Associate Hazardous Materials Manager™ [AHMM™]
An Associate Hazardous Materials Manager (AHMM) is specifically for [a] recent college graduates with little or no experience, [b] military personnel or those out of the military with no degree and less than 3 years of experience, or [c] other professionals such as first responders who have no degree or less than 3 years of experience. The AHMM is an early career professional with experience in handling hazardous materials in a wide variety of specialties, such as safety, environmental protection, compliance, or basic dangerous goods transportation. The AHMM professional focuses on technical knowledge and expertise in handling hazardous materials gained from some experience in the United States military from time in a military occupation specialty code [MOS] or Air Force Specialty Codes [AFSC], or formal education in undergraduate or graduate degree studies in applied science, environmental science, environmental engineering, chemistry, biology, physics, or geology.

GOP “Big Beautiful Bill” Finally Passes the House Budget Committee
On Friday, the 16th, the GOP-controlled House Budget Committee rejected the “Big Beautiful Bill,” the Republican House wrote to further President Trump’s tax and budget priorities for 2025, by a vote of 16-21. 4 Republicans opposed the measure. The full text of the legislation is here:

After intensive negotiations over the weekend, in a rare late-night Sunday vote, 4 Republicans switched their NO votes to PRESENT, and the legislation moved out of the budget committee 17-16. While there are still issues to resolve, the legislation now moves to the House Rules Committee later this week. The timeline for consideration envisioned by Speaker Johnson has House floor action before Memorial Day, then the bill moves to the Senate, where additional changes are likely to be made.

Thanks to the continued efforts of the Tomorrow’s Workforce Coalition, the Institute for Credentialing Excellence (ICE), the Professional Certification Coalition (PCC), and the American Society of Association Executives (ASAE), the Freedom to Invest in Tomorrow’s Workforce Act has been reintroduced in the Senate and the House of Representatives!
We have been informed by our coalition partners that the TWC 529 language is being included in the House Ways and Means Committee version of the 2025 tax legislation. That is wonderful news!
The Freedom to Invest in Tomorrow’s Workforce Act would expand qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications. It would provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes, or alternative career pathways.

IHMM/CIC Launches Grassroots Campaign on Nonprofit Organizations and Tax Reform
As Congress debates tax reform in 2025, some Members of Congress are considering raising taxes on nonprofit organizations – including charities, associations, professional societies, and veterans’ groups – to pay for the extension of expiring tax cuts. Increasing the tax burden on these organizations would leave less funding for your organization to drive toward your mission, resulting in negative consequences for the communities you serve.
Now, it is more important than ever for Congress to hear your voice. The tax legislation will develop over the next two weeks as the House of Representatives works toward finalizing the initial draft of the tax bill.

IHMM, NSC Coalition Letter to Congressional Appropriators – OSHA FY2026
Each year, with input from several associated stakeholders, including IHMM, the National Safety Council develops an occupational safety and health congressional appropriations letter for organizations to sign. Given the state of play, this year’s letter focuses on OSHA funding at the FY25 level ($655.5 million) and the restoration of critical NIOSH programs. The letter is attached.

IHMM and SWANA Join In a Statement on End-Of-Life Management
IHMM has joined the Solid Waste Association of North America [SWANA] to raise awareness of the need for safety and responsible end-of-life management of hazardous products. As described in the press release, the waste and resource management industry is struggling with the frequent fires and explosions caused by batteries, marine flares, compressed gas cylinders, and other products. The goal of the statement is to raise awareness about the need for safe handling of these items and to invite producers and policymakers to work with us on solutions for labeling, design, and responsible end-of-life management.

