Melissa Hamer, CHMM – At Large seat
Ms. Hamer was elected to a four-year term beginning in 2020 to the Institute of Hazardous Materials Management’s (IHMM) National Board of Directors. She was elected to the IHMM Board’s Executive Committee in December 2020 and serves as the Board Secretary. The IHMM certifies and manages multiple hazardous and dangerous materials and occupational safety and health credentials. She is also a regular speaker on environmental law including PFAS topics, administrative laws and procedures, and on construction and insurance law issues.
Ms. Hamer has been a Certified Hazardous Materials Manager (CHMM) since 2010 as accredited under ANSI/ISO/IEC 17024, the International Standard for Personnel Certification Programs and The Council of Engineering and Scientific Specialty Boards (CESB). She also is an environmental professional, as defined in the ASTM E1527 standard for environmental and real estate due diligence and under the U.S. EPA’s guidance.

Dan has served on two IHMM committees as Chair, Professional Standards, and Microcredential. Dan served previously on the ISHM board of directors as vice chair. He also serves on the NFPA 241 Committee, and previously chaired the DC metro ABC Safety Committee, the DCMSA Safety Committee, served on the Montgomery County (MD) Volunteer Fire Rescue Association Board of Directors and is an active professional member of the ASSP.

Your name: Nathan Bolin
2. Where you work: Cummins Seymour Engine Plant
3. What motivated you to pursue your IHMM certification? My department leader has held IHMM credentials throughout his career, and he strongly encouraged me to pursue certification as a career development tool.
4. What does holding the certification mean to you? My AHMM certification identifies me as a developing environmental professional that is committed to continuous education in the field. It also showcases my passion for protecting human and environmental health from exposure to hazardous materials at my facility and across industries.
5. What aspects of your profession do you find most appealing or enjoyable? I love solving problems that come with new/abnormal experiences. Examples of this include emergency response to EHS incidents and hazard identification exercises that are related to hazardous materials and pollution prevention. I also really enjoy participating in sustainability projects that help my facility achieve a smaller environmental footprint.
6. How many years of experience have you accumulated in your field? I have worked for the Seymour Engine Plant HSE team for one year. This position is my first since finishing my undergraduate degree in May 2022.
7. What advice do you have for individuals who are just embarking on their careers? Pursue as many new experiences/opportunities as your manager and company will allow. The knowledge you gain from these experiences will help you make important decisions for your site or company as you accumulate seniority. Networking with other environmental professionals is vital as well, both within your company and externally. It is easy for me to feel like my site’s challenges are unique, but talking with others in my company and industry has helped me realize that most other sites experience the same challenges.
Call for Experts for National Academies Committee on PPE
ASSP received an inquiry from the National Academies of Sciences, Engineering, and Medicine addressing: Committee on Personal Protective Equipment for Workplace Safety and Health. We also received this description from Autumn Downey, Ph.D. Dr. Downey is the Senior Program Officer for the Health and Medicine Division with the National Academies of Sciences, Engineering, and Medicine. IHMM is a member of ASSP and is pleased to pass along this information to our certificants.
“…This committee, sponsored by the National Institute for Occupational Safety and Health’s (NIOSH’s) National Personal Protective Technology Laboratory (NPPTL), serves as a forum for discussion of scientific and technical issues relevant to the development, certification, deployment, and use of personal protective equipment (PPE), standards, and related systems to ensure workplace safety and health (additional details can be found in the attached project summary). We are in the process of appointing new members who could augment the committee’s current expertise in the areas of engineering and PPE design, PPE standards and evaluation, textiles and material science, aerosol science, occupational safety and health/occupational medicine, infection control and prevention, industrial hygiene, and emergency preparedness and response. We are aiming to widely distribute the attached announcement with a call for experts to be considered for serving on the committee and thought it may be of interest to the ASSP membership. The Society is also going to distribute the announcement to a diverse range of ASSP members and communities such as our common interest groups, practice specialties, and other impacted areas. EPA Proposes to Ban TCE
The U.S. Environmental Protection Agency (EPA) proposed on October 31, 2023, to ban all uses of trichloroethylene (TCE) after determining that it presents an unreasonable risk of injury to human health under its conditions of use as documented in EPA’s November 2020 risk evaluation (2020 TCE RE) and January 2023 revised risk determination (2023 Revised RD) pursuant to the Toxic Substances Control Act (TSCA). 88 Fed. Reg. 74712. The proposed rule would ban the manufacture, processing, and distribution of TCE for all uses. It would take effect in one year for consumer products and most commercial uses and would implement stringent worker protections on the limited remaining commercial and industrial uses that would be phased down over a longer period. Comments are due December 15, 2023. Under the Paperwork Reduction Act, comments on the information collection provisions are best assured of consideration if the Office of Management and Budget (OMB) receives a copy of the comments on or before November 30, 2023. In strategic planning on August 17, 2023 IHMM created a strategic imperative to create a broader government affairs operation on behalf of, and with the assistance of, all of IHMM’s certificants.

