
Executive Order Seeks to Limit Use of Disparate-Impact Liability. On April 23, 2025, President Trump issued an executive order (EO) titled “Restoring Equality of Opportunity and Meritocracy.” The EO states, “It is the policy of the United States to eliminate the use of disparate-impact liability in all contexts to the maximum degree possible.” Currently, employers may be held liable under a disparate-impact theory of discrimination if an otherwise neutral employment policy or practice results in an adverse impact on a protected class. The EO directs all federal agencies to “deprioritize enforcement of all statutes and regulations to the extent they include disparate-impact liability” and further instructs the attorney general and the chair of the U.S. Equal Employment Opportunity Commission to review all current legal matters that rely on a theory of disparate-impact liability, and to “take appropriate action with respect to such matters consistent with the policy of th[e] order.” T. Scott Kelly, Nonnie L. Shivers, and Zachary V. Zagger have the details.
Disparate-impact liability in employment discrimination cases was first established by the Supreme Court of the United States in 1971 and codified by Congress in the Civil Rights Act of 1991. In February 2025, U.S. Attorney General Pam Bondi issued a memorandum instructing U.S. Department of Justice (DOJ) officials to deemphasize disparate-impact theories of liability.
Senate HELP Committee Chair Outlines Independent Contractor Proposals. Senator Bill Cassidy (R-LA), chairman of the Senate Committee on Health, Education, Labor, and Pensions, has released a white paper advocating for various legislative proposals related to independent contractors. The white paper, titled, “Portable Benefits: Paving the Way Toward a Better Deal for Independent Workers,” builds on Cassidy’s 2024 “request for information seeking feedback from stakeholders on ways to remove federal legal and regulatory barriers to portable benefits for independent workers.” Among the proposals advanced in the paper are a single statutory test for determining employment status, as well as legislation that would allow employers to provide health and retirement benefits to workers without those benefits triggering employment status. (The Buzz recently detailed bills in the U.S. House of Representatives that address these issues.)
Immigration Policy Update. Recent developments in the immigration policy arena include the following:
- The U.S. District Court for the District of Massachusetts issued an order blocking the Trump administration’s rescission of the Cuba, Haiti, Nicaragua, and Venezuela (CHNV) humanitarian parole program. Emphasizing the need for a case-by-case review prior to revoking grants of parole, the judge ruled that the “categorical termination of existing grants of parole was arbitrary and capricious.” Amanda M. Mullane and Daniela Medrano Sullivan have the details.
- Secretary of State Marco Rubio announced sweeping changes to the operational structure of the U.S. Department of State. While the Bureau of Consular Affairs—the subagency within the State Department responsible for issuing visas—does not appear to be impacted at this early stage, the Buzz will continue to monitor the situation as it develops.
DOL Staff Exit. Workers at the DOL are leaving, either pursuant to deferred-resignation offers from the new administration or involuntary reductions in force.
- Deferred Resignations. Almost 20 percent of the DOL’s employees will reportedly leave their positions in September 2025 after accepting deferred-resignation offers.
- OFCCP Continues to Shrink. According to media reports, most employees in the Office of Federal Contract Compliance Programs’ (OFCCP) enforcement division’s national office and five of its six regional offices have been placed on administrative leave in advance of planned reductions in force at the agency. (Employees in the Southwest and Rocky Mountain Region—often referred to by practitioners as “SWARM”—were not impacted.) The action follows on the heels of a February 2025 DOL memo indicating that 90 percent of OFCCP employees would eventually be removed from their positions. A group of Democratic senators and representatives wrote a letter to Secretary of Labor Lori Chavez-DeRemer, warning that the dramatic reduction in staff at OFCCP would leave veterans and individuals with disabilities vulnerable to discrimination.
The Buzz will keep tabs on how staff reductions at the DOL in general, and OFCCP specifically, will impact the department’s regulatory and enforcement agendas.

OSHA to host public hearing on heat injury and illness prevention proposed rulemaking on June 16
The U.S. Department of Labor’s Occupational Safety and Health Administration will host a virtual public hearing on its proposed rule to protect workers from hazardous heat exposure in indoor and outdoor workplaces on June 16, 2025.
The public hearing on the Notice of Proposed Rulemaking on Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings, will begin on June 16, 2025, at 9:30 a.m. EDT, and continue on subsequent weekdays if necessary.
IHMM Submits Comments on the OSHA Proposed Heat Rule

The Occupational Safety and Health Administration (OSHA) has released a proposed rule that would protect approximately 36 million workers in indoor and outdoor work settings from extreme heat. The proposed rule would require employers to develop an injury and illness prevention plan to control heat hazards in workplaces with excessive heat. The plan would require employers to evaluate heat risks and — when heat increases risks to workers — implement requirements for drinking water, rest breaks, and control of indoor heat. It would also require a plan to protect new or returning workers unaccustomed to working in high-heat conditions.
IHMM initiated collecting comments from its Government Affairs Committee, CSHMs, CSMPs, CHMMs, and CSMPs concerning this proposed regulation and filed the comments linked above on January 13, 2025.
US DOT Procedural Requirements Memorandum
The Interested Parties (IP) Group recently drew attention to the US DOT Procedural Requirements Memorandum issued in March. This is an insightful legal document outlining the definitions and procedural requirements for DOT enforcement actions. Prepared by Acting DOT General Counsel Gregory Cote, this memorandum is expected to be released to the public soon. It clarifies the procedures for both administrative and judicial enforcement actions initiated by the Department of Transportation (DOT), ensuring that these actions align with due process principles and comply with lawful, reasonable, and consistent Administration policies. New Process for PHMSA’s Letters of Interpretation
On April 8, 2025, PHMSA announced its updated interpretations process to allow stakeholders to play a role in reviewing and providing feedback on interpretations requests. The updated process not only offers more transparency, but also provides stakeholders with an opportunity to provide feedback on best practices for compliance with safety requirements covering the transportation of hazardous materials and the operation of natural gas and hazardous liquid pipeline systems.
Through PHMSA’s updated interpretations process, stakeholders can review and comment on interpretations requests prior to issuance of the agency’s final written interpretation. Stakeholders will have up to 30-days following the submission of a request to provide feedback related to compliance with the regulation in question. Prior to the new process, stakeholders were only made aware of new interpretations after their issuance.

