Senate Expected to Change House-Passed Tax Bill
When Congress returns from recess next week, the Senate is expected to take up the sweeping reconciliation bill recently passed by the House of Representatives.
Thanks to the strong advocacy efforts of the Community Impact Coalition (CIC) and associations nationwide, some of the most concerning tax provisions were successfully kept out of the House-passed bill. A major win was the removal of a proposed tax on income derived from association names and logos — a harmful measure that would have undermined critical non-dues revenue streams for many nonprofits.
However, the bill still includes a provision that ASAE and the CIC strongly oppose: it would treat certain transportation-related fringe benefits — such as parking — as taxable income for associations.
While House Speaker Mike Johnson (R-LA) has urged the Senate to make minimal changes to the bill, President Trump indicated on Sunday that he anticipates “fairly significant” revisions. Senate Majority Leader John Thune (R-SD) will be tasked with balancing Republican priorities in the Senate without altering the bill so drastically that it jeopardizes its chances of passing again in the House.
What’s next: Potential Senate changes may focus on Medicaid funding levels, the permanence of certain tax breaks, expanding the state and local tax (SALT) deduction, and pursuing deeper spending cuts than those proposed in the House version.
- One provision ASAE and the CIC want to see preserved from the House-passed bill is the Freedom to Invest in Tomorrow’s Workforce Act.
- This important measure would expand the use of 529 education savings plans to cover career training and professional certification programs, not just traditional college tuition
- If enacted, it would significantly improve access to licensing, certification, and professional development opportunities, including those provided by associations.


IHMM/ASAE Campaign for “Freedom to Invest in Tomorrow’s Workforce Act” CALL TO ACTION
Thanks to the continued efforts of the Tomorrow’s Workforce Coalition, of which IHMM is a part, the Freedom to Invest in Tomorrow’s Workforce Act has been reintroduced in the Senate and the House of Representatives! The language we sought in this legislation is in H.R. 1, which recently passed the House. Now it is on to the Senate.
The Freedom to Invest in Tomorrow’s Workforce Act would expand qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications. It would provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes, or alternative career pathways.
Please take a moment to make your voice heard on this important issue and share this grassroots campaign with your stakeholders to amplify our impact!

IHMM/CIC Grassroots Campaign on Nonprofit Organizations and Tax Reform
As Congress debates tax reform in 2025, some Members of Congress are considering raising taxes on nonprofit organizations – including charities, associations, professional societies, and veterans’ groups – to pay for the extension of expiring tax cuts. Increasing the tax burden on these organizations would leave less funding for your organization to drive toward its mission, resulting in negative consequences for the communities it serves.
Now, it is more important than ever for Congress to hear your voice. The House passed H.R. 1, and now the Senate will consider the legislation. We have all heard several senators discussing numerous changes to the House-passed legislation.

IHMM and the Community Impact Coalition in Washington
Legislative Update:
We are pleased to report significant progress for associations with the removal of the proposed tax on name and logo royalties, which would have clarified this revenue is unrelated business taxable income (UBI).
However, the House-passed bill [H.R. 1] still includes a provision treating certain fringe benefits related to parking and transportation as unrelated business taxable income.
Coalition Next Steps:
The coalition is planning to move forward with advocacy activities opposing the provision on transportation and parking fringe benefits and working to ensure harmful provisions aren’t added in later in the legislative process. We plan to make the following advocacy opportunities available to coalition members with the option to opt-into participating:
- Sign-On Letter: This letter will thank the U.S. House for recognizing the importance of nonprofit resources and removing one of the more widespread tax increases on the sector and signal intent to work with Congress to have the transportation and parking provision removed from future drafts of the bill. The letter will also oppose the reintroduction of harmful proposals to this bill. This letter will be available for sign-on by the end of this week.
- Grassroots portal: The grassroots message will be updated with similar messaging as the sign-on letter and be available to be sent to Senate offices. The portal will become available in early June, following House passage of the bill.
Thanks to the dedicated advocacy of organizations in this coalition, the initial versions of this bill did not include the more severe tax provisions that were feared. However, the fight is not over, and the coalition will remain vigilant against these provisions re-emerging later in the legislative process. We will continue to work to protect this progress and oppose provisions that would increase taxation on the nonprofit sector.

