GOP Leadership Pushes Megabill Forward Amid Deep Internal Fractures
This is the week. Today we have the legislative language we have all worked on for weeks. On Monday afternoon, the House Ways and Means Committee released the whole 389 page bill, seen here with the IHMM analysis of its contents.
The two most powerful Republicans in the country stepped before the press last Wednesday with one unified message: the GOP megabill is moving forward, confidently and deliberately.
🚨 President Donald Trump hailed “great progress” after a closed-door meeting with congressional leaders, while House Speaker Mike Johnson emphatically declared that key committee markups would “100 percent” take place next week.
One such step is already locked in: the House Agriculture Committee has scheduled its markup for Tuesday evening, working late into the night and resuming at 10 a.m. Wednesday to take on Democratic amendments. Momentum is real—but so are the roadblocks.
⚖️ Inside the Halls: Ways and Means Faces a Political Minefield
While the Agriculture Committee gears up, the House Ways and Means Committee remains stuck in the mud, deadlocked over the contentious cap on state and local tax (SALT) deductions.
Meeting Wednesday with so-called SALT Republicans from high-tax states, GOP tax writers failed to reach consensus. Rep. Nicole Malliotakis (R-NY) didn’t mince words, calling SALT “one of the stickiest points” in the entire Republican legislative agenda.
“The bill is dead effectively on the floor,” Rep. Nick LaLota, one of a quartet of so-called SALT Republicans advocating for a higher cap, told our Benjamin Guggenheim Monday night. Smith “insulted us with fake numbers” and “demonstrated bad faith in presenting a bill that … doesn’t even come close to earning our vote,” said LaLota, who is not on Ways and Means, but whose support will be necessary when the bill comes to the House floor.
The implications are serious: failure to resolve SALT risks fracturing the party’s tax coalition and unraveling the broader fiscal framework.
💸 The $500 Billion Question: Can Republicans Shrink the Plan and Still Deliver?
With other committees potentially backing away from ambitious savings targets, GOP tax writers are preparing a contingency. Sources close to the negotiations tell our reporters that the committee may scale back its original $4.5 trillion in tax cuts to a more defensible $4 trillion—a half-trillion dollar pivot designed to save the deal if internal resistance mounts.
But trimming that cost won’t come easily.
Rep. Ron Estes (R-KS) revealed that the committee is considering a “bunch” of temporary tax provisions to make the numbers work. In plain terms, what was once pitched as permanent economic reform may now be marketed as temporary measures—designed to lower the bill’s sticker shock and keep shaky votes on board.
🧩 What’s Next?
As committees scramble to draft, amend, and rescue key provisions, Speaker Johnson and President Trump remain publicly resolute. But the fine print tells a more complicated story—one of intraparty friction, delicate math, and policy horse-trading.
Expect a volatile week ahead as markups begin and GOP leadership works to align its factions behind a single bill. Whether this fragile legislative construct holds will depend not just on deadlines—but on the party’s willingness to compromise, recalibrate, and sell the vision.

Thanks to the continued efforts of the Tomorrow’s Workforce Coalition, the Institute for Credentialing Excellence (ICE), the Professional Certification Coalition (PCC), and the American Society of Association Executives (ASAE), the Freedom to Invest in Tomorrow’s Workforce Act has been reintroduced in the Senate and the House of Representatives!
We have been informed by our coalition partners that the TWC 529 language is being included in the House Ways and Means Committee version of the 2025 tax legislation. That is wonderful news!
The Freedom to Invest in Tomorrow’s Workforce Act would expand qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications. It would provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes, or alternative career pathways.

IHMM/CIC Launches Grassroots Campaign on Nonprofit Organizations and Tax Reform
As Congress debates tax reform in 2025, some Members of Congress are considering raising taxes on nonprofit organizations – including charities, associations, professional societies, and veterans’ groups – to pay for the extension of expiring tax cuts. Increasing the tax burden on these organizations would leave less funding for your organization to drive toward your mission, resulting in negative consequences for the communities you serve.
Now, it is more important than ever for Congress to hear your voice. The tax legislation will develop over the next two weeks as the House of Representatives works toward finalizing the initial draft of the tax bill.

