IHMM Certificant Recognition
IHMM has completed inserting new credential badges in every certificant’s MYIHMM account. Everyone may access those badges for use in their email signatures, LinkedIn accounts, and other social media and communications media. With a link from your credential badge to the IHMM website [see above] you can not only stand out as an IHMM-certified professional, you can also promote IHMM credentials to others. Throughout our certificant’s MYIHMM accounts are also now placed 10 Year, 20 Year, and 30 Year badges signifying their longevity as an IHMM certified professional.
IHMM has also added Distinguished Diplomates and Fellows of the Institute badges to the appropriate people in the MYIHMM database. These two badges will be accompanied by new lapel pins to be sent to each of those distinguished by holding these designations.
IHMM In-Person or Remotely Proctored Exams
The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.
76% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

Top 10 OSHA Violations of 2022
Falling down on the job seems to be a perennial workplace issue, as does failing to provide adequate fall protection, because for the 12th year in a row “fall protection – general requirement” is the most cited standard violation, according to the Occupational Safety and Health Association (OSHA). Patrick Kapust, deputy director of OSHA’s Directorate of Enforcement (DEP), presented preliminary data at the recent National Safety Council show in San Diego, reflecting violations occurring from October 1, 2021, to September 6, 2022. (The tally includes only federal OSHA data; data collected from state OSHA agencies is not included.)
All of the violations on this year’s list also appeared on the previous year’s list, although there was a good deal of shifting up or down the rankings. While fall protection kept its grip on the top spot, last year’s # 2 violation (respiratory protection) dropped to # 3, while last year’s # 5 violation (hazard communication) jumped to the # 2 spot. OSHA Hosts 10th Public Meeting on Whistleblower Program; Suggestions Center Around Outreach and Education
On October 19, the Occupational Safety and Health Administration (OSHA) held its tenth public meeting on the agency’s whistleblower program. During the online event, participants raised issues and provided suggestions related to the program and whistleblowing at large.
Introductions and Changes OSHA Has Implemented
Douglas Parker, Assistant Secretary for OSHA, introduced the event. “We at OSHA believe it’s crucial that all workers feel comfortable bringing issues,” he said, highlighting the importance of whistleblowers and their power to shed light on problems that may otherwise go unnoticed. He laid out the goal of these public meetings: identifying how OSHA can deliver better customer service and assistance the agency can provide to explain the whistleblower program to employees and employers.
Parker talked about how the agency is listening and implementing changes that are results of conversations and input from the OSHA public meetings. One change he mentioned was the updating of the investigations manual, which was the first major overhaul since 2011. Parker also said that the agency “updated internal training,” “added frequently asked questions on immigration,” and made updates to the retaliation webpage.
Ohio Manufacturer Faces $1.2M in Penalties After 7th Worker in 5 Years Suffers Severe Injuries When Caught in Machine Employer Failed To Lock Out
An Ohio vinyl tile manufacturer faces $1,232,705 in proposed penalties after U.S. Department of Labor Occupational Safety and Health Administration inspectors responded when a worker suffered severe injuries as a result of being caught in a machine on April 28, 2022.
The incident marks the seventh injury at the NOX US LLC plant in Fostoria since February 2017 related to the company’s failure to follow required machine safety procedures. Since 2017, the company also recorded at least 13 serious injuries at the plant caused by exposure to burn and amputation hazards. OSHA placed the Fostoria plant in its Severe Violator Enforcement Program in 2017.
The April inspection found that the injured worker’s finger was first caught in a rotating spindle on a plastic winding machine and then their body was pulled around the machine’s spindle. The worker, who had been on the job just six weeks, suffered multiple severe injuries that required surgery.
OSHA cited the company for eight willful violations, one repeat violation and six serious violations, and one other-than-serious violation, for exposing workers to machine hazards, lacking personal protective equipment and failing to train their workers on safety hazards and precautions.

Maine Department of Labor Encourages more Women to Pursue Construction Careers
Through the Maine Department of Labor’s apprenticeship program, the group is looking to encourage more young girls to pursue a career in trades.
After graduating from high school, many students look into other options rather than attending college. Programs like apprenticeships can be a great option for those wanting to pursue a career in trades.
The Maine Department of Labor runs its own apprenticeship program, and folks running the program know it can be a great way for students to get “on-the-job” training while also earning a living.
The program offers apprenticeships in many different fields such as architecture, engineering, art, design, and more. But recently, the program has been focused on encouraging young women who may be on the fence about pursuing a career in construction.
Taking Steps to Prevent Workplace Violence
In both fact and perception, the United States has become a much more dangerous place to live and work than it was just a handful of years ago. The danger extends beyond the street to the workplace as well, and how to protect your workforce is a question almost all employers have to ask themselves in the current environment.
From 1992-2019, workplace violence has killed almost 18,000 people, according to a recent study conducted by NIOSH, the Bureau of Justice Statistics and the Bureau of Labor Statistics (which includes incidents that occurred outside the workplace but stemmed from work-related issues.)
While this is not a new problem, the current situation does represent a renewed challenge to employers because it has arisen following the widespread deterioration of mental and emotional health because of the COVID-19 lockdowns, and now heightened emotions erupting over political differences.