The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

- IHMM has filed comments on the OMB Inquiry concerning the EPA and DOL proposed regulatory measures concerning Methylene Chloride on December 13, 2024.
- IHMM Sent a letter to the U.S. Department of the Interior, National Park Service, concerning the uses of professionally credentialed persons performing work for the Park Service.
- IHMM Signs Letter Opposing Reductions in OSH Worker’s Pay – The IHMM Government Affairs Committee has agreed to sign a coalition letter opposing reductions in pay for IH and OSH employees. Here is the coalition letter we signed.
4. IHMM submitted comments on OSHA Advisory Committee on Construction Safety and Health (ACCSH): Notice of Meetings concerning OSHA-2024-0002-0007, and highlighted the creation of IHMM’s Certified Pandemic Preparedness Specialist [CPPS] credential.
5. State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation, work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.

DOL to Rescind Biden-era ESG Rule. In a status report filed this week with the U.S. Court of Appeals for the Fifth Circuit, the U.S. Department of Labor (DOL) stated that it will no longer defend a legal challenge to the Biden administration’s 2022 ESG (environmental, social, and governance) rule (formally, “Prudence and Loyalty in Selecting Plan Investments and Exercising Shareholder Rights”). Instead, the administration will pursue notice-and-comment rulemaking to rescind the regulation. The pending rulemaking will be the latest regulatory back-and-forth on this issue, as the DOL in 2020 finalized a regulation that limited the abilities of Employee Retirement Income Security Act (ERISA) plan fiduciaries to consider investment factors that “promote non-pecuniary benefits or objectives.” In turn, the 2022 Biden-era rule instituted an “all things being equal” standard that allows plan fiduciaries to consider such factors as “tiebreakers” in investing decisions. There is no timetable for the proposed rule, but the spring regulatory agenda—expected sometime in June or July of this year—should provide some clues.
USCIS Nominee Wants Restrictions on OPT. Last week, the U.S. Senate Judiciary Committee held a hearing on the nomination of Joseph Edlow to serve as director of U.S. Citizenship and Immigration Services (USCIS). In response to a question from Senator Mike Lee (R-UT) regarding optional practical training (OPT), a program that provides F-1 students with up to three years of work authorization after graduation, Edlow responded with the following:
What I want to see would be essentially a regulatory and sub-regulatory program that would allow us to remove the ability for employment authorizations for F-1 students beyond the time that they are in school.
The statement clearly provides insight not just into the future of OPT, but also on the types of employment-based immigration policies that USCIS will pursue in the future. The committee has not yet voted on Edlow’s nomination.
Consulates to Pause Student Visa Interviews. According to media reports, the U.S. Department of State has instructed U.S. consulates to refrain from scheduling new interviews for applicants seeking visas to study in the United States in preparation for new social media vetting protocols. The State Department will reportedly be issuing guidance as to what such vetting will entail. The increased scrutiny of foreign students’ social media activities is likely rooted in President Donald Trump’s executive order, “Protecting the United States from Foreign Terrorists and Other National Security and Public Safety Threats,” which instructs the secretary of state, the attorney general, the secretary of homeland security, and the director of national intelligence to ensure “that all aliens seeking admission to the United States, or who are already in the United States, are vetted and screened to the maximum degree possible.” Whitney Brownlow and Derek J. Maka have the details.
House Committee Examines DEI on College Campuses. The House Committee on Education and the Workforce’s Subcommittee on Higher Education and Workforce Development held a hearing last week entitled “Restoring Excellence: The Case Against DEI.” The hearing primarily focused on fallout from the Supreme Court of the United States’ 2023 ruling prohibiting the use of affirmative action in college admissions, including alleged ongoing discrimination in the college admissions process. Witnesses and lawmakers also examined college accreditation standards and medical school curricula, among other topics. The Dismantle DEI Act, introduced in 2024 by then-senator J.D. Vance, was not discussed.
Republican Lawmakers Seek Input on Transparency Reforms for Union Members. Chair of the House Committee on Education and the Workforce Tim Walberg (R-MI), along with Representative Rick Allen (R-GA), who chairs the Subcommittee on Health, Employment, Labor, and Pensions, sent an open letter to stakeholders soliciting feedback on potential revisions to the Labor-Management Reporting and Disclosure Act (LMRDA) “to inform Congress how it can reform the LMRDA to ensure labor organizations adhere to the highest standards of responsibility and ethical conduct.” The letter is divided into the following issue area categories:
- Strengthening Member Governance and Voting Rights (e.g., “Should a union be required to hold a secret ballot vote of membership to ratify a collective bargaining agreement or authorize a strike?” And, “What information should a union be required to share with membership during contract negotiations and before a strike authorization?”)
- Fiscal Transparency and Fiduciary Duty (e.g., “How can Congress clarify or strengthen fiduciary responsibilities of union officers?”)
- Political Expenditures and Member Consent (e.g., “What reforms would give members more direct control over the portion of their dues used for lobbying, campaign contributions, or ballot-measure advocacy?”)
- Digital Disclosure and Data Accessibility
- Enforcement, Compliance Assistance, and Whistleblower Protections (e.g., “Do current criminal and civil penalties under the LMRDA adequately deter embezzlement, vote rigging, and false reporting? If not, how should they be updated?” And, “Should Congress establish a private right of action or a more robust whistleblower protection program to assist members with reporting wrongdoing?”)
The letter requests that all stakeholder feedback be submitted by July 22, 2025. The Buzz expects that this information will eventually lead to the introduction of legislation amending the LMRDA.
Labor Secretary Outlines Priorities on Capitol Hill. As part of the fiscal year (FY) 2026 appropriations process, Secretary of Labor Lori Chavez-DeRemer testified last week before the Senate Subcommittee on Labor, Health and Human Services, Education, and Related Agencies. John D. Surma has all the details on Secretary Chavez-DeRemer’s testimony on the DOL’s priorities, which touched on the agency’s current staffing levels, the future of workforce training programs, the Office of Federal Contract Compliance Programs, and the independent contractor rule.

