Beltway Buzz – Ogletree Deakins
Uh-oh: Government Shutdown Chances Increase. The Buzz continues to monitor the potential for a federal government shutdown. Last week, we noted a positive development: leadership in both the U.S. Senate and U.S. House of Representatives appears to agree that a short-term continuing resolution will be necessary to avoid a federal government shutdown on October 1, 2023. This week, on the other hand, brings a not-so-positive development. The House Freedom Caucus (comprised of roughly thirty Republican members), issued a statement noting that they will not support a continuing resolution that fails to include a separate border security bill (which the House passed in May 2023)—or one that fails to address policies at the U.S. Department of Justice and the Pentagon with which these representatives disagree. With the thin majority in the House, this means that if Freedom Caucus members remain committed to these demands, the House would not be able to pass a continuing resolution unless they convince some Democrats to vote with them. This could make getting a continuing resolution through the House particularly challenging.
NLRB Returns to 2014 “Ambush” Election Rules. On August 25, 2023, the National Labor Relations Board (NLRB) issued a direct to final rule amending its union election procedures. The rule rescinds changes that the Board made in 2019 to its election procedures and reinstalls the 2014 election procedure rule. According to the rule’s preamble, the latest changes “will enable the Board to better fulfill its duty to protect employees’ rights by fairly, efficiently, and expeditiously resolving questions of representation.” Some of the major changes include the following:
- The pre-election hearing will be scheduled to eight calendar days from service of the notice of hearing. Regional directors may only postpone this hearing for up to two days upon a showing of “special circumstances.” In contrast, the 2019 rule set the pre-election hearing fourteen business days from service of the notice of hearing.
- The employer’s statement of position will be due seven days from the notice of hearing.
- The rule eliminates the 2019 requirement for the petitioning union to file a statement of position.
- The rule limits the scope of the pre-election hearing to determining whether a question of representation exists. Issues concerning the scope of the unit and voter eligibility, which had been traditionally debated at this hearing, will not be litigated under the new rule.
- Post-hearing briefs are only permissible at the regional director’s special permission.
- Employers will have two, as opposed to the current five, business days to post the notice of petition for election.
- The rule requires elections to be scheduled at “the earliest date practicable” and eliminates the twenty-business day waiting period.
Although the Board forecasted these changes on the biannual regulatory agenda, because it is a direct to final rule, it did not seek input from the public on the changes. The new rules become effective on December 26, 2023. Eric C. Stuart, C. Thomas Davis, and Zachary V. Zagger have the details.
Wilcox Out … For Now. Speaking of the Board, Democratic Member Gwynne Wilcox’s term expires on August 27, 2023. President Biden has renominated Wilcox for a second term, and Senate Majority Leader Chuck Schumer (D-NY) has teed up a confirmation vote on her nomination for some time after the U.S. Congress’s August recess. Because President Biden has bucked tradition and has not paired Wilcox with a Republican nominee to fill the seat vacated by John Ring in December 2022, if Wilcox is confirmed, the Board would remain at a 3-1 Democratic majority. There is usually a flurry of activity surrounding the expiration of a Board member’s term, so employers should be on the lookout for a final joint-employer regulation.
EEOC Implements New Strategic Plan. On August 22, 2023, the U.S. Equal Employment Opportunity Commission (EEOC) announced the adoption of its strategic plan for the coming years. The Strategic Plan for Fiscal Years 2022-2026, which went into effect immediately, sets forth the Commission’s three primary strategic goals:
- “Combat and prevent employment discrimination through the strategic application of the EEOC’s law enforcement authorities.” As part of this goal, the EEOC emphasizes its Systemic Program, which makes “the identification, investigation, and litigation of systemic discrimination cases (pattern or practice, policy, and/or class cases where the alleged discrimination has a broad impact on an industry, profession, company, or geographic area) a top priority.” This includes “enhanced monitoring of conciliation agreements.”
- “Prevent employment discrimination and advance equal employment opportunities through education and outreach.” This includes providing “technical assistance to underserved segments of the employer community” as well as an effort to “[t]arget outreach to small, new, and disadvantaged/underserved employers.”
- “Strive for organizational excellence through our people, practices, and technology.” The purpose of this goal is “to ensure the agency is held accountable for improving its operations where necessary,” and focuses on the “effective management of financial and technological resources.”
The document is separate from another similarly named document—the Strategic Enforcement Plan for Fiscal Years 2023-2027—that outlines the Commission’s substantive areas of focus from an enforcement standpoint.
National Preparedness Month and Worker Safety and Health Resources
Following the catastrophic impact of the Maui wildfires and natural disasters that have occurred in other parts of the U.S., we want to remind everyone that September is National Preparedness Month and that OSHA has an Emergency Preparedness and Response webpage that provides information to protect workers responding to hurricanes, wildfires, tornadoes, floods, and other natural disasters. For you convenience, I’ve attached OSHA’s Worker Safety and Health Resources for Hurricane and Flood Cleanup and Recovery and OSHA’s Fact Sheet: Keeping Workers Safe During Disaster Cleanup and Recovery (both found on OSHA’s webpage here). Please note that many of the OSHA materials are available in Spanish, along with a few Public Service Announcements that have been recorded and transcribed. Please share this information, as appropriate, with your stakeholders, including those who may be cleanup and recovery employers, workers, and volunteers.

