The American National Standards Institute [ANSI] has approved Kryterion Remotely Proctored Exams for IHMM’s CHMM, CHMP, and CDGP exams. IHMM has been using the Kryterion Remotely Proctored Exams for the CSHM and CSMP exams since April 2020.
76% of Kryterion in-person testing centers have reopened. If you prefer the comfort and convenience of taking your exam from your home or office instead of at a Kryterion center, IHMM is ready to enroll you in a remotely proctored examination.

OSHA Hurricane Recovery Operation Resources
Due to the catastrophic impacts of Hurricane Ian, many workers are and will be affected with on-going cleanup and recovery efforts. We wanted to remind everyone that OSHA has an Emergency Preparedness and Response webpage that provides information to protect workers responding to hurricanes and floods. Attached is a PDF for our Worker Safety and Health Resources for Hurricane and Flood Cleanup and Recovery, found on OSHA web page here. OSHA is dedicated to the protection of ALL workers including day laborers, temporary workers, and non-English speaking workers. Many of the OSHA materials are available in other languages, along with a few Public Service Announcements that have been recorded and transcribed.
On September 29, 2022, DOL issued a press release urging first responders, recovery crews, and the public to be vigilant from hazards in Hurricane Ian recovery operations. DOL also has a Disaster Recovery Assistance page that provides resources to assist with recovery efforts. Please share this information, as appropriate, with your members and stakeholders, including those who may be hurricane cleanup and recovery employers, workers, and volunteers.

DOL Issued a Notice of Proposed Rulemaking on Employee or Independent Contractor Classification Under the Fair Labor Standards Act
The U.S. Department of Labor has published a Notice of Proposed Rulemaking to help employers and workers determine whether a worker is an employee or an independent contractor under the Fair Labor Standards Act. The proposed rule would provide guidance on classifying workers and seeks to combat employee misclassification. Misclassification is a serious issue that denies workers’ rights and protections under federal labor standards, promotes wage theft, allows certain employers to gain an unfair advantage over law-abiding businesses, and hurts the economy at-large. Individuals may submit comments, identified by Regulation Identifier Number (RIN) 1235-AA43, by either of the following methods:
- Electronic Comments: Submit comments through the Federal eRulemaking Portal at https://www.regulations.gov. Follow the instructions for submitting comments.
- Mail: Address written submissions to Division of Regulations, Legislation, and Interpretation, Wage and Hour Division, U.S. Department of Labor, Room S-3502, 200 Constitution Avenue NW, Washington, DC 20210.
Anyone submitting comments should submit only one copy of your comments by only one method. Of the two methods, the Department strongly recommends that commenters submit their comments electronically via https://www.regulations.gov to ensure timely receipt prior to the close of the comment period, as the Department continues to experience delays in the receipt of mail. All comments must be received by 11:59 p.m. ET on November 28, 2022, for consideration in this rulemaking; comments received after the comment period closes will not be considered.
EPA Announces Initiative to Bring to Market New Chemicals Used in Electric Vehicle, Semiconductor, and Clean Energy Sectors
The U.S. Environmental Protection Agency (EPA) announced on October 5, 2022, a new effort under the Toxic Substances Control Act (TSCA) to implement a streamlined and more efficient process under the New Chemicals Program to assess risk and apply mitigation measures, as appropriate, for new chemicals with applications in batteries, electric vehicles, semiconductors, and renewable energy generation. The new process is for mixed metal oxides (MMO), including new and modified cathode active materials (CAM). EPA states that MMOs are innovative chemistries and have numerous electrical applications in batteries, as well as use as catalysts, adsorbents, and in ceramics. According to EPA, MMOs, including CAMs, are notably a key component in lithium-ion batteries used in electric vehicles, “a growing and important industry.” New MMOs can also be used for semi-conductors, and renewable energy generation and storage, such as solar cells and wind power turbines. They typically consist of lithium, nickel, cobalt, and other metals, and they are the key material used in the production of the cathode in battery cells, which are subsequently assembled into a battery. Emission Standards for Hazardous Air Pollutants
The Environmental Protection Agency issued a final rule amending “the national emission standards for hazardous air pollutants (NESHAP) at major sources from new and existing industrial, commercial, and institutional (ICI) boilers and process heaters.” The rule includes revisions to several emission standards consistent with a previous court opinion and provides further explanation on related issues. Effective December 5.

