McCambridge, and Richard A. Young created what would become an Institute that offers 11 professional credentials across Hazardous Materials/Dangerous Goods and EHS Work Place Safety communities of practice in all 50 of the United States and 85 other countries.

In late October IHMM issued an RFP soliciting proposals to work with IHMM on the creation of an Associate Hazardous Materials Manager™ [AHMM™] examination preparatory course.

IHMM is pleased to announce that it has selected Columbia Southern University and VUBIZ, both organizations already work with IHMM on delivering other credential prep courses, to work with IHMM on the AHMM project.

IHMM Organizing Broader Government Affairs Activities – Call for Volunteers

In strategic planning on August 17, 2023 IHMM created a strategic imperative to create a broader government affairs operation on behalf of, and with the assistance of, all of IHMM’s certificants.

On August 29, 2023 IHMM’s Executive Director made a presentation of this strategic imperative to the AHMP annual conference. Here is what IHMM intends to organize over the next few months:

IHMM To Propose Changes in Government Recognition of Credentials

State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.

The Occupational Safety and Health Administration has a number of courses in occupational safety and health within which OSHA credits “A degree in occupational safety and health, a Certified Safety Professional (CSP) or a Certified Industrial Hygienist (CIH) designation.” IHMM will propose including the CHMM, CSHM, and CSMP.

Congress Returns and Faces Year-End Push. The U.S. Congress returned this week from its Thanksgiving break and is currently scheduled for a three-week legislative session leading up to the end of the calendar year. While the latest government shutdown crisis has been temporarily averted—again—Congress has a lot on its plate and a short amount of time with which to work. Addressing aid for Israel and Ukraine, passage of the fiscal year 2024 National Defense Authorization Act, reauthorization of the Federal Aviation Administration, and military promotions are all items included on the to-do list. Legislators likely want to make progress on those appropriations bills, as well, because those pushed-back funding “double deadlines” of January 19, 2024, and February 2, 2024 (agencies such as the U.S. Department of Labor (DOL), National Labor Relations Board (NLRB), U.S. Equal Employment Opportunity Commission (EEOC), and U.S. Department of Homeland Security (DHS) will be funded through the latter date) will arrive very quickly when the calendar flips to 2024.

House Committee Challenges Overtime Proposal. On November 29, 2023, the U.S. House Subcommittee on Workforce Protections held a hearing entitled, “Bad for Business: DOL’s Proposed Overtime Rule.” As the title implies, the purpose of the hearing was to examine the proposed overtime rule and ramp up political pressure against its finalization. One witness, an independent hotelier, noted that the rule would likely force employers to reclassify employees as nonexempt. She predicted that this would lead to a decline in employee morale as workplace status is diminished and certain benefits, such as flexible scheduling, remote work, and work-related travel, would no longer be available to nonexempt employees. Also in the crosshairs was the proposal’s provision that would automatically adjust the salary basis level, regardless of exigent economic circumstances. In his opening statement, Subcommittee Chair Kevin Kiley (R-CA) stated, “The most concerning part about this rule is that it puts the policy on autopilot. Future changes should be subject to the regular policy review, including consulting with stakeholders, rather than a one size fits all formula. Automatic increases are bad policy and bad government practice.” A final rule is expected in the spring or summer of 2024.

House Committee Examines Right to Work. On November 30, 2023, the House Subcommittee on Health, Employment, Labor, and Pensions held a hearing entitled, “Safeguarding Workers’ Rights and Liberties.” The hearing focused on the National Right to Work Act, a bill that would remove language from federal law that allows for contracts requiring employees to join or pay fees to a union as a condition of employment. The bill has 116 cosponsors in the U.S. House of Representatives and thirty cosponsors in the U.S. Senate—all Republican. The bill is unlikely to get much traction in the Democratic-controlled Senate.

DOL Adjusts Child Labor Penalties. The DOL’s Wage and Hour Division (WHD) continues to take steps to address and prevent child labor violations. On November 28, 2023, WHD issued Field Assistance Bulletin (FAB) No. 2023-4, on “Child Labor Civil Money Penalty Assessments for Nonserious Injury and Noninjury Violations.” The purpose of the FAB “is to ensure that WHD’s Child Labor Civil Money Penalty (CL CMP) assessments are based on the agency’s statutory enforcement authority and that the agency is appropriately and consistently utilizing its full authority in every child labor enforcement action.” The FAB goes on to describe the new process for assessing civil money penalties in child labor cases that involve nonserious injury and noninjury violations:

In order to fully utilize its statutory and regulatory authority, when assessing CL CMPs in nonserious injury and noninjury cases, the agency will no longer determine CL CMP assessments on a per child basis. Instead, the agency will assess CL CMPs per violation as authorized in the statute. For instance, if there are three separate violations relative to a child’s employment (such as two hazardous occupations orders violations and one recordkeeping violation), the employer will be assessed three separate CMP penalties, each of which can reach the statutory maximum.