When it Comes to Safety, Quitting is not an Option
The latest trend in employee disengagement is quiet quitting, which is the currently popular way of describing an employee who does the bare minimum to get the job done without getting fired. It’s not really a new thing at all—we’ve all known people at work who seem to just get by—the last-to-arrive-and-first-to-leave types. What makes the recent reporting on quiet quitting so troubling, though, is how pervasive this do-the-least-possible attitude has become. According to research firm Gallup, more than 50% of the U.S. workplace consists of quiet quitters—employees who say they are not engaged at work.
And that poses a real problem for anybody whose job is heavily reliant on employee engagement, including safety managers.

Back to Basics: Marijuana in the Workplace
As marijuana is legalized in more places, the question of how to deal with it in the workplace gets more complicated, especially for EHS professionals.
Recently, Christina Clearwater, the president of the Drug-Free Solutions Group, LLC, spoke at the 2022 National Safety Council Congress and Expo about marijuana laws and how they will impact the workplace. She said that 79% of the U.S. population now lives in a state where marijuana is legal, and in the workplace, policies have shifted from a zero-tolerance perspective to one that prioritizes safety and fairness.

A stronger California heat stress rule could guide federal efforts: report
Enhancing California’s workplace heat standard could better protect workers in the state and guide current federal rulemaking on heat stress prevention, a new report from the Natural Resources Defense Council suggests.
To assess the implementation of California’s 17-year-old heat stress rule, researchers analyzed nearly 500 fatal or catastrophic heat-related incidents from 2005 to 2019 and more than 16,000 heat citations issued by the California Division of Occupational Safety and Health from January 2005 to May 2021.
2022 IHMM Board of Directors Election – Voting Closes Friday Nov 4th
On Monday, October 3, 2022, the Institute of Hazardous Materials Management began its 2022 elections for the IHMM Board of Directors for 3 seats with service beginning January 1, 2023. IHMM’s Nominating Committee began soliciting candidates for three seats on March 8, 2022, and continued in every Tuesday edition of IHMM Today through June 28, 2022. The three seats up for election in 2022 are [1] seat for a CDGP, [1] seat for a CSHM, and [1] seat for At-Large, which can come from a CHMM, CDGP, CHMP, CSHM, or CSMP.
The election will run from Monday, October 3, 2022, through Friday, November 4, 2022.

IHMM Certified School Safety Manager® [CSSM®] Credential
Mike Howe, CSSM, Chair of the CSSM-CSSS Committee, is pleased to announce that the committee now releases its credential blueprint. When IHMM took over the CSSM credential in 2019 it had no blueprint or examination. Thanks to the outstanding leadership of Mike Howe leading his committee not only do we have a credential blueprint, we are almost ready to begin finalizing the CSSM examination as well.
Identifying all of the threats and vulnerabilities likely to impact a K-12 school district or post-secondary schools is a critical part of the emergency operations planning process for all schools. One only has to look at the day’s news to understand the importance of having professional, certified school safety managers in place guiding the planning and execution of sound safety programs. Colonel Chris Owens, a CSSM committee member, is already at work with the Georgia Sheriffs’ Association and the Georgia Emergency Management and Homeland Security Agency on how what IHMM is creating can be incorporated into the operations of Georgia schools.
This IHMM committee is making the CSSM credential real, and is starting to engage their communities with efforts to make schools safer using professionally certified school safety managers. Look for the new CSSM examination before the end of 2022.

IHMM Certified Pandemic Preparedness Specialist® [CPPS®] Credential
Dan Blankfeld, CSHM, CSMP, Chair of the Microcredential Task Force, is pleased to announce the release of the IHMM Certified Pandemic Preparedness Specialist [CPPS] credential blueprint. The Task Force received more than 200 suggestions for microcredentials that could be used in conjunction with existing IHMM credentials to add depth to specific knowledge and experience areas. Microcredentials are short, focused credentials designed to provide in-demand skills, know-how and experience.
A Certified Pandemic Preparedness Specialist® (CPPS®) Microcredential holder is first a CHMM or CSHM credentialed professional who has demonstrated, through education, experience, and examination, the ability to identify and assess the risks associated with pathogens and their effect on public health, commerce, industry, and/or government operation. The focus of the CPPS microcredential is to: assess and provide guidance concerning the preparedness levels of different entities, and develop and implement risk-reduction strategies.
The Task Force is making progress on the construction of the CPPS examination at this writing. We look forward to the completion of the examination and launch of the credential to the IHMM community and then begin working with federal officials from the CDC, NIH, and White House Pandemic Innovation Task Force on being better prepared for the next pandemic. In 2019 Mark Bruce from AHMP and Gene Guilford from IHMM worked on a project to get the Commonwealth of Pennsylvania to recognize the CHMM and CDGT credentials. With Mark’s work on the ground in Pennsylvania, we succeeded. The 45 in 5 Project is for ALL IHMM credentials. This summer we have worked on the U.S. Army Corps of Engineers health and safety manual that recognizes the CSHM and CSMP credentials. We are working with a CSHM in New York on their Department of Labor recognizing the CSHM.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
In January 2021 Mark at AHMP and Gene at IHMM has launched 45 in 5, getting the other 45 states to recognize our credentials in 5 years. If we can find a volunteer like Mark in other states [see above] we can work with those volunteers on crafting the right message to the right agencies in state governments across the country. If we find enough volunteers we can get this done in less than 5 years.
In January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