Court Approves 2024 Deadline For EPA Secondary NOx-SOx-PM Standards
A federal court has finalized a deal between EPA and environmentalists that will require the agency to complete its overdue review of “secondary” federal air standards for nitrogen oxides (NOx), sulfur oxides (SOx) and particulate matter (PM) in 2024 — weeks before either the start of a second term for President Joe Biden, or of a new administration.
In a consent decree entered Oct. 12 by the U.S. District Court for the Northern District of California, EPA agrees to settle litigation brought by the Center for Biological Diversity (CBD) and the Center for Environmental Health over EPA’s failure to review the standards at issue within a statutory five-year timeframe.
According to the consent decree, which EPA proposed in July, EPA must issue a proposal to either retain the secondary standards for the three pollutants or tighten them by Feb. 9, 2024, and issue a final rule by Dec. 10, 2024.

EPA Plans To Propose TSCA Methylene Chloride Rule In ‘First Half Of 2023’
EPA intends to propose its TSCA risk management rule for methylene chloride — which officials have said will be the next existing-chemical regulation crafted under the law and a bellwether for future policies — “in the first half of 2023,” according to a new filing in the U.S. Court of Appeals for the 9th Circuit.
In an Oct. 11 status report for two linked challenges to the Trump-era Toxic Substances Control Act (TSCA) evaluation of methylene chloride — both of which the 9th Circuit stayed in 2021 — EPA appears to extend the timeline for proposing a rule to govern use of the toxic solvent, after it targeted February 2023 for that step in its spring Unified Agenda of rulemaking actions.
The agency notes it is still working to screen methylene chloride and other chemicals the Trump administration evaluated under TSCA for environmental exposures and risks to fenceline communities — aiming to address what Biden EPA officials and environmental groups say was a failure of those 10 evaluations to consider the full range of exposures, such as through air and water releases.
“EPA expects to address public and peer review comments and describe its findings regarding the chemical-specific application of this screening-level approach in the proposed risk management rule, which the Agency expects to publish for public notice and comment in the first half of 2023,” the report says.

CVSA Announces Results of Hazardous Materials, Dangerous Goods Blitz
A five-day unannounced hazardous materials and dangerous goods inspection special enforcement effort in June netted 1,774 violations in the United States and Canada, the Commercial Vehicle Safety Alliance reported Oct. 12.
During the special hazmat operation, CVSA officers conducted 6,204 vehicle inspections of motor vehicles carrying hazmat and dangerous goods in the United States, and 6,668 inspections in Canada, said CVSA.

IHMM at Federation of Environmental Technologists Conference

On Monday, October 3, 2022, the Institute of Hazardous Materials Management began its 2022 elections for the IHMM Board of Directors for 3 seats with service beginning January 1, 2023. IHMM’s Nominating Committee began soliciting candidates for three seats on March 8, 2022, and continued in every Tuesday edition of IHMM Today through June 28, 2022. The three seats up for election in 2022 are [1] seat for a CDGP, [1] seat for a CSHM, and [1] seat for At-Large, which can come from a CHMM, CDGP, CHMP, CSHM, or CSMP.