IHMM, NSC Coalition Letter to Congressional Appropriators – OSHA FY2026
Each year, with input from several associated stakeholders, including IHMM, the National Safety Council develops an occupational safety and health congressional appropriations letter for organizations to sign. Given the state of play, this year’s letter focuses on OSHA funding at the FY25 level ($655.5 million) and the restoration of critical NIOSH programs. The letter is attached.

IHMM and SWANA Join In a Statement on End-Of-Life Management
IHMM has joined the Solid Waste Association of North America [SWANA] to raise awareness of the need for safety and responsible end-of-life management of hazardous products. As described in the press release, the waste and resource management industry is struggling with the frequent fires and explosions caused by batteries, marine flares, compressed gas cylinders, and other products. The goal of the statement is to raise awareness about the need for safe handling of these items and to invite producers and policymakers to work with us on solutions for labeling, design, and responsible end-of-life management.

IHMM and the Community Impact Coalition in Washington
With Congress beginning to work on tax legislation in 2025, ASAE has launched the Community Impact Coalition — a unified initiative dedicated to educating the 119th Congress about the social and economic benefits of associations, charities, and other tax-exempt organizations. IHMM is a member of the Steering Committee of the Coalition.
The Community Impact Coalition is a national group of 99 organizations formed this year to represent the non-profit community in light of unprecedented attempts to find new sources of federal revenue to finance tax reform.
The Community Impact Coalition is committed to ensuring that lawmakers understand the value of 501(c) organizations and advocating against proposals that would eliminate their tax-exempt status. The Dr. John H Frick Memorial IHMM Scholarship Program – Accepting Applications in September, 2025
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

4. IHMM submitted comments on OSHA Advisory Committee on Construction Safety and Health (ACCSH): Notice of Meetings concerning OSHA-2024-0002-0007, and highlighted the creation of IHMM’s Certified Pandemic Preparedness Specialist [CPPS] credential.
5. State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation, work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.

