ASHM Committee To Create Pathway for ASHMs
The IHMM Associate Safety and Health Manager [ASHM] committee, chaired by Jan Rosenberg, CSHM, will soon begin to create a clear pathway of courses to better prepare an ASHM to become a CSHM.
Starting with the Certified Safety and Health Manager [CSHM] blueprint, the committee will outline a recommended curriculum of courses to strengthen the ASHM and better prepare the ASHM holder to take and pass the CSHM examination, as well as to become a stronger and more valuable professional.
The CSHM blueprint has 6 domains and 45 subdomains, providing the pathway of critical competencies the ASHM should develop in order to become a successful CSHM. Look for these developments in the new year!

IHMM Organizing Broader Government Affairs Activities – Call for Volunteers
In strategic planning on August 17, 2023 IHMM created a strategic imperative to create a broader government affairs operation on behalf of, and with the assistance of, all of IHMM’s certificants.
On August 29, 2023 IHMM’s Executive Director made a presentation of this strategic imperative to the AHMP annual conference. Here is what IHMM intends to organize over the next few months:
Federal Government – Regulatory. We need a group of people watching Federal regulatory developments to advise when taking action can be helpful and raise our visibility in the agencies.
Federal Government – Congress. We need a group of people watching legislation to advise us when taking action can be helpful and raise our visibility in Congress.
State Governments – Regulatory. We need a group of people watching state regulatory developments to advise when taking action can be helpful and raise our visibility in the agencies.
State Governments – Legislatures. We need a group of people watching legislation to advise us when taking action can be helpful and raise our visibility in state legislatures.