IHMM and the Community Impact Coalition in Washington
Legislative Update:
Late Sunday, the House Budget Committee advanced the latest version of legislation extending the 2017 Tax Cuts and Jobs Act and enacting many of the President’s domestic policy priorities. The latest version of the text eliminates two provisions that were concerning to the coalition:
- Treating revenue related to name and logo royalties as unrelated business taxable income.
- Instituting a new process by which the IRS can suspend the tax-exempt status of organizations deemed to have provided material support to a terrorist organization.
This version maintains the provision that treats certain fringe benefits related to parking and transportation as unrelated business taxable income.
We anticipate there will be changes to the bill before it is considered during its next hearing, and we will continue to monitor to ensure the eliminated provisions stay out of future versions of the bill. The next hearing is scheduled for 1:00am on Wednesday, May 21st in the House Rules Committee.
Coalition Next Steps:
The coalition is planning to move forward with advocacy activities opposing the provision on transportation and parking fringe benefits and working to ensure harmful provisions aren’t added in later in the legislative process. We plan to make the following advocacy opportunities available to coalition members with the option to opt-into participating:
- Sign-On Letter: This letter will thank the U.S. House for recognizing the importance of nonprofit resources and removing one of the more widespread tax increases on the sector and signal intent to work with Congress to have the transportation and parking provision removed from future drafts of the bill. The letter will also oppose the reintroduction of harmful proposals to this bill. This letter will be available for sign-on by the end of this week.
- Grassroots portal: The grassroots message will be updated with similar messaging as the sign-on letter and be available to be sent to Senate offices. The portal will become available in early June, following House passage of the bill.
Thanks to the dedicated advocacy of organizations in this coalition, the initial versions of this bill did not include the more severe tax provisions that were feared. However, the fight is not over, and the coalition will remain vigilant against these provisions re-emerging later in the legislative process. We will continue to work to protect this progress and oppose provisions that would increase taxation on the nonprofit sector.

The Dr. John H Frick Memorial IHMM Scholarship Program – Accepting Applications in September, 2025
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

4. IHMM submitted comments on OSHA Advisory Committee on Construction Safety and Health (ACCSH): Notice of Meetings concerning OSHA-2024-0002-0007, and highlighted the creation of IHMM’s Certified Pandemic Preparedness Specialist [CPPS] credential.
5. State of Maine Department of Environmental Protection is proposing to update Chapter 851, Standards for Generators of Hazardous Waste. In the current regulation, work is required by a professional engineer. IHMM is proposing to include an environmental professional as defined by 40 CFR §312.10.

