PHMSA’s ANPRM: Mandatory Regulatory Reviews – IHMM Seeks Certificant Input
Deadline: July 31, 2025
On June 4, 2025, the Department of Transportation (DOT) issued an Advance Notice of Proposed Rulemaking (ANPRM) – Hazardous Materials: Mandatory Regulatory Reviews to Unleash American Energy and Improve Government Efficiency.
Summary: PHMSA is publishing this advance notice of proposed rulemaking (ANPRM) to solicit stakeholder feedback on whether to repeal or amend any requirements in the Hazardous Materials Rulemaking Procedures and Program Procedures, or the Hazardous Materials Regulations to eliminate undue burdens on the identification, development, and use of domestic energy resources and to improve government efficiency.
This ANPRM supports opportunities to identify widely used hazardous material special permits with established safety records for conversion into deregulatory provisions with broader applicability.

H.R. 1 “One Big Beautiful Bill,” Passes the U.S. Senate 51-50
After a marathon vote-a-rama to consider floor amendments and to negotiate various provisions with hold-out Senators, today the Senate passed H.R. 1 by a vote of 51-50. The House is out this week, but Speaker Mike Johnson (R-La.) is calling House Republicans back from recess and targeting a Wednesday vote to try to meet Trump’s July 4 deadline.
On Saturday, the 28th, the Senate held a vote on a “motion to proceed,” an important procedural vote to determine if the legislation can be brought to the floor. The vote was 51-49, just barely passing.

Congress Needs to Hear From US
IHMM and its affiliated organizations continue to focus on two grassroots legislative activities: [a] Tomorrow’s Workforce Coalition and the need to pass HR 1151 and S 756 to provide an important tax benefit for certificates under IRS Code 529, and [b] Community Impact Coalition to discourage Congress from taxing nonprofit organizations. If you haven’t taken advantage of both of these congressional outreach opportunities, please see each below and complete both today.
IHMM/ASAE Campaign for “Freedom to Invest in Tomorrow’s Workforce Act” CALL TO ACTION
Thanks to the continued efforts of the Tomorrow’s Workforce Coalition, of which IHMM is a part, the Freedom to Invest in Tomorrow’s Workforce Act has been introduced in the House of Representatives and Senate! The language we sought in this legislation is in H.R. 1, which recently passed the House. Now it is on to the Senate.
The Freedom to Invest in Tomorrow’s Workforce Act would expand qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications. It would provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes, or alternative career pathways.
Please take a moment to make your voice heard on this important issue and share this grassroots campaign with your stakeholders to amplify our impact!

IHMM/CIC Grassroots Campaign on Nonprofit Organizations and Tax Reform
As Congress debates tax reform in 2025, some Members of Congress are considering raising taxes on nonprofit organizations – including charities, associations, professional societies, and veterans’ groups – to pay for the extension of expiring tax cuts. Increasing the tax burden on these organizations would leave less funding for your organization to drive toward its mission, resulting in negative consequences for the communities it serves.
Now, it is more important than ever for Congress to hear your voice. The House passed H.R. 1, and now the Senate will consider the legislation. We have all heard several senators discussing numerous changes to the House-passed legislation.

IHMM and the Community Impact Coalition in Washington
ASAE’s advocacy is making a meaningful impact as the bill takes shape. Thanks to efforts by ASAE’s Community Impact Coalition, the Senate removed a provision that would have taxed nonprofit organizations on parking and transportation fringe benefits — preserving critical resources that can now be directed toward mission-driven work.
The bill also incorporates the Freedom to Invest in Tomorrow’s Workforce Act, long championed by ASAE’s Tomorrow’s Workforce Coalition. This measure would expand 529 plan eligibility to include licenses and nongovernmental credentials offered by associations, giving more Americans flexible, affordable pathways to career success beyond the traditional college route.
ASAE and the CIC both delivered letters to the House and Senate tax-writing committees last week, applauding the Senate Finance Committee for removing the fringe benefits tax provision and including the 529 expansion language in its bill text. ASAE and its coalitions remain actively engaged as the legislative process moves forward.

