House of Representatives Passes H.R. 1, “One Big Beautiful Bill,” 215-214
The House voted 215-214 along party lines early last Thursday morning to pass its budget reconciliation package that includes a wide array of federal spending cuts as well as changes in the federal tax code, including extending the expiring sections of the federal tax code created in 2017.
H.R. 1 is more than 1,100 pages in length. The legislation passed at 7 am last Friday is here.
This is the “Manager’s Amendment” to H.R. 1
IHMM is providing this section-by-section synopsis of H.R. 1 here.
The bill now heads to the Senate for consideration.

The Tomorrow’s Workforce Coalition Applauds the Inclusion of 529 Savings Account Expansion in the House-Passed “One, Big, Beautiful Bill”
The Tomorrow’s Workforce Coalition, of which IHMM is a part, proudly supports the U.S. House of Representatives’ inclusion of legislation expanding the use of 529 savings plans in the One, Big, Beautiful Bill. The Freedom to Invest in Tomorrow’s Workforce Act, included in this bill, expands qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications. It provides valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes, or alternative career pathways.
America’s workforce is comprised mostly of middle-skill jobs that require more than a high school education but not a bachelor’s degree, according to the National Skills Coalition. Postsecondary credentialing for workers with or without a two- or four-year degree is a differentiator in the 21st century workforce.
Associations are the primary source of this post-college education and skills training for America’s workforce. 57 million adults take formal work-related courses or training each year. 70% of those individuals receive training courses from either a private business or a professional association. Providing additional opportunities for people to access this training and credentialing provides an alternative to traditional higher education for those seeking access to family-sustaining careers. This paradigm shift in 529 savings accounts from “college savings plans” to “career savings plans” will make these accounts more accessible to contributors of all income levels and beneficiaries of all skill levels. Families could save money—utilizing the unique tax advantages that 529 plans offer—for beneficiaries at any stage of their careers and at any education level to boost career prospects and earning potential. This legislation would also provide flexibility for 529 beneficiaries to use their plan funds to cover the high quality educational, training, or credentialing programs that best fit their skills development, professional growth, and chosen career path.
As the bill makes its way to the Senate, the Tomorrow’s Workforce Coalition urges Senators to pass legislation that includes the Freedom to Invest in Tomorrow’s Workforce Act. Doing so will help strengthen our nation’s workforce now and well into the future.

IHMM/ASAE Campaign for “Freedom to Invest in Tomorrow’s Workforce Act” CALL TO ACTION
Thanks to the continued efforts of the Tomorrow’s Workforce Coalition, of which IHMM is a part, the Freedom to Invest in Tomorrow’s Workforce Act has been reintroduced in the Senate and the House of Representatives! The language we sought in this legislation is in H.R. 1, which recently passed the House. Now it is on to the Senate.
The Freedom to Invest in Tomorrow’s Workforce Act would expand qualified expenses under 529 savings plans to include postsecondary training and credentialing, such as licenses and nongovernmental certifications. It would provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes, or alternative career pathways.

CALL TO ACTION: CONTACT CONGRESS
IHMM/CIC Launches Grassroots Campaign on Nonprofit Organizations and Tax Reform
As Congress debates tax reform in 2025, some Members of Congress are considering raising taxes on nonprofit organizations – including charities, associations, professional societies, and veterans’ groups – to pay for the extension of expiring tax cuts. Increasing the tax burden on these organizations would leave less funding for your organization to drive toward its mission, resulting in negative consequences for the communities it serves.
Now, it is more important than ever for Congress to hear your voice. The House passed H.R. 1, and now the Senate will consider the legislation. We have all heard several Senators talking about making many changes to the House-passed legislation.
Fill out the form in the link below to contact your House and Senate members and ask them to protect associations and nonprofits as they develop tax reform legislation this month.