IHMM – 26 Fellows Are Mentors | Where are the Mentees?
IHMM Fellows Committee Chair Atanu Das, CHMM, is leading the effort within the IHMM Collaboration networking platform to provide instruction to the more than 75 IHMM Fellows in becoming mentors.
Given the extraordinary experience Fellows have, this is a unique opportunity for IHMM Fellows to help guide more recent certificants in their professional development activities.

IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

DOL Extends IC Proposal Comment Period. On October 25, 2022, the U.S. Department of Labor’s (DOL) Wage and Hour Division announced an extension of the public comment period for its proposal to amend the independent contractor (IC) regulations under the Fair Labor Standards Act. Comments were originally due by November 28, 2022, which is the Monday following the Thanksgiving holiday weekend. Interested stakeholders now have an additional fifteen days—until December 13, 2022—to submit comments. Buzz readers may recall that a federal judge ruled that the DOL’s previous attempt to reverse the Trump-era independent contractor rule was improper, in part, because the agency did not provide a meaningful opportunity for the public to comment on its proposal.
NLRB to Pursue Interim Relief. National Labor Relations Board (NLRB) General Counsel Jennifer Abruzzo continues to fine-tune the agency’s use of injunctions under Section 10(j) of the National Labor Relations Act. On October 20, 2022, Abruzzo issued a memorandum encouraging NLRB regional directors to attempt to obtain interim relief while a 10(j) case continues to unfold. According to the memo, “if efforts to settle the entire administrative case are unsuccessful, charged parties will be given the opportunity to voluntarily agree to an interim settlement that includes remedies, such as reinstating alleged discriminatees or agreeing to bargain, pending final resolution of the administrative case by the Board.”
Out With the Old, in With the New (Employee Rights Poster). The U.S. Equal Employment Opportunity Commission (EEOC) has made changes to its required workplace poster, now entitled “Know Your Rights: Workplace Discrimination is Illegal.” Dee Anna D. Hays and Zachary V. Zagger have an analysis of the changes, which include the addition of easier-to-understand language, a QR code that helps employees file EEOC charges, and a clarification that it is unlawful to discriminate on the basis of pregnancy and related conditions, sexual orientation, or gender identity. Importantly, the EEOC made revisions to the poster the day after the initial announcement, so employers may want to confirm that they have the most current version. According to the agency’s frequently asked questions (FAQs) guidance, there is no specific deadline by which employers need to replace the previous “EEO is the Law” poster with the updated “Know Your Rights” poster—only that the swap-out must happen “within a reasonable amount of time.”
Second Union Rejects Freight Rail Deal. There was more news this week concerning the ongoing labor dispute between freight rail carriers and the unions that represent their employees. The tentative agreement negotiated in mid-September between the carriers and union leaders suffered an initial blow when one of the unions voted down the deal. This week, the Brotherhood of Railway Signalmen became the second union to reject the deal. Four more unions will vote in the coming weeks, with the last vote currently scheduled to occur on the Monday before Thanksgiving, when the holiday shopping season really kicks into high gear. While there is still time to avoid a national freight rail strike in the midst of the holiday season, these setbacks are not putting anybody at ease.

In each credential’s Exam Preparation section is the graphic at left, linked to the section of the Hazardous Materials Society [HMS] website where the applicant can find the exam prep courses being offered to assist the applicant with preparing for the IHMM exam.
If you are a vendor offering exam prep courses and your prep course is on the HMS site, IHMM applicants will find it. If you do not have an exam prep course on the HMS site, no applicant will find it.

Applications for the 2022 HMS Scholarship Awards Now Open
The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
DEADLINE TO SUBMIT SCHOLARSHIP AWARD APPLICATIONS IS December 1, 2022. All submissions and associated materials must be submitted using the online form.
Scholarship Winners Will Be Announced at the HMS Annual Meeting.

Retiring? IHMM Invites You to Become an Emeritus
You may have decided, after a long and successful career, to retire from active daily duty. Congratulations. That doesn’t mean you have to completely disengage from your profession. IHMM is pleased to offer Emeritus status to all certificants who will no longer be actively engaged in their communities of practice but who still want to stay in touch.