The Dr. John H Frick Memorial IHMM Scholarship Program – Accepting Applications in September, 2025
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

- IHMM has filed comments on the OMB Inquiry concerning the EPA and DOL proposed regulatory measures concerning Methylene Chloride on December 13, 2024.
- IHMM Sent a letter to the U.S. Department of the Interior, National Park Service, concerning the uses of professionally credentialed persons performing work for the Park Service.
- IHMM Signs Letter Opposing Reductions in OSH Worker’s Pay – The IHMM Government Affairs Committee has agreed to sign a coalition letter opposing reductions in pay for IH and OSH employees. Here is the coalition letter we signed.
4. IHMM submitted comments on OSHA Advisory Committee on Construction Safety and Health (ACCSH): Notice of Meetings concerning OSHA-2024-0002-0007, and highlighted the creation of IHMM’s Certified Pandemic Preparedness Specialist [CPPS] credential.
5. State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation, work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.

SCOTUS Rejects Retiree’s ADA Claim. Late last week, the Supreme Court of the United States affirmed a decision by the U.S. Court of Appeals for the Eleventh Circuit that limits the ability of retirees to bring discrimination challenges under Title I of the Americans with Disabilities Act (ADA). In Stanley v. City of Sanford, Florida, the plaintiff—a retired firefighter—claimed that her employer had violated the ADA by deciding (fifteen years prior to her retirement) to provide different health insurance coverage to employees who retired due to disability, as opposed to those who retired after a certain amount of service. Writing for the majority, Justice Neil Gorsuch determined that the ADA only prohibits disability-based discrimination against a “qualified individual”—defined in the statute as “an individual who, with or without reasonable accommodation, can perform the essential functions of the employment position that such individual holds or desires.” The Court ruled that the retiree plaintiff was not a “qualified individual” and therefore could not bring her claim. DOL Jump-Starts Regulatory Agenda. The Trump administration has not yet issued its first regulatory agenda (though it is expected to be released at any moment now), but officials at the U.S. Department of Labor (DOL) aren’t letting that stop them from moving forward with several rulemaking initiatives. The following proposals were sent this week to the Office of Information and Regulatory Affairs (OIRA) and are at the pre-rule stage:
- Occupational Safety and Health Administration (OSHA): “Interpretation of the General Duty Clause: Limitation for Inherently Risky Professional Activities.”

Unfortunately, at this stage of the rulemaking process, these proposals are not made available to the public. After OIRA reviews and approves these proposals, the DOL will publish them as notices of proposed rulemaking in the Federal Register, and this will kick off the public comment process.
EEOC, DOL Nominations Update. On June 26, 2025, the Senate Committee on Health, Education, Labor and Pensions (HELP) voted along party lines to advance the nominations of Andrea Lucas to be a member (for a second term) of the U.S. Equal Employment Opportunity Commission (EEOC), Jonathan Berry to be solicitor of labor, David Keeling to be assistant secretary of labor for occupational safety and health, Daniel Aronowitz to be assistant secretary of labor and head the Employee Benefits Security Administration (EBSA), and Andrew Rogers to be administrator of the DOL’s Wage and Hour Division. The next step for the nominees is a vote on the floor of the U.S. Senate.
Additionally, while Aronowitz awaits that vote by the full Senate, the former chair of the EEOC, Janet Dhillon, has been named acting assistant secretary for EBSA. Dhillon is also awaiting a vote on her own nomination to run the Pension Benefit Guaranty Corporation.
DHS Launches “Status Change Report” for E-Verify Users. The Trump administration’s actions to terminate the Cuba, Haiti, Nicaragua, and Venezuela (CHNV) parole program and other parole programs have left many employers confused as to how to balance their legal obligation to refrain from hiring unauthorized workers without violating the discrimination provisions of federal immigration law. The U.S. Department of Homeland Security (DHS) recently issued a notice to employers about a new E-Verify “Status Change Report” that “allows E-Verify employers to review their aggregated case data for any employees who presented an EAD [employment authorization document] for employment verification which has now been revoked by DHS.” Employers are required to “begin reverifying each current employee whose EAD the Status Change Report indicated was revoked, and complete all reverifications within a reasonable amount of time.” Of course, this new guidance only impacts employers enrolled in E-Verify.
GAO: OLMS Can Improve LMRDA Enforcement. The Government Accountability Office (GAO) has issued a report, “Labor Organization Oversight: Department of Labor Should Enhance Enforcement and Assistance Processes.” The report examines how well OLMS is doing in enforcing the Labor-Management and Reporting Disclosure Act (LMRDA), the federal law that promotes transparency and financial integrity of labor organizations. According to the report, “from fiscal years 2019 through 2023, OLMS identified LMRDA violations in at least 92 percent of labor organizations selected for audit.” The report offers seven recommendations for how the DOL can improve in this area, including developing protocols “to track labor organizations that OLMS officials determine merit follow up based on past violations identified during a compliance audit.” OLMS was basically dormant during the Biden administration, but as indicated by the proposals it has already sent to OIRA (described above) the Buzz expects the office to be more diligent in ensuring labor unions’ compliance with their LMRDA obligations.