POTUS Issues Executive Order on AI Framework. On October 30, 2023, President Biden issued the “Executive Order on the Safe, Secure, and Trustworthy Development and Use of Artificial Intelligence” (EO). According to its terms, the executive order sets forth “a coordinated, Federal Government-wide approach” to the responsible development and implementation of artificial intelligence (AI) technology. While the U.S. Congress has had hearings and discussions about various aspects of AI, and agencies, such as the U.S. Equal Employment Opportunity Commission (EEOC), have issued some guidance on the subject, this week’s EO sets the first real actionable road map for the federal government’s approach to AI. Regarding workplace issues, the EO instructs federal agencies to take steps to ensure that AI experts travel to and work in the United States, and it requires the U.S. Department of Labor (DOL) to publish best practices for employers on how to “mitigate AI’s potential harms to employees’ well-being,” as well as guidance on the interplay of AI and the Fair Labor Standards Act. The EO also instructs the DOL to publish “guidance for Federal contractors regarding nondiscrimination in hiring involving AI and other technology-based hiring systems.” Michael A. Masse and Daniel J. Ruemenapp have the details on the immigration-related aspects of the EO on AI.
EEOC Deadlines. Employers may want to be aware of two significant EEOC-related dates announced this week.
• EEO-1 filing. This week, the EEOC announced the opening of its EEO-1 Component 1 data collection. Covered employers’ EEO-1 data is due to the Commission by December 5, 2023. The EEOC has published an updated instruction booklet for filers.
• Harassment guidance one step closer. November 1, 2023, was the deadline for stakeholders to submit comments in response to the EEOC’s proposed “Enforcement Guidance on Harassment in the Workplace.” The proposed guidance addresses recent changes in federal antidiscrimination law and policy, including the EEOC’s “position on important legal issues,” such as harassment based on pregnancy or childbirth, harassment based on sexual orientation and gender identity, “virtual” harassment (e.g., via video conferences), and when social media posts can contribute to a hostile work environment.
Child Labor Update. Policymakers in Washington, D.C., continue to explore ways to address unlawful child labor. According to recent blog post authored by DOL Wage and Hour Division Administrator Jessica Looman, from October 2022 through September 2023,
the division concluded 955 investigations that found child labor violations, holding more employers accountable for such violations than in any year in the last 15 years. [The division] also found almost 5,800 kids employed in violation of the law, an 88% increase in the number of children employed in violation since 2019. Finally, [the division] assessed more than $8 million in penalties for child labor violations, an 83% increase compared to last year.
Meanwhile, Congress remains hard at work on the issue:
• Late last week, a bipartisan group of senators introduced the “Child Labor Accountability Act of 2023,” which extends from thirty to ninety days the time during which the DOL can bring actions to halt the shipment of “hot goods” produced by child labor.
• Also last week, Senators Josh Hawley (R-MO) and Cory Booker (D-NJ) introduced the “Preventing Child Labor Exploitation Act,’’ which would require federal contractors to make an annual disclosure to the secretary of labor regarding “whether, within the preceding 3-year period, any administrative merits determination, arbitral award or decision, or civil judgment, as defined in regulations issued by the Secretary of Labor, has been issued against the entity, or any subcontractor of the entity.” (This is language borrowed almost verbatim from President Obama’s “Fair Pay and Safe Workplaces” executive order.)
• Finally, the Children Harmed in Life-Threatening or Dangerous (CHILD) Labor Act of 2023 (H.R. 6079), introduced by Democrats in the U.S. Senate and U.S. House of Representatives would extend child labor liability up and down the contractor/subcontractor chain, dramatically increase fines and penalties for child labor violations, and provide that the secretary of labor “may seek records related to any contractor or subcontractor at any tier of any person suspected of a violation of [child labor prohibitions] and may request any annual profit or loss statement of any such person or any contractor or subcontractor of such person.”
It is always challenging to pass legislation in Congress, but the bipartisan appeal of cracking down on unlawful child labor makes this a space worth watching.
NLRB and OSHA Partner in MOU. On October 31, 2023, the National Labor Relations Board (NLRB) and the Occupational Safety and Health Administration (OSHA) announced that the two agencies had entered into a memorandum of understanding to establish “a process for information sharing and referrals, training, and outreach between the agencies.” The memorandum generally focuses on referrals between the agencies. For example, a Board official investigating an unfair labor practice is instructed to share information with and refer employees to OSHA, if the Board investigator is made aware of potential workplace safety violations. Further, the memo states, “In appropriate cases and to the extent allowable under law, the agencies will determine whether to conduct coordinated investigations and inspections.” The Board has also entered into similar agreements to conduct coordinated investigations and inspections. In 2022, the Board entered into agreements with the Federal Trade Commission (FTC) and the U.S. Department of Justice (DOJ).
OFCCP Issues New Pre-Complaint Form. On November 11, 2023, the Office of Federal Contract Compliance Programs (OFCCP) introduced a new pre-complaint inquiry form. According to the press release, “The pre-complaint inquiry allows employees and applicants to share their concerns about employment discrimination and can assist in determining if filing a complaint with OFCCP is the right choice.” Importantly, submitting a pre-complaint inquiry form to OFCCP does not extend the statute of limitations period for filing a complaint. Complainants alleging discrimination on the basis of their disability or veteran status have 300 days from the employer’s action to file a complaint, while claims involving other protected classes, such as race, sex, or religion, have 180 days.
Seeking Compliance Focus, Industry Fights EPA Plans For New Drum Rules
Industry groups are urging EPA to focus on ensuring compliance with current Resource Conservation and Recovery Act (RCRA) rules governing drum reconditioners rather than introducing new regulatory options, warning that the agency’s suggested revisions could increase burdens while failing to address risks officials have identified.
Duke McCall, an attorney at law firm Morgan Lewis representing the Reusable Industrial Packaging Association (RIPA), told EPA’s Nov. 1 public webinar on its planned rulemaking for used drum management and reconditioning that the agency’s 2022 damage case report — which serves as the basis for the regulatory proposal — does not support further regulations for the sector.
“The damage cases EPA identified in that report also do not support the conclusion that it is a growing problem requiring regulatory action targeting reconditioners. As we noted in our response, many of the damage cases EPA identifies are not and never were reconditioning facilities. Many of the reconditioning facilities identified ceased operations decades ago, even before the promulgation of EPA’s empty container rule, and still others involve issues that are wholly unrelated to container management,” McCall said.
“In short, EPA’s damage case report does not demonstrate a need for, or indeed even provide support for regulatory action. At best, it supports a conclusion that the agency should do more to promote compliance with the existing regulatory scheme, as EPA concluded more than 40 years ago when it first considered the same issues before the agency today,” he added.