Beltway Buzz – Ogletree Deakins
Smackdowns and Shutdowns on Capitol Hill. It is a good thing that Thanksgiving is around the corner, because it seems like the stress level on Capitol Hill is very high and our federal legislators could use a break. This week, Representative Kevin McCarthy (R-CA), the immediate past Speaker of the U.S. House of Representatives, allegedly elbowed or shoved Representative Tim Burchett (R-TN) as he walked by him in the hallway. (It is probably no coincidence that Burchett was one of eight Republicans who voted to remove McCarthy from the speakership.) Additionally, former mixed martial arts fighter and current junior U.S. senator from Oklahoma, Markwayne Mullin (R-OK), challenged the International Brotherhood of Teamsters’ president, Sean O’Brien, to a fight during a hearing of the U.S. Senate Committee on Health, Education, Labor and Pensions (HELP) before which O’Brien was testifying on Tuesday. With all of this legislative physical activity and eyebrow-raising posturing, it was perhaps fitting that Dwayne “The Rock” Johnson paid a visit to Capitol Hill this week.
Despite all the shenanigans, the U.S. Congress actually accomplished something by agreeing to an unusual “two-step” continuing resolution to avoid a government shutdown that would have started at midnight, November 17–18, 2023. President Biden signed the measure yesterday, on November 16. Like the September 30, 2023, appropriations deal, this week’s action kicks the spending debate down the road once again. This time, however, funding for agencies covered by four bills concerning agriculture, energy and water, military construction and veterans affairs, and transportation will continue through January 19, 2024. Funding for other federal agencies—including the U.S. Department of Labor (DOL), National Labor Relations Board (NLRB), U.S. Equal Employment Opportunity Commission (EEOC), and U.S. Department of Homeland Security (DHS)—will continue through February 2, 2024. So, if you are a fan of government shutdown drama, you have more to look forward to in 2024.
House Spending Bill Addresses Workplace Issues. This week’s continuing resolution has bought Congress some time to continue work on individual appropriations bills, including H.R. 5894, the House version of the Senate’s Departments of Labor, Health and Human Services, and Education, and Related Agencies Appropriations Act, 2024 (S. 2624). The text of the House bill contains several provisions that address some of the Buzz’s favorite workplace policy issues. For example, H.R. 5894 would prohibit the DOL from using any appropriated funds “to alter or affect the administration, implementation, or enforcement” of the Trump-era independent contractor rule, thereby preventing the DOL from finalizing its current proposed independent contractor rule.
The bill would similarly prohibit the NLRB from changing its existing joint-employer standard, which focuses on direct and immediate control. (As described below, the Board has issued a new joint-employer regulation that becomes effective on February 26, 2024.) Finally, the bill maintains a long-standing prohibition on the Board’s use of funds to allow for “voting through any electronic means in an election to determine a representative for the purposes of collective bargaining.” Of course, these riders are unlikely to be acceptable in the Democratic-controlled Senate—and they have already met with objection from the White House—but they serve to demonstrate that these labor policy issues are important for some members of Congress.
Board Extends Joint Employer Effective Date. On November 16, 2023, the NLRB announced that it would extend the effective date of its recently finalized joint-employer rule from December 26, 2023, to February 26, 2024. According to the announcement, the purpose of the postponement is to “facilitate resolution of legal challenges with respect to the rule.” The announcement also states that the new rule “will only be applied to cases filed after the rule becomes effective.”
OSHA Walkaround Proposal Moves Forward. November 13, 2023, was the deadline for stakeholders to submit comments in response to the Occupational Safety and Health Administration’s (OSHA) “walkaround” regulatory proposal. Like most of the proposed regulations that the Buzz is tracking, this regulation is expected to be finalized in the late spring or summer of 2024.
DHS/DOL Make More H-2B Visas Available. Today, November 17, 2023, DHS and the DOL published a joint temporary final rule “making available an additional 64,716 H-2B temporary nonagricultural worker visas for fiscal year (FY) 2024, on top of the statutory cap of 66,000 H-2B visas that are available each fiscal year.” The allocations will be made as follows:
• October 1, 2023, through March 31, 2024 (first half of FY 2024): 20,716 immediately available visas limited to returning workers. Employment must start on or before March 31, 2024.
• April 1, 2024, through May 14, 2024: 19,000 visas for returning workers when employment starts on or after April 1, 2024, and no later than May 14, 2024.
• May 15, 2024, through September 30, 2024: 5,000 visas for returning workers when employment starts on or after May 15, 2024, and no later than September 30, 2024.
• 20,000 visas allocated to nationals of El Salvador, Guatemala, Honduras, Haiti, Colombia, Ecuador, and Costa Rica throughout FY 2024, regardless of returning worker status.
According to the press release accompanying the rule, “By making these supplemental visas available at the outset of FY 2024, the Departments will help ensure U.S. businesses with workforce needs are able to plan ahead and find the seasonal and temporary workers they need.” Regarding filing deadlines, the notice states, “DHS will not accept any H-2B petitions under provisions related to the FY 2024 supplemental numerical allocations after September 16, 2024.”
OSHA announces National Advisory Committee on Occupational Safety and Health will meet Dec. 12
The Department of Labor’s Occupational Safety and Health Administration will hold an in-person and online meeting of the National Advisory Committee on Occupational Safety and Health on Tuesday, Dec. 12, 2023, from 10 a.m. to 4 p.m. EST. Committee members will meet in person and the event will be open to the public either in person or online.
The meeting will include new member introductions, updates from OSHA and the National Institute for Occupational Safety and Health, and discussions about the NIOSH Mental Health for Healthcare Workers Campaign, safety as a core value and whistleblower protection.
Register to attend the meeting in person or online. Once registered, online attendees will receive a link for remote meeting access and in-person attendees will receive directions for participation. In-person attendance by the public is limited to 25 people.
Submit comments and requests to speak to the Federal eRulemaking Portal, Docket Number OSHA-2023-0003, by Nov. 27, 2023. Be sure to include the docket number on all submissions. Read the Federal Register notice for submission details.
Supreme Court sets argument in Chevron challenges
The Supreme Court will hear oral argument on Jan. 17 in a pair of linked suits that could overturn or sharply limit the long-standing Chevron doctrine that gives deference to EPA and other agencies on their “reasonable” interpretations of ambiguous statutory text.
The justices on Nov. 17 released their oral argument calendar for January, with the two Chevron cases — known as Loper Bright Enterprises, et al., v. Raimondo, et al., and Relentless, Inc., et al., v. Department of Commerce, et al. — both set for Jan. 17, the final day of hearings that month.
Both suits were brought by fishing companies seeking to overturn the National Marine Fisheries Service’s (NMFS) stance that the Magnuson Stevens Act allows it to force domestic vessels to pay the salaries of monitors they are required to carry.
Lower courts have so far upheld the rule as a matter of Chevron deference, finding that the law is ambiguous and NMFS’ reading is reasonable.
Petitioners in the NMFS suits are asking the high court to either overturn Chevron entirely or “clarify that statutory silence concerning controversial powers expressly but narrowly granted elsewhere in the statute does not constitute an ambiguity requiring deference to the agency.”