OSHA Heat Rule Hearings Updated
As follow-up to the email below, the Occupational Safety and Health Administration (OSHA) has provided a schedule for the informal public hearing on its Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings proposed rule. The public hearing will to be held virtually beginning on June 16, 2025, and continuing through July 2, 2025.

OSHA Public Hearing on Heat Injury and Illness Prevention Proposed Rulemaking: OSHA will host a virtual public hearing on its proposed rule to protect workers from hazardous heat exposure in indoor and outdoor workplaces. The public hearing on the Notice of Proposed Rulemaking on Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings will begin on June 16, 2025, at 9:30 a.m. EDT, and continue on subsequent weekdays if necessary. OSHA Releases 2024 Workplace Injury and Illness Data: The Occupational Safety and Health Administration (OSHA) issued a press release announcing the release of 2024 injury and illness data based on reports by more than 300,000 establishments through the Injury Tracking Application. PHMSA Announces Public Meetings For International Standards On The Transport Of Dangerous Goods
The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced on March 12, 2025, that its Office of Hazardous Materials Safety (OHMS) will host four public meetings during 2025 in advance of certain international meetings. The second meeting will be held in preparation of the 66th session of the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) scheduled for June 30 – July 4, 2025, in Geneva, Switzerland. The third meeting will be held in preparation of the 30th session of the ICAO DGP (DGP/30) scheduled for October 6 – 10, 2025, in Montreal, Canada. The fourth meeting will be held in preparation of the 67th session of the UNSCOE TDG scheduled for November 24 – December 3, 2025, in Geneva, Switzerland. PHMSA will solicit public input on current proposals for each of these meetings. PHMSA states that each public meeting will take place approximately two weeks preceding the international meeting at the headquarters for the Department of Transportation in Washington, D.C.

UNSCOE TDG 66th Session – Day 1 Summary
The United Nations Subcommittee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) is holding their 66th Session June 30 through July 4, 2025 in Geneva, Switzerland. There are 36 formal and 57 informal papers submitted for discussion as of Day 1. This session is the first of four sessions during the 2025-2026 biennium.
All daily sessions are to be held formally (interpreted). Therefore, papers are to be reviewed as listed on the agenda (INF.2) and final decisions will be taken when appropriate.
This summary is provided to assist you in following the discussions of the papers and is not intended as a full summary of document that was presented. Note that the Official report of the session will be made available by the UN Secretariat 3-4 weeks after the session concludes.

DHS -Threats to the United States
With the growing conflict in the Middle East, multiple US agencies have issued warnings to raise awareness of the heightened cybersecurity risks that foreign states may pose to the United States, US-based companies, and US-based individuals. Restoring NIOSH: Progress and Pressure

Since AIHA launched our Restore NIOSH campaigns, thousands of members, OEHS professionals, and other stakeholders have heeded our calls, voiced their support for this critical agency, and asked their elected representatives to stand up for worker health and safety. The swift response was both gratifying and effective: last month, the Department of Health and Human Services, where NIOSH resides, reversed some of the staff terminations.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

IHMM Foundation Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