IHMM and SWANA Join In a Statement on End-Of-Life Management
IHMM has joined the Solid Waste Association of North America [SWANA] to raise awareness of the need for safety and responsible end-of-life management of hazardous products. As described in the press release, the waste and resource management industry is struggling with the frequent fires and explosions caused by batteries, marine flares, compressed gas cylinders, and other products. The goal of the statement is to raise awareness about the need for safe handling of these items and to invite producers and policymakers to work with us on solutions for labeling, design, and responsible end-of-life management.

IHMM and the Intersociety Forum [ISF]
Driving Business Growth and Profitability
IHMM is a member of the Intersociety Forum, made up of organizations dedicated to the EHS professions and to communicating with policy makers about the critically important role that the EHS professionals play in our world.
Modern occupational environmental, health, and safety (EHS) practices are key to driving economic growth. This document, developed by the Intersociety Forum (ISF), a coalition of organizations dedicated to safeguarding worker safety and health, highlights the many ways safety practices create a strategic advantage that powers enduring business success while fostering innovation and protecting workers.
Despite advancements, workplace injury and fatality rates remain stagnant. By adopting proactive, risk-based safety strategies, businesses can unlock greater productivity, reduce costs, and strengthen their global competitiveness. We urge today’s business leaders and policymakers to prioritize occupational EHS as a foundation of economic competitiveness. Adopting this approach will position the U.S. as a global leader in safety, innovation, and workforce well-being, enabling workers and businesses to thrive. Driving Business Growth and Profitability.
Here is the “Driving Business Growth and Profitability Through Modern Occupational Environmental, Health and Safety Practices” document.

IHMM and the Community Impact Coalition in Washington
Legislative Update:
We are pleased to report significant progress for associations with the removal of the proposed tax on name and logo royalties, which would have clarified this revenue is unrelated business taxable income (UBI).
However, the House-passed bill [H.R. 1] still includes a provision treating certain fringe benefits related to parking and transportation as unrelated business taxable income.
Coalition Next Steps:
The coalition is planning to move forward with advocacy activities opposing the provision on transportation and parking fringe benefits and working to ensure harmful provisions aren’t added in later in the legislative process. We plan to make the following advocacy opportunities available to coalition members with the option to opt-into participating:
- Sign-On Letter: This letter will thank the U.S. House for recognizing the importance of nonprofit resources and removing one of the more widespread tax increases on the sector and signal intent to work with Congress to have the transportation and parking provision removed from future drafts of the bill. The letter will also oppose the reintroduction of harmful proposals to this bill. This letter will be available for sign-on by the end of this week.
- Grassroots portal: The grassroots message will be updated with similar messaging as the sign-on letter and be available to be sent to Senate offices. The portal will become available in early June, following House passage of the bill.
Thanks to the dedicated advocacy of organizations in this coalition, the initial versions of this bill did not include the more severe tax provisions that were feared. However, the fight is not over, and the coalition will remain vigilant against these provisions re-emerging later in the legislative process. We will continue to work to protect this progress and oppose provisions that would increase taxation on the nonprofit sector.