DOL to Rescind 2024 Independent Contractor Regulation? The U.S. Department of Labor (DOL) is backing away from the Biden-era independent contractor regulation finalized in January 2024. More specifically, the DOL’s Wage and Hour Division (WHD) has issued guidance (Field Assistance Bulletin No. 2025-1, “FLSA Independent Contractor Misclassification Enforcement Guidance”) instructing its field staff to “no longer apply the 2024 Rule’s analysis when determining employee versus independent contractor status in FLSA investigations.” The DOL will be taking this position while it reconsiders the 2024 Rule, “including whether to rescind the regulation.” In the meantime, DOL investigators are instructed to rely on Fact Sheet #13: Employment Relationship Under the Fair Labor Standards Act (FLSA). Finally, the guidance notes that “the 2024 Rule remains in effect for purposes of private litigation.” The first Regulatory Agenda of the second Trump administration—expected sometime in June or July of this year—should provide stakeholders with a clearer picture of the DOL’s intentions regarding a potential rescission of the 2024 independent contractor rule.
Bipartisan Paid Family Leave Bill Introduced in House. In January 2024, the Buzz discussed the U.S. House of Representatives’ bipartisan Paid Family Leave Working Group’s four-pillar paid leave framework. This week, Representatives Chrissy Houlahan (D-PA) and Stephanie Bice (R-OK), who co-chair the working group, introduced the More Paid Leave for More Americans Act. The legislation combines two pillars of their framework, the Paid Family Leave Public Partnerships Act and the Interstate Paid Leave Action Network Act. Here is how it would work:
- Paid Family Leave Public Partnerships Act. This portion of the bill would offer DOL grants to states that establish paid family leave programs. To be eligible for such grants, states would be required to:
- provide eligible employees with at least six weeks of paid leave for the birth or adoption of a child;
- provide wage replacement between 50 percent and 67 percent based on employees’ income, with a cap equal to 150 percent of the state’s average weekly wage;
- enter into a partnership with a private entity—such as an insurance carrier—to administer the benefits; and
- participate in the to-be-created Interstate Paid Leave Action Network (I-PLAN).
- Interstate Paid Leave Action Network Act (I-PLAN Act). This aspect of the More Paid Leave for More Americans Act would help states reduce the variances between the programs that have led to the current “patchwork” of paid leave compliance requirements. The I-PLAN would be tasked with establishing an agreement that will “[c]reate a single policy standard with respect to all participating States to facilitate easier compliance with and understanding of paid leave programs across States[.]” In other words, the I-PLAN aspect of the bill will strive to seek uniformity between states on key paid family leave terms such as employee eligibility, family member, intermittent leave, etc.
The More Paid Leave for More Americans Act still has a long way to go before becoming law. But the bipartisan nature of the bill is an optimistic sign for its supporters.
EEOC Personnel News. Recent nominations and hiring decisions shed some light on where the U.S. Equal Employment Opportunity Commission (EEOC) is heading from a policy perspective:
- Commissioner Appointment. President Donald Trump nominated Brittany Bull Panuccio to serve on the Commission. Panuccio is currently an assistant U.S. attorney in Florida and previously served as an attorney at the U.S. Department of Education. If confirmed, Panuccio would join Acting Chair Andrea Lucas to form a Republican majority on the Commission. Current Commissioner Kalpana Kotagal is the only Democrat on the Commission. Further, Panuccio’s confirmation would return a functioning quorum to the Commission and would likely allow Acting Chair Lucas to move forward with her regulatory—and subregulatory—agendas. D’Ontae D. Sylvertooth and Sean J. Oliveira have the details.
- Chief of Staff. Acting Chair Lucas has selected Shannon Royce as her chief of staff. Royce is an attorney and former president of the Christian Employers Alliance. Lucas has announced that one of her top priorities is “protecting workers from religious bias and harassment.”
Bill Would Provide Tax Break on Overtime Pay. The Buzz has discussed President Trump’s desire to limit the taxes that workers pay on tips and overtime earnings. Bills have already been introduced in the U.S. Congress to address the “no tax on tips” issue. This week, Republican legislators turned to the overtime issue by introducing the Overtime Wages Tax Relief Act. The bill would allow workers to deduct up to $10,000 ($20,000 for those filing jointly) of income derived from working overtime for each taxable year. The deduction begins to phase out when income reaches $100,000 for individuals or $200,000 for married couples. Republicans may try to include this bill in their larger reconciliation tax reform package.
OFCCP Layoffs Arrive. President Trump’s rescission of Executive Order 11246 eliminated the affirmative action requirements for federal contractors, and, in turn, most of the operations of the Office of Federal Contract Compliance Programs (OFCCP). Many OFCCP employees were subsequently offered a deferred resignation option or placed on administrative leave. This week, most of OFCCP’s remaining employees received notice that they would be laid off, effective June 6, 2025. According to reports, this is more than 300 employees (according to its fiscal year 2025 budget justification, OFCCP has about 490 employees). OFCCP will reportedly maintain one regional office in Dallas, Texas.

OSHA to host public hearing on heat injury and illness prevention proposed rulemaking on June 16
The U.S. Department of Labor’s Occupational Safety and Health Administration will host a virtual public hearing on its proposed rule to protect workers from hazardous heat exposure in indoor and outdoor workplaces on June 16, 2025.
The public hearing on the Notice of Proposed Rulemaking on Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings, will begin on June 16, 2025, at 9:30 a.m. EDT, and continue on subsequent weekdays if necessary.

The Occupational Safety and Health Administration (OSHA) has released a proposed rule that would protect approximately 36 million workers in indoor and outdoor work settings from extreme heat. The proposed rule would require employers to develop an injury and illness prevention plan to control heat hazards in workplaces with excessive heat. The plan would require employers to evaluate heat risks and — when heat increases risks to workers — implement requirements for drinking water, rest breaks, and control of indoor heat. It would also require a plan to protect new or returning workers unaccustomed to working in high-heat conditions.
IHMM initiated collecting comments from its Government Affairs Committee, CSHMs, CSMPs, CHMMs, and CSMPs concerning this proposed regulation and filed the comments linked above on January 13, 2025.

PHMSA Announces Public Meetings For International Standards On The Transport Of Dangerous Goods
The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced on March 12, 2025, that its Office of Hazardous Materials Safety (OHMS) will host four public meetings during 2025 in advance of certain international meetings. The first meeting will be held in preparation of the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP) Working Group 25 (WG/25) scheduled for April 21 – 25, 2025, in Delhi, India. The second meeting will be held in preparation of the 66th session of the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) scheduled for June 30 – July 4, 2025, in Geneva, Switzerland. The third meeting will be held in preparation of the 30th session of the ICAO DGP (DGP/30) scheduled for October 6 – 10, 2025, in Montreal, Canada. The fourth meeting will be held in preparation of the 67th session of the UNSCOE TDG scheduled for November 24 – December 3, 2025, in Geneva, Switzerland. PHMSA will solicit public input on current proposals for each of these meetings. PHMSA states that each public meeting will take place approximately two weeks preceding the international meeting at the headquarters for the Department of Transportation in Washington, D.C.