In 2019 Mark Bruce from AHMP and Gene Guilford from IHMM worked on a project to get the Commonwealth of Pennsylvania to recognize the CHMM and CDGT credentials. With Mark’s work on the ground in Pennsylvania, we succeeded.
- We have already succeeded in 13 states – New York, Connecticut, Pennsylvania, Indiana, California, Colorado, Nebraska, Minnesota, Arkansas, Oklahoma. Ohio, North Dakota, and Georgia. [Red states in the map above]. These are states where IHMM credentials are cited or 40 CFR 312.10 is cited by reference.
- We have partially succeeded in another 16 states – Alaska, Hawaii, Idaho, Montana, Arizona, Kansas, Iowa, Missouri, Illinois, Kentucky, Florida, Delaware, Rhode Island, Massachusetts, Vermont, and Maine. [Orange/Black Stripe states in the map above] These are states where the requirements of an “environmental professional” or QEP are cited that coincide with an IHMM credential so that relatively little work would need to be done to clarify the desired outcome.
- We have 21 states where no reference to an IHMM credential is made in either statute or regulation, nor is there anything defined in the area of an environmental professional. These states will require legislation or regulatory work. [Yellow states in the map above].
In January 2021 Mark at AHMP and Gene at IHMM has launched 45 in 5, getting the other 45 states to recognize our credentials in 5 years. If we can find a volunteer like Mark in other states [see above] we can work with those volunteers on crafting the right message to the right agencies in state governments across the country. If we find enough volunteers we can get this done in less than 5 years.
In January 2022 Gene Guilford released the 40 CFR § 312.10 EPA regulation that states a private certification that meets or exceeds the requirements of the regulation is an Environmental Professional under the regulation. Here is the crosswalk between the 40 CFR § 312.10 EPA regulation and the Certified Hazardous Materials Manager [CHMM] blueprint. The CHMM meets or exceeds the requirements of an Environmental Professional.
Here’s what we ask each volunteer to do:
- Watch legislative and regulatory developments in your state that provide an opportunity for us to create amendments or other interventions
- Be willing to speak with regulators and legislators in your area about the recognition efforts we craft together
EPA’s Industrial Stormwater Sector-Specific Fact Sheet Stakeholder Meetings
The U.S. Environmental Protection Agency (EPA) is hosting a series of public meetings in Fall 2022 to inform updates to EPA’s industrial stormwater fact sheet series. Last updated in 2006, EPA developed a fact sheet to provide guidance to each of the 29 industrial sectors covered under the Multi-Sector General Permit (MSGP), which authorizes stormwater discharges from industrial activity in areas where EPA is the National Pollutant Discharge Elimination System (NPDES) permitting authority. Each fact sheet describes the types of facilities included in the sector, typical pollutants associated with the sector, and types of stormwater control measures used to minimize the discharge of the pollutants. These resources are an important part of EPA’s industrial stormwater program to assist facilities in managing their stormwater discharges. The industrial stormwater fact sheet series is used by a variety of other stakeholders, including facilities covered under state industrial stormwater permits and other industry groups.
Since industries and stormwater control measures may evolve over time, EPA is undertaking an effort to review and update the fact sheets. In January 2022, the Agency published a Federal Register Notice seeking written comments on the fact sheets. EPA received many valuable comments, as well as input that highlighted areas in need of further clarification and interest in continuing the dialogue with EPA on these resources. In response to this request, the Agency will be hosting a series of public meetings focused on certain industrial sectors to hear more about stakeholders’ individual real-life experiences with industrial stormwater management. Through these meetings, EPA would also like to engage those stakeholders who may not have had the chance to submit comments to attend and share their thoughts.
EPA is particularly focused on hearing stakeholder’s input on: common activities, pollutant sources, and associated pollutants at facilities in these sectors; and stormwater control measures or best management practices, including source control and good housekeeping/pollution prevention measures for potential pollutant sources at facilities in the sector.

IHMM is pleased to announce the launch of the IHMM Scholarship program.
The Institute of Hazardous Materials Management is pleased to have created $32,000 in academic scholarships, divided equally between $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student CHMMs, and $16,000 for students enrolled in undergraduate or graduate education in approved schools and who are also Student ASHMs.
IHMM seeks to foster the growth and academic success of students whose courses of education, and participation in one of our Student certifications, will lead to those students becoming fully-certified IHMM credential holders later in their professional lives.

The workshop curriculum is in accordance with 49 CFR § 172.704 for General Awareness, Function-Specific, Safety, and Security Awareness training requirements.

DOL Proposes New Independent Contractor Test. On October 13, 2022, the U.S. Department of Labor’s Wage and Hour Division published a notice of proposed rulemaking—“Employee or Independent Contractor Classification Under the Fair Labor Standards Act”—to rescind the Trump-era independent contractor rule that was finalized in 2021 before President Biden assumed office. In its place, the DOL proposes a test for determining employee or independent contractor status that, rather than focus on two “core” factors of degree of control over the work and the worker’s opportunity for profit or loss, “[would] return to a totality-of-the-circumstances analysis of the economic reality test in which the factors do not have a predetermined weight and are considered in view of the economic reality of the whole activity.” These factors are as follows:
- Opportunity for profit or loss depending on managerial skill
- Investments by the worker and the employer
- Degree of permanence of the work relationship
- Nature and degree of control (this factor includes an analysis of the following subfactors: scheduling, supervision, setting a price for goods or services, and the ability to work for others)
- Extent to which the work performed is an integral part of the employer’s business
- Skill and initiative
- Additional factors (noting that “the enumerated factors are not to be applied mechanically but should be viewed along with any other relevant facts in light of whether they indicate economic dependence or independence”)
While not necessarily novel, the lengthy analysis of equally weighted factors and subfactors is likely to prove confusing and unreliable for many employers. Importantly, the DOL states that it “believes it is legally constrained from adopting an ABC test” that has proved so controversial in California. Comments on the proposal are due by November 28, 2022. Steven F. Pockrass, Taylor E. Gillan, Charles E. McDonald, III, and Zachary V. Zagger have more on this development.