EPA Proposes to Amend TSCA Risk Evaluation Framework Rule
EPA announced on October 19, 2023, a proposed rule that would amend the procedural framework rule for conducting risk evaluations under TSCA. Published in the Federal Register on October 30, 2023, the proposed rule states that the purpose of risk evaluations under TSCA is to determine whether a chemical substance presents an unreasonable risk of injury to health or the environment, without considering costs or non-risk factors, including unreasonable risk to potentially exposed or susceptible subpopulations identified as relevant to the risk evaluation by EPA, under COUs. 88 Fed. Reg. 74292. EPA states that it has reconsidered the procedural framework rule for conducting such risk evaluations and determined that certain aspects of that framework should be revised to align better with applicable court decisions and the statutory text, to reflect its experience implementing the risk evaluation program following enactment of the 2016 TSCA amendments, and to allow for consideration of future scientific advances in the risk evaluation process without the need to amend further the Agency’s procedural rule. Comments are due December 14, 2023. EPA notes that under the Paperwork Reduction Act, comments on the information collection provisions are best assured of consideration if OMB receives a copy of the comments on or before November 29, 2023. B&C encourages interested parties to review carefully EPA’s proposed rule and to provide comments as appropriate. This is potentially the most impactful TSCA rule proposed to date this year. Democrats Fear Shutdown As House Slashes EPA’s FY24 Spending Plan
House Democrats are warning that the government will shut down when current spending approval expires Nov. 17 after Republicans, on a near-party-line vote, approved a bill that slashes EPA spending for fiscal year 2024 by nearly 40 percent from current levels, a cut that President Joe Biden has pledged to veto and the Senate will not consider.
“Continuing to consider these extreme Republican bills only brings us closer to a shutdown. We continue to waste our time debating partisan policies instead of coming together to write bills that can earn the bipartisan, bicameral support needed to become law. It is past time for House Republicans to meet House Democrats at the negotiating table,” Rep. Rosa DeLauro (D-CT), ranking Democrat on the House Appropriations Committee, said in a Nov. 3 statement.
Her comments came shortly after the House voted 213-203 to approve H.R. 4821, the Interior-Environment Appropriations bill for FY24.
Three Republicans — Reps. Brian Fitzpatrick (PA), Mike Lawler (NY) and Marc Molinaro (NY) — voted against the bill, while Rep. Vicente Gonzalez (D-TX) backed the bill.
Specifically, the legislation would provide EPA top-line funding of $6.1 billion, a $3.9 billion cut from current levels and would return the agency’s budget to a level not seen in over three decades.