Republican Legislators Push Ahead With Agenda. This week, the U.S. House of Representatives’ Committee on Ways and Means advanced—on a party-line 26–19 vote—a tax reform package that included Republicans’ top fiscal priorities. The bill makes permanent many provisions of the 2017 Tax Cuts and Jobs Act and includes other measures, such as an expansion of the child tax credit. Of particular interest to the Buzz, the bill also provides temporary (2025 through 2028 tax years) above-the-line deductions for qualified tips and overtime premium pay. There is still quite a long way to go for this bill, and changes are expected, especially considering that some Republicans in the U.S. Senate have already expressed some reservations about the proposal.
OMB Approves EEO-1 Changes. On May 12, 2025, the Office of Management and Budget (OMB) approved changes to the EEO-1 form that removes employers’ option to disclose non-binary employee data. The U.S. Equal Employment Opportunity Commission (EEOC) requested the changes pursuant to President Trump’s Executive Order 14168, “Defending Women From Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.” The proposed instruction booklet filed with OMB indicates that the 2024 EEO-1 filing period would begin on May 20, 2025. There has been no word yet from the EEOC in light of OMB’s approval of the change. Kiosha H. Dickey and James A. Patton, Jr. have the details.
PBGC Nominee on the Move. On May 15, 2025, the U.S. Senate Committee on Health, Education, Labor and Pensions voted to advance the nomination of Janet Dhillon to serve as the director of the Pension Benefit Guaranty Corporation (PBGC). Created by the Employee Retirement Income Security Act of 1974, PBGC protects workers’ retirement benefits through its single-employer and multiemployer insurance programs. Dhillon previously served as chair of the EEOC. Her nomination now awaits a vote on the Senate floor.
House Committee Examines OSHA. On May 15, 2025, the House Committee on Education and the Workforce’s Subcommittee on Workforce Protections held a hearing entitled “Reclaiming OSHA’s Mission: Ensuring Safety Without Overreach.” The hearing focused on the Occupational Safety and Health Administration’s (OSHA) regulatory and enforcement agenda during the Biden administration and “explore[d] common-sense solutions that can return OSHA to fulfilling its purpose of advancing workplace safety.” Legislators and witnesses discussed OSHA’s proposed heat standard, the final “walkaround rule,” and the Severe Violator Enforcement Program. With regard to OSHA’s heat proposal, Republicans and their witnesses criticized its one-size-fits-all proscriptions—arguments that are likely to be made at OSHA’s public hearing on the proposal in June.
Disparate Impact Follow-Up. President Trump’s recent executive order directing federal agencies to limit the use of disparate-impact theories of liability is having a ripple effect at implementing agencies and among stakeholders. Here is the latest fallout:
- Department of Energy Rescinds Regulations. The U.S. Department of Energy—not an agency that we normally deal with at the Buzz—took steps this week to rescind forty-seven regulations. Included is a direct-to-final rule, entitled, “Rescinding Regulations Related to Nondiscrimination in Federally Assisted Programs or Activities (General Provisions).” With regard to a regulatory provision concerning nondiscrimination in federally assisted programs or activities, the direct-to-final rule states the following:
Furthermore, absent a specific, identified, instance of intentional discrimination, statistical information indicating that certain protected groups are underrepresented in some occupations or professions does not obligate any FFA [federal financial assistance] recipient to take remedial or affirmative action under this part. To the contrary, any affirmative action for which “measures of success” depend on “whether some proportional goal has been reached” amounts to “outright racial balancing” which is “patently unconstitutional.” For these reasons, DOE is rescinding 10 CFR 1040.8 in its entirety.
- While not directly impacting private-sector employment policy, the move provides some clues as to how federal agencies will respond to President Trump’s recent executive order.
- Former EEO Officials Respond. While federal agencies begin implementing the executive order (EO), former EEOC and Office of Federal Contract Compliance Programs (OFCCP) officials issued a statement challenging the legal rationale underlying the EO, noting that President Trump’s executive order “may not change a clear statutory mandate and decades of legal precedent.” The statement further notes that contrary to the EO’s claim that the disparate impact theory eliminates meritocracy in the workplace, “disparate impact liability is a means to ensure that merit prevails and that unnecessary and unjustified criteria do not disqualify meritorious candidates on grounds linked to their race, sex, or other protected personal characteristic.” To be sure, the statement will have no impact on the administration’s current views, but it does serve as a reminder to employers and workers that while disparate impact may be deprioritized by the administration, it is still codified in federal law, has been affirmed by the Supreme Court of the United States, and is a viable legal theory for plaintiffs’ counsel.
Immigration: TPS Update.
- In a notice published in the Federal Register on May 13, 2025, the U.S. Department of Homeland Security announced that it would not extend the designation of Afghanistan for Temporary Protected Status (TPS), which is set to terminate on May 20, 2025. Pursuant to the required sixty-day notice period, TPS for Afghanistan will now expire on July 14, 2025. According to the notice, “there are notable improvements in the security and economic situation such that requiring the return of Afghan nationals to Afghanistan does not pose a threat to their personal safety due to armed conflict or extraordinary and temporary conditions.”
- Venezuela TPS. A bipartisan group of representatives has introduced the Venezuela TPS Act of 2025. The bill would automatically designate Venezuela for TPS for eighteen months—with an option for renewal—from the time the bill is enacted. Of course, enactment will be a significant challenge in the Republican-controlled U.S. Congress. Pursuant to a federal court ruling, Venezuela’s TPS designation has been extended through October 2, 2026, and work authorization remains valid through April 2, 2026.

OSHA to host public hearing on heat injury and illness prevention proposed rulemaking on June 16
The U.S. Department of Labor’s Occupational Safety and Health Administration will host a virtual public hearing on its proposed rule to protect workers from hazardous heat exposure in indoor and outdoor workplaces on June 16, 2025.
The public hearing on the Notice of Proposed Rulemaking on Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings, will begin on June 16, 2025, at 9:30 a.m. EDT, and continue on subsequent weekdays if necessary.