SCOTUS: Wilcox to Remain Off NLRB. On May 22, 2025, the Supreme Court of the United States issued a decision blocking NLRB Board Member Gwynne Wilcox’s reinstatement to the NLRB while her challenge makes its way through the courts. The stay will remain effective through the appeals stage and until the Supreme Court declines to review the case or issues a decision on the merits. C. Thomas Davis and Zachary V. Zagger have the scoop.
House Passes Massive Tax Passage. Lawmakers in the U.S. House of Representatives this week passed a far-reaching tax and spending package by a narrow 215–214 vote. The bill would extend provisions of the 2017 Tax Cuts and Jobs Act, provide additional funding for national security and immigration enforcement, roll back green energy tax incentives, and add Medicaid work requirements. On the labor and employment policy front, the bill includes provisions to allow deductions for income earned as tips or overtime pay. Now it is the U.S. Senate’s turn, where some Republicans have expressed some skepticism about the bill, so any final legislation that the U.S. Congress may pass will likely be different than what the House passed this week.
Senate Says “Yes” to “No Tax on Tips.” In a surprise move, the U.S. Senate this week passed the No Tax on Tips Act (S.129). Democratic Senator Jacky Rosen (NV), a cosponsor of the bill, asked that the bill be passed via the Senate’s unanimous consent mechanism, and no one objected. Passage of a bill this significant in this manner is unusual. Here are the details:
- The bill would allow individuals a 100 percent tax deduction on income from qualified tips, up to $25,000.
- Individuals claiming the tip deduction must be employed “in an occupation which traditionally and customarily received tips,” as set forth in a pending list to be published by the secretary of the treasury.
- The deduction is available to individuals earning $160,000 or less in 2025, with this amount being adjusted for inflation going forward.
Language in the Senate-passed No Tax on Tips Act is similar in concept to the provisions included in the tax package described above. However, there are some significant differences in the details. It is unclear at this time how this will be resolved, but some form of “no tax on tips” has a very good chance of being enacted in this Congress.
2024 EEO-1 Data Collection Opens, With Warning From Acting Chair. The U.S. Equal Employment Opportunity Commission’s (EEOC) 2024 EEO-1 Component 1 data collection opened this week (May 20, 2025) with covered employers having until June 24, 2025, to file. In a statement accompanying the announcement of the opening of the data collection, EEOC Acting Chair Andrea Lucas wrote, “Your company or organization may not use information about your employees’ race/ethnicity or sex—including demographic data you collect and report in EEO-1 Component 1 reports—to facilitate unlawful employment discrimination based on race, sex, or other protected characteristics in violation of Title VII.” T. Scott Kelly and Zachary V. Zagger have more details.
House Committee Examines “Modern Workers.” On May 20, 2025, the House Committee on Education and the Workforce’s Subcommittee on Workforce Protections held a hearing entitled “Empowering the Modern Worker.” The hearing focused on the benefits of worker flexibility, practical problems associated with the “ABC” worker classification test (as embodied in California’s A.B. 5), and the value of portable benefits, as set forth in the Modern Worker Empowerment Act (H.R. 1319). The hearing follows on the heels of a March 25, 2025, hearing about the application of the Fair Labor Standards Act to the modern workplace.
DOL, MSHRC Nominees on the Move. On May 22, 2025, the Senate Health, Education, Labor, and Pensions (HELP) Committee advanced the following nominations en bloc by a party-line vote of 12–11:
- Julie Hocker to serve as assistant secretary of labor and head the U.S. Department of Labor’s (DOL) Office of Disability Employment Policy
- Marco Rajkovich to serve as a commissioner of the Mine Safety and Health Review Commission (MSHRC)
- Wayne Palmer to serve as assistant secretary of labor for mine safety and health, leading the DOL’s Mine Safety and Health Administration
- Henry Mack III to serve as assistant secretary of labor, leading the DOL’s Employment and Training Administration
The nominations now move to the Senate floor.
NLRB Acting GC Issues New Guidance on Settlement Agreements. On May 16, 2025, National Labor Relations Board (NLRB) Acting General Counsel William B. Cowen issued a memorandum entitled, “Seeking Remedial Relief in Settlement Agreements.” The memorandum follows on Cowen’s rescission of various memoranda issued by his predecessor that instructed NLRB regional offices to expand the scope of remedies in settlement agreements (e.g., reimbursement of car loan payments, letters of apology, etc.). Cowen’s latest memo provides regional directors with more discretion in approving settlement agreements, and it reminds them that they should seek make-whole relief in settlement agreements, but “should be mindful of not allowing our remedial enthusiasm to distract us from achieving a prompt and fair resolution of disputed matters.” Thomas M. Stanek has more.
SCOTUS Permits Cancelation of Venezuela TPS. In an 8–1 order issued this week, the Supreme Court stayed a March 31, 2025, decision by a federal court to preliminarily block the U.S. Department of Homeland Security’s (DHS) January 28, 2025, notice of termination of the 2021 and 2023 Temporary Protected Status (TPS) designations for Venezuela. While both the Supreme Court’s order and U.S. Citizenship and Immigration Services’ (USCIS) TPS website are unclear as to the ruling’s impact on stakeholders, it appears that applicable dates for termination of the 2023 TPS designation reverts to April 7, 2025, while the 2021 TPS designation will remain in effect until September 10, 2025. Because the Supreme Court’s decision only concerns the lower court’s grant of a preliminary injunction, the underlying legal challenge to the TPS termination decision will continue.
Administration Pauses Enforcement of Mental Health Parity Regs. Last week, at the request of the U.S. Departments of Health and Human Services, Labor, and the Treasury, the U.S. District Court for the District of Columbia stayed a lawsuit challenging 2024 changes to regulations implementing provisions of the Mental Health Parity and Addiction Equity Act (MHPAEA). As a result, the departments issued a statement noting that they will not enforce the 2024 regulatory changes and will “reconsider the 2024 Final Rule, including whether to issue a notice of proposed rulemaking rescinding or modifying the regulation through notice and comment rulemaking.” Timothy J. Stanton and Kristine M. Bingman have the details.