Sources Doubt EPA Vows To Issue PFAS Drinking Water Rule This Year
EPA Administrator Michael Regan is reiterating the Biden administration’s pledge to finalize Safe Drinking Water Act (SDWA) limits for six PFAS by the end of the year, though observers say that timeline is highly unlikely as the White House Office of Management and Budget (OMB) has yet to begin formal review the final rule.
A state source is “hearing both end of the year and January” for a final rule but says “neither is likely,” in part because the rule is not under OMB review.
Another source notes says the agency may be facing resource limits, noting that the same team that is crafting the agency’s high-profile lead and copper rule improvements (LCRI), which is currently undergoing OMB review, is also crafting the SDWA rule for per- and polyfluoroalkyl substances (PFAS).
While EPA did not respond to a request seeking comment, Regan and other officials continue to promise the rule will be issued by the end of the year.
During a Nov. 8 event in Eau Claire, WI, the administrator said the agency is committed to finalizing by the end of the year, according to reporting by Wisconsin Public Radio.

EPA to label PV panels, lithium-ions as universal waste
In response to electric power industry requests, the EPA is looking to classify solar panels as universal waste. The agency is also working to create a category of universal waste specifically for lithium-ion batteries.
The Resource Conservation and Recovery Act allows the EPA to regulate management of hazardous waste. Within those regulations, the EPA also developed the classification of “universal waste,” which allows for an alternative set of regulations for certain hazardous wastes. The alternative regulations reduce the regulatory burden by allowing for longer storage of the materials and reduced recordkeeping.
“EPA supports the increased use of solar power and electric vehicles as integral emissions-free sources of energy and transportation in the fight against climate change,” a press release noted. “Like all energy production technologies, when solar panels and electric vehicle and other lithium batteries reach the end of their useful lives, their associated wastes must be responsibly recycled and managed.”

EPA Proposes to Amend TSCA Risk Evaluation Framework Rule
EPA announced on October 19, 2023, a proposed rule that would amend the procedural framework rule for conducting risk evaluations under TSCA. Published in the Federal Register on October 30, 2023, the proposed rule states that the purpose of risk evaluations under TSCA is to determine whether a chemical substance presents an unreasonable risk of injury to health or the environment, without considering costs or non-risk factors, including unreasonable risk to potentially exposed or susceptible subpopulations identified as relevant to the risk evaluation by EPA, under COUs. 88 Fed. Reg. 74292. EPA states that it has reconsidered the procedural framework rule for conducting such risk evaluations and determined that certain aspects of that framework should be revised to align better with applicable court decisions and the statutory text, to reflect its experience implementing the risk evaluation program following enactment of the 2016 TSCA amendments, and to allow for consideration of future scientific advances in the risk evaluation process without the need to amend further the Agency’s procedural rule. Comments are due December 14, 2023. EPA notes that under the Paperwork Reduction Act, comments on the information collection provisions are best assured of consideration if OMB receives a copy of the comments on or before November 29, 2023. B&C encourages interested parties to review carefully EPA’s proposed rule and to provide comments as appropriate. This is potentially the most impactful TSCA rule proposed to date this year. EXTENDED: HM-265A: Modernizing Regulations to Improve Safety and Efficiency
On July 5, 2023, PHMSA published the Advance Notice of Proposed Rulemaking (ANPRM) “HM-265A: Modernizing Regulations to Improve Safety and Efficiency” to the Federal Register. Based on feedback from industry stakeholders, internal PHMSA review, NTSB safety recommendations, and modal safety partners, the ANPRM addresses 46 separate areas where the requirements of the HMR may need to be updated to increase efficiency while improving safety. Topics addressed in the ANPRM include those related to UN Performance Oriented Package testing, tank car safety, hazardous material employee training, and updates to standards incorporated by reference, among others.
The public comment period for this ANPRM has been extended, in response to a request from the American Short Line and Regional Railroad Association. Comments are now due by December 4, 2023. For questions, please contact Mr. Eamonn Patrick at [email protected].
Professional Certification Coalition
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis. The PCC has compiled several “Watchlists” identifying and analyzing provisions in pending legislation at both the state and federal level that, under applicable rules, may still be enacted in the current legislative session. Depending on the carry-over rules in the relevant legislature, the charts listing current legislation may include bills introduced in a prior year. In addition, the PCC compiles each year a chart of enacted legislation that affects certification. The charts include hyperlinks to every bill or executive order. Note that the Watchlist and the Enacted Legislation document do not include profession-specific legislation and do not include regulatory initiatives. The charts will be updated as needed based on new developments.
IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together
Regulatory Updates
PHMSA’s Office of Hazardous Materials Safety will be hosting public forums in advance of four international meetings, to allow the public to give input on current proposals being considered by the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP) and the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG). The international meetings include:
- The 29th session of the ICAO TDG, scheduled for November 13 to 17, 2023, in Montreal, Canada
- The 63rd session of the UNSCOE TDG, scheduled for November 27 to December 6, 2023, in Geneva, Switzerland
Each of these public meetings will be held approximately two weeks before the corresponding international meeting. Specific information for each meeting, including date, time, conference call-in number, and details for advance registration will be posted when available on the PHMSA website under “Upcoming Events.” These meetings will be virtual, with hybrid options available as possible, pending public health guidelines.