USDOT Seeks Comment on Pipeline and Hazmat Regulatory Relief
The U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (PHMSA) today announced that the agency is seeking public comment on two Advance Notices of Proposed Rulemaking (ANPRM) to reduce regulatory burdens imposed on the energy sector. These ANPRMs are the latest in a series of priority actions PHMSA is taking to implement the President’s “Unleashing American Energy” and “Unleashing Prosperity through Deregulation” Executive Orders. These rulemakings could save hundreds of millions of dollars in regulatory costs.

OSHA Updated Site-Specific Targeting (SST) Program Directive
We want to make you aware that the Occupational Safety and Health Administration (OSHA) has updated the inspection program that directs agency enforcement resources to establishments with the highest rates of injuries and illnesses based on injury and illness data submitted in accordance with OSHA’s recordkeeping requirements.
The Site-Specific Targeting (SST) program is OSHA’s primary planned inspection program for non-construction workplaces that have 20 or more employees. Using OSHA Form 300A data from calendar years 2021-2023, establishments may be selected for inspection based on:
- High injury and illness rates from 2023 data.
- Upwardly trending injury and illness rates based on 2021-2023 data at or above twice the 2022 private sector average.
- Injury and illness rates markedly below industry averages.
- Failure to submit an OSHA Form 300A in 2023.
The new directive replaces the previous directive issued on February 7, 2023. For more information, please see the directive and the news release.

OSHA to host public hearing on heat injury and illness prevention proposed rulemaking on June 16
The U.S. Department of Labor’s Occupational Safety and Health Administration will host a virtual public hearing on its proposed rule to protect workers from hazardous heat exposure in indoor and outdoor workplaces on June 16, 2025.
The public hearing on the Notice of Proposed Rulemaking on Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings, will begin on June 16, 2025, at 9:30 a.m. EDT, and continue on subsequent weekdays if necessary.