Regulatory Updates

OSHA Updated Site-Specific Targeting (SST) Program Directive
We want to make you aware that the Occupational Safety and Health Administration (OSHA) has updated the inspection program that directs agency enforcement resources to establishments with the highest rates of injuries and illnesses based on injury and illness data submitted in accordance with OSHA’s recordkeeping requirements.
The Site-Specific Targeting (SST) program is OSHA’s primary planned inspection program for non-construction workplaces that have 20 or more employees. Using OSHA Form 300A data from calendar years 2021-2023, establishments may be selected for inspection based on:
- High injury and illness rates from 2023 data.
- Upwardly trending injury and illness rates based on 2021-2023 data at or above twice the 2022 private sector average.
- Injury and illness rates markedly below industry averages.
- Failure to submit an OSHA Form 300A in 2023.
The new directive replaces the previous directive issued on February 7, 2023. For more information, please see the directive and the news release.

OSHA to host public hearing on heat injury and illness prevention proposed rulemaking on June 16
The U.S. Department of Labor’s Occupational Safety and Health Administration will host a virtual public hearing on its proposed rule to protect workers from hazardous heat exposure in indoor and outdoor workplaces on June 16, 2025.
The public hearing on the Notice of Proposed Rulemaking on Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings, will begin on June 16, 2025, at 9:30 a.m. EDT, and continue on subsequent weekdays if necessary.
IHMM Submits Comments on the OSHA Proposed Heat Rule
Read IHMM’s Comments Here Filed 1-13-2025
The Occupational Safety and Health Administration (OSHA) has released a proposed rule that would protect approximately 36 million workers in indoor and outdoor work settings from extreme heat. The proposed rule would require employers to develop an injury and illness prevention plan to control heat hazards in workplaces with excessive heat. The plan would require employers to evaluate heat risks and — when heat increases risks to workers — implement requirements for drinking water, rest breaks, and control of indoor heat. It would also require a plan to protect new or returning workers unaccustomed to working in high-heat conditions.
IHMM initiated collecting comments from its Government Affairs Committee, CSHMs, CSMPs, CHMMs, and CSMPs concerning this proposed regulation and filed the comments linked above on January 13, 2025.