OMB Completes WOTUS Review, Teeing Up Likely Industry Challenges
The White House Office of Management and Budget (OMB) has completed its review of the Biden administration’s final rule defining “waters of the United States” (WOTUS) as a result of the Supreme Court ruling in Sackett v. EPA, clearing the way for the rule’s release and likely new challenges from industry groups concerned over its narrow scope and amendment process.
The final rule, to be issued jointly by EPA and the Army Corps of Engineers, cleared OMB review on Aug. 17, exactly one month since it was sent to OMB, and coming just weeks before officials’ Sept. 1 target release date, as outlined in litigation over the administration’s January 2023 Clean Water Act (CWA) rule.
EPA and other officials have not yet provided significant details about the rule’s content though they have told stakeholders, lawmakers and courts that they intend to issue a “good cause” final rule that “surgically” amends portions of its rule issued earlier this year to account for Sackett.

DOD Notifies Hundreds More Agricultural Sites Of Possible PFAS Impacts
In response to a congressional mandate, the Defense Department (DOD) has issued new notifications to more than 360 agricultural operations that PFAS-contaminated groundwater may be affecting local agriculture and has provided updated information to hundreds of previously notified farm sites about potential PFAS impacts.
While DOD emphasizes in its fiscal year 2023 status report that the notifications do not necessarily mean that per- and polyfluoroalkyl substances (PFAS) are in the groundwater at the agricultural location or that cleanup is required, the new notifications represent an expansion of the scope of possible agricultural impacts.
Congress in section 335 of the FY21 National Defense Authorization Act (NDAA) required DOD to notify agricultural operations within one mile down gradient of military bases or National Guard facilities where any of three PFAS stemming from the bases has been detected in groundwater above advisory levels and “has been hydrologically linked to a local agricultural or drinking water source.”
The three PFAS are perfluorooctanoic acid (PFOA) and perfluorooctane sulfonate (PFOS) at 70 parts per trillion (ppt), individually or in combination, and/or perfluorobutanesulfonic acid (PFBS) at 40 parts per billion (ppb).
DOD has long used 70 ppt for PFOA and PFOS as a cleanup level, adopting EPA’s non-regulatory drinking water advisory levels (HALs) set in 2016, even as EPA in 2022 updated the chemicals’ interim HALs to be at near-zero levels.

Embroiled In Complex ‘Good Neighbor’ Suits, EPA Delays Ozone Review
EPA is spurning calls from environmentalists and Hill Democrats to quickly tighten ozone air quality standards and is instead announcing a years-long delay to study the underlying science, a decision that could be due in part to the litigation morass the agency faces over its landmark ‘Good Neighbor’ rule to help achieve current standards.
The agency’s flurry of recent policy actions on ozone pollution is headlined by Administrator Michael Regan’s Aug. 21 decision to drop a reconsideration of the Trump administration’s decision to retain Obama-era ozone national ambient air quality standards (NAAQS) and instead launch a new statutory review of the standards:

In a blow to environmentalists, EPA Administrator Michael Regan has dropped the agency’s contested reconsideration of Trump-era ozone standards and started a new statutory review, citing questions by his hand-picked advisers about the underlying science, and pushing the issue beyond the end of President Joe Biden’s current term.
Critically, Regan’s decision means EPA’s new review will push any final decision well beyond the end of 2024, when EPA had hoped to conclude its reconsideration.
EPA cited questions by Regan’s hand-picked advisers about the underlying science of the ozone NAAQS, arguing the agency must start from scratch with a fresh integrated science assessment (ISA), a time-consuming process.

EPA Seeks to Modify RCRA Standards for Managing Containers and Drums
The U.S. Environmental Protection Agency (EPA) released an advance notice of proposed rulemaking with a focus on modifying the treatment and handling of “empty” containers and drums under the Resource Conservation and Recovery Act (RCRA). The EPA is soliciting information and requesting comments “to assist in the potential development of non-regulatory and regulatory options that would ensure the proper management of used industrial containers that held hazardous chemicals or hazardous waste, up to and including the drum reconditioning process.”