Professional Certification Coalition
Congress has started working and among our priorities is the Freedom to Invest in Tomorrow’s Workforce Act that we started in the last Congress. This legislation would allow IRS 529 plans to use proceeds for certain certification-related expenses. We expect that bill to be introduced the first week of February, and we have also received strong signals that the legislation will be in the coming reconciliation package. Very hopeful signs.
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis.

Tomorrow’s Workforce Coalition – IHMM Lobbying Congress
IHMM has launched lobbying efforts with all of our U.S.-based credential holders to contact their House and Senate members, encouraging support for HR 1151 and S 756. We and the TWC coalition are undertaking this enormous push as we learned last week that the House Ways and Means Committee will be marking up a new tax bill on May 13, 2025. So, the time is now. We have been informed by our coalition partners that the TWC 529 language will be in the new tax bill! Fantastic news.
The Tomorrow’s Workforce Coalition, led by the American Society of Association Executives (ASAE), and the Professional Certification Coalition (PCC), and on which IHMM is a member of the TWC Steering Committee, recently surpassed 900 member organizations that represent more than 50 different industries across the country.
The Tomorrow’s Workforce Coalition supports the bipartisan, bicameral Freedom to Invest in Tomorrow’s Workforce Act (S. 756 / H.R. 1151), which would expand qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications; it would provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes or alternative career pathways.
H.R. 1151 has 151 co-sponsors in the House. S 756 has 13 co-sponsors in the Senate. IHMM’s Executive Director Gene Guilford, CAE was on Capitol Hill in March working with the coalition on meeting with Members of Congress to co-sponsor the legislation.

EPA Postpones TSCA PFAS Reporting Period to April 2026
The U.S. Environmental Protection Agency announced on May 12, 2025, an interim final rule that would extend the dates of the reporting period for data submitted on the manufacture of perfluoroalkyl or polyfluoroalkyl substances (PFAS) under the Toxic Substances Control Act (TSCA). Under the interim final rule, the data submission period would begin April 13, 2026, and end October 13, 2026. Small manufacturers reporting exclusively as article importers would have until April 13, 2027, to report. According to EPA, the extension will allow it to develop and test further the software being used to collect data from manufacturers, “thereby providing critical feedback to EPA, including what additional guidance would be useful for the reporting community.” A pre-publication version of the interim final rule, which is scheduled to be published on May 13, 2025, has been posted. Publication of the interim final rule in the Federal Register will begin a 30-day comment period. EPA Extends Public Comment Period for Proposed Multi-Sector General Permit

EPA has extended the public comment period for the proposed 2026 Multi-Sector General Permit (MSGP) until May 19, 2025.
Comments must be received on or before May 19, 2025. Comments must be submitted on www.regulations.gov for docket ID EPA-HQ-OW-2024-0481.

What I Learned at NIOSH
Editor’s note: On April 1, more than 92 percent of NIOSH staff received reduction-in-force (RIF) notices, with many placed on immediate administrative leave. A second RIF on May 2 laid off almost everyone else at the agency. The Health Hazard Evaluation (HHE) program was one of the many NIOSH functions that were eliminated.
It was early fall 2010. I had just moved to Cincinnati after finishing my PhD and postdoc in occupational health and safety, and I was going to start my dream job at an agency whose sole mission was to care for the health and safety of workers. I was nervous and exhilarated at the same time.
After going through security, I entered the building where I would work. A few steps into the main corridor, I saw a plaque explaining I was at the Alice Hamilton laboratory building. I got goosebumps. The agency and this building were a testament to Dr. Hamilton’s long, dedicated, productive career, which profoundly impacted the promulgation of the Occupational Safety and Health Act in 1970 and the creation of NIOSH. Dr. Hamilton was already an inspiration to me and remains so to this day.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.

- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together

IHMM Foundation Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