The Occupational Safety and Health Administration (OSHA) has released a proposed rule that would protect approximately 36 million workers in indoor and outdoor work settings from extreme heat. The proposed rule would require employers to develop an injury and illness prevention plan to control heat hazards in workplaces with excessive heat. The plan would require employers to evaluate heat risks and — when heat increases risks to workers — implement requirements for drinking water, rest breaks, and control of indoor heat. It would also require a plan to protect new or returning workers unaccustomed to working in high-heat conditions.
IHMM initiated collecting comments from its Government Affairs Committee, CSHMs, CSMPs, CHMMs, and CSMPs concerning this proposed regulation and filed the comments linked above on January 13, 2025.
PHMSA Announces Public Meetings For International Standards On The Transport Of Dangerous Goods
The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced on March 12, 2025, that its Office of Hazardous Materials Safety (OHMS) will host four public meetings during 2025 in advance of certain international meetings. The first meeting will be held in preparation of the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP) Working Group 25 (WG/25) scheduled for April 21 – 25, 2025, in Delhi, India. The second meeting will be held in preparation of the 66th session of the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) scheduled for June 30 – July 4, 2025, in Geneva, Switzerland. The third meeting will be held in preparation of the 30th session of the ICAO DGP (DGP/30) scheduled for October 6 – 10, 2025, in Montreal, Canada. The fourth meeting will be held in preparation of the 67th session of the UNSCOE TDG scheduled for November 24 – December 3, 2025, in Geneva, Switzerland. PHMSA will solicit public input on current proposals for each of these meetings. PHMSA states that each public meeting will take place approximately two weeks preceding the international meeting at the headquarters for the Department of Transportation in Washington, D.C.
Professional Certification Coalition
Congress has started working and among our priorities is the Freedom to Invest in Tomorrow’s Workforce Act that we started in the last Congress. This legislation would allow IRS 529 plans to use proceeds for certain certification-related expenses. We expect that bill to be introduced the first week of February, and we have also received strong signals that the legislation will be in the coming reconciliation package. Very hopeful signs.
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis.

Tomorrow’s Workforce Coalition – IHMM Lobbying Congress
It is with great excitement that we write to report that, after significant advocacy efforts by the Tomorrow’s Workforce Coalition (TWC) team and by you, the TWC membership, the language of the Freedom to Invest in Tomorrow’s Workforce Act has been included in the major tax legislative package that House Republicans released this week! The House Ways & Means Committee finished marking up the broader tax bill, including Freedom to Invest, earlier today, and the bill will head to the House floor next week. From there, if the House passes the legislation (a big “if”), it will move over to the Senate for further consideration over the next 4-6 weeks.
The inclusion of Freedom to Invest is a byproduct of years of lobbying by scores of organizations who understand how this legislation could transform 529 savings accounts from “college savings plans” to “career savings plans” by allowing beneficiaries to use funds in those plans for, among other things, obtaining and maintaining professional certifications, licenses, and credentials, like those offered and represented by TWC members. But make no mistake: this legislation would not exist and would not be advancing without the TWC’s existence and efforts—our organization and our members have been the driving force behind it since we first devised and drafted it several years ago!
The inclusion of Freedom to Invest in the tax package coincides with the bill having just hit a significant milestone: as of Friday, the House version of the bill now has at least 161 cosponsors, exceeding last session’s total of 150. Democratic support for the bill, with 67 cosponsors, has also now surpassed last session’s total of 60, which is somewhat remarkable given that many Democrats recognize that the bill stands its greatest chance of enactment by being included in the Republican tax package. The upshot of this bipartisan progress is that, even if the GOP tax package fails to be enacted, our bill stands a chance to be considered on a standalone basis or as part of a bipartisan tax package later this year. We are pursuing all available paths to ensure that Freedom to Invest is enacted into law at the earliest possible opportunity.
To be sure, there are several separate provisions in the wide-ranging Republican tax bill that could pose potential complications for certification organizations/professional societies/membership associations. We are currently assessing those provisions and their potential impact. As such, to the extent you are engaging in your own advocacy efforts, TWC members will need to assess whether or not they will support the broader bill beyond Freedom to Invest. However, we are pleased that this transformative legislation is making the progress we were hoping it would and will keep you updated as the legislation process continues to unfold.
H.R. 1151 has 168 co-sponsors in the House. S 756 has 13 co-sponsors in the Senate. IHMM’s Executive Director Gene Guilford, CAE was on Capitol Hill in March working with the coalition on meeting with Members of Congress to co-sponsor the legislation.

