The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.

Sackett v. Environmental Protection Agency – The Next Major Environmental Case at SCOTUS
Issue: Whether the U.S. Court of Appeals for the 9th Circuit set forth the proper test for determining whether wetlands are “waters of the United States” under the Clean Water Act, 33 U.S.C. § 1362(7).
On October 3, 2022 the United States Supreme Court heard oral arguments in the case Sackett v. Environmental Protection Agency
The Clean Water Act[1] (CWA) governs the discharge of pollutants into waters of the United States. Supreme Court rulings and agency rulemakings that define the reach of this act have considerable consequences for protection of US waters and wetlands. Defining “waters of the United States” has been attempted by the Obama administration, the Trump administration, and now the Biden administration is again working to define what waters are protected under the CWA. However, the Supreme Court’s decision in Sackett v. EPA[2] will potentially shape EPA’s rulemaking, implementation, and breadth of its authority under the CWA.
Michael and Chantall Sackett own a residential lot near Priest Lake, Idaho, and want to build a home there. However, shortly after they began placing sand and gravel, the federal Environmental Protection Agency told them that they could not build on their lot because construction on the land violated the Clean Water Act. According to the EPA, the Sacketts’ lot contained wetlands that qualify as “navigable waters” regulated by the Act, so they needed to remove the sand and gravel and restore the property to its natural state.
Litigation ensued, and in 2012, the Supreme Court permitted the Sacketts to litigate their challenge to the EPA’s order in federal court. During the litigation, the EPA removed its compliance order.
The U.S. Court of Appeals for the Ninth Circuit held that the EPA’s withdrawal of the compliance order did not render the Sacketts’ challenge moot and that the EPA does have jurisdiction over their property under the Clean Water Act. The court reasoned that, under binding circuit precedent, “jurisdiction over wetlands depends upon the existence of a significant nexus between the wetlands in question and navigable waters in the traditional sense.”

2022 IHMM Board of Directors Election
On Monday, October 3, 2022, the Institute of Hazardous Materials Management began its 2022 elections for the IHMM Board of Directors for 3 seats with service beginning January 1, 2023. IHMM’s Nominating Committee began soliciting candidates for three seats on March 8, 2022, and continued in every Tuesday edition of IHMM Today through June 28, 2022. The three seats up for election in 2022 are [1] seat for a CDGP, [1] seat for a CSHM, and [1] seat for At-Large, which can come from a CHMM, CDGP, CHMP, CSHM, or CSMP.
The election will run from Monday, October 3, 2022, through Friday, November 4, 2022.