National Environmental Policy Act Implementing Regulations Revisions Phase 2
The Council on Environmental Quality (CEQ) is proposing this “Bipartisan Permitting Reform Implementation Rule” to revise its regulations for implementing the procedural provisions of the National Environmental Policy Act (NEPA), including to implement the Fiscal Responsibility Act’s amendments to NEPA. CEQ proposes the revisions to provide for an effective environmental review process that promotes better decision making; ensure full and fair public involvement; provide for an efficient process and regulatory certainty; and provide for sound decision making grounded in science, including consideration of relevant environmental, climate change, and environmental justice effects. CEQ proposes these changes to better align the provisions with CEQ’s extensive experience implementing NEPA; CEQ’s perspective on how NEPA can best inform agency decision making; longstanding Federal agency experience and practice; NEPA’s statutory text and purpose, including making decisions informed by science; and case law interpreting NEPA’s requirements. CEQ invites comments on the proposed revisions.

EPA Selects Final National Enforcement and Compliance Initiatives
After proposing new National Enforcement and Compliance Initiatives (NECI) in January and considering comments from states, tribes, NGOs and other parties, newly confirmed Environmental Protection Agency (EPA) enforcement chief David Uhlmann announced Thursday the adoption of three new NECIs and one modified NECI for the 2023-2027 cycle.
The EPA selects NECIs to guide the EPA and delegated states’ deployment of criminal and civil enforcement resources. The initiatives are selected based on the need to address serious and widespread environmental issues and significant violations impacting human health and the environment, particularly in overburdened and vulnerable communities. The agency also considers where federal enforcement authorities, resources, and expertise are needed and ensures the initiatives are consistent with the EPA’s strategic plan.

Pipeline Safety Research and Development Forum 2023 – Registration OPEN 8/8-10/20
The mission of the Pipeline and Hazardous Materials Safety Administration (PHMSA) is to protect people and the environment by advancing the safe transportation of energy products and other hazardous materials that are essential to our daily lives. In helping with this advancement, PHMSA Pipeline Safety Research and Development (R&D) Forum is held periodically to generate a national research agenda that identifies technical challenges, fosters solutions to improve pipeline safety and protect the environment, and provides a venue for information exchange among key stakeholders, including the public, states, other federal agencies, industry, and international colleagues. The meeting and forum are open to the public; those who wish to attend must register on the meeting website, including their names and organizational affiliation.
The forum will be held October 31–November 1, 2023, from 8:00 a.m. to 4:30 p.m. Online preregistration are open on Tuesday, August 8, 2023, and close on Friday, October 20, 2023. The forum will be held in person at the Westin Crystal City Reagan National Airport, 1800 Richmond Highway, Arlington, Virginia 22202. There will be a webcast of the opening remarks, including the technical presentations on Day 1.
The full agenda will be updated on the meeting website below. Day 1 will start with technical presentations, followed by five working group breakout sessions. Day 2 will have continued working group sessions, finishing up with brief out presentations from each working group to wrap up the forum.

Professional Certification Coalition
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis. The PCC has compiled several “Watchlists” identifying and analyzing provisions in pending legislation at both the state and federal level that, under applicable rules, may still be enacted in the current legislative session. Depending on the carry-over rules in the relevant legislature, the charts listing current legislation may include bills introduced in a prior year. In addition, the PCC compiles each year a chart of enacted legislation that affects certification. The charts include hyperlinks to every bill or executive order. Note that the Watchlist and the Enacted Legislation document do not include profession-specific legislation and do not include regulatory initiatives. The charts will be updated as needed based on new developments.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together
Regulatory Updates
PHMSA’s Office of Hazardous Materials Safety will be hosting public forums in advance of four international meetings, to allow the public to give input on current proposals being considered by the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP) and the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG). The international meetings include:
- The 29th session of the ICAO TDG, scheduled for November 13 to 17, 2023, in Montreal, Canada
- The 63rd session of the UNSCOE TDG, scheduled for November 27 to December 6, 2023, in Geneva, Switzerland
Each of these public meetings will be held approximately two weeks before the corresponding international meeting. Specific information for each meeting, including date, time, conference call-in number, and details for advance registration will be posted when available on the PHMSA website under “Upcoming Events.” These meetings will be virtual, with hybrid options available as possible, pending public health guidelines.