The statutory maximum is $15,138 per violation. The FAB goes on to instruct regional administrators and district directors on how to adjust the penalties depending on the gravity of the offense and the size of the employer. The FAB is effective immediately.

Senate Rejects ETA Nominee. President Biden’s nominee to run the DOL’s Employment and Training Administration (ETA), José Javier Rodríguez, did not advance past a crucial procedural vote this week on the floor of the U.S. Senate. Senators Joe Manchin (D-WV) and Bob Menendez (D-NJ) voted with Republicans against Rodríguez, effectively scuttling the nomination. The ETA, which oversees federal apprenticeship programs, the federal component of the unemployment insurance program, and the Office of Foreign Labor Certification, has not had a confirmed assistant secretary during the Biden administration.

Comment Period Opens for EPA’s Proposed PGP

The U.S. Environmental Protection Agency (EPA) is seeking public comment on the proposed 2026 National Pollutant Discharge Elimination System (NPDES) Pesticide General Permit (PGP) for discharges of pesticides to waters of the United States in areas where EPA is the NPDES permitting authority. Pursuant to a settlement agreement, EPA is issuing the 2026 PGP on or prior to December 17, 2024, with an effective date of October 31, 2026.

Pipeline Safety Research and Development Program

Develop and Demonstrate a Remote Multi-Sensor Platform for Right of Way Defense

Objective: The project will improve and deploy additional instances of a pipeline right-of-way (ROW) monitoring system based on stationary sensors mounted on/near the pipeline. Sensor data from multiple locations along the pipe is wirelessly forwarded to a central location for processing and analytics, correlating the data from multiple sensors to rapidly alert operators to events occurring in the ROW. The project will deploy improved field hardware with machine learning analytics.

EPA Air Rules Face Scrutiny, Global Climate Talks Heat Up In Dubai

EPA’s air quality advisors and other groups are slated to discuss a suite of pending rules governing criteria pollutants, air toxics and greenhouse gases including its Good Neighbor Plan governing interstate ozone emissions, mobile source rules and others. Negotiators at international climate change meeting in Dubai are slated to ramp up discussion about whether to restrict fossil fuels, increase renewable energy capacity, slash methane emissions, and make various other efforts to curb climate change.

EPA Invokes TSCA To Block Manufacture Of PFAS-Contaminated Plastics

EPA is ordering a plastics manufacturer already facing a landmark TSCA enforcement suit over alleged PFAS contamination in its fluorinated plastics to stop production of the materials within two months, saying several of the chemicals clearly present unreasonable risks banned by the law while others require more testing to gauge their safety.

EPA Aims To Strip ‘Affirmative Defense’ From Oil And Gas Air Toxics Rules

EPA is proposing to remove “affirmative defense” provisions shielding the oil and natural gas industry from civil liability for malfunctions in the production and transmission sectors, in line with agency policy and legal precedent, as the agency presses to remove waivers for periods of plant startup, shutdown and malfunction (SSM) more broadly

Industry, Environmentalists Clash Over Legality Of EPA’s Air Reporting Plan

Industry groups and environmentalists are at odds over the legality of EPA’s planned expansion of air emissions reporting, with a host of manufacturers warning the plan exceeds the agency’s legal authority and would overburden regulators and facilities, but environmentalists counter that the expansion is not only legally necessary, but must go further to measure air toxics.

EPA Floats 10-Year Plan For Replacing Lead Lines But Utilities Fear Barriers

Lithium batteries are a fact of modern life. They power our computers, smartphones, and a wide variety of other consumer goods. The high value of such products and the demand for swift delivery means that, more often than not, air cargo is the transportation mode of choice. The revenue potential is huge.

But the devil is in the detail. All lithium batteries must be declared, labeled, packaged, and handled correctly. We want to make sure you are always in full compliance with the regulations and there are a multitude of manuals and support tools to help you with the processes involved.

Lithium Battery Shipping Regulations (LBSR)

As adoption of electric cars, e-bikes increase and lithium batteries become lighter and last longer, the number of products relying on lithium batteries will only continue to grow.

Though a practical and efficient way to store energy, lithium batteries, if not properly designed, tested and manufactured can fail and catch fire. In addition, the stored energy and flammable electrolyte in the battery means that they must be prepared properly for shipping to reduce the potential risk to the transport system.

To help address this, we’ve put together the LBSR; a manual with all the information manufacturers, retailers, wholesalers, freight forwarders and others in the supply chain need to ensure compliance when shipping lithium batteries.