EXTENDED: HM-265A: Modernizing Regulations to Improve Safety and Efficiency
On July 5, 2023, PHMSA published the Advance Notice of Proposed Rulemaking (ANPRM) “HM-265A: Modernizing Regulations to Improve Safety and Efficiency” to the Federal Register. Based on feedback from industry stakeholders, internal PHMSA review, NTSB safety recommendations, and modal safety partners, the ANPRM addresses 46 separate areas where the requirements of the HMR may need to be updated to increase efficiency while improving safety. Topics addressed in the ANPRM include those related to UN Performance Oriented Package testing, tank car safety, hazardous material employee training, and updates to standards incorporated by reference, among others.
The public comment period for this ANPRM has been extended, in response to a request from the American Short Line and Regional Railroad Association. Comments are now due by December 4, 2023. For questions, please contact Mr. Eamonn Patrick at [email protected].
Official Says EPA Will Reopen Cleanups For PFAS On ‘Case-By-Case Basis’
An EPA regional official told a recent waste conference that the agency will decide whether to reopen Superfund cleanup decisions at PFAS-contaminated sites “case-by-case” as it moves forward with designating the chemicals as hazardous constituents under the waste law — a move an industry attorney says could have “monumental” impacts.
During an Oct. 27 session of the Association of State and Territorial Solid Waste Management Officials’ (ASTSWMO) annual conference in Arlington, VA, EPA’s Charlotte Mooney, chief of the Resource Conservation and Recovery Office’s cleanup programs branch, said the agency’s proposal to designate per- and polyfluoroalkyl substances (PFAS) as hazardous under Superfund could lead it to reopen past cleanup actions.
In response to an audience question on the potential for EPA to revisit previously established cleanup requirements for contaminated sites, Mooney said the agency would most likely make such decisions on a “case by case basis.”
Industry groups and attorneys have raised concerns over potential for reopenings since EPA proposed Superfund designations for the two most-studied PFAS, perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS), in 2022. It is slated to finalize the action early next year, and has already floated an advance notice of proposed rulemaking (ANPRM) to sweep in several other perfluoroalkyl chemicals.