HM-265A: Modernizing Regulations to Improve Safety and Efficiency

On July 5, 2023, PHMSA published the Advance Notice of Proposed Rulemaking (ANPRM) “HM-265A: Modernizing Regulations to Improve Safety and Efficiency” to the Federal Register. Based on feedback from industry stakeholders, internal PHMSA review, NTSB safety recommendations, and modal safety partners, the ANPRM addresses 46 separate areas where the requirements of the HMR may need to be updated to increase efficiency while improving safety. The Dr. John H Frick Memorial IHMM Scholarship Program
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

IHMM – 26 Fellows Are Mentors
IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to engage both 26 IHMM Fellows as Mentors and anyone who seeks some assistance as Mentees.
Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities. This article from ASAE magazine outlines how a mentoring program can become more successful – engagement!
IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

While the full recertification cycle is 5 years, IHMM encourages all certificants to start a recertification application and add certification maintenance points as they are earned to make the final submission quick and easy to accomplish.
Retiring? IHMM Invites You to Become an Emeritus
You may have decided, after a long and successful career, to retire from active daily duty. Congratulations. That doesn’t mean you have to completely disengage from your profession. IHMM is pleased to offer Emeritus status to all certificants who will no longer be actively engaged in their communities of practice but who still want to stay in touch. At this point, the adoption process is complete. We will conclude limited public review and then move forward with publication of ISO 45002 and ISO 45006 as an ANSI Registered Technical Report[s].

CHEMTREC, HMS Training Partner, Adds HAZWOPER Refresher Training
This week CHEMTREC has added its HAZWOPER 8-hour Refresher Training to the HMS Daily Training schedule. This HAZWOPER 8-hour Refresher Training is designed for individuals who need to refresh their existing 24-hour or 40-hour HAZWOPER certification. This course meets the requirements outlined in OSHA 29 CFR 1910.120 for 8 (eight) hours of annual refresher training for workers involved in the transport, storage, or handling of hazardous materials or hazardous waste.

Respiratory Protection Program Management – Susan Harwood Training Grant
University of Texas Medical Branch, William J. Pate, CHMM
This training course is intended to educate participants on the requirements of developing and implementing a compliant Respiratory Protection Program. The focus of this course will be on topics related to preparation for an infectious disease pandemic. At the end of this training the attendee should be able to:
1) Manage an effective respiratory protection program through proficient application of 29 CFR 1910.134
2) Compare potential routes of exposure
3) Identify and implement potential controls (engineering, administrative, and PPE)
4) List the equipment needed to support fit testing
5) Explain the difference between qualitative and quantitative fit testing
6) Discuss the different types of respiratory protection available
7) Demonstrate correct donning/doffing of respiratory protection
This training course is 7.5 hours and participants will receive a certificate of completion that may be suitable for professional certification maintenance (CSP, CIH, CHMM, CHSP, etc.).
This course will provide 7.5 Continuing Nursing Education (CNE) contact hours. Accreditation statement: University of Texas Medical Branch at Galveston is approved with distinction as a provider of nursing continuing professional development by Louisiana State Nurses Association – Approver, an accredited approver by the American Nurses Credentialing Center’s Commission on Accreditation. LSNA Provider No. 4002176
This training is available only to employees and employers who are subject to OSHA regulatory requirements. Grant-funded training is not available to state or local government employees unless they have occupational safety & health responsibilities (e.g. occupational safety and health trainers, program managers, committee members, or employees responisble for abating unsafe and unhealthy working conditions for their organization). Registration in this course confirms that meet these conditions. This training will include the opportunity to don, doff, and fit test respiratory protection including N95, half-face, full-face, and powered air-purifying respirators. Anyone participating in this training and wanting to put on a respirator agrees that they have been medically cleared by their employer to do so in accordance with OSHA’s Respiratory Protection Standard.

FREE US DOT PHMSA HMIT GRANT HAZARDOUS MATERIALS REGULATIONS AWARENESS TRAINING WORKSHOP – 24 IHMM CMPs

These workshops are offered with U.S. DOT PHMSA HMIT (Hazardous Materials Instructor Training) Grant support to the National Partnership for Environmental Technology Education (National PETE). This training is FREE for employees and federal, state, county, and local government employees involved in DOT HazMat Shipping, Receiving and Handling via Ground, Air, and Vessel Transportation.
The workshop curriculum is in accordance with 49 CFR § 172.704 for General Awareness, Function-Specific, Safety, and Security Awareness training requirements. Class size is limited to 10-15 students with mask/social distancing protocols, so act fast. Minimum of 6 attendees is needed to confirm the class.

You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 365 CHMM applicants IHMM had on June 27, 2023, all 365 looking for CHMM prep courses could see and choose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 365 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.

HMS Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).

The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
DEADLINE TO SUBMIT SCHOLARSHIP AWARD APPLICATIONS IS December 1, 2023. All submissions and associated materials must be submitted using the online form.