OSHA announces National Advisory Committee on Occupational Safety and Health will meet Dec. 12

The Department of Labor’s Occupational Safety and Health Administration will hold an in-person and online meeting of the National Advisory Committee on Occupational Safety and Health on Tuesday, Dec. 12, 2023, from 10 a.m. to 4 p.m. EST. Committee members will meet in person and the event will be open to the public either in person or online.

The meeting will include new member introductions, updates from OSHA and the National Institute for Occupational Safety and Health, and discussions about the NIOSH Mental Health for Healthcare Workers Campaign, safety as a core value and whistleblower protection.

Register to attend the meeting in person or online. Once registered, online attendees will receive a link for remote meeting access and in-person attendees will receive directions for participation. In-person attendance by the public is limited to 25 people.

Submit comments and requests to speak to the Federal eRulemaking Portal, Docket Number OSHA-2023-0003, by Nov. 27, 2023. Be sure to include the docket number on all submissions. Read the Federal Register notice for submission details.

Professional Certification Coalition

IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis. The PCC has compiled several “Watchlists” identifying and analyzing provisions in pending legislation at both the state and federal level that, under applicable rules, may still be enacted in the current legislative session.  Depending on the carry-over rules in the relevant legislature, the charts listing current legislation may include bills introduced in a prior year.  In addition, the PCC compiles each year a chart of enacted legislation that affects certification. The charts include hyperlinks to every bill or executive order. Note that the Watchlist and the Enacted Legislation document do not include profession-specific legislation and do not include regulatory initiatives. The charts will be updated as needed based on new developments.

IHMM Credential Recognition

The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/

In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.

  • We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
  • We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
  • We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].

in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional. 

Here’s what we ask each volunteer to do:

  • Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
  • Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

The Dr. John H Frick Memorial IHMM Scholarship Program – Closed for 2023 –  Deadline 10/15/2023 – Re Opens in 2024

The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.

IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

You may have decided, after a long and successful career, to retire from active daily duty. Congratulations. That doesn’t mean you have to completely disengage from your profession.   • ISO/ASSP TR 45002-2023:   Occupational health and safety management systems – General guidelines for the implementation of ISO 45001:2018
  • ISO/ASSP TR 45006-2023:  Occupational health and safety management – Guidelines for organizations on preventing and managing infectious diseases

At this point, the adoption process is complete.  We will conclude limited public review and then move forward with publication of ISO 45002 and ISO 45006 as an ANSI Registered Technical Report[s].

AHMP Cyber Chapter Adds EHMM Course

The  AHMP Cyber Chapter has added the Essentials of Hazardous Material Management (EHMM) Course for January 15-17, 2024. This course provides instruction on laws and regulations as well as technologies and practices in an overview fashion that highlights and emphasizes what is important for a hazardous materials manager to know and provides essential information for the hazardous materials manager to better conduct his/her job.

This two-day workshop provides comprehensive training to offer hazardous materials for transportation in compliance with the US DOT/PHMSA Hazardous Materials Regulations (HMR). The two-day workshop is approved for 12 CM Points toward IHMM re-certification.

CHEMTREC, HMS Training Partner, Adds HAZWOPER Refresher Training

CHEMTREC has added its HAZWOPER 8-hour Refresher Training to the HMS Daily Training schedule. This HAZWOPER 8-hour Refresher Training is designed for individuals who need to refresh their existing 24-hour or 40-hour HAZWOPER certification. This course meets the requirements outlined in OSHA 29 CFR 1910.120 for 8 (eight) hours of annual refresher training for workers involved in the transport, storage, or handling of hazardous materials or hazardous waste.

Every IHMM certification that requires an examination has a section of its website entitled Examination Preparation.

Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.

You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.

When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.

For the 404 CHMM applicants IHMM had on November 8, 2023, all 404 applicants looking for CHMM prep courses could see and choose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 404 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy

Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.

Earning Certification Maintenance Points [CMPs] is illustrated under Recertification of Your Credential, that includes the Recertification Claims Manual – Appendix A, that details all of the ways a certificant may earn CMPs > https://ihmm.org/recertification-claims/

Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?

HMS has made that simple and easy.

  1. Go to https://hazmatsociety.org/education-training/
  2. Scroll down until you see a row of buttons…click on the CMPs button

The system will then generate all of the courses on the HMS E&T platform with IHMM CMPs already attached.

The next developments by the HMS E&T committee will refine available courses’ CMPs by individual credential!

HMS Certified Dangerous Goods Professional [CDGP] Exam Prep

The Columbia Southern University/HMS CDGP prep course is found here on the Hazardous Materials Society [HMS] education and training website > https://hazmatsociety.org/training/ce-1112-cdgp-exam-prep/2022-02-02/

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:

  • UN Recommendations on the Transport of Dangerous Goods, and
  • International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
  • International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
  • International Maritime Organization’s Dangerous Goods Code (IMDG Code).