In 2019 Mark Bruce from AHMP and Gene Guilford from IHMM worked on a project to get the Commonwealth of Pennsylvania to recognize the CHMM and CDGT credentials. With Mark’s work on the ground in Pennsylvania, we succeeded.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
In January 2021 Mark at AHMP and Gene at IHMM has launched 45 in 5, getting the other 45 states to recognize our credentials in 5 years. If we can find a volunteer like Mark in other states [see above] we can work with those volunteers on crafting the right message to the right agencies in state governments across the country. If we find enough volunteers we can get this done in less than 5 years.
In January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together
NPDES BASIC PERMIT WRITERS’ COURSE
Virtual Guided Learning
October 13, 2022 – November 17, 2022
The U.S. EPA is pleased to announce the opening of registration for the the National Pollutant Discharge Elimination System (NPDES) Basic Permit Writers’ Virtual Guided Learning Course starting on October 13, 2022, with an afternoon session running for five weeks.
The objective of this course is to provide the basic regulatory framework and technical considerations that support the development of wastewater discharge permits required under the NPDES program. The course was designed for permit writers with about six months to one year of experience in the NPDES program, but experienced permit writers wanting a refresher course and other water program staff or interested parties wanting to learn more about the NPDES program also are welcome.
The 5-week course will begin on Thursday, October 13, 2022. Participants should anticipate a time commitment of approximately 8-10 hours per week and should seek supervisor approval before signing up. The course is scheduled to conclude on November 17th, however a “rain date” of November 22nd should be reserved by the participants in case of technical issues.
Each week, participants will have assigned “homework” consisting of NPDES online modules and permit exercises. These modules and exercises will then be discussed in a live virtual classroom setting on Tuesday and Thursday of each week. Participants will have the opportunity to join live office hour discussions with instructors and other participants each Tuesday as well.
Microsoft Teams will be utilized for the virtual classroom and can be accessed through the desktop application or a web browser. Course materials will be provided electronically on the Microsoft Teams classroom site for download by the participants prior to the start date.
As a foundational course, the training does not address in detail specialized topics such as industrial and municipal stormwater, concentrated animal feeding operations, and pesticide discharges. NPDES Permit Writers’ Course – Virtual Guided Learning October 2022 (PM)
EPA’s Industrial Stormwater Sector-Specific Fact Sheet Stakeholder Meetings
The U.S. Environmental Protection Agency (EPA) is hosting a series of public meetings in Fall 2022 to inform updates to EPA’s industrial stormwater fact sheet series. Last updated in 2006, EPA developed a fact sheet to provide guidance to each of the 29 industrial sectors covered under the Multi-Sector General Permit (MSGP), which authorizes stormwater discharges from industrial activity in areas where EPA is the National Pollutant Discharge Elimination System (NPDES) permitting authority. Each fact sheet describes the types of facilities included in the sector, typical pollutants associated with the sector, and types of stormwater control measures used to minimize the discharge of the pollutants. These resources are an important part of EPA’s industrial stormwater program to assist facilities in managing their stormwater discharges. The industrial stormwater fact sheet series is used by a variety of other stakeholders, including facilities covered under state industrial stormwater permits and other industry groups.
Since industries and stormwater control measures may evolve over time, EPA is undertaking an effort to review and update the fact sheets. In January 2022, the Agency published a Federal Register Notice seeking written comments on the fact sheets. EPA received many valuable comments, as well as input that highlighted areas in need of further clarification and interest in continuing the dialogue with EPA on these resources. In response to this request, the Agency will be hosting a series of public meetings focused on certain industrial sectors to hear more about stakeholders’ individual real-life experiences with industrial stormwater management. Through these meetings, EPA would also like to engage those stakeholders who may not have had the chance to submit comments to attend and share their thoughts.
EPA is particularly focused on hearing stakeholder’s input on: common activities, pollutant sources, and associated pollutants at facilities in these sectors; and stormwater control measures or best management practices, including source control and good housekeeping/pollution prevention measures for potential pollutant sources at facilities in the sector.

PHMSA – Hazardous Materials: Adjusting Registration and Fee Assessment Program
On September 22, 2022, the Pipeline and Hazardous Materials Safety Administration (PHMSA) published an Advance Notice of Proposed Rulemaking (ANPRM) to solicit feedback on potential adjustments to the hazardous materials registration and fee assessment program.
SUMMARY: PHMSA is publishing this ANPRM to solicit feedback on potential adjustments to the statutorily mandated hazardous materials registration and fee assessment program. Actions such as the potential adjustment of fees or the addition of other entities among those required to register may be necessary to fund PHMSA’s national emergency preparedness grant programs at the newly authorized level in accordance with the Infrastructure Investment and Jobs Act of 2021. To fully engage with stakeholders, this ANPRM solicits comments and input on questions related to the scope of the registration and fee assessment program. Any comments, data, and information received will be used to evaluate and draft proposed amendments.

PHMSA Extension of Time to Comment
PHMSA published an extension to the comment period for the Request for Information (RFI) on Electronic Hazard Communication Alternatives published July 11, 2022. PHMSA has identified electronic “hazard communication” to include shipping papers, train consists, dangerous goods manifests, notifications to the pilot in command, and emergency response information. In addition, they are including any administrative documents such as Approvals, DOT Special Permits and registrations.
Comments are now due to the docket by October 24, 2022.

IHMM Launches Scholarship Program
IHMM is pleased to announce the launch of the IHMM Scholarship program.
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

These workshops are offered with U.S. DOT PHMSA HMIT (Hazardous Materials Instructor Training) Grant support to the National Partnership for Environmental Technology Education (National PETE).

The workshop curriculum is in accordance with 49 CFR § 172.704 for General Awareness, Function-Specific, Safety, and Security Awareness training requirements.