PHMSA Announces Public Meetings For International Standards On The Transport Of Dangerous Goods
The Pipeline and Hazardous Materials Safety Administration (PHMSA) announced on March 12, 2025, that its Office of Hazardous Materials Safety (OHMS) will host four public meetings during 2025 in advance of certain international meetings. The first meeting will be held in preparation of the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP) Working Group 25 (WG/25) scheduled for April 21 – 25, 2025, in Delhi, India. The second meeting will be held in preparation of the 66th session of the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG) scheduled for June 30 – July 4, 2025, in Geneva, Switzerland. The third meeting will be held in preparation of the 30th session of the ICAO DGP (DGP/30) scheduled for October 6 – 10, 2025, in Montreal, Canada. The fourth meeting will be held in preparation of the 67th session of the UNSCOE TDG scheduled for November 24 – December 3, 2025, in Geneva, Switzerland. PHMSA will solicit public input on current proposals for each of these meetings. PHMSA states that each public meeting will take place approximately two weeks preceding the international meeting at the headquarters for the Department of Transportation in Washington, D.C.

Professional Certification Coalition
Congress has started working and among our priorities is the Freedom to Invest in Tomorrow’s Workforce Act that we started in the last Congress. This legislation would allow IRS 529 plans to use proceeds for certain certification-related expenses. We expect that bill to be introduced the first week of February, and we have also received strong signals that the legislation will be in the coming reconciliation package. Very hopeful signs.
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis.

Tomorrow’s Workforce Coalition – IHMM Lobbying Congress
The House of Representatives passed the reconciliation package, the “One, Big, Beautiful Bill” that will extend the 2017 Tax Cuts and Jobs Act and enact many of the President’s domestic policy priorities.
We are pleased to report significant progress for associations with the removal of the proposed tax on name and logo royalties, which would have clarified this revenue is unrelated business taxable income (UBI).
However, the House-passed bill still includes a provision treating certain fringe benefits related to parking and transportation as unrelated business taxable income.
In positive news, the Freedom to Invest in Tomorrow’s Workforce Act was included in the House-passed bill. This important provision expands qualified expenses under 529 savings plans to cover postsecondary training and credentialing, such as licenses and nongovernmental certifications. This will provide valuable tax-advantaged resources to more workers pursuing career growth, mid-career changes, or alternative career pathways.
H.R. 1151 has 176 co-sponsors in the House. S 756 has 13 co-sponsors in the Senate. IHMM’s Executive Director Gene Guilford, CAE was on Capitol Hill in March working with the coalition on meeting with Members of Congress to co-sponsor the legislation.

Important Stories for IHMM Certificants

EPA Proposes Temporary Relief to Ensure Lab Compliance with Methylene Chloride Regulations under TSCA
- IHMM filed comments on the proposed Methylene Chloride regulations last December when they were under review at OMB –
The U.S. Environmental Protection Agency (EPA) is proposing to extend various upcoming compliance dates in the final risk management rule for methylene chloride under the Toxic Substances Control Act (TSCA) in order to ensure long-term compliance with the rule’s requirements. The proposal extends the Workplace Chemical Protection Program (WCPP) compliance dates for non-federal laboratories by an additional 18 months, to align with the dates allowed for federal laboratories and their contractors. EPA is issuing this proposal to address non-federal laboratories’ near-term challenges with implementation of the May 2024 final rule on methylene chloride.
If finalized, this proposal would extend the following compliance dates for non-federal laboratories: for initial monitoring from May 5, 2025, to November 9, 2026; for establishing regulated areas and ensuring compliance with the Existing Chemical Exposure Limit from August 1, 2025, to February 8, 2027; and for ensuring the methods of compliance, as well as developing and implementing an exposure control plan, from October 30, 2025, to May 10, 2027.
Shortly after publishing the 2024 final rule, representatives from various laboratories using methylene chloride contacted EPA with questions and concerns including on the applicability of the rule and the requirements for WCPP compliance. Many of these laboratories, especially those associated with local governments or universities on fixed budget cycles that did not contemplate these requirements, use methylene chloride in small quantities and somewhat infrequently and are facing challenges completing the rule’s initial monitoring requirements across potentially hundreds of labs in such a short timeframe. EPA’s proposal would avoid disrupting important environmental monitoring and associated activities, while these non-federal labs work to comply with the rule’s new requirements.
EPA will soon publish a Federal Register notice extending the compliance dates for non-federal laboratories. Upon publication of the Federal Register notice, EPA will accept comments for 30 days via docket EPA-HQ-OPPT-2020-0465 on regulations.gov.
While we are proposing new compliance dates through this action, the current deadlines remain effective until modified through this rulemaking. Enforcement of the current deadlines is a low enforcement priority for the agency, and EPA intends to focus its resources on compliance with the new compliance dates that may be established by this rulemaking. EPA retains the right to take action to address imminent and substantial threats to human health and the environment.