PHMSA Announces Public Meetings For International Standards On The Transport Of Dangerous Goods
The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced on March 12, 2025, that its Office of Hazardous Materials Safety (OHMS) will host four public meetings during 2025 in advance of certain international meetings. The first meeting will be held in preparation of the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP) Working Group 25 (WG/25) scheduled for April 21 – 25, 2025, in Delhi, India. The second meeting will be held in preparation of the 66th session of the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) scheduled for June 30 – July 4, 2025, in Geneva, Switzerland. The third meeting will be held in preparation of the 30th session of the ICAO DGP (DGP/30) scheduled for October 6 – 10, 2025, in Montreal, Canada. The fourth meeting will be held in preparation of the 67th session of the UNSCOE TDG scheduled for November 24 – December 3, 2025, in Geneva, Switzerland. PHMSA will solicit public input on current proposals for each of these meetings. PHMSA states that each public meeting will take place approximately two weeks preceding the international meeting at the headquarters for the Department of Transportation in Washington, D.C.
Professional Certification Coalition
Congress has started working and among our priorities is the Freedom to Invest in Tomorrow’s Workforce Act that we started in the last Congress. This legislation would allow IRS 529 plans to use proceeds for certain certification-related expenses. We expect that bill to be introduced the first week of February, and we have also received strong signals that the legislation will be in the coming reconciliation package. Very hopeful signs.
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis.
IHMM participated in the March 5, 2025, Member Meeting and Capitol Hill Advocacy Day.

Tomorrow’s Workforce Coalition – IHMM Lobbying Congress
IHMM has launched lobbying efforts with all of our U.S.-based credential holders to contact their House and Senate members, encouraging support for HR 1151 and S 756. We and the TWC coalition are undertaking this enormous push as we learned last week that the House Ways and Means Committee may begin marking up a new tax bill in the week of May 10-12, 2025. So, the time is now.
The Tomorrow’s Workforce Coalition, led by the American Society of Association Executives (ASAE), and the Professional Certification Coalition (PCC), and on which IHMM is a member of the TWC Steering Committee, recently surpassed 900 member organizations that represent more than 50 different industries across the country.
The Tomorrow’s Workforce Coalition supports the bipartisan, bicameral Freedom to Invest in Tomorrow’s Workforce Act (S. 756 / H.R. 1151), which would expand qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications; it would provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes or alternative career pathways.
H.R. 1151 has 130 co-sponsors in the House. S 756 has 8 co-sponsors in the Senate. IHMM’s Executive Director Gene Guilford, CAE was on Capitol Hill in March working with the coalition on meeting with Members of Congress to co-sponsor the legislation.

U of L Sustainability Masters student Sam Satterly exposes ‘Gully of the Drums’ in Louisville
A University of Louisville graduate student has exposed a comedy of errors by federal, state and local agencies that has allowed hazardous wastes to pollute the ground and, possibly, a nearby waterway.
LOUISVILLE, Ky.—When the U.S. Environmental Protection Agency responded to a “surface water pollution emergency” on farmland 17 miles south of downtown in 1979, federal officials joined state regulators in removing 17,000 barrels of hazardous waste from an illegal dump site. It would become notorious nationally as the “Valley of the Drums.”
But the EPA didn’t do anything about dozens of other hazardous waste containers strewn in a nearby forested hollow, about 700 feet away, in what eventually became dubbed the “Gully of the Drums,” even though a local court had ordered a cleanup.

Emergency Operations Plan Training and Exercises for Schools
The Emergency Exercises Training Package from the REMS TA Center supports schools in developing and strengthening emergency operations plans (EOPs). An Introduction to Mental Health First Aid
Imagine you have a colleague who is typically responsible and reliable, but lately, they’ve seemed uncharacteristically tired, forgetful, or distracted. They previously arrived at work on time, but now they’re often late. They don’t dress as sharply as they used to. You know they’re under heightened stress due to factors in their professional or personal life, and you’re worried these pressures are affecting their mental health. If you’re certified in first aid, you would know how to help a physically ill or injured colleague until emergency services arrive. But you may not know how to help a colleague facing a mental health challenge, such as depression, anxiety, or a substance use disorder.
In situations such as this, you may benefit from training in mental health first aid. According to Megan Hammes, a certified mental health first aid instructor, this training helps “any adult or caring citizen to learn how to identify, understand, and respond to signs of a mental health challenge or a substance use challenge,” similar to how traditional first aid training helps people respond to physical health emergencies.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

IHMM Foundation Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