Important Stories for IHMM Certificants
Standing Down to Prevent Falls
On May 7, Deputy Secretary of Labor Keith Sonderling joined more than 1,800 construction workers, employers, and other stakeholders at the National Institutes of Health work site in Bethesda, Maryland, for OSHA’s National Safety Stand-Down to Prevent Falls.
Similar stand-downs were held at worksites across the country. During these events, employers pause normal work activities and lead employees in toolbox talks or other activities such as conducting safety equipment inspections, developing rescue plans, or discussing job specific hazards. Falls from heights continue to be the leading cause of fatal injuries in construction.

New TDG FAQ under Part 4 – Dangerous Goods Safety Marks
Transport Canada has advised that the TDG Directorate has added a new question to the frequently asked questions (FAQ) regarding UN1203 & UN3475 placard requirements (Labels and Placards – TDG Regulations (Part 4 – Dangerous Goods Safety Marks). The purpose of this addition to the FAQ is to provide clarity regarding section 4.19 of the Transportation of Dangerous Goods Regulations, and does NOT introduce any new regulatory requirements.

Transport Canada Advisory: Class 111 Tank Cars
Transport Canada advised railway stakeholders that starting May 1, 2025, the phase-out of Class 111 tank cars in flammable liquids service across Canada will be fully implemented. Per the requirements of Transport Canada standard TP14877, Clause 10.5.6, jacketed and unjacketed legacy Class 111 tank cars, as well as jacketed and unjacketed enhanced Class 111 tank cars (also known as jacketed and unjacketed CPC-1232 tank cars) are no longer permitted to be used to import, offer for transport, handle or transport Class 3, Flammable Liquids as of May 1, 2025 at 00:01 PST. The purpose of the advisory is to remind all industry stakeholders of these requirements and notify that Transport Canada inspectors will be conducting on-site inspections to verify compliance with these requirements as of May 1st. With a new Trump Administration and the relentless pace of regulatory developments related to Lautenberg implementation, there are many issues to consider and problems to solve.

EPA Postpones TSCA PFAS Reporting Period to April 2026
The U.S. Environmental Protection Agency announced on May 12, 2025, an interim final rule that would extend the dates of the reporting period for data submitted on the manufacture of perfluoroalkyl or polyfluoroalkyl substances (PFAS) under the Toxic Substances Control Act (TSCA). Under the interim final rule, the data submission period would begin April 13, 2026, and end October 13, 2026. Small manufacturers reporting exclusively as article importers would have until April 13, 2027, to report. According to EPA, the extension will allow it to develop and test further the software being used to collect data from manufacturers, “thereby providing critical feedback to EPA, including what additional guidance would be useful for the reporting community.” A pre-publication version of the interim final rule, which is scheduled to be published on May 13, 2025, has been posted. Publication of the interim final rule in the Federal Register will begin a 30-day comment period. Eliminating NIOSH Will Hurt American Workers
Editor’s note: This week, news organizations reported that some NIOSH employees whose positions were terminated have been recalled.
Since NIOSH was established by the Occupational Safety and Health Act of 1970, the agency has been a world leader in promoting workplace health and safety and supporting a highly trained corps of health and safety professionals. I have personally benefited from the work of NIOSH in terms of educational opportunities (my Master of Science and doctoral degrees were both partially funded by the agency) and research support (NIOSH has funded many applied research projects over my career). I can say, with complete certainty, that without the support of NIOSH my career in industrial hygiene would likely have looked much different, and that I might not even have gone into this field in the first place. This is true for me, and it is also true for literally tens of thousands of other occupational health and safety professionals across a variety of disciplines—industrial hygiene, occupational safety, occupational medicine, occupational health nursing, occupational epidemiology, ergonomics, and more—whose education was supported by NIOSH. These professionals are our first and most important line of defense against workplace injuries, illnesses, and fatalities, and it is precisely this professional workforce that is threatened by the Trump administration’s April 2025 decision to essentially eliminate NIOSH and end 55 years of federal funding to train critically important health and safety practitioners and researchers.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. - AHMP has welcomed Aleta Finney, MS, CHMM, CEA, REP, to the Board of Directors. Aleta has been appointed to serve the remainder of a vacated term lasting until the end of 2025. Based in Pennsylvania, Aleta serves as the Senior Environmental Program Manager at Pepco Holdings. She brings extensive experience in Environmental, Health, and Safety (EHS) and has actively contributed to several national volunteer committees and professional organizations within her field.

IHMM Foundation Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