Congressional Review Act Revocation of Waste Emissions Charge for Petroleum and Natural Gas Systems: Procedures for Facilitating Compliance, Including Netting and Exemptions
Environmental Protection Agency (EPA).
ACTION:
Final rule; CRA revocation.
SUMMARY:
Congress has passed and the President has signed a joint resolution of disapproval under the Congressional Review Act (CRA) of the Environmental Protection Agency’s (EPA) final rule titled, “Waste Emissions Charge for Petroleum and Natural Gas Systems: Procedures for Facilitating Compliance, Including Netting and Exemptions” (2024 WEC Final Rule). The 2024 WEC Final Rule implemented and facilitated compliance with the requirements of the Waste Emissions Charge in the Clean Air Act’s (CAA) Methane Emissions Reduction Program. Under the joint resolution and by operation of the CRA, the 2024 WEC Final Rule now has no legal force or effect. Because the rule has been nullified, the EPA is removing it from the Code of Federal Regulations (CFR). This action is exempt from notice-and-comment rulemaking because it is ministerial in nature.

EPA Postpones TSCA PFAS Reporting Period to April 2026
The U.S. Environmental Protection Agency announced on May 12, 2025, an interim final rule that would extend the dates of the reporting period for data submitted on the manufacture of perfluoroalkyl or polyfluoroalkyl substances (PFAS) under the Toxic Substances Control Act (TSCA). Under the interim final rule, the data submission period would begin April 13, 2026, and end October 13, 2026. Small manufacturers reporting exclusively as article importers would have until April 13, 2027, to report. According to EPA, the extension will allow it to develop and test further the software being used to collect data from manufacturers, “thereby providing critical feedback to EPA, including what additional guidance would be useful for the reporting community.” A pre-publication version of the interim final rule, which is scheduled to be published on May 13, 2025, has been posted. Publication of the interim final rule in the Federal Register will begin a 30-day comment period. For more information about this announcement, as well as links to our memoranda and blogs, please read the full memorandum.

Eliminating NIOSH Will Hurt American Workers
Editor’s note: This week, news organizations reported that some NIOSH employees whose positions were terminated have been recalled.
Since NIOSH was established by the Occupational Safety and Health Act of 1970, the agency has been a world leader in promoting workplace health and safety and supporting a highly trained corps of health and safety professionals. I have personally benefited from the work of NIOSH in terms of educational opportunities (my Master of Science and doctoral degrees were both partially funded by the agency) and research support (NIOSH has funded many applied research projects over my career). I can say, with complete certainty, that without the support of NIOSH my career in industrial hygiene would likely have looked much different, and that I might not even have gone into this field in the first place. This is true for me, and it is also true for literally tens of thousands of other occupational health and safety professionals across a variety of disciplines—industrial hygiene, occupational safety, occupational medicine, occupational health nursing, occupational epidemiology, ergonomics, and more—whose education was supported by NIOSH. These professionals are our first and most important line of defense against workplace injuries, illnesses, and fatalities, and it is precisely this professional workforce that is threatened by the Trump administration’s April 2025 decision to essentially eliminate NIOSH and end 55 years of federal funding to train critically important health and safety practitioners and researchers.

IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together