Nomination News. With control of the U.S. Senate in 2023 up for grabs, the Biden administration continues its push to fill agency leadership positions. Late last week, the Senate confirmed attorney Lisa Gomez to run the U.S. Department of Labor’s (DOL) Employee Benefits Security Administration. The vote represented a second chance for Gomez: in June of this year, her confirmation vote failed when Vice President Kamala Harris was unavailable to break a tie vote. Still awaiting confirmation are Jessica Looman (nominated to serve as administrator of DOL’s Wage and Hour Division) and Karla Gilbride (nominated to serve as general counsel of the U.S. Equal Employment Opportunity Commission (EEOC)), but as the Buzz recently reported, their votes keep getting postponed. Finally, there is no update on the status of EEOC commissioner nominee Kalpana Kotagal.
SCOTUS to Review Union’s Destruction of Employer’s Property. This week, the Supreme Court of the United States kicked off its 2022–2023 term (more on that below). On the first day of its new term, the Court agreed to hear a case concerning whether the National Labor Relations Act (NLRA) preempts an employer’s claim that a union intentionally destroyed its property during a strike. The employer in the case, a ready-mix concrete company, sued the union representing its workers alleging that the union deliberately timed its work stoppage to occur shortly after the employer’s mixing trucks were loaded for delivery. As a result, the concrete hardened and became unusable. The Washington Supreme Court held that the claim was preempted by the NLRA, and the employer appealed. If the Supreme Court does not reverse, the concept of “economic weapons” deployed during the bargaining process will take on new meaning, and certain employers could be left without recourse if unions intentionally destroy their property, products, tools, or equipment.
NLRB: Dues Checkoff Continues After CBA. As expected, the National Labor Relations Board (NLRB) continues to reverse Trump-era Board rulings to tilt the labor-management landscape in favor of unions. This week, the Board released a decision requiring an employer to continue a contractual union dues checkoff clause, even after the collective bargaining agreement (CBA) had expired. The majority reasoned that “a dues-checkoff provision properly and reasonably belongs in the broad category of mandatory bargaining subjects that Section 8(a)(5) of the Act bars employers from changing unilaterally after the expiration of a contract, rather than in the small handful of exceptions to the rule.” Dating back to 1962—except for a brief four-year period beginning in 2015—Board jurisprudence had held that the requirement to remit union dues was a creature of contract and therefore expired along with a CBA. In this recent case, the Board reverted to that anomalous four-year period in its history. The Board will apply the new policy retroactively in all pending cases.
NLRB: Petitions Are Up. The federal government’s 2021–2022 fiscal year wrapped up on September 30, 2022. Since then, the number crunchers at the NLRB have counted a total of 2,510 union representation petitions that were filed during that time period. This is a 53 percent increase from the 1,638 petitions filed in the previous fiscal year.
Federal Court Strikes Down EEOC’s Bostock Guidance. On October 1, 2022, the U.S. District Court for the Northern District of Texas vacated a June 15, 2021, EEOC technical assistance document “explaining ‘what the Bostock decision means for LGBTQ+ workers (and all covered workers) and for employers across the country.’” The court reasoned that the Commission “misread Bostock by melding ‘status’ and ‘conduct’ into one catchall protected class covering all conduct correlating to ‘sexual orientation’ and ‘gender identity.’” The court also ruled that the Commission had made several procedural mistakes, including issuing what the court determined was a substantive rule, even though the Commission lacks such rulemaking authority under Title VII of the Civil Rights Act of 1964.
Monday Morning You Sure Look Fine. As mentioned above, the Supreme Court kicked off its current term on Monday, October 3, 2022. The annual “First Monday” tradition—or more accurately, requirement—has evolved over the years. The Judiciary Act of 1789 required the Court to meet in two separate sessions each year, one beginning on the first Monday of February, and the other beginning in August. Beginning in 1802, the U.S. Congress eliminated the second session and began to move the start back from February to January and then to December. In 1873, Congress moved the start date to the second Monday in October. Finally, in 1916, as part of a broader reform effort to add more cases to the Court’s docket, Congress settled on the first Monday in October for the start of the Court’s term.

Thank you CHEMTREC and Erica Rohde for contributing programs enabling IHMM certificants to engage in professional development and earn important CMPs! Both of the new CHEMTREC programs are available online and on-demand.
These are the first programs to be added to the “CHMM Blueprint CMPs” hot button on the HMS site. The HMS Education and Training Committee has reviewed the contents of these programs and compared the contents to the CHMM blueprint. IHMM thanks the HMS Education and Training Committee and its Chair, Diana Lundelius, CHMM, for their work on reviewing programs proposed for CMPs for recertification of credentials. This effort ensures that only the programs that meet the highest standards get to participate in the IHMM recertification effort and HMS education and training.

IHMM and HMS Tie Exam Preparation Together for Applicants
Every IHMM certification that requires an examination has a section of its website entitled Examination Preparation.
Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.
You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 397 CHMM applicants IHMM had on August 31, 2022, all 397 looking for CHMM prep courses could see and chose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 397 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.

HMS Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).