EPA Will Hold Virtual Training On High Throughput Toxicokinetic Modeling In November 2023:
EPA will hold a two-day training on its high throughput toxicokinetic (HTTK) R package as part of its New Approach Methods (NAM) Training Program:
- Day 1: Presentation and demo: Wednesday, November 8, 2023, 10 a.m. – 12 p.m. (EST); and
- Day 2: Expert-led hands-on learning activity: Thursday, November 9, 2023, 10 a.m. – 12 p.m. (EST).
EPA’s goal for the two-day training is to familiarize those engaged in chemical exposure assessment, including researchers, regulators, and health and environmental safety professionals, with EPA’s generic and open-source models and data for toxicokinetic, including reverse dosimetry and physiologically based pharmacokinetic (PBPK) modeling for internal dose calculation.
EPA Proposes To Amend General Provisions For NESHAP:
On September 13, 2023, EPA proposed to amend the General Provisions for National Emission Standards for Hazardous Air Pollutants (NESHAP) to address applicability and compliance issues resulting from the addition of a compound to the list of hazardous air pollutants (HAP) under the Clean Air Act (CAA). 88 Fed. Reg. 62711. According to EPA, this action focuses on issues related to newly applicable standards for sources that become major sources solely from the addition of a compound to the CAA HAP list. This action also includes a discussion of the impacts of a newly listed HAP on the federal operating permit program. Comments are due November 13, 2023.
EPA Issues Phase II FOIA Final Rule:
EPA issued on September 14, 2023, its Phase II Freedom of Information Act (FOIA) final rule updating and modernizing EPA’s FOIA regulations. 88 Fed. Reg. 63020. According to EPA’s September 7, 2023, press release, the final rule “promote[s] transparency and accountability, make[s] FOIA more affordable, and expedite[s] access to information to communities potentially experiencing disproportionate and adverse human health or environmental effects.” The final rule establishes a new standard, in addition to the existing “compelling need” standard, for expediting EPA’s response to FOIA requests for records when there is a pressing need to inform a community that is potentially experiencing disproportionately high and adverse human health or environmental effects. EPA will also waive fees for such FOIA requests. The final rule removes barriers by raising the threshold for when requesters will be charged fees, benefiting all requesters, as well as making other changes to bring EPA’s fee rates and other regulatory provisions into compliance with the FOIA statute, government wide policy, and relevant case law. Additionally, EPA updated the FOIA fee rates and will no longer charge any fees to a requester if the Agency accumulates less than $250 of chargeable fees. The final rule will be effective November 13, 2023.
Professional Certification Coalition
IHMM is a member of the PCC. The PCC monitors state and federal legislative and regulatory activity affecting professional certification on an ongoing basis. The PCC has compiled several “Watchlists” identifying and analyzing provisions in pending legislation at both the state and federal level that, under applicable rules, may still be enacted in the current legislative session. Depending on the carry-over rules in the relevant legislature, the charts listing current legislation may include bills introduced in a prior year. In addition, the PCC compiles each year a chart of enacted legislation that affects certification. The charts include hyperlinks to every bill or executive order. Note that the Watchlist and the Enacted Legislation document do not include profession-specific legislation and do not include regulatory initiatives. The charts will be updated as needed based on new developments.
IHMM Credential Recognition
The highest priority of IHMM’s Government Affairs Committee is the recognition of IHMM’s credentials by government. We have made substantial progress in the two years we have undertaken this endeavor, as outlined in detail here > https://ihmm.org/credential-recognition/
In this project we have 45-in-5, increasing the number of states that recognize IHMM credentials.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
in January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together
Regulatory Updates
PHMSA’s Office of Hazardous Materials Safety will be hosting public forums in advance of four international meetings, to allow the public to give input on current proposals being considered by the International Civil Aviation Organization’s (ICAO) Dangerous Goods Panel (DGP) and the United Nations Sub-Committee of Experts on the Transport of Dangerous Goods (UNSCOE TDG). The international meetings include:
- The 29th session of the ICAO TDG, scheduled for November 13 to 17, 2023, in Montreal, Canada
- The 63rd session of the UNSCOE TDG, scheduled for November 27 to December 6, 2023, in Geneva, Switzerland
Each of these public meetings will be held approximately two weeks before the corresponding international meeting. Specific information for each meeting, including date, time, conference call-in number, and details for advance registration will be posted when available on the PHMSA website under “Upcoming Events.” These meetings will be virtual, with hybrid options available as possible, pending public health guidelines.

The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

IHMM’s Collaboration platform contains a “Mentor Match” module [see below at right] that allows mentors to signup designating the hours, number of mentees, subject areas, and length of time they wish to mentor – as well as allowing mentees to signup requesting assistance in specified areas. The mentor match module does the rest by matching mentors and mentees.

HMS Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).

The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