The Dr. John H Frick Memorial IHMM Scholarship Program – Closed for 2023 – Deadline 10/15/2023 – Re Opens in 2024
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities. This article from ASAE magazine outlines how a mentoring program can become more successful – engagement!

The U.S. TAG to ANSI for ISO TC283 approved ISO 45002 and ISO 45006 as ANSI registered technical reports.
- ISO/ASSP TR 45002-2023: Occupational health and safety management systems – General guidelines for the implementation of ISO 45001:2018
- ISO/ASSP TR 45006-2023: Occupational health and safety management – Guidelines for organizations on preventing and managing infectious diseases
At this point, the adoption process is complete. We will conclude limited public review and then move forward with publication of ISO 45002 and ISO 45006 as an ANSI Registered Technical Report[s].

IHMM and HMS
The graphic to the left illustrates the relationship between IHMM and HMS. IHMM formed HMS to serve IHMM’s certificants. IHMM offers a variety of professional credentials and HMS creates education and training programs to serve the applicants and certificants of those credentials.
AHMP Cyber Chapter Adds EHMM Course
The AHMP Cyber Chapter has added the Essentials of Hazardous Material Management (EHMM) Course for January 15-17, 2024. This course provides instruction on laws and regulations as well as technologies and practices in an overview fashion that highlights and emphasizes what is important for a hazardous materials manager to know and provides essential information for the hazardous materials manager to better conduct his/her job.

Lion Tech, HMS Training Partner, Adds Hazmat Ground Shipper Certification [DOT] Webinars
This week Lion Tech has added its Hazmat Ground Shipper Certification [DOT] webinars to the HMS Daily Training schedule. This two-day workshop provides comprehensive training to offer hazardous materials for transportation in compliance with the US DOT/PHMSA Hazardous Materials Regulations (HMR). The two-day workshop is approved for 12 CM Points toward IHMM re-certification.

This two-day course provides comprehensive training to offer hazardous materials for transportation in compliance with the US DOT/PHMSA Hazardous Materials Regulations (HMR). The webinar is approved for 12 CM Points toward IHMM re-certification.

• Determine what regulations apply to the material.
• Select authorized and compatible packaging.
• Choose and place required labels/markings for transportation.

CHEMTREC, HMS Training Partner, Adds HAZWOPER Refresher Training
CHEMTREC has added its HAZWOPER 8-hour Refresher Training to the HMS Daily Training schedule. This HAZWOPER 8-hour Refresher Training is designed for individuals who need to refresh their existing 24-hour or 40-hour HAZWOPER certification. This course meets the requirements outlined in OSHA 29 CFR 1910.120 for 8 (eight) hours of annual refresher training for workers involved in the transport, storage, or handling of hazardous materials or hazardous waste.

Every IHMM certification that requires an examination has a section of its website entitled Examination Preparation.
Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.
You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 404 CHMM applicants IHMM had on November 8, 2023, all 404 applicants looking for CHMM prep courses could see and choose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 404 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.
Earning Certification Maintenance Points [CMPs] is illustrated under Recertification of Your Credential, that includes the Recertification Claims Manual – Appendix A, that details all of the ways a certificant may earn CMPs > https://ihmm.org/recertification-claims/
Having mastered that manual, how does an IHMM certificant find courses to earn CMPs?
HMS has made that simple and easy.

The system will then generate all of the courses on the HMS E&T platform with IHMM CMPs already attached.
The next developments by the HMS E&T committee will refine available courses’ CMPs by individual credential!
HMS Certified Dangerous Goods Professional [CDGP] Exam Prep
The Columbia Southern University/HMS CDGP prep course is found here on the Hazardous Materials Society [HMS] education and training website > https://hazmatsociety.org/training/ce-1112-cdgp-exam-prep/2022-02-02/
The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).

Applications for the 2023 HMS Scholarship Awards Now Open
The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
DEADLINE TO SUBMIT SCHOLARSHIP AWARD APPLICATIONS IS December 1, 2023. All submissions and associated materials must be submitted using the online form.
Scholarship Winners Will Be Announced at the HMS Annual Meeting.