The Occupational Safety and Health Administration (OSHA) has released a proposed rule that would protect approximately 36 million workers in indoor and outdoor work settings from extreme heat. The proposed rule would require employers to develop an injury and illness prevention plan to control heat hazards in workplaces with excessive heat. The plan would require employers to evaluate heat risks and — when heat increases risks to workers — implement requirements for drinking water, rest breaks, and control of indoor heat. It would also require a plan to protect new or returning workers unaccustomed to working in high-heat conditions.
IHMM initiated collecting comments from its Government Affairs Committee, CSHMs, CSMPs, CHMMs, and CSMPs concerning this proposed regulation and filed the comments linked above on January 13, 2025.

PHMSA Announces Public Meetings For International Standards On The Transport Of Dangerous Goods
The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced on March 12, 2025, that its Office of Hazardous Materials Safety (OHMS) will host four public meetings during 2025 in advance of certain international meetings. The second meeting will be held in preparation of the 66th session of the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) scheduled for June 30 – July 4, 2025, in Geneva, Switzerland. The third meeting will be held in preparation of the 30th session of the ICAO DGP (DGP/30) scheduled for October 6 – 10, 2025, in Montreal, Canada. The fourth meeting will be held in preparation of the 67th session of the UNSCOE TDG scheduled for November 24 – December 3, 2025, in Geneva, Switzerland. PHMSA will solicit public input on current proposals for each of these meetings. PHMSA states that each public meeting will take place approximately two weeks preceding the international meeting at the headquarters for the Department of Transportation in Washington, D.C.

The House of Representatives passed the reconciliation package, the “One, Big, Beautiful Bill” that will extend the 2017 Tax Cuts and Jobs Act and enact many of the President’s domestic policy priorities.
We are pleased to report significant progress for associations with the removal of the proposed tax on name and logo royalties, which would have clarified this revenue is unrelated business taxable income (UBI).
However, the House-passed bill still includes a provision treating certain fringe benefits related to parking and transportation as unrelated business taxable income.
In positive news, the Freedom to Invest in Tomorrow’s Workforce Act was included in the House-passed bill. This important provision expands qualified expenses under 529 savings plans to cover postsecondary training and credentialing, such as licenses and nongovernmental certifications. This will provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes, or alternative career pathways.
H.R. 1151 has 186 co-sponsors in the House. S 756 has 14 co-sponsors in the Senate.

Worker Safety and Health Resources for Hurricane and Flood Cleanup and Recovery
As we approach the 2025 hurricane season, we would like to highlight several key resources available through the Occupational Safety and Health Administration (OSHA) to help you prepare for, respond to, and recover from hurricanes and related hazards.
Early preparation plays a critical role in ensuring that employers and workers have the necessary equipment, know where to go, and understand how to stay safe in the event of an emergency OSHA’s Emergency Preparedness and Response pages provide information on how to prepare and train for emergencies, and outline the hazards to be mindful of when an emergency occurs. These resources provide information for employers and workers across industries and include material specifically for those directly involved in response and recovery efforts.
While hurricanes pose significant risks to life and property, tropical storms and depressions can also cause severe damage. Hazards associated with tropical cyclones (which include tropical depressions, tropical storms, and hurricanes) — including flooding, heavy rains, destructive winds, and tornadoes — can be life-threatening. Moreover, hurricane response and recovery workers may face additional hazards such as heat.

Updated OSHA Letters of Interpretation Webpage
One of the compliance assistance tools OSHA offers is the Letter of Interpretation (LOI), their official response to questions about how OSHA requirements apply to specific workplace situations or hazards. We are emphasizing how these letters can help employers understand how to comply with Federal OSHA standards, regulations, and section 5(a)(1) of the OSH Act in specific workplace situations.
To make LOIs more accessible, OSHA has updated the Letters of Interpretation webpage so you can now search by keyword, standard number, or date, and see direct links between standards and related letters.