The Buzz previously directed readers to Lauren Hicks’s analysis of the situation at the Office of Federal Contract Compliance Programs (OFCCP) concerning the potential public disclosure—pursuant to a FOIA request from the media—of federal contractors’ EEO-1 data. Contractors that wish to object to the release of this information must notify OFCCP by October 19, 2022.
Railroad Row Redux. Several weeks ago, when it seemed as though the nation had avoided a potentially disastrous national freight rail strike, the Buzz was quick to note that the tentative agreement between rail carriers and labor unions still needed to be approved by rank-and-file union members and that things could still go off the rails. Fast-forward to this week, and we have now learned that the third-largest railroad union in the United States has rejected the proposed deal. Although there are multiple unions involved in the bargaining, even one union’s decision to go on strike could have national implications, because other unions are unlikely to cross the picket line. So while this is not the end of the line just yet, the situation absolutely bears watching. The parties have until November 19, 2022, to reach a deal.
Will Labor/Employment Provisions Hitch a Ride on the NDAA? This week, the U.S. Senate started debate on the fiscal year 2023 National Defense Authorization Act (NDAA). The bill is considered “must-pass” legislation and will be a top priority for senators during the post-election lame-duck session of the U.S. Congress. As such, it will be viewed as a prime vehicle upon which senators can attach their specific policy preferences, even if seemingly unrelated to national defense. More than 900 amendments to the bill have already been filed. Readers may recall that the U.S. House of Representatives included multiple labor and employment-related amendments in the version of the NDAA that it passed in July 2022. The Buzz will be monitoring whether these—or other labor and employment provisions—make it into a final bill.

IHMM and HMS Tie Exam Preparation Together for Applicants
Every IHMM certification that requires an examination has a section of its website entitled Examination Preparation.
Connected to the Examination Preparation panel is a companion panel that is Find a Course to Prepare for the Exam.
You see the Find a Course to Prepare for the Exam panel from the CHMM site at left.
When you click on the Find a Course to Prepare for the Exam panel it takes the applicant directly to the HMS site where all CHMM prep courses may be found and chosen.
For the 397 CHMM applicants IHMM had on August 31, 2022, all 397 looking for CHMM prep courses could see and chose their favored CHMM exam prep course. If your course is not on the HMS platform, none of the 397 CHMM applicants could find you.

HMS Makes Finding Courses to Earn CMPs Easy
Every year more than 1,600 IHMM certificants have to recertify their credentials, evidenced their continuing commitment to improvement and learning to elevate their professional credential.

The system will then generate all of the courses on the HMS E&T platform with IHMM CMPs already attached.

HMS Certified Dangerous Goods Professional [CDGP] Exam Prep

The CSU CDGP exam prep course is delivered entirely online and may be initiated by any CDGP applicant at any time. The CDGP applicant has up to 10 weeks to complete the prep course, though an extension of the 10 weeks may be requested from CSU directly. The CSU CDGP exam prep course contains 8 modules covering the 4 principle texts involved in the CDGP exam, as follows:
- UN Recommendations on the Transport of Dangerous Goods, and
- International Civil Aviation Organization’s Technical Instructions (ICAO TI), and
- International Air Transport Association’s Dangerous Goods Regulations (IATA DGR), and the
- International Maritime Organization’s Dangerous Goods Code (IMDG Code).

The HMS scholarship award is given annually to undergraduate and graduate students whose academic program and research studies have the potential to address the most serious issues in handling hazardous materials, dangerous goods, environmental issues, health & safety challenges. Applicants must be U.S. citizens or permanent residents enrolled in accredited U.S. academic institutions.