EPA Proposes Temporary Relief to Ensure Lab Compliance with Methylene Chloride Regulations under TSCA

The U.S. Environmental Protection Agency (EPA) is proposing to extend various upcoming compliance dates in the final risk management rule for methylene chloride under the Toxic Substances Control Act (TSCA) in order to ensure long-term compliance with the rule’s requirements. The proposal extends the Workplace Chemical Protection Program (WCPP) compliance dates for non-federal laboratories by an additional 18 months, to align with the dates allowed for federal laboratories and their contractors. EPA is issuing this proposal to address non-federal laboratories’ near-term challenges with implementation of the May 2024 final rule on methylene chloride.
If finalized, this proposal would extend the following compliance dates for non-federal laboratories: for initial monitoring from May 5, 2025, to November 9, 2026; for establishing regulated areas and ensuring compliance with the Existing Chemical Exposure Limit from August 1, 2025, to February 8, 2027; and for ensuring the methods of compliance, as well as developing and implementing an exposure control plan, from October 30, 2025, to May 10, 2027.
Shortly after publishing the 2024 final rule, representatives from various laboratories using methylene chloride contacted EPA with questions and concerns including on the applicability of the rule and the requirements for WCPP compliance. Many of these laboratories, especially those associated with local governments or universities on fixed budget cycles that did not contemplate these requirements, use methylene chloride in small quantities and somewhat infrequently and are facing challenges completing the rule’s initial monitoring requirements across potentially hundreds of labs in such a short timeframe. EPA’s proposal would avoid disrupting important environmental monitoring and associated activities, while these non-federal labs work to comply with the rule’s new requirements.

With a new Trump Administration and the relentless pace of regulatory developments related to Lautenberg implementation, there are many issues to consider and problems to solve.

EPA Postpones TSCA PFAS Reporting Period to April 2026
The U.S. Environmental Protection Agency announced on May 12, 2025, an interim final rule that would extend the dates of the reporting period for data submitted on the manufacture of perfluoroalkyl or polyfluoroalkyl substances (PFAS) under the Toxic Substances Control Act (TSCA). Under the interim final rule, the data submission period would begin April 13, 2026, and end October 13, 2026. Small manufacturers reporting exclusively as article importers would have until April 13, 2027, to report. According to EPA, the extension will allow it to develop and test further the software being used to collect data from manufacturers, “thereby providing critical feedback to EPA, including what additional guidance would be useful for the reporting community.” A pre-publication version of the interim final rule, which is scheduled to be published on May 13, 2025, has been posted. Publication of the interim final rule in the Federal Register will begin a 30-day comment period. Strengthening Student Mental Health with Community Partnerships – June 18, 2025 – 1.00 PM ET

Eliminating NIOSH Will Hurt American Workers
Editor’s note: This week, news organizations reported that some NIOSH employees whose positions were terminated have been recalled.
Since NIOSH was established by the Occupational Safety and Health Act of 1970, the agency has been a world leader in promoting workplace health and safety and supporting a highly trained corps of health and safety professionals. I have personally benefited from the work of NIOSH in terms of educational opportunities (my Master of Science and doctoral degrees were both partially funded by the agency) and research support (NIOSH has funded many applied research projects over my career). I can say, with complete certainty, that without the support of NIOSH my career in industrial hygiene would likely have looked much different, and that I might not even have gone into this field in the first place. This is true for me, and it is also true for literally tens of thousands of other occupational health and safety professionals across a variety of disciplines—industrial hygiene, occupational safety, occupational medicine, occupational health nursing, occupational epidemiology, ergonomics, and more—whose education was supported by NIOSH. These professionals are our first and most important line of defense against workplace injuries, illnesses, and fatalities, and it is precisely this professional workforce that is threatened by the Trump administration’s April 2025 decision to essentially eliminate NIOSH and end 55 years of federal funding to train critically important health and safety practitioners and researchers.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.

- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

Some of these courses are 24 hours long and approved for 24 IHMM CMPs; some are 8 hours long and approved for 8 IHMM CMPs and are FREE to attend. They are available only as in-person training.

IHMM Foundation Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
